monster truck showdown where dozens are competitors are getting set to crush cars. why? i just told you why. let's get to it. >> first from fox at 3:00 in new york city with the deadline looming for a deal on iran's nuclear program, president obama is now calling for iran to release three american prisoners and help find a missing fbi agent. the white house says the iranians have held the man in the top left of your screen here for about two and a half years, over his religious beliefs. official says the guy on the top right has spent more than three years in prison over accusations he is a spy. bottom left there a reporter for the "washington post" newspaper whom iran has held for eight months. what the white house calls them vague charges, and finally president obama is asking iran to step up efforts to find the man, former federal agent who went missing eight years ago. back now to the nuclear talks. this is all really connected.

as we have been reporting both sides have until the end of this month to figure out a framework for an agreement with iran. under it, iran would scale back its nuclear program and in return the world would ease up on economic penalties. a senior russian negotiator told the "associated press" both siders close to a deal but "the wall street journal" reports talks hit a snag eve how quick the penalties should be rolled back. iran wants them gone almost immediately after any deal is reached. but the u.s. and european diplomats say iran should first prove it's using nuclear energy for peaceful purposes and not to build bombs. in the video of that the white house put out just about this time yesterday, or yesterday evening president obama called on the iranian people to support the deal, and he said that the days and weeks ahead are critical. >> our negotiations have made progress but gaps remain and there are people in both countries who oppose a diplomatic resolution mitchell

will they finally decide to agree to, say take care of step one before the u.s.a. and its partners can even think about step two. the white house is saying that without sanctions the u.s. would lose a major bargaining chip in the talks. >> those are some over enough toast sanctions ever been put in place against any country by the united states. and the president believes that we should leave those sanctions in place for not just a few weeks to verify iranian compliance. >> reporter: that's the rub. trust but verify is what the americans say but the iranians are saying we're concerned that you'll simply keep moving the line, and that makes it impossible to crime. on capitol hill you'll hear a lot of dissent for any deal with iran especially from g.o.p. senators. listen to lindsey graham. he says it's time to involve congress in the process or else. >> here's what the president needs to understand. if you go to the u.n. security

council and you try to bypass the congress to get this deal approved by the u.n. security council but not come to your own congress, then you're going risk congress cutting off money to the united nations. >> line in the sand no question about it. john kerry obviously right now briefing our partners in this discussion, still r'g to meet the deadline by the 24th. bark to you. >> thanks. let's bring in bob cusick, editor in chief of the hill newspaper and live in wafers. this is clearly all politics now. one side, if you're opposition to the president, you're against it. if you're with the president, you're for it. but let's move forward a little bit. let's say there is no deal. a deal is scuttled. then where are we? where are we in our ability to monitor and understand what iran is doing? >> well that's what the white house has been saying. if there's no deal what's the compromise to make sure at least the assurance that iran is not going to get nuclear weapons? now, i think what the next step would be is if iran won't come

to the table they won't strike a deal, democrats on capitol hill will agree with republicans and impose additional sanctions. >> sanctions nor good if it's just americans because there's no way to get the chinese to do that. what about the russians? >> that's right. that's why any deal would go as lindsay graham was saying, before the u.n. security council not to congress. the white house has made that clear and that's not only upsetting republicans. that upsetting some democrats who want congress to have some role, and the administration says if the sanctions are lifted, well then congress would have to do that. but that could be years down the road, and remember the interim agreement that was reached to start these talks all of that was not fully made public. some was but some wasn't. only to congress. lawmakers can look at it but the public can't. >> if the big picture goal is to keep an eye on iran and make sure that iran doesn't become a nuclear state, is a deal the best path or is there some better way that no one is

speaking about? >> well, it's a very difficult issue and very difficult problem that multiple administrations have grappled with. the issue is, i think, comps down to trust. can you trust the iranians? a lot of members of congress are saying, look, we struck a similar deal with north korea and they broke it. so they don't see much difference between iran and north korea. the administration says this is the only way to get a deal to make sure that they don't go after and try to make a nuclear weapon. but i don't think there's any easy solution here, shep. just a matter of trust. >> okay. if you don't trust them, then what you whatnot to be able to do is monitor them. right? under some sort of deal -- i don't know what it would be whether it would be good or bad -- but we would be able to monitor, the international community would be in abc sense of a deal there's no monitoring. that only leaves one thing to stop them, just one. nothing else. no other option except bombing the hell out of them, and the moment you bomb the hell out of

them. if you're israel doing that, then you risk something that we can't even really wrap our minds around and that is another one of these massive wars. if you can think of anything else i'd like to hear another thing that might do it. >> some people say, shep, that if you impose more sanctions put more pressure on the leaders of iran -- >> can't do that without china or russia. >> that's true. >> they won't do it. >> but at the same time if congress passes it they think that the economy is going to pressure iran to come to the table but this is crunch time. there's going to be a deal. the administration has said it's 50-50, it think it's more like 80% chance. the president is laying the groundwork. i think there's going to be a deal and then it's going to be a very interesting p.r. effort from the white house. >> going to be interesting p.r. effort on both sides. talk about congress passing sanctions. when congress starts ruling over china and russia that might be helpful but unless and until that comes about that's no good. without sanctions that are from

everyone, there are no sanctions at all. and then you can't monitor iran and then what do you have? then you have what mr. netanyahu and others say they don't want and that is a nuclear armed iran. so it's either a deal of some kind or start a war. that is it. right? >> well, certainly for years israel has threatened to bomb iran and if this deal falls apart, i don't think netanyahu is going to back off on that. do you? >> haven't seen any indications from the speak of the prime minister he would ever back off in that way. no history to suggest he would do that. no hoyt that suggests that sort of a strike wouldn't start a conflict and history tells us that would draw us in, and away we go. so deal or war. we'll see which one we get. nice to see you. thank you. as negotiators try to prevent iran from getting a nuclear weapon we're hearing from a country that has them and is willing to use them. north korea's ambassador to britain confirming this communist nation has developed nuclear missiles.

isis and not al qaeda in the arabian peninsula. the sources note that historically al qaeda in yemen has tried to limit civilian casualties. the extraordinary civilian death toll today, including children, most likely he says, points to david -- different organization a source crimes the bombings as the worst mass casualty attack on women in modern history. it happened ad as yemen forces trying to fight off the houthi rebels, accused of fighting on behalf of iran. the houthis have successfully taken over parts of yemen's north, including the capitol, sana'a, and are advancing quickly south. today government forces fired on war planes flying above the president's compound. he has been living there since the houthis booted him from the north. yesterday isis took credit for the terror attack that targeted tourist at the art museum in tunisia. general david petraeus just cut

emerson. the islamic state is not the biggest threat to the long-term stability of iraq, according to the former cia director david petraeus. he says iranian backed militias or iraq's biggest threat. he made the comments last week while visiting iraq for the first time in more than three years to attend a forum with officials. the white house says general petraeus has been advising the obama administration on the battle against isis this even though he pleaded guilty to giving classified documents to his former mistress. their affair led him to resign at cia director in 2012. since general petraeus stepped down the islamic state has carved out a huge section of iraq and syria and has emerged as wound of the world's

through an ad on craigslist about clothes or something. then sliced open her stomach and ripped the baby out of her womb. the victim was about a month away from giving birth. somehow the victim survived but the baby did not. and cops say the victim responded to a craigslist ad for baby clothes. investigators say it was premeditated plot to steal the baby after the suspect convinced her family she was pregnant. she is facing attempted murder charges for attacking the mother, and now an autopsy on the unborn baby could determine whether she will also face murder charges. but here's the thing. colorado is one of just 12 states plus d.c. that do not have a law allowing homocide charges in violent deaths of fetuses. state lawmakers rejected not one but two recent efforts to make the death of a fetus a homocide. let's bring in diana iceman a criminal defense attorney. is a understand it, diana, the

perpetrator got the baby out of the womb and the baby started breathing and the baby died this can be homocide but if the perpetrator while trying to cut the baby out of the womb, killed the baby and the baby never came out and took the first breath, this can't be homocide. is that right? >> essentially, yes there is one additional element in colorado and that is not only that the baby came out and took a breath but also that the conduct that the cause of death was caused after the baby took its first breath, and that is going to be really difficult here for a prosecutor to prove. to substantiate a filing of murder charges against this baby. and colorado is one of very few states that has a law like this. again there have been several attempts to change the law but they've been unsuccessful. that doesn't mean that prosecutors can't charge the crime in this case and allow it to go up on appeal and possibly have the chance of create something new law that would make sense of this, because the way the law is in colorado now just does not make sense.

it's counterintuitive and obviously this defendant is responsible for the death of the baby. >> well, what you're saying the third option is, if the baby came out of the womb, took a breath, then later died of causes unknown, you can't necessarily be charged with murder as the one who stole the baby because there's no 0 proof you murdered the child. >> that's exactly right. so they'd have to show that something that this woman did after the child took his or her first breath caused the death and that is the element that is going cause the biggest problem for prosecutors. >> if they've get her on attempted murder she goes away for how long? >> usually attempted murder, depending on the facts is anywhere up to life in prison -- >> 20 to life usually. >> usually about 25 to life, yes. depending on the circumstances. >> if you were convicted of murder you could get at least life, maybe with or without the possibility of parole and in some states the possible of a death penalty. >> that's correct. for example in california, if

you're convicted of murder you are eligible for the death penalty under special circumstances. >> but if you have mental impairment which seems like the kind of defense one might mount in defending this woman who cut a baby out of another woman's belly, you could be hospitalized and treated in some way. >> in theory yes. if the jury goes with you on that particular issue. but realistically, under these facts it's going to be very difficult for a jury to come back not guilty by reason of insanity. juries are usually very hesitant to come back with that verdict in the first place, and so i think under these facts it would be even more difficult for a jury to place this woman in a facility for her mental health rather than a state prison. >> reading back on the two laws i mentioned that were not passed, it sounds as if in fact it's very clear that the reason for this is it was an abortion debate. it was laws wrapped around an abortion debate on right to life and mother's right to choose, and this sort of scenario kind of got lost in the weirdness of

that ongoing struggle. >> which i think is completely inappropriate. i think that the right of -- abortion rights and murder of an unborn child are completely mutually exclusive and under these facts there is no way to say that this is anything even resembling abortion. this is clearly murder. >> i just heard half the audience scream at you. and you know that. because this is not something you can talk about and not have people scream at you. i've turned the filters on my mail now because i don't want to hear from them. i've been hearing from them for 30 years, not one side or the other. all of them. but there are plenty of people who think at that time what happened to this baby is exactly the same thing as an abortion, and they are very, very loud about it. >> maybe. but ultimately what it boils down to is whether or not the law allows for a filing of murder under these facts and and in colorado that law needs to be changed. >> you're on point.

doubts. >> accord together "new york times" the white house officials suggest the administration might now support a united nations resolution that calls for the establish opt of palestine -- establishment of a palestinian state roughly along the borders before 1967. on the left you see what israel looks like now with occupied territories in orange. on the right you see what israel looks like before it took over the territories in the six days war in 1967. of course the relationship between the momentum, benjamin netanyahu, and our own president has been at very minimum tense. the israeli leader has blasted the president's nuclear negotiations with iran and spoke before congress after the republican house speaker john boehner invited him to without giving the white house a heads up. meantime speaker boehner today announced he plans to visit israel when congress takes a recess at the end of the month. chris wallace joins us now. i wonder if the two sides realize they're messing with a long are standing relationship and messing with it hard.

>> that's right. the interesting thing is here you go to the map you showed of 1967 borders and the current borders. the fact there is wasn't be a two-state solution an)k because the two side are so divided among other things. the palestinians are divided amongst themselves. between hamas and the palestinian authority isn't anybody to negotiate with. but it has been the policy of the united states and of israel for years that they support evidence at least in principle if not in reality the idea that israel would have a state and alongside it palestine would have a state, and when netanyahu said what he said the day before the election, that under his watch there was not going to be a palestinian state, that basically blew up and at least the pretense of what the policy has been for over a decade and the administration has decided to really put the wood to him on this. do i think there are actually going to allow a u.n. resolution that would ratify a palestinian state? no i developments. but i think they enjoy seeing netanyahu twist in the wind for a while and be forced to walk

back some of the things he said before the election. >> it's usually better to judge people on their actions than on their words because politicians and their words -- there's so many words out there and they use them a lot, and usually just kind of watch what they d.a. do. what the prime minister has done is with george w. bush saying no more settlements stop it, and president obama saying no more settlements you're getting would n the way of peace what netanyahu has done is continue to build settlements which makes it less and less possible to have the two-state solution. so he has been saying one thing and doing another for a long time and it felt like three or four days ago he came out and told the truth. >> well, that's why i say for all of this talk about is he going to support it or -- there isn't going to be a two-state solution, and yes, netanyahu has done plenty of things to hurt the peace process. so have the palestinians. when hamas is raining missiles on israel after israel had pulled out of gaza, that doesn't
