minneapolis. al shabaab is the same group that claimed responsibility for the deadly terror attack at the mall in kenya in 2013 killing more than 60 people. it depicts an image of the mega mall with the gps coordinates. the man tells the followers to use the west gate shooting as inspiration. the mall of america is increasing security. other terror targets named malls in the united kingdom and canada. >> they said they want to wage jihad against those in the west. those against islam. this is a first direct threat against the west from al shabaab. they have ties to al qaeda. they align themselves a number of years ago. there's been some friction of the leaders for years. they represent what they call a

youth movement of jihad. and they come out of somalia, which is a lawless country. it's been without a government for over 20 years. it was a scene of black hawk down. and many somalis moved to the united states resettled here by the federal government. many clustered in the minneapolis saint paul area. not surprisingly, there's been a wave of somali-born americans going back from minneapolis and training with alsha baseball for terrorist organizations. they called them a terror group in 2008. they have the ties closely to al qaeda through the senior leadership. responsible for the deadly attack in nairobi. it lasted many weeks in 2013 that killed 67 people. really a shocking terror attack. they walked through the mall with ak 47s executing people for no apparent reason. >> americans began traveling to somalia to join al shabaab in

2007. they attracted many from the minneapolis. >> i was on the air that weekend when the story unfolded. they were asking people if you were a christian. if you were you were shot in the head. >> what is fascinating the u.s. government resettled so many somali refew agrees mostly in the united states in minneapolis but also in maine, portland, maine, most americans not aware it's going on. much less the rationale for it. what is the purpose of this? we know the fruits of it have been questionable. >> where do they get their money? one of the biggest resources for al shabaab for money. they kill elephants for the tusks. british soldiers had to try to stop them from brutally slaughtering thousands of elephants for their tusks to sell. that's how they finance their terror. unbelievable unbelievable. we'll have more on the story as it unfolds. we're following other

stories. overnight isis releases new video claiming to show kurdish fighters caged paraded down a crowded street iraq. onlookers cheered. 21 prisoners are carted on pickup trucks. the nine-minute video is similar to the group's execution footage. at this time fox news cannot confirm awe then titusty. rescuers saved 30 people from a river after a ferry capsizes in bangladesh. at least 100 people were on board. we're hearing a child was killed in the crash. no word on how many may be missing. okay. in minneapolis it's ambushed outside of a squad car. this morning police have arrested the suspect they believe targeted him. the officer was shot while investigating burglary. he's expected to be okay.

his partner rushed him to the hospital. 43-year-old andrew neil is charged with violating probation and burglary. he's not yet charged with attacking the officer. for the first time in 15 years, both busch brothers out of the daytona 500. kurt busch losing a last-ditch appeal to overturn the indefinitely suspend from nascar. he was sidelined after he choked and beat former girlfriend patricia dris cool. his lawyers say ss sent out a statement. kurt's brother kyle is off the track during a crash during the xfinty series. he hit a concrete barrier hard breaking his leg and foot. he's out indefinitely. >> speaking of our friend -- we're on the scene there at the

al shabaab releasing a video calling for an attack on the mall of america near minneapolis. how concerned should we be about the concern to the homeland? joining us now is j.d. >> nice to see you. >> we'll talk about isis in a moment. first, your reaction to the latest threat from al shabaab. >> it's not surprising. we have a lot of radical elements in minnesota. we have to pay for a lot of attention to it. we i fear for mall of america. >> mall of america said they're watching it closely. are we watching these guys? yes, we are. you can't necessarily catch everybody. we have to be right every single time. the terrorist have to be right once. >> let's talk about isis in iraq. you'll walk us through how it unfolds. and what problems the obama administration is facing. what are we seeing here? >> since the bombing campaign started in august, isis had about a third of iraq and a third of syria.

they still have that today. team obama's strategy is not getting it done. we're at risk for 9/11. >> you see kobani. it took 100 days to win back kobani. not a lot of civilian targets to worry about. how does mosul differ? >> mosul is over a billion people. there are 2,000 isis fighters that are occupying the city. iraq is going to plan the major assault in april or may with about 25,000 troops. unfortunately, we shouldn't have telegraphed that. isis has more time to prepare. >> so senator john mccain sent a letter saying never in my history have we telegraphed our position this way. the white house spokesperson from the pentagon saying, look, this is maybe an way to see if isis fighters would melt away. do you buy that?

>> not really. it's a gamble, for sure. the pentagon wants to try to win the battle without fighting. the isis guys are radical. i think they'll go down swinging. i think isis will double down. i don't think it's a good strategy. >> mosul dam and the city here how important is the dam to the city? >> the dam is very important. right now the kurds have taken it back from isis. if isis is able to take it back and destroy the dam that could destroy mosul. we have or it carebleful about keeping the dam. >> let's talk about libya and the mediterranean. what are we looking at here? >> we're looking at benghazi. egyptian aircraft struck after the beheading of christians. italy has been asking for nato help. but italy is only a few hundred miles from libya. they could launch aircraft from sicily.

myself or my son in harm's way to see him. to go to the motor home that night. i was there only 10 minutes, you know, just to have him eventually just saying crazy things he was saying and then threatened to pop up out of bed and grab me by the throat and smash my head into the wall three times. my son was in the front. i just -- i don't understand why he -- like that. after that i had to leave. it is hard to comprehend why somebody who you love and you lived in their life for four years would do something like that. it doesn't make sense. but, you know, the guy had been suffering from severe depression. i've talked to his doctors about it. he wasn't taking his medicine anymore. he started drinking again. i found out about a month before that. he broken our deal. and he was sober for a good

couple of years and got his mental health in a good sate. people don't understand that i was very concerned for him and his mental health. >> i think a lot of people watching knows what it's like to be in a long-term relationship. you don't just say it's over. >> four years. you know, and my clothing and all my belongings are still on the bus. i had a bus code that didn't change. in fact, kurt didn't even change the locks under his testimony until three or four weeks later. if you're a guy who feels like he's been invaded upon and you have broken into first thing you're going to change the locks. right. however when i went home that night, i changed my locks. i changed the alarm code. >> he also went out of his way to portray you as somebody who is a hired assassin. came in with blood on your dress one night. talked about the difference operations you've been open. what was that like? what is your response? >> it's so hard to sit in court and have people make up lies.

to sit there, like, to have that guy sit there and just fabricate something like she came in a ball gown with blood and matter and a trench coat. a bloody ball gown? you don't think that the hotel security or somebody would think something is strange enough to be on a hotel camera? how do you defend yourself against lunacy like this? >> all right. we have a statement from kurt's attorney. attorney. also a thing from nascar. kurt busch now exhausted his appeal options and the suspension remains in effect. he'll not be allowed to race or

have seen that. we have seen it with the sheer numbers. so i think there would be a lot of americans that are zpoibt disappointed tonight if that's the case. but who probably wouldn't be disappointed is michael moore who made the, you know, incredibly disappointing chents about snipers. which according to polling, 77% of americans disagreed with his comments including 63% of democrats. >> we want to show the poll if we can put it up. about michael moore's comments saying snipers were cowards. what does this tell you? >> it shows he's standing out alone on his comments, right. he made the incredibly obnoxious comments and what our numbers show that the americanmajority of americans disagree with him. even his democrats disagree as well. 63%. >> some are saying that snipers

the video include malls in the united kingdom and canada. >> the obvious point is whether or not an attack occurs at the mall of america. it has hurt the retailers there. and sent everybody scrambling to respond. who is al shabaab? al shabaab, from what we know, is a terror group located in somalia. a country on the indian ocean. the east coast of africa that hasn't had a government in almost 25 years and has been for most of that time, a hot bed of islamist extremism. >> they designated al shabaab as foreign terrorist organization since 2008. they joined al qaeda in 2012. their senior leadership they have sort of been at odds over their battle plans. in 2013 of course, anna mentioned they took responsibility for that nairobi kenya shopping center attack that killed 67 people. they were walking up to christians and asking them if they were christian. if they were.

terrorists al shabaab releasing a video calling for an attack on the mall of america near minneapolis. as new isis video reportedly showing 21 kurdish fighters being paraded through the streets in cages. joining us now with his reaction retired lieutenant general richard. >> good morning. >> and your response to both of these headlines this morning. >>well, late breaking we heard a few hours or so ago with regard to al shabaab, as you mentioned at the beginning is it shows again, the ever present terror threat, i'm sure that it alerted our local and state certainly federal law enforcement and the sharing of intelligence information. as i recall i think the threat is also in malls in the u.k. and canada. i have to think we're sharing adds much information with our international partners. particularly great britain and canada as well. >> so general, americans have been traveling back to somalia to join al shabaab because those

same people were one somali refugees brought to this country by the u.s. government and various church groups. with that in mind, why would the obama administration want to bring in thousands of refugees from syria at taxpayer expense to the united states. what is in it for us americans? >> well, again, my research shows and according to state department since 2011 we've allowed 524 syrian refugees to be brought back to the united states. as we heard from the state department spokesman earlier last week, rather increasing that number from anywhere from a 1,000 to 2,000 for fiscal year 2015. my concern there, i think represent representative mike mccall in the house said that reportedly if we do that we to realize these time with the siryrian refugees we don't have the footprint on the ground in syria to effectively vet as we did

with previous refugees such as iraq and afghanistan and somalia. the concern is their ability to gather the intelligence and do the do the proper vetting. i'm confident will be remain a vigorous process. >> in this age of terror threats, should we be strengthening our border. what is the importance of assimilation? >> i believe we should be strengthening the fact we are, again, we're still relatively open country. however, there's looming threat there, as you mentioned early with al shabaab threatening our malls both in the u.s. and great britain and canada. also with isis. that growing threat not only do they have, you know, looking for an expanse for the caliphate in syria and iraq but we've seen where they have now had terror campaign most recently the 21 christians that were beheaded on the beach just out of tripoli and so forth. it does give us not only pause

people go online to strangers websites, which could be yours, and especially instagram is a big target here or if your facebook profile is public and you're posting regular living your life everyday shots of your children. they're swiping their digital pictures and pretending the kids are their own or in some cases acting if they're children with other people into the bizarre behavior. what is your recourse. it's so little at this point. while you can certainly reach out and say what the heck are you doing with my kids' pictures. take them off and give them back. if they're no the in the u.s. you have no recourse. it's not illegal. you maid the pictures public so the police or fbi might argue back and say i'm sorry there's not a lot we can do because you already posted those pictures publicly. >> and once you post them on the websites like facebook or instagram. they don't really belong to you

anymore. facebook can do -- we've seen it before. they can put in their advertisements and publications. you opted to put it on their website. you have tips here about sharing. first of all, think before you share your child's photograph. if it goes on the internet then it's out there. >> prevention is the key. if you're a parent and you have little ones and they're not uploading it's you. i want you to think about when you upload that picture is there anything you wouldn't want the public to see? is it a location revealing shot. does it show where your kids are. does it contain the information of your location inside the photograph? and think before you do that. i'm not saying don't upload any pictures of your kids. i'm saying you have to think that everything so you're uploading is public. and there are wackos in the whorld are going to get ahold of it and do with it what it will. it will blow our minds how creepy people's thoughts get in their heads when they take

advantage of us. the fact is it's there. >> sometimes people don't think that the companies are actually companies. right. instagram as a company. you know, path is a company. pinterest is a company. would you take your baby photographs and walk down to the local grocery store and hand over the photographs? it's the same thing. >> right. would you take your picture of your cuds andkids and pin it on the telephone pole? would you tape your wall up there. no. it's time to reign in our privacy a little bit more here. i want you to think about if it makes more sense to you to not publicly post on social websites and limit those to your own family. that would be a great tip. that is set your privacy settings to you know -- understand what the boundaries are when you're uploading. this is instagram here. it's my instagram account. i have it public. there's nothing i'm not concerned about sharing.

i don't have kids i'm worried about on here. you tap yourself. you go to the top right on the instagram. it works for -- and then you simply scroll down where it says private account and you'll check it on android and you just hit the toggle on the right side here next to private account and it says when your account is private only people you can approve can see your photographs and videos on instagram. you have it on or off. if you have a little kid and posting it i'm saying turn it on. be private with it. also, facebook. here is a real quick way to do it on facebook. go to yourself on here and then you go to settings. and i lost it but i'll post it online. and i'll show you how to do this step by step. >> you set the privacy. who can see your facebook post. you're controlling that. >> you have a smartphone or an

after a ferry capsizes in bangladesh. it was carrying 100 passengers when it was hit by a cargo ship on the padma river. no word how many others may be missing or dead. a police officer in minneapolis is ambushed outside his squad car. police arrested the suspect they believe targeted him. the officer was shot while investigating a burglary. his partner rushed him to the hospital. he's expected to be okay. the busch brothers will not be driving in the daytona 500. last night kurt busch losing a last-ditch appeal to overturn his indefinite nate suspension from nascar.

we have the heart of it in daytona beach with a look at the weather and the drama. hey, rick. >> yeah, certainly a dramatic time. when they went into this daytona 500. i think everybody thought the story was going to be jeff gordon racing in the final daytona 500 and starting in pole position. it gets eclipsed by kurt busch and now kyle busch and his broken leg and the surgery he went through last night. a lot going on here. the race getting ready. it starts early this year. 1:00 to the pits are already getting set up. and the action starts to begin. weather has been a story the last few years here in daytona. not today. we'll have a spectacular day with temperatures in the 70s and sunshine. a slight chance of a shower to the south. i think we'll be good. that's great news. the rest of the country

something that is good. this is a piece of it but it's not the whole thing. there needs to be a military strategy as well. >> john we also learned this week in a leaked document that the administration believes that the real threat domestically in this country comes not from islamist extremisms from conservatives. right wing anti-government groups. >> i'm shaking my head because that's a story that i think has been twisted beyond all proportion. by one particular news organization that had some source in law enforcement who said something to that effect. i just was siing down with the homeland security secretary and asked him off camera about that. about this southern citizens extremist intelligence report. i read that from beginning to end. there is no mention in there about sce being any kind of greater threat that isis. i asked the secretary and he said i'm focussed on isis i'm focussed on al qaeda, i'm focussed on international terror

received. and we knew it was special when we were living in real life with chris kyle, all the s.e.a.l.s and marines and army on the streets of baghdad but you don't know how the audience is going to perceive it when you put it out there. we knew it was special. after the opening weekend it slowly dispersed and got bigger and snowballed. we are humbled that people have come out and supported the movie as much as they have. >> what about the criticisms like saying it glorifies war and killing and triggers anti-muslim sentiment. how do you respond? >> i think those -- it's criticism nonetheless. it's negative criticism and for those that have worn the uniform, carried the flag, and represented america well it's criticism we don't listen to because we've gone on and done great things and continue to do great things. that criticism is pretty cheap. >> i know you'll be watching tonight. thank you. coming up is the air you breathe while you fly killing

all the states except alaska. the fbi has a huge job in front of them. you know, you look at the mall of america. you look at the malls and you backtrack and said it would be nice to know who comes and goes into the country. we don't have a clue who comes and goes. >> i don't believe we have a clue, no. not at all. what precautions do you think they're taking at the mall of america? >> i think you're going to see more police presence. they'll be checking inging backpacks and move the perimeter to the parking area. they'll have, you know the video will be everywhere. the people will be more alert. it puts a chill on what the country is about. >> it's even more chilling. the fbi has their eyes on these guys. anybody coming into the country suspect. we know the flights.

we'll be tracking them quietly in the background. to think we continue know who these people are. >> back to the conference, you know, the fbi director didn't go there and he probably chose not to go there. he has an awful lot to do. and, you know, the fbi director has a position with a term. he's not political. he's not part of the political apparatus. he can't be. he shouldn't be. he's good friend of mine but he said a few things about the police business. he mimicked what the attorney general was saying when i thought he should stay away from that. and be more concerned about the fbi investigations. you know for instance, why is the fbi visiting, you know, the four times and not interviewing

him? the victims in the irs scandal. people ask me that because i know 100 times what is the fbi doing? the fbi cannot be political. they have to take their own stand. we hire people that don't like kicking in doors. we hire people that respect the rights and the dignity of every american. that's always been my experience. >> yes. >> but they get a huge job i had head of them. it's difficult to control. why people are going to the training camps and coming back and going into the population is bewildering to me. why they're not arrested on the border. why they get on the airplane is bewilder. >> how they got to america in the first place is another question. you are overseeing a tribute to the 70th flag raising. >> i'm involved with the marine corp. law enforcement

this morning. >> thank you for having me. >> why minnesota? why do we see so much focus on islamic radicalization outside minneapolis? >> well, we're looking at, you know immigrants that come in here whether through the amnesty or through obama, you know, dream act, and we've seen many of them are coming through the borders, you know, of the united states of america, and these somalis have been coming in here we have not investigated them. statistics shows that about 80% of it will -- you know when they cross the mexican border they're considered oshgts tm, other than mexicans. these people all we have to do is make one mistake and bring the radical person to the united states of america to take pictures in our mall or maybe, you know, do radical act within our nation. >> kamal you have a unique perspective, being a reformed terrorist yourself. tell us what the radicalization process is like when they're recruiting folks here from the

united states to go to al shabab or the three girls we reported on from the united kingdom kwhof crossed the border into syria, potentially, to join isis. how were they recruited and what is that radicalization process like? >> the unfortunate way that's done, it's done through our universities, mosque system, which is the islamic holy prayer centers, you know, and jail system. also it's happening, you know, in our social media and then also happening even high school nowadays. and all these lead to one another. for example, when we take, you know moore, the one who did the beheading, he was converted in the jail system and then he was indoctrinated with radical islam in the mosque, you know, outside of oklahoma university. and therefore he did the beheading. then we look at jihad, you know, ft. hood, hassan, you know, major hassan what he did.

he was indoctrinated in the mosque, and he turned from a good soldier to a radical islamist. so therefore we see all this happening, you know, in our media, you know, through social media and universities and mosques. >> and yet the obama administration refuses to tie these terrorists to their religion and saying what they say about being religious leaders is a lie. is that a mistake? >> it's a big mistake, not just big mistake. eventually, you know, in my humble belief, that i think obama is trying to really make islam looks good. but the way it is going about he's not doing favor to the muslims. i think ultimately what he's doing, he's dealing with a special group called the muslim brotherhood, but then he's leaving the moderate muslim outside of this. and we saw what happened in egypt. in egypt, you know, when the mus lick brotherhood took over, the

"fox news alert," two new terror videos out overnight and one is a direct threat to america. al qaeda-linked somali group al shabab calling for an attack on the mall of america near minneapolis. al shabab is that same group that claimed responsibility for the deadly terror attack in the westgate mall in kenya in 2013, killing more than 60 people. the video depicts an image of the biggest mall in america with its gps coordinates. security has been increased. other terror threats named in the video include malls in the united kingdom and canada. the second video released by isis claims to show 21 kurdish fighters in cages paraded down a crowded iraqi street. the nine-minute video is similar to earlier execution footage. fox news cannot confirm the film's authenticity or what happened to the prisoners but it doesn't look good. >> so who is al shabab? what is this group? this is the first time they've made a direct threat against the

west. why now? is isis gathering all the headlines? why have they desaided to wait until now to do this? the state department designated al shabab a terror organization in 2008. they have close ties to al qaeda through its leadership, in fact, pledged allegiance to al qaeda in 2012 but have had some friction over the years. >> tw-in 2013, they were responsible for that attack on the westgate mall in nairobi. 67 people were murdered in that thing. they e moergeed, like most terrorist groups do from chaos from the lawlessness of somali which has not had a central government in over 20 year, and at the same time thousands of somali refugees have been relocated by the u.s. government and church groups into american cities. and it's from those populations we are seeing scroll tears from al shabab moving from the united states back to somalia. law enforcement in the u.s. concerned about those people this morning. >> mainly in minneapolis, which has the largest muslim population in the united states.

>> al shabab, they call themselves the youth or the youngsters. i'm fascinated how they get their money. some gather hostages and demand ransom. al shabab slaughters tens of thousands of elephants and sell the ivory tusks. that's how they get a large bulk to of their money to run their operation. >> let's remember our faith this morning on this sunday morning when that attack that they're known for last year in kenya on the mall when they were asking people who appeared to be christians, are you christian, and if they would denounce their faith they were executed right there. 67 people died. >> tim clementi retired fbi special agent and expert on counterterrorism. give us some perspective on all this. >> good morning. >> al shabab, how grave threat do you believe that group poses to the united states? >> i believe they pose a very great threat. the example of the mall you just mentioned at westgate was a perfect example of what they can do here. it doesn't involve a great deal of planning or extensive amounts

of weaponry or materiel. it involves use of guns and they're very easy to get in the united states. the somali diaspora in the united states, estimates about 750,000, a small minority would be considered radicalized something that al shabab would want to recruit from that pool. and al shabab has been very effective in bringing fighters from here over there but they're even more effective at radicalizing people here. that's the problem, the real threat. they don't need to bring al shabab fighters that work in the westgate mall attack and bring them to minneapolis to attack a maul. they can have individuals living in minneapolis radicalized, get them armed in any way and go into any kind of a crowded public place and commit an atrocity. >> how different are these types of attacks from what we've come to expect over the years, these large, spectacular attacks, airline crashes and the like? are we going to see more of these style pop-up attacks at shopping centers or public areas? we've heard about coffee shop

attacks. >> yeah. the fbi has been worried about this and concerned about this for a long time. we've always been involved even pre-9/11 in planning and counterterrorism planning for major special events. you know, the super bowl comes to mind as something that we all recognize. but we also work at major events that are just like everyday professional sports, college sports venues and in concerts and things like that, because anytime you have a large gathering of the public you need to have some kind of a counterterrorism plan in effect because it's something that is a soft target ordinarily. now, the if the president of the united states goes to an event, it becomes a hardened target becomes a national special security event and the secret service takes over security. but a regular, everyday event eve an little league game where you might have hundreds or maybe a couple thousand people watching, there might be no physical security presence at all. and that's something that might have to be modified because of groups like this. >> let's talk about this specific target being in the crosshairs, though. why is it the mall? we think about 9/11 and being the twin tower, a symbol of a

thriving economy and economic prosperity. we think about the boston marathon on this bombing and the american hard work and sportsmanship and all that. is the mall a symbol of commercialism or what is it? what's the deal? >> it's an american icon. just the fact that it has the name, the mall of the americas, it has america in its name. it's also an icon. malls are something that probably were generated in america and have spread throughout the world and it's that commercialism you just mentioned that's spread throughout world that a lot of these radical islamists hate to much. you have boko haram in western africa, which hates western education. al shabab, you know, the youth, as you mentioned it hates western life, period. and one of the things you just had in your segment was how they received so much of their money through the poaching of ivory in africa. these aren't individuals that go in and just selectively kill one or two elephants. they use rpgs and chainsaws to

slaughter entire herds and walk away with just the ivory from it. this is a group that butchers animals and human beings wantonly. >> so we're never going to have enough security to protect every little league game. we're just not. so when is law enforcement going to say publicly maybe we should stop letting scary people into the country in the first place? >> well, that's something we need to look at. we need to also look at some of the scary people that are already in the united states. the problem is i actually worked an investigation pre-9/11 that involved looking for some of the individuals within the small i diaspora in america and canada that may have been involved in the blackhawk down attack in the killings of the medal of honor winners in mogadishu back in 1993. some of those people we know got into the united states and the fbi and other groups have been trying to track them down far long time. >> so irresponsible someone would allow that to happen. you wish someone could be held accountable for that at some point. >> i agree with that. >> i'm heartened by some of the

netting of some of these guys, portland comes to mind, of course, the bombing that was set to unfold there the fbi watching them and lured them into that trap. what we saw in times square. can we think the fbi is on top of all of it? >> the fbi can't be on top of all of it. there's 12,000 fbi agents throughout the world and that's not a big enough force to look at literally hundreds of thousands of potential people that could be involved in something like this. local law enforcement is also a big player in this. but individuals are. and i think the muslim community itself and especially the small i community needs to monitor its own. you know, i saw a story recently about parents of the young individual the 19-year-old somali male that was going over the fight with isis and his parents were totally surprised that he would doing do something like this. i don't think it could be 100% surprise. somebody close to these individuals sees their radicalization, hears what they're saying, see what is they're posting and is either ignorant playing ignorant about it or not doing anything about it and they need to.

>> tim clementi retired fbi special agent and counterterrorism expert, thanks for your expertise. now some other stories making headlines in another "fox news alert." defense secretary ashton carter in kandahar afghanistan, overnight. he spoke to about 100 soldiers saying training and organizing afghan forces is the heart of the mission. our military presence at kandahar closes down this year, but the president now considering changes to that plan. also breaking overnight, the death toll continues to rise from a capsized ferry accident in bangladesh. at least 31 people including a child are dead after it was hit by a cargo ship on the padma river. more than 100 passengers were on board. 50 people have been rescued. no word yet on how many others may be missing or dead. for the first time in 15 years the busch drivers will not be driving the daytona 500. late last night, kurt bush losing a last-ditch appeal to overturn his indeaf net suspension from nascar.

he was sidelined after a judge ruled busch almost surely choked and beat former girlfriend patricia driscoll. kyle busch off the track as well after a dramatic crash during yesterday's xfinity series race. busch losing control hitting a concrete barrier hard, breaking his right leg and left foot. he's out indefinitely. rick is in daytona. >> are you behind the wheel? >> i am behind the wheel. and i think i found the ignition switch in this car and it's really tempting to try to start it. but take a look inside this car. you have to understand these guys drive for about four hours at about 195 miles an hour trapped in this, and they are fully belted in and a helmet and cannot move. and if you have any propensity towards claustrophobia, which i do shgt it sounds really, really horrible. anyway, that's a look inside the

there he is, america's mayor, made some headlines this week. he was on "fox & friends" earlier this week responding to criticism he got for comments he made during a fund-raiser with governor scott walker of wisconsin where he took to task president obama, saying he doesn't know if the president loves america. he more often hears the president criticizing and apologizing for america than praising it. >> and doesn't believe in american exceptionalism. he when he was on "fox & friends" he was asked if he wanted to apologize it or repeat what he wanted to say. he doubled down on it. now, he's getting death threats and the trickle-down is affecting governor scott walker as well. now he is getting raked over the coals by the mainstream media. let's take a look at the headlines bashing him. scott walker's spineless silence from "the washington post." >> from the post, scott walker says he doesn't know if obama is

earlier in the show we heard her describe the attack. our own brian kilmeade asked her what can be done to help victims of domestic abuse. >> anyone who cares about the welfare of their troops knows your name, especially in washington. >> yes. >> the town has been running over ten years now. >> yeah. >> people know that. but now everybody knows your name. what has that been like for you? >> it's really awful because i like to talk about the issues that matter. i want to talk about our troops. i want to talk about ptsd and how these guys need help. and instead, you know, my name is out there for a bunch of craziness that has nothing to do with anything. and the worst part is that they're distracting from the real issue here that an act of domestic violence has occurred np guy committed a crime. at the very bottom he says he cupped my face and tapped my head against the wall. you know if that's where he's starting it was a lot worse than that. and when i have pictures that show completely different and a judge who obviously didn't agree

because he also ordered him to get a mental evaluation and the help that he need too and turn in his firearms. >> the judge found you were right. >> yes. >> now he has to stay away from you at least 100 yards for a year and he's found guilty of abuse. what would you like to see happen? >> this is about an issue of kurt and i anymore. this is a much bigger issue. i love so many of the people in nascar. we've had a long-standing relationship. but i'm very disappointed in the way that they've handled this situation. you know, they had a driver a year before i was assaulted assault his wife. he was charged. he was arrested. and he was convicted. and they did nothing. then ray rice happened. and i thought at some point you have to take a stand as a sport about how you feel about domestic violence. there's so many little kids who look at these athletes like they are a superhero. so if this is your superhero, these are your brands do you really want that representing your sport? because i've had a lot of women come forward to me from the nascar community to say they were also abutz and that they're

being la raszharassed by other team members, that when they've gotten protective orders they're still harassed by ex-huhs or ex-boyfriends or the guys he works with because unlike a lot of sports they all live in the same community. i want there to be a way for there to be protection for these women, a clear channel where they can come and report and say, look, they're not abide big the restraining order, they're bothering me. the teams need to stand up and take responsibility, too and say we're not going to tolerate this, it's a company policy. >> do you think if they act strongly they'll be empowered to come forward? >> absolutely, because i've had all these women say i'm there's no way in the world i'm going to put myself through what you've been through and god bless you for doing it, but i don't think i could handle it. and i don't think i can afford it because with the lawyers, i mean, it's been tens of thousands of dollars. and a lot of these women are not financially independent. how are they going to pay that bill? >> patricia driscoll, thanks so much. >> thank you. >> totally clear that nobody has been convicted of a crime here

"oscars by numbers." one number you should look at 3-9-8. i think we have a full screen of it. bradley cooper made history. nominated for the third year in a row for best actor. he joins a group of nine other actors who have only done so in history, richard burton, a whole group of them. and of those nine eight have gone on to win best actor. so i would not count him out tonight. if there's going to be a surprise tonight, i think there will be a couple surprises. it will happen with "american sniper" for best film or best actor. you can't ignore if this movie. one of the things it has going for it of course is the box office pip think we have another full screen of that. it has gone on to outgross all its competition combined, grossing over $300 million worldwide to date. that's a hard thing for the academy to overlook. when this whole process started off this season, the academy was worried they didn't have a box office hit for people to rally and get behind and tune into the

actual show. now they do in "american sniper." >> profiling an american hero, chris kyle, the most decorated navy sniper in american history. and really accurately depicting what military family members have to go through as well. let's talk tact tom four studio nomination nominations, michael. >> everyone says they're voting on art tonight, but don't kid yourself. this is a business and a lot is at stake for some of these studios. the studio going in with the most nominations tonight 24 would be fox, between 20th century fox and fox searchlight has the most nominations going into tonight. they've had a fantastic year with movies like "birdman," "grand hotel budapest" and "dawn of the planet of the ape," "how to train your dragon 2," "gone girl," all to be the top grossing studio of the year. no matter what happens tonight there will be a lot of champagne and celebration at the fox after party for sure. >> let's show that best picture

nominee award totals there. you want to go over this one for us? >> sure. let's look at what movie may have the momentum going into tonight. right now it looks like "birdman" leads with about a total of 12 trophies they've taken home since the beginning of this process between the critics awards and some of the guild awards. when this whole process started off, everyone was saying "boyhood," all the kritcritics, then the gild started vote, the vga, the sags, the prokjus deucers gild and "birdman" swept. so that has the edge and momentum but i would not discount "american sniper." the first time it's going head to head in a real way with some of these movies. >> as we go, michael, what are the chances that brald ss ss that bradley cooper gets it for best actor and the film gets best film? >> pretty good. having to vote for best film, it's a crazy system, a ranking system, like the iowa caucus in

moved as others have seen their fortunes go up. when you look at who's done well, the stock market near all-time highs that is affecting the highest earner the wealthy out there. the middle class is getting squeezed because they're not really benefitting from some of these policies. and the federal government has really not done the policies that can move the needle on jobs like vice president bide season saying that, for example, the federal reserve has been trying to move. so it's been very much a monetary policy story in terms of economic growth. the fed has injected money into the system. the fed has kept interest rates at rock bottom low levels. that has enabled consumer activity and the rich to do very well. the middle class remains getting squeezed and they're facing higher prices for a number of items out there and they're not even spending the money they saved at the gasoline pump because they're worried about all the uncertainties out there. he's right about the middle class. >> you can't have a responsible functioning democracy without a strong middle class.

that's the whole point of america. what policies do you think we need to institute to raise wages? >> first off we need growth. we need to see that we have sustainable economic growth. gdp report is out next week. that's going to be very important to watch because this last gdp report that was out was actually below expectations because you had a whole host of jobs getting impacted. in order to see jobs you need to see growth. so without economic growth you're not going to actually get to where you want to be. what needs to be done. the business environment has to feel conducive to creating jobs. so businesses have to see an environment where their taxes are at reasonable level, the regulatory environment is not choking them so, that they have a feeling of confidence that in fact, things will get better on the demand side so they can hire people. business creates jobs so you have to create an environment that is favorable for business. this president has not done that. >> they have to think the rules are going to change tomorrow. you always have the strongest

guest lineup. who have you got? >> general richard myers, former chairman of the joint chiefs of staff. this is the highest ranking uniformed military man formerly of the -- overseeing the war in iraq, the war in afghanistan, 9/11. when i talk to him about what has hammed over the last 15 years in terms of the terrorists, of course today we have another threat on our home land with al shabab saying that they want to attack the mall of america. we'll talk with representative michael mccaul on that, chairman of the homeland security. of course as you know the bill to fund homeland security is -- we've got a deadline this friday, what happens to the states and the economy if, in fact we don't fund homeland security so we'll talk with him about that. then we've got governor gary herbert of utah. this weekend we have the national governors association. the governors of this country are upset because they feel they know their state better than anybody, so why is the federal government coming out with rule making that actually impacts
