mall of america now stepping up security after al-shabaab -- you know the terror group -- released a video threatening the largest shopping center in the united states and now a minnesota lawmaker is challenging the mall's no-gun policy. >> the situation at mall of america is completely ridiculous. it's just the opposite of what they should be doing. if we're threatened with an attack of any type, the last thing you ever want to do is disarm citizens. >> the mall has not responded to this lawmaker's recommendation. at least not yet. the american sniper murder trial expected to wrap up this morning after winter weather delayed the case yesterday. this morning the jury will hear from one final witness and then they'll get closing statement before deciding whether or not eddie ray routh was insane when he killed chris kyle two years ago. if routh is found guilty of murder he'll spend the rest of his life in prison. looks like neil patrick harris will not be asked to

i'm still stressed. >> meanwhile exactly five minutes after the top of the hour. we've got a fox news alert. the department of homeland security sounding the alarm saying a shutdown threatened this friday means our national security could be at rick. >> we're live with the latest. >> the clock is ticking. we should sort of maybe put a little running clock at the bottom of the screen. time is running out on fully funding the department of homeland security. i want to point you back to december as i sort of unpack this story for you briefly. remember back then congress fully funded the rest of the federal government for the full year, but g.o.p. leaders held back funding for d.h.s. in reaction to what many are calling the president's unlawful executive action on

immigration. that gives the department budget authority only until midnight friday. >> until congress acts, more than a week from now, more than 100,000 d.h.s. employees will show up to work without getting paid. >> a shutdown of homeland security would have serious consequences and amount to a serious disruption in our ability to protect the homeland. >> so what happens next? yes, the battle continues in congress but keep this in mind. d.o.j. lawyers have asked the federal judges to issue a stay, essentially saying i know that one judge says this is an illegal action on immigration. we're asking you to issue a stay. in other words keep status quo, allowing the executive action to continue. but even that is a bit of a contradiction. we'll be watching how that plays out here in washington. guys? >> kevin, democrats are blocking the bill, but weren't some of them against the president's

executive amnesty business in the first place? >> absolutely. i want to give credit where credit is due because a lot of people feel like this is a one-party issue. it simply isn't. take a look at this list. you're going to see some pretty big names on this list from democratic circles including claire mack cass skill. joe manchin obviously on that list. we hear him all the time on fox news. the president does not have full sweeping authority or full sweeping support of his executive immigration amnesty program. you'll hear a lot more criticism about that in days to come. >> in the meantime you have democrats who have said in the past i'm not comfortable with the executive order and the president was not comfortable with the executive order in the past. he said i wish i could do what i want to do on immigration but i am not involved. joe manchin who will be here shortly is what happened. when are they going to stand up to the president and look out for their party? >> if by friday this

doesn't get passed here, if this new budget is not approved are we left safe? you remember jeh johnson went on five programs saying we would be at a greater risk but yesterday the white house press secretary josh earnest was grilled about what this would mean because there would be individuals who would still be showing up to keep our country safe. so what's the deal. watch. >> people who don't collect a paycheck will not do their jobs as well? >> i'm not saying that at all. the thought that congress because they're not willing to do their job is going to put these patriotic employees in a -- >> you're saying the country will be less safe if these people are not paid because it will have a direct effect on national security. but you're saying these people will do their job even under the onerous condition of not being paid smoip there are a variety -- >> there are a variety of impacts from shutting down homeland security.

i think one of them is an issue of fairness. >> way jeh johnson's warning a scare tactic to get congress to pass this thing? it kind of looks like it given the fact that there are mixed messages. the intel people say there are no credible threats. at the same time you've got jeh johnson saying this outfit, they want to blow up the mall of america. >> you know what else is interesting? you keep hearing we need this funding to keep our nation safe, fine. fine with that. when you hear between 2001 and 2014 this administration spent nearly $150 million on office furniture and office makeovers, it kind of makes you wonder how well they're doing balancing their own budget there. nearly $150 million. >> a great point. at some point when the latest crisis is over they've got to revamp or revisit what they're doing with d.h.s. because nobody is happy there. it doesn't seem to be functioning as one unit. there's units involved that don't seem to be motivated and there's a lot of people that think they're not

doing the job. >> one department we know has not been working is veterans affairs. we know we've told you stories over the last year about how many, many people have apparently died while on the wait list and they were cooking the numbers. robert mcdonald, former c.e.o. of procter & gamble has been hired by the administration to fix things. it was just last week when he claim on television that under his leadership 900 people have been fired since he took over. that is a misstatement. it was way wrong. and "the washington post" in fact gave him four pinocchios. meanwhile fast forward to not long ago, he was out in los angeles -- >> in january. >> cbs was following him. he's out on the street canvassing and talking to homeless vets when he said this -- >> really? army?

navy? >> army. >> what unit? >> special forces. what years? i was in special forces. >> no, he wasn't. that's a lie. >> in a moment of trying to relate he said as i thought about it later i knew this was wrong. he said while i was in los angeles -- his official statement -- engaging a homeless individual to determine his veteran status i asked a man where he served in the military. he said he served in special forces. i incorrectly stated that i had been in special forces. that was inaccurate and i apologize to anyone offended by my misstatements. >> we're all offended. that's a lie. >> it's not a truth. you look at his background. out of everything he could have said, he graduated out of west point completed army ranger training and assigned to the 82nd airborne. with everything that has gone on with the v.a., i don't think that is a big deal. >> it is a good lesson in even trying to relate to someone even though the premise of what was going on

hoirk -- historic policy of no concessions. if you look at the state department, white house and the defense department press secretaries the verbal gymnastics has been noteworthy and they can't really explain it. it's a hard situation. >> that was a situation where this was done at the white house without the pentagon's okay even though they were pushing bowe bergdahl back. if somebody is taken tomorrow, do you feel we have it right? these families feel frustrated because they are civilians and feel the f.b.i. is taking too much of a lead. >> i would say that we currently have a method in place with a hostage working group at the national security council. the process is there. how well it's done, who does it and how they do it, i'm not there anymore. but the fact is it's got to be joint military, interagency, multinational. there is no one agency currently leading.

the obama administration fighting back against 26 states in their efforts to end the president's executive order on immigration. they have now filed a stay in an attempt to get a judge's injunction on the order lifted and the white house says the law is on their side. >> the specific measures that the judge has prevented the administration from implementing are actually the same measures that would bring greater accountability to our broken immigration system. there is not just a strong legal basis for the action we're pursuing, there's actually a strong basis for those who are interested in doing the right thing for our economy and for public safety. >> could this latest legal maneuver put the president's plan for amnesty back on track? we're going to ask fox news

senior judicial analyst judge andrew napolitano. where does it stand? does it put the president's executive order on amnesty back? >> no but that's what the president would like it to do. the president and the administration has every right to file this appeal. there are supporters who would think they are crazy if they didn't do so. the problem is they made some weird and bizarre arguments to the judge in an effort to get him to lift his stay. remember, here's how this started. the president tries to get congress to chang the immigration law. congress for whatever reasons declines. so he signs two executive orders changing it on his own and that affects the states because it makes people who were here illegal but gives them the right to stay. >> placing the burden on the state? >> to provide services, hospital schools welfare. the states say we don't have this money. the president changes the law on his own. we want you to stop this immediately. a federal judge says that.

yes, you probably will win the president is probably wrong, the president probably changed the law and i'm going to enjoin the president. that is what happened last monday. yesterday the president's people filed an appeal in an effort to get the judge to change his mind and if he doesn't change his mind, to appeal his decision. in the papers they filed yesterday they basically said the government will be irreparably harmed if you don't lift this injunction because we need to provide a service to the illegal aliens we promised we would help. so think about this. the government wants to break the law so they be help other lawbreakers stay here. i have never heard the government make an argument like that. i've heard some creative arguments in a courtroom in my life. i never heard a government make an argument like that. >> when you put it like that it's almost unbelievable they can make that argument. will it actually work? >> i don't know but i don't think so. >> why? >> it's a shaky argument to

we've got a graphic that shows how big they are. isis first established in 2004 under the name al qaeda in iraq. the founder was czarzarkawi. separated from al qaeda in 2014. so now as we look at isis the main territory we think of regarding them is syria and iraq? >> this is what they call their interior. this is their caliphate to establish the islamic state. think of isis as four elements. governance governance. having financial support. their campaign which actually is a global reach in terms of the cyber domain. >> the video of where isis marched those coptic christians out on the beach and then beheads them, that's libya. libya once again, just a short trip across the mediterranean from europe.
