islamic terrorism in three days? >> sean, what's interesting is that the president's gotten some bipartisan criticism. you mentioned some of the media criticism. but democrat tulsy gabbert from hawaii who's a member of the house armed services committee, she came out and told fox that she thinks the focus of this summit was off. that it should have been on islamic extremism. you had the republican chairman of the house homeland security committee, michael mccaul saying today he thinks this was a summit without substance because the president did not call out radical islam and is not going to be able to go after the fanatics if he doesn't call it what it is. interesting because i had an exchange with josh ernst about the statement that he put out over the weekend about this awful beheading of 21 people. he called them citizens this weekend, and did not mention their faith. listen. i'm curious, why didn't you mention it was 21 christians killed by muslims? is that relevant? >> it sure is because the isil

extremists who carried out this attack indicated that the reason they were killing them wasn't just because they were egyptian but also because they were christian. >> it went out under your name. why didn't you say 21 christians were killed? >> well ed, i try to be clear here. i can't account for that specific line in the statement. but we've been clear there that we condemn this murder. >> interesting because two days earlier last week the white house put out a statement under the president's name about the tragedy of three muslim students being killed at the university of north carolina. and in that statement they invoked their faith talked about being muslim american students. and also the president in that written statement said no one in america should be targeted, he said, because of what they look like, who they are or how they worship. and so specifically their muslim faith was invoked in that case. but strange that the christian faith was not mentioned in the 21 beheadings. that's what i was pressing josh earnest on, sean. >> if you go through it step by

step, mention terrible deeds done in the name of christ, i've never heard him say that about muhammad or allah or islam. and even goes out of his way to suggest that it's not tied to the religion in terms of islam. and then with paris the president said was random at the kosher supermarket. we had another spokesperson claim that no jewish people were killed when in fact that was not true. he is in a political war with b.b. netanyahu that is well-known throughout political circles. and he mentioned south carolina in that particular case almost immediately. >> north carolina. >> north carolina rather, sorry. what is the reaction of the white house for the comments i'll get to them in a minute, of rudy giuliani? >> well, it's interesting. white house spokesman eric schultz today said he thinks rudy giuliani test drove that message, he said, back in his quote/unquote, fleeting 2008 campaign. it was a poke teasing, jabbing rudy giuliani for having such a short-lived presidential campaign. doesn't really answer the substance of it.

denying american exceptionalism. what is your reaction to that? >> well, rudy's exactly right. i've said this many years on my radio program. when somebody says they want to fundamentally transform america, then you must not love america. it's like saying i'm going to fundamentally transform my wife, or my girlfriend. that means you must not love your wife or your girlfriend. and obama has shown no indication that he loves the constitution. he never talks about capitalism. he's always bringing up the past. he's always picking at scabs. even now he's a patsy for islamic terrorism. half speeches are about how terrible america is and america shouldn't react in negative way. i want to remind this president, he likes to bring up jesus in a certain context, and i say this as a jew, you know there's an awful lot of christians in america and in europe who've died, who've been maimed, who've been harmed trying to defend innocent, peace loving muslims in the middle east, in

stabbed multiple times. sounds like a hate crime to me. >> it could be, sean. i mean i think we got to kind of see where the evidence falls out. it could be a hate crime it could be a terrorist act. it could be just some crazy lunatic. >> well there's obviously some component here because he says are you muslim no and they get stabbed to death -- or stabbed multiple times rather. >> right. so law enforcement goes through the evidence here as they talk to the witnesses as they look to quite frankly what he was doing on social media. that really is the key nowadays is to kind of what these people are thinking. as i said it could be a hate crime. it might be a terrorist attack. we'll see. >> what is -- what are we discovering, high muslim population, what is law enforcement doing about radicals that are known in the area? >> well, i think there's two components, sean. i think first of all what do you know and what don't you know. here in detroit the fbi and federal law enforcement has done an outstanding job of community outreach a lot based on personal

relationships with community leaders. so you're trying to find out what you don't know. and that is really kind of your first set of eyes and ears. the second part as you said is the people we do know. i think what you're seeing and what's playing out on the world stage right now is intelligence agencies around the world do not have enough assets to really attack this problem. >> all right. so what about like we know in chicago, nation of islam -- louis farrakhan said anti-semitic things over the years, i would like to think law enforcement has an eye on him. what about radical imams or clerics identified in the area. law enforcement keeping an eye on these guys? >> i'm sure they are, sean. >> sure they are? >> first amendment speech, protected speech or is this radical, you know, recruiting type speech. so if it crosses the line i'm sure that the fbi is definitely on top of this. >> all right. i hope so. and we're going to follow the

case and find out what happens. see if the president mentions this because he's very quick to mention the case in north carolina three muslims shot, turned out to be a parking dispute. he mentioned religion there. but of course he doesn't mention religion at the summit that we've been discussing. sir, thank you. appreciate it. also tonight, syrian refugees, should they be coming to america? well, they are in record numbers. my next guest is very concerned about it. joining us now is house homeland security chairman congressman michael mccaul with us. congressman, apparently the president now wants to increase the number of syrian refugees coming into america. this is the home of isis. how do we know that the people we let in are not sympathetic towards or even a part of this group? >> well, we don't know that. this is a very dangerous and reckless policy in my judgment. i held a -- chaired an oversight hearing with fbi, with homeland security, with the national counterterrorism center. they all three witnesses stated that this would pose a greater

risk to americans if we bring in these refugees from syria that have not be properly vetted. and the fbi admitted they don't have the databases to properly vet these refugees. i was actually over there, sean, and the jordanian minister of interior told me he doesn't know who these people are. so why in the world -- you know, we're working hard to keep these foreign fighters out of the united states. why in the world we have a federally sanctioned government program to bring thousands of syrian refugees into the united states that could pose a greater risk to americans. >> it's estimated that 4 million have been forced to flee syria, 7 million out of their homes, 500 have already come to the united states. and how many is the president talking about bringing in? and what d the vetting process to find out where they're sympathies lies? in other words, are they somewhat sympathetic to isis? how do we ascertain that? you almost have to read somebody's heart to find out

what they're thinking, right? >> i think that's exactly right. and the fbi again because we don't have an intelligence footprint on the ground in syria, we really don't know who these individuals are that we're just going to bring into the united states. >> how many is he talking? thousands? >> thousands. >> thousands of syrians are going to come in here. i don't think we have the manpower to possibly vet all the people he's talking about, do we? >> we don't. and we can't even monitor them when they come here. remember, even in iraq we had refugees coming in from iraq. and we had two terrorists that killed americans in iraq that were allowed to come into the united states. and that's with all the intelligence on the ground we had in iraq. this is, again, i think a very dangerous policy. i'm glad you're covering this story because more americans need to know about this. i sent a letter to national security adviser susan rice asking her to explain why she's doing this and to try to stop this from happening.

compound raid that specifically mentioned him. joining me now kimberly gilfoil. >> he said it's misunderstood. this is just a jihadi looking for love in all the wrong places, sean. interesting though he did this posing as a woman, which is a well-known tactic that terrorists do to communicate in code with other operatives. so he was being watched. this was actually picked up by our friends in british uk intelligence that were monitoring his accounts and another terrorist named zazi that pled guilty to this multi-country plot to detonate destructive devices, et cetera. it was a big plot the likes of 9/11. so this individual's now on trial because he was extradited in january of 2013. they allowed him to come to the united states so that we could bring this evidence and this trial against him. but keep in mind the juxtaposition.

defense is saying he was unable to tell the difference between right and wrong because he was suffering from a mental disease or defect. >> but on tape he said he knew what he was doing. >> he directly contradicts himself. that's why that was a key piece of evidence that the judge ruled after an extensive hearing that could come in. and the jurors heard for themselves. key today was an officer who said i felt like he was trying to form late his defense by using words like oh, i'm crazy, what did i do as if to cover-up and make the case for himself that he could later plead self-defense. but if you have a mental illness, if that is not sufficient under the law in fact there's a m'naghten rule, therefore no crime, you have to be able to say does he know the difference between right and wrong at the time he committed the offense? and the evidence thus far i believe in my analysis is that he did. it's going to be up to a jury. if you use his words his actions, the direct conduct in the aftermath, that tells the tale. >> great analysis. kimberly, see you every day on "the five". coming up the left has

welcome back to "hannity." more potential trouble for hillary clinton as ethical questions are being raised over foreign donations to the clinton foundation. our friend ainsley earhart is at the "hannity" big board with all the details. >> thank you so much.

the clinton foundation, which was created as a charity after bill clinton left the white house, draws big money donations from all around the world. $2 billion have been raised so far since 2001. the foundation stopped bringing in money from foreign governments in 2009 when hillary became secretary of state. but that ban was lifted when she resigned two years ago. and those donations are now being scrutinized in "the wall street journal." "the clinton foundation has dropped its self-imposed ban on collecting funds from foreign governments and is winning contributions at an accelerating rate raising ethical questions as hillary clinton ramps up her expected bid for the presidency." some recent donors include the united arab emirates saudi arabia and oman. and now even the left wing washington post is questioning some of the foreign donations. here's a post review of the foundation's data. "found substantial overlap between the clinton political machinery and the foundation." now, since it's illegal for foreign governments to

contribute to u.s. political campaigns, that overlap could be an indirect way of supporting hillary's potential presidential run. in a statement denying any wrongdoing, a foundation representative wrote this "as with other global charities the clinton foundation receives the support of individuals, organizations and governments from all over the world. the clinton foundation has strong donor integrity and transparency practices that go above and beyond what is required of u.s. charities." the conservative group america rising pact doesn't buy it and launched an online petition calling for the foundation to return the money from foreign governments. it reads in part "right as hillary clinton is gearing up to run in 2016 the clinton foundation has begun accepting foreign money? remember the foundation spends a lot of their money on flying the clintons around the world and paying future and former hillary political advisers." this is wrong. sean, back to you. >> one quick question.
