to be the next president. and i think that she needs to step up and come out and state exactly what the situation is. i think at this point from this point on the silence is going to hurt her. >> california senator dianne feinstein there and then there is this. south carolina republican congressman who heads the house select committee on an investigation into the deaths of a u.s. ambassador and three other americans. goudy now says clinton has turned over hundreds of pages of e-mails related to benghazi but there are items missing. >> there are gaps of months and months and months. if you think to that iconic picture of her on a c-17 flying to libya she has sunglasses on and her hand held device in her hands. we have no e-mails from that day or that trip. it is strange credibility to believe if you are on your way

to libya to discuss libyan policy that there is not a single document turned over to congress. >> the president is also weighing in on this with this nugget of information. president obama telling cbs news he only learned of hillary clinton's use of personal e-mails through news reports and he defended her saying her offer to turn over e-mails now shows transparency. our doug mcelway is live with the news in washington, d.c. we know she turned over more than 55,000 e-mails. we don't know how many though exist which have not been turned over. >> that's right. and that is why republicans are determined to get a hold of them all. this is not just a question of e-mails. remember that clinton had her own server apparently at her house. as much as she said she wants the public to see them the public can't verify that she is not hiding some without access to the server. >> now, if she wants to release all of them with the emphasis

network. >> it was clinton e-mail.com. teenagers about to join the savages of the islamic state didn't get very far this weekend. customs officials in australia came across something in the luggage of the two brothers, some letters which reportedly detailed how to make up a cover story to get out of the country. it is worth noting under a new australia law entering an isis-held territory [ inaudible ] we'll see what charges -- what are the australian authorities saying we might learn from them? >> they are saying that the two

brothers were recruited and radicalized online. just minutes ago we received pictures of surveillance video from some inside the airport where you can see the two brothers. they looked like any other teens you might see in an airport. authorities say these brothers were heading to a conflict zone. according to australian media they were flying to turkey which borders syria. you can see authorities searching the teenage boys bags. we don't know where they got the money for a ticket but authorities say it was far from a vacation they were heading on. >> they were two misguided young australians, australians borne and bred, went to school here grew up here and yet it seems they have succumb to the lure of the death cult and on the verge of doing something terrible and dangerous.

>> a death cult he says recruiting teenagers in australia. these teens are not facing charges yet. authorities do say they will be filed, though. now they have been released to their parents who say they are shocked but that should come as no surprise. we have heard that before. isis likes to recruit the teens and tell them to act completely normal until the day they disappear. >> we are kind of seeing this trend, too with siblings. it was interesting to hear them call misguided. we would probably call them radicalized. what else now are american authorities doing to stop isis from recruiting here? >> well, they are asking for parents and communities to be vigilant. right now isis has 90,000 twitter accounts. take a listen to representative mike turner on the house intelligence committee. >> we need to have greater information sharing tracking the individuals down tying them to groups and organizations and

what they are fighting for. >> that is exactly right. so far we have heard from 17 witnesses over the past two days. victims, family members and first responders who were there. this week the prosecution will lay out more evidence which is likely to include more testimony against 21-year-old dzhokhar tsarnaev particularly concentrating on actions in the days after the bombing, the point blank shooting of sean colier and the shootout in massachusetts. among key pieces of evidence will be dzhokhar tsarnaev's computer containing e-mails and texts about radical islam. also expected to play an important role are the messages tsarnaev wrote on the walls of the dry docked boat where he hid from police. amid messages he wrote america needed to be punished for killing muslims overseas.

after admitting he carried out the attack his defense attorney is trying to spare him from the death penalty saying he was influenced by his older brother. the prosecution is trying to prove that he wanted to be a radical terrorist all on his own and wasn't somehow brainwashed by his brother. this is the criminal phase of the trial. after this there will be the penalty phase to determine whether he will receive that death sentence. so far the trial is moving faster than anticipated because the defense has not cross examined any witnesses. he has admitted he has done it. >> the witnesses have told their compelling life changing stories. we mentioned that some 260 were injured. these were life changing injuries, people losing their limbs. how do you really cross examine that? no cameras in the courtroom, clearly. have we been able to ascertain what the mood is like inside

it got fiery moments ago. you are joining us via satellite with the fox news insiders. before the commercial break said the white house is seeming to go after and these are his words going after a member of their own party. there is a corruption case against new jersey senator bob menendez. we do know just turning the

clock back a week or so he was critical of the process leading up to the deal that the united states and other western allies are potentially making with iran over nuclear capabilities. he said we have to hear from everybody. what are your thoughts? >> well, i think senator menendez has been courageous but what did he get in response? he got a leak saying he is going to be charged within a month with very serious crimes. i have to wonder whether there is a link between the leak of the potential indictment and senator menendez's being so outspoken. one other point david petraeus has been very quiet and got a very good deal from the obama justice department. no jail time lying to a federal officer, sharing classified materials with somebody outside the government as a cia head. it is not lost on me how we have

seen two elements of the dispensation of justice from our justice department in the last two or three weeks. >> what you and pat are eluding to that is what people hate about politics. >> they should hate it because using the law to punish political enemies is terrible. >> to tighten up whatez said was one of the most strongest statements ever saying it sounds like this administration is getting their talking points from tehran. that is a democrat saying that. >> he was chairman of the foreign relations committee. >> then they leak this thing out two weeks before the nuclear agreement. my question is, is this a shot across his bow saying shut up and you won't get indicted? keep quiet when the agreement is done but if you continue to criticize us we will hit you with the indictment? >> in a message to everyone on

the democratic side when they are trying to hold the line against the congress and passing on this agreement are not. we have a justice department, we have benghazi. we have the irs run an investigation disappeared by obama donor. they have covered up such crimes but menendez, this thing has been around for a long time. they are going after him and they are sending the message to other democrats in other people. this is chicago gangster politics. as i said it is nixon on steroids. when is somebody in this party, my party, doug's party going to stand up when jerry brown and jim web and most of all elizabeth warren and run against hillary and these people? >> don't you ever wonder how pat gets invited to a democratic

you hear so much criticism from democrats that republicans don't have an alternative, a replacement for obamacare. congressman john cline, paul ryan outlining the replacement plan they are calling a quote offramp for the president's signature health care law. the fox news political insiders are back. republicans have this. it has some interesting options in it. it is a solid alternative, if you will, something that democrats are wrong about but you are still not happy with your party. >> if they have a plan that all republicans pretty much signed on to they should have unveiled it last year and should have run on it and they should have said if you don't like obamacare here is our alternative. and if they then went to congress the public put their

stamp of approval on it. to unveil this thing with three guys riding it it will not do a thing. where is the unity of the thing? the fact of the matter is this is alternative. i see republicans don't get enough credit for putting together an idea. >> they don't have a party alternative. they are in power. they just surrendered on immigration where 74% of the american people according to the fox poll say that they have serious great concerns what the president is doing because they didn't campaign on it and because the leadership and the donors plotted all along so after netanyahu's speech they plotted to cave on this and they passed and just passed the thing. i predicted this was going to happen on obamacare you have republicans being quoted in the

newspaper, senate stafrs saying maintains it so we won't have problems. they don't want to -- >> the supreme court may wipe away subsidies in the states. it was 37. three other states. last week we heard from democrats that the backup plan is that you won't have to pay a fee if the subsidies in your state get wiped away and you can no longer afford to buy your health insurance. you won't have to pay a fee. that is the back door kind of way of doing this from not having health insurance. >> the democrats have a plan that may be wildly expensive but have a plan. the republicans are facing a 50/50 likelihood that obamacare will disappear by the end of june and the republicans have not articulated an alternative
