editor for town hall. also a fox news contributor joins us live this morning. good to see you. >> good morning. >> is this an example of the principle if you just lie boldly and do it enough that people will start to believe it? >> you know, i'm not sure necessarily it works in this case because the obama administration as you and i know has not been scandal-free. the types of scandals that we have seen come out of the obama administration impact americans very directly. the irs scandal is one of them. when they see that the most powerful government agency is reaching in to their pockets and actually targeting americans just like them, they have a problem. other scandals that affect americans directly are obamacare, lying to millions of americans about keeping their healthcare or, you know talking about that they are stupid. there are some scandals that have happened during president obama's tenure that it's almost hard to keep track of them. in terms of why is david axelrod saying this? i think it comes down to what the obama

administration scandal and also doing a disservice. by him saying there haven't been any just brings us. and reminding how many there have actually been. >> they didn't care for james rosen's reporting. james rosen reporter at fox washington bureau and great reporter. they spied on his parents. i wonder if there has ever been an administration that could get away with that. but they did. >> right. they certainly maybe david axelrod doesn't think that the obama administration has had any scandals and they have gotten away with it or that they don't consider them scandals because they have gotten away with it they have gotten away with scandal after scandal after scaddle operation fast and furious. hundreds of people in mexico were killed as a result of that scandal. federal law enforcement agents were killed. this administration is like teflon as this administration says. so maybe because they get away with everything, that's why david axelrod doesn't think that they are actually scandals. unfortunately. >> unfortunately they have. they have done so with the complicity of the press.

that's what is so striking. reporters who cover the administration day in and day out says there has never been an administration less committed to the first amendment to cover government and yet, the press continues to gloss over or ignore these ethical lapses. why is that? >> you know, tucker last year i went to the print and radio correspondent wants dinner. one of the ironic things they invited the white house chief of staff to speak at that dinner despite all the administration has done. to spy on reporters to sources. to spy on parents of reporters. i think the most telling thing and important thing we need to discuss when it comes to axelrod saying that scandals haven't existed these are scandals that are serious impacts not only on the press and first amendment but people's constitutional rights. i think it's really a serious situation that they are trying to make light of and people's right have been violated in multiple cases. people have been killed as a result of v.a. as one

example of people dying as a result of government incompetence. and so these, you know these scandals have had very serious consequences. and yet you have an administration not only saying that they aren't scandals but no accountability for the behavior that has gone on. >> so obama is not running again obviously so it doesn't matter in electoral sense but history matters if you don't record something you can't learn from it later. i wonder if this administration will be recorded by historians as one with a lot of ethical problems. >> i would hope. so and i would hope that going into the next presidential election, either side of the aisle that the candidates will take a look at government corruption. accountability and true transparency and actually following up with campaign promises. you know, the administration is very good at saying one thing, we want to be the most transparent administration in history and doing the opposite. and david axelrod saying this administration is scandal free is exactly opposite of what the facts are. >> katie pavlich joining us

campaign plan. it's those kind of things you want to be kept close to the vest. you want to be able to protect your troops. and you want to be able to protect coalition troops as well and surprise the enemy tactical and strategic level. so, that's been removed. so now the actual resourcing of that fight as the good planners and the pentagon and general james terry on boots on the ground in charge over in iraq take a look at this thing, you you have got good people over there, and you have got good people in the pentagon. i think what they are doing is a realistic assessment of can we resource this fight and, you know, the next month or two with brigades that can push this enemy outs. it's really the she shia from the southwest part of iraq. what's their vested interest in pushing isis out of mosul when that's primarily a sunni part of the country. we are back to this three dimensional chess we are playing in iraq with regard

testimony of the american sniper murder trial winds down. >> prosecution gets its chance to rebut the case. eddie ray ralph was insane at the time. >> testified that he knew exactly what he was doing. will his defense hold up? the host of judge alex joins us now. thanks for coming on. >> so, the guy -- really insane. >> that's because we do tend to lump people into the crazy category, but legal insanity has a very specific definition. if you think about just general mental illness, nobody would doubt that a serial killer is mentally ill. we prosecute them and convict them all the time. it requires that people have a defect that results in them not knowing what they're doing is wrong. insanity cases usually turn out

to be a battle of experts. it's the kind of case where after you hear one side, you go, oh, that makes sense, then you hear the other side, it's normal to flip-flop, but i think the prosecution scored a lot of good points. they not only concluded he wasn't insane, they believe he's faking schizophrenia and gave examples of how he's doing that. one of the examples was that he made a statementhat he thought about killing chris kyle and chad littlefield when they were driving him to the range. he was going to shoot them from the backseat of the car, then thought better because he said, well, i might get injured in the crash. that's not the type of reasoning insane people have. it also contradicted his original version, he was at the range and started getting suspicious of them because littlefield would stand behind them. he gave a different version. they concluded he suffers from

paranoid personality disorder, which causes them to hold grudges, complicated by his use of alcohol and smoking weed because the, the weed that he allegedly smoked he said when he was first confronted, that he had smoked wet marijuana, soaked with pcp and fer mald hide. his girlfriend testified that the biggest fights they have had was because he's smoking multiple times a day and drinking throughout the day. that's what their focus is on. >> what about the jury? it's going to come down to that. will they be able to latch on to portions of his personality that he may be insane that he wasn't in his right mind, forget the actual legal definition of it. therefore, we can't send him away. >> it's the prosecution's job to break it down. they have to make it clear that people suffer from mental

illnesses, but if you knowingly commit a crime even though you're mentally ill you're still legally sane even though we go, that's nuts. so, it's up to the prosecution to bring that out. you have to focus on the fact that jurors don't like insanity. the insanity defense fails nine times out of ten. for a variety of reasons, but one is jurors just, gun level, don't like taking extremely violent, dangerous people and setting them free because they know as soon as, if this guy's not insane then a doctor down the road will say, he's got mental problems, but he's not insane and they have to relos heim lease him from the hospital and he's walking the streets with the jurors. they are skeptical of the insanity defense. it's not to say they can't win it. look, if he didn't know what he was doing was wrong, why did he fly? why did he want to apologize and why did he regret it after he

shot them. if he thought what he did was okay. that's really the test for the jurors. >> your prediction? >> if i'm a betting man, it would be the prosecution wins this one, but it can go either way. all the defense has to do is get a win is hang one juror, so if they find one who thinks he is insane, they hang the jury and defense attorneys are focused on the battle in front of him, not the long-term war. win this one, focus on the next. >> if you were on the jury how would you vote? >> i think i would vote to convict. >> and finally, this ralph character, he's going to spend his life in prison -- finding out -- >> not necessarily. >> he's admitted to doing it. >> if somebody's found not guilty by reason of insanity, they can't be punished. they can be committed to a mental hospital, but they can be released once a doctor declares

this may affect when they duoto sleep at night and their school performance the next day. >> if they have to get up at 7:00 a.m. and they're not going to bed until 3:00 a.m. that could be a problem. >> coming up with a bedtime routine is crucial. this enables your child's sleep clock to power down and relax. it's crucial to come up with a routine and not give in to their demands. i recommend dimming the lights, powering down, reading a book and having your child choose between several different options because it gives them a little bit of ownership over their routine, a feeling of independence. >> you also mention temperature balance. an age old fight my wife and i fight about. it's too cold in there, not going to sleep well. she might be right because you want to keep the room between 68 and 70 degrees? zwl my ideal temperature is around 68 degrees.
