she abortion that choice saved my life. >> why aren't liberals watching other liberals on television? the msnbc network imploding. bernie goldberg has some thoughts. >> caution, you are about to enter the no spin zone. the factor begins right now. ♪ ♪ >> hi i'm bill o'reilly. thanks for watching us tonight. hillary clinton's latest drama. that is the subject of this evening's talking points memo. from january 2009 to february 2013, four years hillary clinton served as secretary of state. during that time, she apparently did not use secure government email instead choosing to use her own private account which was not a vital at the time it is now. even before the change all private email by federal employees was mandated supposed to be mandated to

be preserved. you couldn't erase anything. and then there is the question of security. it's much easier to tap into email account that's not secure. that's why the law has changed. so once again, hillary clinton is in the middle of a controversy. this one comes just a few days after this was revealed that the countries of algeria and qatar donated money to the clinton foundation. some of that money was sent before hillary clinton left the state department, a conflict of interest. so you can see that is gill da adna once said there is always something. that is beginning to worrisome democrats. >> i think it is obviously highly unusual. it's much easier for critics to explain why they don't exist than it would be for her to explain why she used private email. >> why did she use a separate email? how did she secure that email? was there another email through which she communicated with people? by not answering these questions, they are allowing

this story to fester in ways that are unhelpful. >> again, those are democrats. talking points believes that hillary clinton situation is pretty well defined in the u.s.a. americans know her. they know her husband. and they know the clintons as the "wall street journal" points out often walk a thin ethical line. to quote the journal this is how the clintons roll. it will be very hard for federal investigators to uncover any emails secretary clinton may have not provide to the government as she is compelled to do. but, if mrs. clinton did, indeed, hold back emails and investigators find them that will absolutely hurt her presidential run. if she held emails back on benghazi, she might even be prosecuted. those are big ifs and if history is any guideline it will take years to get to the bottom of email gate. in the meantime, hillary clinton will run, millions of americans will support her. and the sun will come up tomorrow. it's just the way of the

world. but it should be noted that in a very dangerous time for america, it is imperative that we, the people, elect a president who is going to look out for us. not become bogged down in one controversy after another. and that's the memo. now for the top story tonight, reaction, joining us from chicagoing dr. austan goolsbee a democrat who worked for president obama in the economic area. doctor, i want to talk to you about the sense of entitlement that's attached to the clintons. i don't think there is any question that they see themselves a little bit differently than just a regular person would see him or herself. or am i wrong? >> look i don't know. i'm not an expert on psychology. i think it's a little fair, a little unfair to say that we can't have a president who is going to be mired in controversies when you know the way the system works now is both parties are trying to myer the nominees of either side in controversy. >> but, but that's true. >> if she had a personal email account and if she had given it up and was doing

her personal email on the state department account, people would say that's a scandal. >> personal email on government account. >> there is no question mrs. clinton is a target. no question at all. and the republic can nominee or the guys that run will be targets as well. you are absolutely right. can't rewrite history. a lot of the things that the clintons have been involved in, way back in the arkansas days up to the presidency of bill clinton up to clearly clinton's senatorial regime here in new york and her secretary of stateship have been mired in controversy. it's not the time for it in history now. it's really not the time for it we need a president that the whole country can get behind to deal with iran, to deal with isis to deal with the economy. and mrs. clinton's a polarizing figure. you know that. >> look. i think my own opinion is that she could be a unifying figure. >> how? >> i think you know we are going to have polarizing figures on both sides.

continuing with lead story email gate. hillary clinton once again. joining us laura ingraham. you heard my debate with aaron goolsbee and you say? >> i think what can be conclude canned now is even if the letter of the law was not violated, member it was 2009 imflementing regulation bill on the federal records act which said that agency email had to be preserved but it wasn't clear on private vs. official email. the language. it gives mrs. clinton wiggle

room there. the intent behind the law for someone as smart as hillary clinton is obvious. we want integrity in the record-keeping process. the gate keeper should be the state department, not the individual who is working for the u.s. taxpayers in this case, of course mrs. clinton. so the problem with the analysis is it's the transparency, it's for historical purposes. it's for congressional year sight purposes. that the individual who is subject to the regulation is not determining what emails are preserved and what emails are not preserved. >> if she chose to go private, which she did, i think collin paul did some of that too when he was secretary of state. she had to preserve them all. i don't think there is any debate about that. but the clinton people say she did. and has handed over everything. >> we don't know. >> and da'da da'da da. >> we don't know what she has preserved. we don't know what she wasn't preserved. that's the reason that any smart person and she went to yale law school. top lawyer she would know that i don't know that we

found out that collin powell set up a private server in his home. i haven't read that but if he did. >> he just used a private email sometimes. >> she had a whole operation there at her house. i think the question has to be asked why. why did you do that? >> okay. now, my opinion is that the clintons, and, again president clinton has helped me with the track chairs for the disabled veterans. >> we like them because they are good to you and our veterans so we applaud that. >> okay. but i want to, you know, i'm trying to be fair. >> they can be nice people but be violating the law too. they can be nice. >> listen, we don't know whether they violated the law or not. >> i'm saying hypothetically. >> that's for our government to find out. the inspector general has to find that out. but he will do it in six years. what i do believe, i really believe this is that they both have a sense of entitlement. that they don't have to go. >> of course they do. they don't have to go by the same rules that everybody else has to go by. >> bill, that's like it's snowing out.

yes, the clintons have a sense of entitlement. >> but everybody doesn't believe that you just heard dr. goals buy say, you know, look. they are not different -- maybe i'm putting words in his mouth. it doesn't seem to upset people, some people that they do have a sense of entitlement. they do have operate the way they want to. >> right. let's just see. so the clinton foundation gets all this money from foreign governments, foreign entities, kind of skirting the rules there. after the white house made it clear what had to be done. they kept doing it they have one set of rules for how they operate and another set of rules for the way republicans are supposed to operate. and they are not equal opportunity critics on this stuff. hillary can claim damsel in distress. vast right wining conspiracy is after me. last time i checked ron foreign yea of the journal with a.p. is he out there saying. >> axelrod and what's his name? >> right. >> they are saying this could disqualify her from serious consideration can.

folks. i think. i could be wrong. >> yeah, i think you are on to great point. one set of rules applies to the regular people who don't have hundreds of millions of dollars and aren't incredibly connected by mostly compliant media and the rest of america has it to live under these rules okay? i think that's a problem. i think bill something else you have touched on is that hillary is going for the woman's vote, right? >> right. >> she is going to go for that sweet spot of the woman's vote. last time around there was 2 o% gender gap with romney and obama. here is another wrinkle on this. in 2008 hillary barely won a majority of the woman's vote. barely 50%. there is a bit of a generational divide among younger women voters and older women voters who i think are going to go for hillary. married women turned out more for romney 7% gender gap going the other way in 2012. so she is going to try to do this whole pay inequality and women's voices and women in politics is great. but i think in the end,

have. factor following up segment tonight. ferguson, missouri. as you may know darren wilson shot 18-year-old michael brown dead last night. the story became national in protests and rioting erupted in ferguson. yesterday, the justice department issued a report saying the town does indeed target african-americans especially for civil

relations ticketsz. ferguson 67% black. but 90% of the citations issued there go to african-americans. joining us now from st. louis jeff spokesman for the police officers association. and mcgraw, radio talk show host on ktrs. >> what do you think of the justice department report? >> two things, bill. first of all, they excoriated 9/11 ferguson except officer darren wilson, right? they said it never hands up don't shoot. he was justified african-american witnesses came forward and supported officer wilson's claim. so he is completely innocent. that's one. two, you have to understand ferguson. ferguson doesn't live in the the middle of a cornfield. there are little communities all around ferguson that are predominantly african-american. those numbers, right 67% of the residents of ferguson are right. i want to know of those 90% who got those tickets how many of them actually lived in ferguson, how many lived around the surrounding

areas? just to take that number and put those numbers on it, you show me a good statistician, i will show you a good liar. >> i can give you some perspective. in the low level beef of failing to comply, which is like jay walking and all of that stuff, 94% mr. milhaven, of all citations issued to blacks. they are targeting blacks. they are. i mean, no way on earth that that -- this is a discretionary beef. you don't have to give a ticket to somebody who is not crossing the street properly. they are targeting it they are doing it for money. they want the money. and it's an easy play. come on. >> no question. no question. they are targeting blacks and whites and everyone knows. >> not and whites. it's only 6% of whites get these things. so it's not and whites. blacks. wrong, it's wrong. you know it's wrong. >> no, no no. it is wrong, bill. you have to remember that people get caught for

information that they could leak about the ferguson police department was leaked out and in advance of the announcement that the justice department determined the same thing that the much derided grand jury here decided and that was that darren wilson was the victim of an attempted murder and that he used reasonable force in the face of. >> i think that's established yard. anybody can wear a t-shirt. the facts are the facts. the officer has been exonerated north going to be charged with a civil rights violation and the grand jury didn't charge him with anything else. how is he processing that? i understand you spoke with him. how is he doing? >> i haven't spoke to him since the decision came out. i spoke to his attorney yesterday. he described darren as very relieved. the weight of the world is on your shoulders when you are under charges like this. and and really everybody in the media except for a handful like you declaring before any facts come out that he is guilty.

is that true? joining us from washington fox news white house correspondent ed henry. he knows that stuff. he knows he has the info. personal animus between the two men yes or no? >> they don't hate each other. i think it's exaggerated. there is absolutely no love loss between them. yes, it's tense. i think my read from people behind the scenes is they get a lot more business done in phone calls than you ever hear about publicly. there is a lot the u.s. has done beyond iron dome, which we know publicly you this defense system that helps israel repel these attack from the palestinian side. there has been a lot more secret conversations. they are on the phone, i'm told all the time. but bottom line is, this recent situation with netanyahu speaking before the u.s. congress, the president was furious about that his top aides were furious about that that's why you heard the president lash back at him. he felt like he was being disrespected. >> why was he disrespected?

netanyahu wants to get his message out to the world. so why would president obama feel he was personally insulted? >> because he was in the middle of these negotiations with the iranians. it may go bad. it may end up being a bad deal with the president basically let the negotiation happen and then you can attack it or praise it or do whatever you want. >> it's too late then. >> the white house feel bill, what if in the runup to the war in iraq as president was negotiating. putting together an alliance the democrats invited the french president jacques chirac to go address the congress. >> i would like to hear what say himself. >> i don't believe in monolithic. >> president obama may sign a deal that puts israel in danger. don't think israel has a right total world they absolutely like this deal and put pressure on obama to get tougher on him? >> of course they have that right. he is -- i just think it wasn't my feeling it's the feeling of the people inside the west wing behind me.

thanks for staying with us, i'm bill o'reilly in the weekdays with bernie segment tonight. wild whether i perceived that the national media in america is overwhelmingly favorable to the democratic party. but here's something very interesting. left wing networks both on tv and radio have failed dismally. you may remember air america radio, which launched nationwide 2004 went bankrupt six years later losing at least $40 million in the process is. a disaster. now we have the collapse of the trawl level msnbc network. on tuesday, after benjamin netanyahu gave his speech, millions of americans tuned into the news. but they did not tune in to

msnbc. the ratings for them were catastrophic. at 8:00 p.m. the factor had nearly five times many viewers as the program on nbc. at 9:00 p.m. megyn kelly slaughtered her opposition 3 to 1. in february the fox news channel was the number one rated cable channel in the world in prime minister. number one. msnbc on the other hand declined an amazing 55% in the key prime time advertising age group and 28% overall from year to year. total collapse of ratings that were never high to begin with the question is why. why are american liberals not watching their own? joining us from miami, the purveyor of bernard goldberg.com. mr. goldberg. so do you know why? >> i think i have at least a theory. i will give you three reasons. but let me start out with this. in the last six presidential elections, going all the way back to 1992, the more liberal candidate, one in

five of the six popular votes five of the six popular votes the more liberal candidate one. now, you would think that that would help liberals in the media but it doesn't. as a matter of fact, if msnbc or liberal talk radio were political candidates, they would lose every election. okay. give you three possible reasons. the first one i think is the most important. liberal news media violate the cardinal rule of all media they are not entertaining. on prime time, msnbc they lecture us. i already went to college. i sat through lectures. i didn't find them fun then. i don't want to see some lecturer talking to me now. okay? so that's one reason. whether you love fox or hate fox and people do both, it's never boring. and whether you love barack obama or bill clinton, they
