happened today. a big up day on the markets. tonight on fbn we are exploring what is driving that and whether it is the wrong things driving that. whether the recovery is what it appears to be tonight on fbn. i'm eric bolling along with kimberly guilfoyle dana perino and juan williams. the last few weeks have been particularly brutal in america. assaults beatings, shootings fights in public. we are literally witnessing american culture disintegrating. we have four pieces of tape. this can be brutal. if you don't want the kids to see them now is a good time to tell them to look away. we show you the attack on the outnumbered girl in a mcdonald's
2:01 pm
in brooklyn. now something that broke my heart indianapolis. watch as this teenaged girl is beaten. pay particular attention to the young boy with her, maybe 5 years old. after several beatings on his sister he steps in only to be pounded by the attacker. [ bleep ] [ bleep ]. >> what is going -- what are we witnessing? >> i have to leave because i have to go back to the district attorney's office to prosecute people like that. this is clearly going wrong.
2:02 pm
when i worked in the juvenile justice department if you do not intervene not only with punishment as a deterrent and counseling and complete analysis of that kind of imoral behavior you have an adult recidivist who will continue to prey on people. the people can stand by. who raised you? i would rather get beat up myself trying to protect somebody to do the right thing so i can go to bed at night and wake up knowing i was a person of consequence and kwarkt than see something like this. >> the victims and attackers on both videos were 14 15 and 16 years old wit exception of the little boy. >> it is horrific. that is why i go through the drive through at mcdonald's. they call themselves the savage crew. these girls remind me of isis. they have no regard for human life. the girl does put up a good
2:03 pm
fight. on the other video it is more disturbing when the kid gets hit. that is child abuse. >> and pushed to the ground. >> it looked like black on white. i don't know where holder is. it could be a hate crime. what is the honor? you are supposed to step in and try to break it up. this is disgusting behavior. >> these are young people, high school students attacking and being attacked. we noticed a trend around the country. new york, chicago, philly where teachers unions are complaining that it is harder and harder to discipline young people. >> is this a spillover effect? >> what do you mean? >> if it is harder for the teachers to discipline the kids in the school they go out in the street and start beating the heck out of each other. >> i think what we are seeing is more of it. to me i notice the racial components that jesse touched on. i wonder if it has a lot to do
2:04 pm
with family and lack of discipline of here is how you behave. specific i think when you talk about low income communities where there is lots of violence by the adults, one of the things that troubles me in my community is just walking around in washington, d.c. i grew up where that mcdonald's fight took place in brooklyn, new york. you see mothers cursing at little kids using foul language. you want to say why are you hitting that child? what is the child learning? the way you resolve anything is use violence. to me it is like the parent -- we are pointing at the kids when i think the parents are the ones setting a bad model. >> sometimes it's not parents but on lookers standing around and not helping, not lending a hand to the victim. >> the other thing they are doing is filming it. it could be -- juan is right maybe we are just seeing more of it now because everyone has a phone and are able to video tape
2:05 pm
and get information -- get us talking about it. it's probably good except that i read stories about the teachers, this goes back a ways in the teachers shouldn't have to be america's disciplinariens. they should be teachers and educators but they do have to show some muscle sometimes in the classroom and i don't mean with any sort of physical violence but show that this is where you are going to behave. >> authority is a better word. what juan said is i think this is the most important thing. the root cause of almost every issue is the family structure. and the break down of it. and the unwillingness of a lot of people in the media or communities to talk about the problems of several generations in a row of single parent households because mom and dad are busy trying to put food on the table make ends meet. they can't do everything. something has to give. they are frustrated and angry
2:06 pm
and dealing with their frustration in a way that is unhelpful to the children learning. so there is a vicious cycle. the only way to break that is to talk about family structure. i don't know if i'm the best messenger for that. president obama tried. i think my brother's keeper was a good program. >> why do you say that? >> i don't know if i went into a black community and said you should -- >> disproportionate in terms of family break down, high rates. i thought you were saying for some other reason. >> these were young kids i showed you before. we go a little older college age kids continuing the culture. here is star quarterback from mississippi state being ambushed by a group of guys in a parking lot in panama city, florida one of the most popular spring break
2:07 pm
destinations. watch. >> we have kids here. i have a son two years away from going to college and spring break. that scares the living day lights out of me. >> i have two girls and no way they are going near that. everybody knows about it. the criminal element is going there. they are selling rich white kids drugs and guys flashing guns on instagram. the s.e.c. schools and vendettas. they have scooters you can rent and go around drunk and get together with the crew and haze guys. and now with the internet you have people putting it on tv. you have sex traffickers throwing escorts all through the internet. it is a very combustable combination. >> it used to be kids got drunk
2:08 pm
and pass out in their hotel room. and now it is more violent and more disrespectful. >> who would want to let their child go away to one of these destinations? when i went on spring break it was not like that. i'm telling you. maybe somebody is having drinks or whatever. now you have to be worried about your personal safety. you can get drugged, beaten up, a sexual assault committed against you. especially for women you should not let little girls go. >> i remember when my daughter especially wanted to go to spring break you would have thought i was the most oppressive dad in the world. we are going. it's me and this friend and that friend and we are staying here. what are you trying to do? why can't i go? >> didn't you ask your daughter if you could go with her? >> did you give in? >> of course i gave in. >> earlier this weekend i
2:09 pm
received a few tweets from people knowing i like to have good news one more things and one was pertaining to this how many college students actually don't go to the party spring break but do a lot of good work and charitable work. one is from shepherd university in west virginia. they went on a trip to construct habitat for humanity homes. at university of georgia the impact spring break program did a whole bunch of environmental awareness and wetlands trails and canoed which seemed much more productive and good way to spend spring break. >> i didn't go away on spring break when i was in college. i was working three jobs. i did go on a high school trip. and then i was the legal guardian of several of my other classmates because i was 18. that was a nice clean fun. and then there is this.
2:10 pm
these two drunken spring breakers were no match to this cop who had to administer a little justice beach side. >> [ bleep ]. >> backup! [ bleep ]. >> get off. >> yeah, baby! [ bleep ]. >> all i have to say is thank god for law enforcement. i feel bad for cops having to deal with these disrespectful little punks. we should be offering them the support they need and deserve. this guy had to take down two spring breakers at once coming at him. >> this is the problem.
2:11 pm
it's every community you should have respect. you should obey the rule of law. if you have a dispute you should settle it in the proper venue. don't resist arrest. show respect for law enforcement. they have a tough job to do. that is the message we should give from ferguson to spring break. >> what you are seeing is alcohol. people say don't do drugs kids. binge drinking on spring break out of control. drinking is just excessive. it's excessive and i know especially for young women because sexual assault is a big part of this threat. >> and rising. the numbers are going up. >> you would be surprised how many kids die on college campuses from binge drinking today. >> you see how crowded that beach was. >> no one is helping the cop. >> one cop. >> nobody helped the cop.
2:12 pm
earlier everyone was standing by while somebody filmed the horrible fight at mcdonald's and the one on the street and this one. no guys can tell their friends knock it off. that would be the honorable thing to do. >> he needs help give him a hand. >> imagine if the punk kids were black? all hell would have broken loose. obama would have been like those kids could have been my sons. >> a track suit. two arrests in two crime cases, robert durst and ferguson shooting suspect in custody. details coming up.

infamous real estate heir facing first degree murder charge. he waived extradition this morning. durst has been suspected and never charged in the disappearance of his first wife. he was acquitted in 2003 of murdering his neighbor.
2:17 pm
after three decades under suspicion a confession in all the cases may have been caught on tape by hbo. according to film makers of a documentary on his bizarre life durst was still wearing a microphone when he went into a hotel bathroom after an interview and was caught saying this. >> there it is. killed them all. >> nothing that can do you in like a hot mic. fascinated by this case. >> everything i knew about it i learned today. do you think that he wanted to be caught? why would he participate in this documentary if he didn't want to have some sort of fame? >> the arrogance, narcissism, the fact that he is a sociopath. it doesn't surprise me but he is not as familiar with how many of us have talked on a hot mic.
2:18 pm
he is not familiar with the fact that he can be caught and recorded. >> could he call it entrapment? >> no because they are not working on behalf of law enforcement to do it. is it a statement against interest. it would be in court to see if it gets in but other substances like physical evidence to get a conviction. this is a step in the right direction coupled by the envelopes, the writing where he misspelled beverly hills. it is almost meticial sly the same. >> so his wife goes missing and then a cold case and says i want to know more and his friend who is going to be questioned by the d.a. in new york is subsequently killed. then in 2003 he killed his neighbor and dismembers and claims self defense. when cases go cold case, too far
2:19 pm
away from the actual crime things get ugly and messy, litigation and prosecution gets messy, as well. the resources that cops need should be there for them now so they can find these people. this man should have been put away in '82. he should have been put away in 2000. he should have been put away in 2003. >> i hear what you are saying. i think they had every intention and desire to put him away and they were trying to do that. when you have someone who the allegation is whacking witnesses how can you put the case forward. that is the best thing about cold cases and testing things we do now you can prosecute something later on. >> he is 71 years old. he is on the list. he is worth like $4 billion. he has every lawyer in the world willing to work for him. he has the protection. i think part of this is that
2:20 pm
he's never been properly the focus of law enforcement because everybody knows if you get close to him the lawyers are going to fight you and he is going to have a real cocoon around him because of the wealth. i think at the moment -- in the documentary he said the only person that could have written that letter with the misspelling of beverly was the killer. if he is tied to the note that is pretty strong. >> how do you like it smarty pants? >> this reminds me of the white o.j. everybody knows he did it and he is walking around looking like an idiot. at one point he gets popped for taking a leak at a cvs and then popped for stealing a sandwich. he is cross dressing. and the guy is worth billions of dollars. this is what the point is. money talks in law. if this guy was a broke joke he would be someone's girlfriend in
2:21 pm
prison. >> i need the urban dictionary to follow along with all of that. let's segue into another development. ferguson with the arrest of jeffrey williams. what do you make about this and do you think it will settle down some of the unrest in ferguson? >> i don't think it settles much. do you think that this guy was shooting at the cop or do you think he was like a broken down busted criminal sitting in the car with his buddies and shoots the gun twice? which is believable? protesters say he wasn't one of us. we don't know. clearly both sides want to fix their own narrative here. >> if you want to take a shot at an enemy you don't do it outside of a police station where your targets gathered. >> according to the police the shot had to go through the
2:22 pm
protesters. it's crazy. >> so you are doing a drive by in front of a police station and doesn't want to take out cops. >> somebody who is willing to fire a weapon at people is willing to take a life or lives regardless if it is going to hit an innocent by stander and shoot through a crowd to get through cops. to them that's called like wednesday. >> i don't think it matters. i think he will get prosecuted either way. he will go to jail. very important this afternoon i couldn't believe i'm watching this on msnbc. there was a bishop derek robinson who claims this shooter jeffrey williams was set up by the cops. he said he was beat up and coerced. >> set up to take the fall for this shooting. >> this is on tv, juan. don't make a face at me like i'm making this stuff up. my point is a bishop is making
2:23 pm
up nonsense just to continue the race debate, continue the division over ferguson. this town will never heal. >> i just don't understand why they are even protesting ferguson at the moment. it seems if there is protest it should be against guys like this who are damaging any effort at healing and trying to get things straight betwce and the black community. >> here is what we have to do, take the word of a criminal, someone with a weapon shooting into a crowd and wanted to kill someone else and not shooting at the police. that's the point. we have to take his word. >> if there is evidence of a dispute with somebody else i think that that individual or someone will know information about whatever dispute he supposedly had with somebody else. doesn't sound like his story is going to hold up. >> it is very convenient because there are stiffer penalties when you are trying to murder a police officer. >> i will say one thing.
2:24 pm
apparently according to police everybody got involved in finding this guy. >> great point. >> community involvement. >> he is still getting stiffer penalties whether he intended to. >> because of transferred intent. he is trying to say -- >> i wanted to murder someone else is not the best defense. >> it's not charming. next on "the five" ed henry caught up with hillary clinton today on the streets of new york city. he asked a very important question regarding her e-mail scandal. did she answer it? ed will be with us.

last week hillary clinton gave this excuse as to why she used a private e-mail account during her time as secretary of state. >> i opted for convenience to use my personal e-mail account which was allowed by the state
2:29 pm
department because i thought it would be easier to carry just one device for my work and for my personal e-mails instead of two. >> but did one of her cheap defenders just reveal the real reason? here is james carville. >> you wonder why the public is not following this? because they know what it was, something that was legal. i suspect she didn't want congress rifling through her e-mails. it amounts to nothing but people flapping jaws about nothing. >> carville suggests she did it to avoid congressional oversight and scrutiny and fox's ed henry caught up with clinton in manhattan. he is here on set with us. this is almost unprecedented. we are glad to have you here. this story has more holes than swiss cheese. greg is not here so bear with me with something better than that. what happened? >> we have a quick tape.

waters segment. >> this story they would have liked to have had her come out and answer a couple of questions and had it go away. even this morning her spokesperson had to put out a statement revising the revised statement like the fourth iteration which raised more questions. >> saying contrary to talking points, fact sheet that the clinton camp put out after her news conference where they seem to suggest that they have not read every e-mail but surmged through them and searched for words like benghazi and then deleted the rest in that section. then they said we read every e-mail. friday the state department said it was only this past february that the state department started automatically archiving e-mails coming from the administration. why is that significant? last tuesday secretary clinton three or four times said even though i was using a personal

2:33 pm
the truth that she wanted the e-mail because she didn't want republicans rifling through the e-mail. that is an honest statement. here is secretary of state being paid by taxpayers. you can't just say i don't want oversight. >> if you don't want republicans rifling through e-mail then don't e-mail. you have staff. it is just as easy to say can you e-mail this for me? >> another piece of information. general petraeus advising the president on isis. general petraeus is advising the president on isis and he also has to admit guilt on e-mail issues. hillary clinton revealing clearly is guilty of at least protocol if not law breaking protocol. >> that is how it works for a low program where you prosecute you get less sentence. >> seeing hypocrisy here? >> there is a distinction made
2:34 pm
which is that petraeus was being investigated by the justice department. to have a plea deal they felt like they could potentially prosecute crimes. there are allegations. did she sign the form or not? we haven't gotten an answer. >> the justice department if you really want to know what went on has to be -- >> good luck with that. >> they let the black panthers skate with a billy club. >> let juan speak. let's get back to the news if you don't mind. i read today that abc is saying that speaker boehner is thinking there should be a special committee to investigate hillary clinton's e-mails. last week it was tray goudy and the benghazi committee. then you had on the sunday show. it seems to me yesterday on fox news sunday you had a

congressman democrat saying at this point the benghazi committee has become the clinton investigation committee that all republicans are doing is they are desperate to get something. >> maybe you are leading to one question for me if you have so many republicans investigating you at some point will hillary clinton endorse the investigations and say you spend time on that and i will campaign. >> the form that was talked about last week, that is one piece of paper, it either exists or doesn't at the state department. you have covered a lot of white houses and state departments. how hard is it to tell somebody if that document exists? >> i think in fairness hillary clinton we shouldn't say this is an e-mail scandal. we should get facts first. hillary clinton has been her own worst enemy and hasn't given us facts. some things last tuesday haven't

>> jeb bush signed a document that said you should immediately turn over everything. >> is jeb bush on federal law? >> he is a governor of florida. he had information according to the reports that had to do with troop movements and everything else. these guys are focused. i think it is to the point where republicans have one view in this and the world has another. >> all of the administration officials combined and not under federal obligation to preserve them. >> she had an obligation to do so so she has stolen four years of public records that should have been part of the national archives. >> if you don't toss to break i'm going to. >> he is nervous. >> he has to go to a news show. coming up it's eve of an election that can have a great impact on the future of the middle east. will israeli voters keep
