that there's been a great deal of peer pressure among adjudicators, to get to what we saw get to yes. in other words if you can't approve these people and they're denied, we're going to send it up the chain of command for approval. because we because we -- the message goes out then that we want these people not deported. >> yes. and virtually no one is deported. just a tiny number of people, relatively speaking who are deported, correct? >> early last year, there were 36,000 people that were put up for deportation, and then were released. and some of those had even committed murder. now, we have this example of hernandez being given deterred action and responsible for the murder of four people. the president himself if you remember, said a year before

doca was announced that he didn't have the constitutional authority to do it. here we have an amnesty issue that led to the murder of four people. >> is there any congress >> is there any congress review about this? >> sure, we can take away the president's authority. we're trying to do that now through an appropriation bill. we can pass a good immigration bill that secures the borders. and making sure that we have interior enforcement. >> so will -- you've demanded something. was this guy given a stay of deportation, they haven't responded yet. do you think they will? >> well, they better. you know, i'm chairman of the committee. before i before i was compharman of the committee, they all used the excuse that they didn't have to respond to an individual senator, only chairman. now, they don't like to give these answers out, so i wouldn't be surprised that they'll come up with some other reason that they can't give the information

nut is going to fall out. you do that 100 times one time you find something 99 time, what you're doing is creating a whole group of people who are really angry at the police for being harassed by the police for no good reason. >> elliott. >> i completely disagree. look, when it comes to pot the nose knows. when i was a prosecutor, i oversaw the prosecution of literally thousands of low-level drug cases including marijuana cases. i can tell you every single time that an officer sees evidence based on smell and suspicion of pot and it was sent 0 to the lab, it came back to the for pot. what does that meaner the suspicion based on odor turned out to be a reasonable one. and that's a certainty because that's the prevailing cons stufgs standard. under the law when have you a reasonable suspicion of criminal activity, you're allowed to stop, to detain, to investigate further, okay? so, if in my experience the smell led to a reasonable

suspicion, then this -- this guideline contradicts that. >> matt, on that point, though, i mean, is there a double standard here which is if police officers smell, empty liquor bottles in the car and they smell alcohol, you're going to get locked under or handcuffed. if they smell pot, they give you the good to go? >> no the rules for d.c. on alcohol and marijuana, it's basically the same thing. if they pull you over and a cloud of smoke comes out, the rule is not to ignore that. and they do a breath liez to see if you're drunk. >> what if you're not driving. and you're sitting there and the car is smoking. >> in d.c. be the law is crystal clear, you're not allowed to smeek marijuana in public. it's just like alcohol. except you can legally buy and sell alcohol. with marijuana in d.c. you've

got to come to possess it somehow. they'll deal with that they'll deal with that later. >> elliott. >> that's the problem, it's still illegal in some circumstances. you can't smoke it out on the streets. how how do you detect it on the streets? you're saying you can't use the effect of smell but they can do it on what appearance? if you're going to leave some of these marijuana laws on the books, don't take away the ability of a cop to use their basic sense enforce the law on the books. >> to that point are, the cops say i didn't smell it i saw that the joint was small, smaller than a cigarette, so that's why i arrested the person. >> look that's fine. if a cop seeing somebody smoking air marijuana, they're breaking a law. that's that's illegal in d.c. it's illegal in colorado. just take you can't take a bottle of vodka and drink that. if you're in your house smoking marijuana here in d.c. that's now legal. if a cop smells you walking down
