baby daddy talk? you can hear what he says about all the gossip. let get to it. good monday afternoon from the deck. first today man who once pretended to be a mute woman did himself in with his own words it would rain, according to the sunning finale ooh hbs's sear about rob durst. it air ed last night a short time after the feds busted durst in new orleans. the steers told the story of the multi, multimillionaire and hi connections to the uninvolved murders involving his wife a friend and a neighbor. a little background on this guy. robert duty was heir to the real estate empire that runs the world trade center among other things. the family's words at least four billion dollars. but he has been estranged from
12:02 pm
his family for a long time, since his dead and others chose his young irbrother to run the company. last night the show ended with an extraordinary moment caught on an open microphone when robert durst apparently thought he was all alone in the toilet. >> there it is. you're caught. you're in trouble. killed them all. >> what the hell did i do? killed them all of course. we just learned from police that he had a gun at the time of the arrest. and if prosecutors in new orleans go after him for that it could delay his transfer to california where he is charged with murder. prosecutors in california say 15 years ago robert durst shot and killed this woman his former spokeswoman. she has spoken out on durst's behalf after his wife mysteriously vanished. investigators long suspected durst in her murder as well. after the spokeswoman died durst moved to texas. the open microphone confession came after the filmmaker
12:03 pm
confronted robert durst about the letters. one durst wrote, the other, an anonymous note to police. the letter that tipped the cops off to a cadaver in beverly hills. it was the spokeswoman's body. the word beverly is misspelled in both letters and hand writing in each looks similar. >> i guess i'm searching for a way, among other things to understand how two people could be misspelled beverly. i'm searching to figure out how you didn't write the could cadaver note that is so similar. >> what i see is a similarity is really the misspelling of the beverly. other than that, the block letters, are block letters. how else would you write a block letter than that? it's almost like a typed thing.
12:04 pm
it's going look like two typewriters, going to look the same. >> it wasn't typewriters at all. first, to the third murder. that happened many years ago while he was in texas. investigators charged if with murdering this neighbor who reportedly found out who he was. robert durst admitted he used a knife and an axe and two saws to cab up this corpse. his attorney says it was self-defense and the jury let him off. now there's this hbo confession. the late nest a long string of very bizarre slipups, if you will. at one point while in hiding the cops caught him after he stole a chicken sandwich. that is even though he had close to $40,000 and guns in his car with him at the time. he had another run-in with police while he -- when he urinated on a candy display at a cvs pharmacy in houston. his attorney told him it was an
12:05 pm
unfortunate medical mishap. which leads us to job roberts in thorns. what happened in court today, john? >> reporter: this is just such a bizarre case and keeps getting more and more bizarre as more evidence is uncovered. it was a first appearance here at this new orleans parish court what what an interesting contrast compared to robert durst in the past. the son of real estate tycoon durst, and he was there in an orange jumpsuit with handcuffs and leg irons on. as the hearing began durst was being kept in a glass isolation booth in the courtroom. he appeared to be either sleeping or meditating in a room where nearly every prison was assigned a private investigator, durst had four private attorneys, including the high-poured hewitt of houston attorney who defended him against the charges of murdering the neighbor more than a decade ago. durst waived his right to extra addition and through his attorney said he is eager to go to los angeles. >> let me just say that we came
12:06 pm
here to waive jurisdiction and go back to california and get it on. bob durst didn't kill susan berman, he is ready to end all the rumor and speculation and have a trial. >> but there is a hangup because even though the magistrate said he was free to 0 go to los angeles the deputy assistant district attorney here for or liens parish said wait a minute. we may want him on charges in new orleans so let's not be hasty. we don't know what the charges might be but according to the arrest report when he was picked up on saturday afternoon he had a .38 caliber handgun in his possession. his attorney talked about he had some pain killers taken away from him so we don't know if there might be some narcotics or contraband involved here as well. so far the parish district attorney's office is keeping tight-lipped. >> back to the lawyer saying he didn't do this.
12:07 pm
he has a bit of a problem in that on an open microphone in the bathroom he said he killed all of them. >> and there's going to be a problem here as to whether that and the letter may be admissible in court. if they'red a miss nibble court whether or not a jury will buy that. his attorneys are really downplaying what happened in that bathroom that is now being called the bathroom confession. chip lewis said last night he didn't see much to it. he was really trying to be helpful through the entire interview, and as he was entering the courtroom today i asked about his thoughts. >> it's pretty slick. probably get him an emmy. but very misleading too. >> misleading. we don't know what charges l.a. is going to file against him but if the tradition waiver is any indication, they're going to be serious. it's somewhere here -- it says he could to back to face first degree murder charges in los angeles. so this obviously for robert durst has turned very serious very quickly.
12:08 pm
>> no duty there, john roberts in new orleans at the courthouse. that -- the confession, as they're calling it, happened in the bathroom right after they had been -- the producer of the film had been asking him about these two letters that looked so similar with the two sets of hand writhing they thought tied together and that's when he went into the bathroom and started talking to himself. let bring in the lawyers evangeline is a defense attorney and michelle is a former prosecutor. so, they're talking about this situation about these two hand writings that look so much alike and when he is in the bathroom he's like, what have done and then answers the question, i killed them all. that problematic. >> not reality. if you're defending him, you'll say this isn't a confession help didn't make this statement to another person. these are basically mutterings of a 71-year-old man who could be on medication who recently
12:09 pm
underwent brain surgery and you have nothing state so let's get it on. >> this evidence is clearly admissible. it's a voluntary statement. his lawyers gave him a warning for a reason. anything that he said is definitely admissible at trial. it's up to the jury to determine if it's true. not many people admit to killing somebody if they didn't kill him. >> it would be a weird fib. >> hough do you know he is not being sarcastic or ironic. >> i decent know that but i note context. i know the context. the question was look at these two letters and the question is, what have i done? i killed them all, of course. >> his attorneys were there, so if they a thought, this is a big hot potato, a mine, a fire, it's going to -- not going to go out, they would have immediately run in there, and they didn't. so as his attorney said this evidence is underwhelming. they're going to need a lot more -- i'm talking about the state of california -- irif they
12:10 pm
want to have him basically sit in jail for the rest of his lifetime police can't record you without telling you in advance, but this isn't that at all. >> he knew he had the recording on him and if this is one of those basketballings of a mad man -- he did this when he knew he got caught and it's my understanding they didn't hear this until hours later, if you take this with the other evidence in the case, that letter at the time that letter was sent to the police department, and if they prove that letter was authored by him he has another problem bus he said at the time the letter was forecasted he did not know missberman was dead. if the letter can be proven it was written by him he has an inconsistency there as well. so that in combination with the new statement you have a good circumstance charl case building for the prosecution here. >> we only new about one letter in the beginning. that was the cadaver letter that someone sent. and then they not another letter which came from a family member,
12:11 pm
and it just shows so many similarities, including the misspelling of the word beverly in all caps. >> in 2003, this was deemed as being inconclusive evidence. so his defense attorney is going to have a hand writing expert who will take the stand and say, it's not the same. a battle of the experts. that together with this murder -- muttering made in the boardroom, -- bathroom is not enough. for a murder conviction, not going to stand. >> the spelling of beverly to exact same ways, that in combination with two payments made to miss berman prior to her death one immediately prior 25, thousand. one a month before 25,000. right before the was about to speak to the west which he wasser county district torn about the case you have a very good circumstantial case here. there will be an expert from the prosecution that will say that those letters were draft bid the
12:12 pm
same person, and he had the difficulty of the inconsistencies all along of saying he didn't know he didn't do this, and now makes this statement. >> last thought. >> i don't think this is going to go anywhere. perhaps -- >> really. >> i think if he goes to california, he has trial, perhaps the charge will be dismissed prior to trial. we don't know all the evidence that the state has but they're going to need more than a hand writhing sample and more than a muttering in a bathroom. >> the state has nothing to do with the hbo documentary. >> it's a tough case but a the good to trial. >> it's a fascinating case isn't it? muttering to yourself in the barrel with -- in the bathroom and with a mic on. >> change of plans in afghanistan. the white house says the number of troops there would drop to fewer than 6,000 by the ends of this year. not so much. details hate. plus the u.s. government hitting its borrowing limit again.

are also using chlorine gasp doesn't feel like much of other stretch. i'm not sure physically and in the day-to-day war going on, well how much of a difference would it make? >> tactically the weapons don't make much difference but psychologically it has a huge impact. today is the 27th anniversary of the chemical weapons attack of saddam hussein on the kurds, so now doubt chemical weapons are something that is near and dear to them and something that is terrifying. >> and they're in collaboration with and actually some of the former members of the baathist regime that was under saddam hussein are up in there with isis now and they have this history you just mentioned with chemical weapons so comed together nicely, whether true or not. >> yes. the iraqis that used chemical weapons against the kurd, against the iranians before. and al qaeda has used them for a long time. 1993 in the world trade center bombing, they attempted to put a

chemical plume in the world trader in. 2004 they used to use the against jordan, and most recently in 2007, al qaeda used a chemical weapon in anbar. they're cute but they terrify people. -- they're crude but they terrify people. >> you wonder how the administration might react especially after what happened in syria in 2013. >> i can't mam they're going to do much. they drew the red line on syria when the regime was killing independent civilians, and now isis is using them. i can't imagine the administration would take much of a stand against it. it's just not typical of what they do. it's not -- i couldn't predict that. >> are things improving on the ground here? it's so had to decipher what is true because we get so many veried reports. >> looks like the iraqis are making progress particularly going toward tikrit, but that's why isis is deploying weapons, because the opposition, the iraqi army, is making some minor
12:39 pm
bit of progress, but it's too early to say whether this is going to be sustained. another point is that the people that are running the iraqi military right now are the iranian-backed shiite militia can all otheir reason for isis to use chemical weapons. >> before we good, one of the least reported and among the most serious aspects of the war is the refugee crisis that overwhelming the region you. just got back from jordan, do you have an assessment how the reef fujii crisis is developing? >> well the 85,000 people that lived in the refugee camp i was at in northern jordan are being well-fed and secured but there are a million of these refugees in jordan alone, and it's making the economic situation very difficult you. got a million and a half of these refugees in lebanon where they're not being so well taken care of. and the population of lebanon is only 4.5 million. so this is a profoundly disturbing development that will continue to grow and fester as
12:40 pm
long as the war in syria continues. >> david shanker, appreciate your observations and analysis here. thank you. >> thank you. >> all right. today marks as you heard, 27 years since the former dictator saddam hussein used chlorine gas to kill thousands of kurds in iraq. now iraqi forces are fighting isis for control of saddam saddam hussein's home town of tikrit and we're hearing the fighting there has destroyed saddam's tomb. which is new information. sarah has this. saddam's tomb is in more? >> that's right. so back in 2003 he was found hiding in the spider hole near his home town in tikrit. after this, this opulent tomb was build to house his body. this is an older picture of it. flowersflowers and marble and picture's of saddam. now with the fighting it's essentially been leveled. it's been decimated. the "associated press" shot this video and you can see it's basically just columns holding
12:41 pm
up the outer shell and there are reports that pictures of saddam were taken down and replate width picture odd of shiite leaders and word that the body was moved by loyalis last year but nobody knows where it is now. >> sarah, thank you very hutch. >> cops in ferguson, missouri, questioning whether the man accused of shooting two officers acted alone. here's the guy's mug shot. the james is jeffrey williams. police say he admitted firing the gun but insists he didn't intend to shoot the officers help said hey was firing at somebody during an argument. and hit the officers by mistake. the prosecutor says his team is not sure whether they buy that story or not. it all happen last thursday during a demonstration outside the ferguson police department over the chief's resignation. let's get to steve harrigan who is live in ferguson this afternoon if mentioned that investigators are looking into whether the suspect acted alone. >> police here are stressing that this is stale very active
