director of the national intelligence right here, james clapper says this. >> in 2013, just over 11,500 terrorist attacks worldwide killed approximately 22,000 people. preliminary data for the first nine months of 2014 reflects nearly 13,000 attacks which killed 31,000 people. when the final accounting is done 2014 will have the most lethal year for global terrorism in the 25 years such data has been compiled. i will say as i say every year that this will be the fifth year in my 50-plus years in the intelligence business i don't know of a time that has been more beset by challenges and crises around the world. i worry a lot about the safety and security of this country for a lot of reasons. >> and he should because he's the national intelligence director, and he must realize a few months ago when the president was giving an

interview, he basically said my intelligence division let us down there when they underestimated isis, and that's why he called them the j.v. team. so i think clapper goes out there and says it is dangerous. no one is going to deny it. i don't care what the secretary of state says. i've had a great career and i'm not going to screw it up and get thrown under the bus again. it seems james clapper is on the same page as lieutenant general michael flynn who also said i guess secretary of state kerry is not reading his threat assessments because clapper is on the money. >> under this administration, who was nominated under this administration. >> if you're going to diagram what has happened you have the president of the united states throw james clapper under the bus, and then james clapper just threw secretary of state john kerry and the administration under the bus saying that stuff about us being safe, not true. >> by the way, it's all about us. we don't care about their careers. we just like to know what's going on here. it's not the 24-hour news cycle, not if it leads, it

lois lerner. she is the woman at the very center of this targeting scandal. e-mails from lerner could tell investigators more about who, if anyone, actually ordered the targeting of conservative groups that were applying for tax exempt status. congress requested the e-mails from the agency but over the summer officials told lawmakers most of them had been lost when lerner's computer crashed. >> the actual hard drive after it was determined that it was dysfunctional and with experts no e-mails could be retrieved was recycled and destroyed in the normal process. >> now we're learning the i.r.s. never asked technicians to look for the tapes. and when the independent investigators from the treasury department started looking around it only took a couple of days. >> it looks like we've been lied to or at least misled. >> the i.r.s. takes four months to tell us something as important as we lost lois lerner's e-mail. and their excuse is we're doing our due diligence. we're doing everything we darned well can do to get

those. when they do make it public to the whole world they didn't tell you ahead of time. they told you when they told the whole world and in two weeks you got them. all you did was get in the car, drive to west virginia one state over, and get the tapes. >> the inspector general is looking into a number of issues including how the e-mails got lost and also obviously if there was any criminal activity involved in the targetings. we know lois lerner invoked her fifth amendment rights. what we're still waiting to figure out, number one, is if these e-mails are new or things we have seen before. number two what's in them. and lastly, it appears as though there may even be more of these backup tapes out there to sift through in the coming days and weeks. back to you guys. >> thank you, leland with that story from on stonewalling. two stories took twitter and the internet by storm. first up, you saw yesterday when shepherd smith was describing the lamas on the loose in sun city, arizona. eventually even though they

endorsements. pete, first off where do you stand? what does your report conclude? >> our report concluded that right now under secretary mcdonald unfortunately the bureaucracy is still in control, not the veterans. our 100-page report called fixing veterans health care is meant to put the veteran at the center. give the veteran a choice. if they want to go elsewhere they can. if they want to stay at a vament -- v.a. facility they can. the v.a. is forced to compete for veterans as customers and not take them for granted. that triggers accountability which changes the culture. secretary mcdonald is defending the bureaucracy, not holding it accountable. that is why people are frustrated who are hopeful about his tenure. instead they're seeing business as usual. >> the west point and procter & gamble seemed to be the perfect mix.

about choices centered around that. and prioritize service-connected disability. first off by making the v.a. independent, are you breaking it from the government but yet asking the government to finance? >> right now it's just the hospital system. we're going to take the provider function and spin off an insurance system as well so that the v.a. can both deliver insurance plans so veterans can go wherever they want but it can also run efficient and quality hospital as an independent organization. right now the hospital can't fire bad managers, can't hold people accountable, can't rationalize their business decisions and make sure they're getting rid of facilities they no longer use. it makes it run more like an actual hospital and private sector hospital than a washington bureaucracy. on the choice people there's millions of choice cards out there. veterans received them in the mail but there's very little choice because you have to call a 1-800 line wait on hold and someone tells you whether you qualifeteran has the choice up front and

communications commission approved yesterday new sweeping regulations giving the government more control over the internet. but a new report suggests that decision may have been bought. >> interesting. here to explain it from our sister network fox business is stuart varney. okay, what do you mean by that? may have been bought? >> the media research center has found two groups which have provided enormous amounts of money to groups who want government control of the internet. for years they have been funding these groups which have pushed very very hard for government takeover essentially, a government takeover of the internet and now they've got it. >> like the phone company used to have? >> very similar. >> treating it like a utility? >> yes. in the future you will have to go to the government. you'll have to go to a bureaucrat, to a lawyer if you want to change thing on the internet to innovate or change pricing policy. if you want to make things move on the internet, you have to ask permission of the government. >> so many people are upset about this because since

prosecutors say he was a close confidante of bin laden and led a training camp in afghanistan. he now faces life in prison. a man scales an airport fence and ends up on a tarmac. police say kevin bruce was spotted on surveillance cameras walking in a restricted area at minneapolis st. paul airport. he is accused of jumping over an eight foot barbed wire fence. police say the man spelled like alcohol and pot. he's been charged with trespassing and the airport is investigating that breach. they crossed the line, that's what parents in indiana are fired up about after middle schoolers were asked to fill out a personal survey. the indianapolis students were given questions about drug and alcohol use. they were also asked to respond to statement like this: people in my family have serious arguments, and people in my family often insult or yell at each other. listen to this. >> they crossed the line when they entered the home. >> those are personal

>> we're still looking at very cold temperatures across parts of the plains and the northeast this morning. in new york city current wind chill temperature only 12 degrees. we are going to be seeing more snow across parts of southern states. that includes parts of texas and the plains states like oklahoma. that storm system is going to be impacting that area throughout the day today. most snowfall accumulations going to stay generally light out there about 2 to 4 inches but locally heavier amounts and ice as we head into this weekend it will continue to be a concern with freezing rain in the forecast. just a messy forecast for parts of the plains and even into the rockies. again, those wind chill temperatures are very cold across the country. you can see them below zero in places like minneapolis and chicago and high temperatures will stay below average as well in parts of the great lakes and down into the southeast. let's head back inside. >> thanks maria. if you have more kids should you be allowed to receive more welfare? a controversial law trying to make this actually

for terrorism. >> joining us is the c.e.o. for the national center of policy analysis lieutenant colonel allen west. congressman, what do you make of this? who's right? >> without a doubt mr. clapper is right when he's looking at the current threat, existing threat which is this global jihaddism. i think what john kerry is trying to do is play a little apples and vegetables game. he's looking at the mass nation-state mobilized in world war 1, world war ii korea and vietnam. this is a dinner -- different battle field the 21st century. if you look at how isis is spread over the past year they are having affiliates in about 12 different countries. they're trying to dismiss this away and make us believe in a fantasy world and orwellian message that tries to make us dismiss it. >> when you look at the numbers, terror around the world in 2013 over 11,500

attacks. in 2014, the first nine months alone nearly 13,000 attacks and an estimated 31,000 people have been killed. that's why james clapper the deadliest year for global terrorism recorded. how wrong do you see it that the administration is using politics to play with our national security and security of mind-set? >> they are horribly wrong. one of the things the administration can't refuse to do is admit they are wrong. al qaeda and iraq have reconstituted as isis. a year ago about 3,000 fighters they were called the j.v. team. now estimators have them up to 6,000 fighters. they are in 11 to 12 different countries. we still have al qaeda out there. they're not on the run but this administration does not want to admit that. they're more so interested in the fundamental transformation of america. >> a couple of weeks agod president said global warming is a bigger threat

and said we're overhyping the threat because if it bleeds it leads. that plays into what secretary of state kerry says but no administration wants this embarrassing disconnect. what's going on behind the scenes do you think? >> i think that you have some people in the administration that are worried about their reputation and speaking the truth. you saw that with mr. clapper after his n.s.a. performance. he doesn't want that to come back again. then you saw the counter terrorism expert at the administration testifying on capitol hill about the recruitment for isis while you had the president of the united states saying they had been demorlzed and were in retreat. there is a sense of fantasy and i think the administration wants that sense of fantasy out there. >> michael flint said it is irresponsible to make the statements secretary kerry made. >> what they're doing is putting out a false narrative. that is why i say it is really almost orwellian

debate. joining is the director of poverty to prosperity program rebecca valis and robert rec torch r who played a major role in crafting the 1996 federal welfare legislation. good morning to both of you. rebecca rebecca, once upon a time back before the reform in '96 people gamed the system where they would have more children to get more money. you say we should go back to those days. why? >> the fact is that these sorts of policies not only don't work the evidence actually shows that they can be counter productive greater poverty actually leads to more unplanned pregnancies not fewer. second, pro life and faith-based groups are all united in supporting reform of this policy because it actually acts as a period penalty for carrying a baby to term. boosting family income not only mitigates hardship in the short term but improves a child's

chances later in life makes it more likely they will graduate from high school and get a job. if we care about the future of family we should look to boost family security not weaken it. >> robert you were instrumental in changing the law in the mid-'90s. why is she wrong? >> in fact, these policies when states do them do, in fact, reduce dependency they reduce poverty, but they are very small policies. they don't have much effect because they don't really affect the aggregate welfare benefits the family gets. we have a welfare system that's out of control. we're spending close to $400 billion a year providing cash food housing to single parents. that's around $5,000 for each tax paying family. there's no work requirements in the system. the california change will just take an out of control system where we have one out of three americans getting welfare and make that even larger. >> sure. rebecca, why not end the cycle

of poverty and encourage going out and finding work and encouraging self-reliance? >> the fact is that i thinking fromives agree with conservatives that what we should be doing is encouraging people to find work but what's important is we make sure there are jobs available and they are high quality jobs that pay a living wage. that's the reason that people are living in poverty is because they can't even make ends meet on a full time job. >> robert, you have the final word. >> somebody who earns a minimum wage job if you're a parent they get an additional $20,000 in welfare benefits. this system is out of control. what we need to say is any able bodied person that gets cash food or housing from the welfare system should be required to work or prepared network. stop penalizing low-income parents when they get married. it's a disaster system that's breeding more and more dependence year by year. >> we thank you both for joining us today. >> thanks. meanwhile it's happened

places like north korea who continues to increase their capability in ballistic missiles and nuclear weapons and threat of cyber attacks that continue to grow and develop which could threaten our economy and our nation's infrastructure. >> congresswoman, you were tailing the problems we face from around the world. you talk about these islamic groups. i know you're a democrat. however, the leader of your party the president of the united states simply refuses to call it islamic terrorists. do you have a problem with that? >> well here's why i think it's important. first of all, this is not an issue of party politics or partisanship. this is an issue of questioning how can we make sure that we keep the american people safe. is this first and foremost responsibility that the leaders of our country have. as a soil look back to some of the basic things that i've learned in the military which is, if you have an enemy you have someone who is declaring war against you, you have to understand them. you have to identify them in order to come up with a winning

strategy to defeat them and that's what's so critical as we deal with this unconventional threat that we haven't faced in a big way in our nation's history. it's something that wasn't done well after 9/11. and because it wasn't done well our country was diverted into waging war against those who hadn't waged war against us and find ourselves in a situation today with trillions of u.s. dollars spent, thousands of american lives sacrificed and still in a position where these groups like isis and al qaeda boko haram continue their horrific activities. >> congresswoman as a combat veteran what specifically would you ask our president commander-in-chief to do to make steps towards victory in defeating, completely defeating isis? >> the first step that must be zone understanding and identifying them. >> good. >> these are radical islamic extremist groups who are motivated by a very clear ideology.

president to seize executive order on am midwesty upheld. >> there are going to be some jurisdictions and there may be individual i.c.e. officials or border patrol who aren't paying attention our new directives. but they are going to be answerable to the head of the department of homeland security because he's been very clear about what our priorities should be. if somebody is working for i.c.e. and there's a policy and they don't follow the policy there will be consequences. >> how are border patrol agents taking this news and what is the policy? sean moran is the vice president of the national border patrol council. how do you feel about that warning from the president first off, sean? >> obviously i think it's a bit premature. this policy hasn't even been put in place so border patrol agents even haven't had an opportunity violate it. not that we would. we follow orders. we're federal agents. if there's a policy in place we'll follow that. and if we violate that we know that there could be possible discipline or termination.

it's a bit premature for the president to be making threats. >> so hard to do your job, i imagine because the dreamer act was pushed forward by fortunate. if you were brought here as a child you can stay. now the new rule executive order puts forward if you've been here a certain number of years haven't been convicted, don't father deportation. a judge stayed that. meanwhile you guys are doing your job every day. how do you do your job? >> well, it is very difficult when you have a president that is just dismissing the fact that you have thousands of agents out there risking their lives every day trying to protect this country and meanwhile we're being under mined by allowing different classes of people that are already breaking our laws to remain here. it's a real slap in the face to border patrol agents but especially to the 120 agents who died in the line of duty. >> that's never brought up. you said right now you're getting mixed messages. you don't know how to do your job per se in that moment when

you decide to arrest or let go. what do you mean? >> well the guidelines are very contradictory because we've been told if they are arrested at the border they are a tier one offender, ineligible for these programs. but yet later in the same guidance it says we need to screen these people to see if they are qualified for these programs. dhs needs get their act together. >> the last thing you got after the texas judge got after staying the order. how does it stand now today? >> right now the policies are on hold. the guidance went out prior to the judge's order but we're on hold until that is decided. >> homeland security funding is that going to affect your job as we find out if there's a shutdown today or tomorrow? >> yeah. we are hostages in a political standoff. the very people that protect the borders and provide border

and all the buildings destroyed and to get home this, is a man and woman who bought this house 50 years ago. raised their family, you know, my father just broke down, you know. so it was like the loss of a family member. >> it was a moment that shook wendell. prompting him to action. >> i committed myself to saying, whatever i do i'm going to make sure to get them back in this home before they die. >> and he did. two years later his parents moved into a new house on their old lot just in time for christmas. >> and then neighbors came to me afterwards and said make sure that we all come back. >> nearly a decade later you see his new homes sprinkled throughout the neighborhood. >> we're at 40 new homes. still moving forward. brick by brick, house by house, street which street. neighborhood by neighborhood. we're coming back. >> can't thank you enough because without wendell we wouldn't be here and i don't think this neighborhood would be here as it is now.

new troubles for the irs. months after republicans in congress accused him of not telling the truth when he claimed the agency lost lois lerner's emails that allegedly targeted conservative the emails have reappeared. here to break it down is peter johnson jr. i saw some of this yesterday. i couldn't sleep. it's very disturbing stuff. >> now the inspector general for the irs said they have recovered 33,000 emails that may not have been recovered before. there's been sworn testimony before congress and in federal court that the irs, including the commissioner could not find these documents and so now we learn in front of congress they found 33000 emails and that they are looking according to the inspector general and the deputy inspector general at criminal conduct. >> a couple of things that jump out at me.

number one were they ever damaged or lost and number two if you cared about giving congress what they asked for you would have gone to west virginia and found the back up tapes themselves. instead congress went daytona. >> this has been riddled with games and fraud, in my opinion from the very beginning. miss lerner said they were lost. irs said they couldn't recover them at the time that they were lost. they made different stories in a federal lawsuit and to congress as to what they could find. they found more and more and more over time. but there have been sworn statements by the irs including the commissioner who was brought in to clean up the irs after this was revealed in 2013 this has been going on two years brian, brought in to clean it up. and the statements that he made are not true. they are false. now whether they are criminal or not the ig will look at it and perhaps the u.s. attorney will look at it.
