charges the new report that makes the case against hillary clinton much stronger. "fox & friends first" continues right now. >> kay yoschaos overnight. two police officers shot outside of the police department during a protest. >> we are joined live from chicago. good morning, garrett. what do we know so far? >> good morning. two police officers are in the hospital. they have received very serious injuries. one was shot in the face. the other shot in the shoulder. this occurred after midnight last night after protests have
2:01 am
been going on from the purring son furgason police department. at least three shots were fired directly across the street from a crowd of police officers there in the department. as soon as that followed the police entered the defense positions guns drawn and pulled the injured officers away from the scene. they are being treated at a local hospital. they are conscious but we haven't received an update on what their condition is at this time. their names have not been released. what we know is one is 41 years old a 14 year veteran of law enforcement the other a 32-year-old officer with approximately 5 years of service. these protests have been going on since august really. they picked up in november since the decision came down. there were several hundred shots fired in ferguson within a span
2:02 am
of about an hour after the grand jury decision. the police chief says they were lucky there were no serious injuries and it was only a matter of time before that happened. >> we have had around occasion to be involved in many of the events in furgason sinceerguson since michael brown was killed. we have been fortunate not to have more incidents like this happen to us. i have said we cannot sustain this forever without problems. >> he will be giving an update on the status of the officers as well as the investigation they have no suspects at this time. >> we will check back with you. thank you so much. >> the shooting of the police officers overnight in furgason in the city plagued by protests

and violence in recent months. >> rob wheeler joins us right now over the phone. we know the police officers are in the hospital. they have not captured a shooter just yet. a potentially dangerous situation for officers whoever is responsible for the shooting could be heldold up somewhere. how do they manage the crowds and a shooter on the lose. >> it is imperative they find the shooter or shooters very soon. who is this person whether theyor not they plan on more shootings. the police officers know they walk around with a target on their backs. they are doing the best job they could possibly do in terms of keeping the community safe. most of the protestors out there are peaceful protestors. you have a certain segment of
2:04 am
the community that wants one thing what they want is trouble. under the cover of darkness the police officers gathered standing around talking. some officers were talking to the community shots range out. the shots rang out from the police department and if you think about it, it sets the stage for the viewers the area where the shots came from is a parking lot directly across the street from the police department and there's a row of houses behind the parking lot. that area is very dark. so i think that is probably why the shooter took that as a vulnerability and took that as an opportunity to try to kill police officers. thankfully the two officers will survive. >> you were there after the initial shooting happened in august. you were also there after the verdict came down in november. the when you talk about the protestors and the violence that
2:05 am
is happening you came across many protestors the majority who were not even from this area, correct? >> you are absolutely right. it was amazing and shocking to me. i was actually literally walking the streets out there with the protestors talking to them. i witnessed and talked to a lot of people that wasn't even from missouri let alone ferguson. i saw car loads of people coming in from north carolina and new york city. it was amazing, because some of these individuals it was obvious to me some people were there to do one thing and that was to start trouble. there were also two individual the arrested in november for trying to make explosive material. they were members of the new black panther party. the police said their intent back then was to harm police officers. the police have a challenge ahead but something has to change out there. i tell you there's no leadership

before you sign this, understand that you are certifying something, that that we can prosecute you for. making a false statement in this context knowingly and willfully. i can't image anything more knowing and willful knowing you have 6 # 5000 records sitting in your home. >> according to him this all hinges on whether or not clinton signs this form. if she didn't she needs to explain why. the white house was peppered with questions about this from every angle. they don't have a reason not to believe clinton's story yet but president obama has been very up front all along about transparency transparency. >> what has not changed however is the administration's commitment to ensuring everybody in the obama administration lives up to the terms of the federal regulations act by providing all of her personal e-mails that relate to business. >> "washington post" item

>> two police officers shot during a protest in ferguson, missouri. joining us on the phone is former lapd detective and key investigator in the o.j. simpson trial, mark fuhrman. it appears the police officers according to a press conference we had earlier that the police officers were specifically targeted. how can authorities there try to regain control of the situation and is there the political will finally to do so. >> i am not sure there's a political will. they may want it but they have given so much time and allowed so much bad conduct and crimes that it is going to be hard and more difficult than it would

have been initially. there was an unreasonable expectation that was given from the top political figures community leaders that actually knew the facts of this case and knew that there probably was absolutely no chance that darren wilson would be incitedsight -- indicted and there was no chance of a civil rights violation on darren wilson and they still pushed the narrative that somehow this was a bad shooting. so the crowd was very angry and continues to be angry because those expectations were not met. now this violence that continues has been completely out of control. now you have to go back from square one to start back from where furgason pd was in august. >> we appreciate your insight as always.

department this was after the news police chief tom jackson would be resigning around midnight the protests began to dwindle out. around that time shots range out from the ferguson police department. shots we are told with a group of police officers. that is when the two officers were hit. they say they are still searching for who it was that did that shooting. they did not have any suspects. shortly after the shooting when the officers were taken from the scene investigators began to comb over that area to look at shell casings and any evidence they could find. they say that will be updated as well later on this morning. the sun does come out and they are able to make more progress on that. it has been a volatile situation since november. john belmar said earlier this morning it was a matter of time at the rate the things have been going until something like this
2:33 am
happened. >> we have been taking a look at these images. this is video two protestors were arrested prior to the shooting. going back to the shooting itself we have been told three shots were fired. the police chief's news conference later this morning he said that the shots came from the suspects. were there any shots fired police officers? >> you know by all accounts from what we have heard from protestors and police in the video we have seen it does not appear the shots were fired. if you look at the scene from where we are told the shots came, it is about 50 to 100 yards from the front of the ferguson police station. this is around midnight. thees not much light-- there's not much light in the area. it would have been difficult for any one to see. with the crowd that is out there shots are not going to be immediately returned. again this is an ongoing investigation. we will hear more this morning from police. >> i know you have been been

following this since the beginning. thank you so much. appreciate it. >> the shooting of two police officers overnight in ferguson is the latest for the city plagued by so many protests and so much violence in recent months. >> fox news contributor and former detective rod wheeler joins us from the phone. we have bee all morning. these officers not involved in the shooting they have to go back out there today and protect these streets. what is it going to take to stop this violence? >> that is an excellent question. those police officers you are referring to are out there right now. they have never left. they have been out there since august involving michael brown. what is it going to take? is it will take a combination of things the community leaders to come together from the ground up. it will take responsible politicians and allow the police department to police the community out there.
2:35 am
i heard what mark fuhrman said the police have had their hands tied. they have been told to stand down. they can't make arrests. it is horrible. they can't do their job. as a result of that someone last night under the cover of darkness decided they wanted to kill any police officer, anybody in uniform. what they did they stood about 50 to 100 yards away. i was there on the street when the shooting took place before when i was out there it is very dark out there they shot past the protestors hitting two police officers. it is a miracle no one was killed. >> we have seen some of the video this morning. not sure if you have had a chance to see it. you do see the protestors fighting. you see scuffles going on. large large crowds. how did it even get to that point? were police at a point where they could step in and disperse these crowds of protestors last night amid all of the tensions and all of the news or are they
2:36 am
truly being hamstrung? >> the police chief, it was relatively quiet. chief jackson stepping down you would think the crowd would go away and things would start getting better. they made progress out there. you have six high level officials in that city step down. the problem is police are not allowed to do what they are allowed to do or what they can do so we continue to see the protests. >> that's what we are hearing time and time again police not being allowed to do their jobs effectively. rod wheeler we have to leaf it there -- leave it there. thank you so much. >> two secret service agents under a serious investigation for drinking and driving. doug luzader is live with us. this is the latest in a long line of embarrassments for that agency. doug these weren't any secret service agents. they were top level ones charged with protecting the president directly. what can you tell us? >> good morning. at least one of them was. the secret service didn't have
2:37 am
enough problems now these two agents are accused of crashing a car into a barricade last week. the "washington post" is reporting it came after a night of drinking. these two agents have since been reassigned. one was in command of the security detail. the secret service itself won't say a whole lot about this incident, but a spokesperson did say if misconduct is identified appropriate action will be taken based on established rules and regulations. this is just the latest embarrassment to the secret service and perhaps the most jarring incident was back in september when a man with a small knife was able to clafsh a fence -- climb a fence and enter the residence through a locked door. that led to the dismissal of several top officials including the former director of the secret service julianne pearson. they are the ones that will be in charge of investigating the incident. a lot of this comes right to
2:38 am
president obama's doorstep. after the september incident members of congress urged the president to brirng in outside leadership. he brought in a guy who was seen as a consummate insider joseph clancy who once headed up his personal security detail. >> joe clancy has been in the position for less than a month now. has he taken any steps to try to correct all of these problems? seems like another day another month another major scandal that puts the president's life potentially at risk if this stuff isn'ted contained. >> you have house cleaning when you are dealing with federal employees, a lot of people were reassigned to other jobs. the thing that kept coming up again and again in the aftermath of that september since dentincident was the culture of service. there have been no major changes since that incident. >> we will be following the

story through out the day. more on this as we get it. more gaps found in hillary clinton's e-mail records. the associated press now suing the state department to force the release of all of the e-mails. peter doocy has the latest on this. >> potential new problems may hinge on paper would. we are hearing from a former doj attorney that there are forms, state department officials signed saying they understand concealing records on the way out the door is a fell ony. >> the form itself says, hey, before you sign this understand that you are certifying something that we can prosecute you for. making a false statement in this context knowingly and willfully which i can't image anything more knowing and willful than knowing you have 55,000 records
