eight-year-old victim bringing jurors to tears. the defense blames tsarnaev's brurts for the plan to plant bombs along the finish line. this next story will make any parent gas want. a car crash leaves a young mother dead. this morning, new information about how her 18 month old daughter survived. nearly 14 hours inside that car upside down in a cold river in utah. investigators say that lily's 25-year-old mother died after she hit a barrier and plunged into the icy water. she was found still in her car seat. >> the car seat could have been out of the water. it was along the embankment. so i don't know how much water was getting into the car. >> isn't that amazing? she remains in critical, but stable condition.

gaps in the e-mails that have been turned over to investigators. transparency is less of a problem when you're on the same server as everybody else. al she chose not to do that and she could face major trouble. it's one thing to thumb your nose as white house policy as she did. it's a whole other issue when you're holding back documents related to the benghazi investigation. i'm not saying she did that, but that's the question. and now she could be in big legal trouble, too. >> a subpoena which trey gowdy issued is so, in fact, it will be a crime if she knowingly withholds documents pursuant to subpoena. he needed to do that because she wasn't forthcoming two and a half years ago. she in fact hid the very existence of this until she was caught. >> as you might imagine, democrats are closing ranks behind clinton. some of them are growing weary of this controversy, among them senator dianne feinstein.

charge of handing over e-mails. 50,000, 50 million, it doesn't matter. the question is still out there, is she giving over all her e-mails. it's her server and it's her decision. >> it bothered enough to take down her photo. when you send a tweet you have that photo that indicates it's you. it's a big change when someone changes their feed. that is now some sort of picture that sends you to a women's rights website. >> i mean, it's implausible, as you just heard, that she sent no e-mails during the libyan trip unless she was communicating solely by text, which is a possibility. we don't know that. if she was, that would be an effort to evade any kind of requirements to save documents. >> at&t had our blackberry. i remember taking a trip overseas and the only wunl who could text. the president of the united states had a chance to defend her, he didn't. he said i told everybody they

should actually be using the state department e-mails. i don't know whether she did. senator feinstein wasn't helpful at l. she said basically show me everything i'm not going to defend you. lannie davis is always defending the clintons, this time hillary. he was at it again with chris wallace. who was curious if he's getting tired of this. >> you served in the clinton white house handling clinton matters like impeachment. do you ever get tired of cleaning up after the clintons? >> i don't call it cleanup. after you mentioned bill clinton left with a 6 #% approval rating. hillary clinton is the most popular political figure in the united states. >> i know lannhim well. he definitely gets tired of cleaning up after the clintons.
