territory in yemen fears grow that terrorist groups take over that country. we will be live as the security council gets ready for a emergency meeting. and ted cruz officially throwing his hat into the presidential run stoem, tomorrow. he will make a run for white house in 2016. our political panel will be weighing in. we are now just nine day as way from the deadline for a framework deal with iran over its nuclear program. as top u.s. officials sound optimistic, even excited about a deal yesterday iran supreme leader spoke to a large crowd about a deal with the united states and they chanted back "death to america" still u.s. has ability to keep the pressure on iran regardless of a deal.

doug is here to unpack the latest. >> as you well know there are very different interpretations how close the countries are to reaching a deal. top russians negotiator said in recent day that's details were nearly completed but fresh negotiators insist there is a great distance between parties. secretary kerry suggested significant obstacles remain, one of those of course is the u.s. congress. bob corker is concerned that the u.s. and its partners are giving up valuable negotiating tools. >> we keep moving from our initial position, the p5 plus 1 towards iran's position. so there's a concern that the administration cares more about making a deal versus a right deal. i think you know one of the things that brought iran to the table was congress mandated

sessions. congress played a vital role bringing iran to the table. >> also saying there's a number of things u.s. has available to keep iran from getting above. but critics say iran has continually cheated in the past and are asking why should things be different this time around. >> i think we've gone to school over those developments over the last decade or so so that we now can have a better plan to verify some of the things they say they will do and not do. >> and lindsey graham threatening to pull u.s. funding if the administration bypasses congress. >> if they try to bypass us and leave us as the last guy standing is there will be a violent reaction against the united nations 22% of funding comes from the american tax payer and i'm in charge of that

a problem from the beginning. if you will recall in the last session of congress, we had a bill that passed 400-20 to put further sanctions on iran and give ayatollah a choice. it was passed and able to hold up in senate. from the beginning we have been moving back from our positions. so the french are objecting at this point because first the sanctions would be lifted and over a very short period of time maybe a ten-year period iran would no longer be under any pressure. and the second problem for them, i think, is the problem we have in congress, with the iaea the inspectors telling us they have a thousand pages of documents

that iran was working to develop a nuclear war head and put it on an icbm missile and we want access to that information. we want to verify in agreement. so we backed up on everything else. icbms. the ayatollah said we will have massive icbms backed by iran and it's not in this agreement. and then are going to be allowed to continue to enrich. and if we are not allowed to go in to evidence then we have capitulated. >> are the action clearly devisive towards the u.s. one day after president obama appeals to iran for historic opportunity for a nuclear deal and kerry saying substantial progress is being made and you

have iran's supreme leader calling "death to america". with this to say -- that's a reference to iran's big push to lift sanctions immediately. it seems unreal this is happening while the white house is saying everything is on track forbes a deal for a diem. for a deal. >> the white house is naive. -- they push the reset button to create favor with the russians all they did was to make us more vulnerable in my opinion. at this point it takes on a very real national security meaning if we allow iran while it is messaging "death to america" death to the great satan and

little satan, to go forward and not have the verification on the agreement to have it lifted after ten years such a short time frame, the head of state in france is saying we should not be capitulating on. it is interesting that the president is spending more time putting pressure on iran. i have a letter signed by 367 members of congress, both sides of the aisle, siting with the position sfrans france is saying don't give up these points of negotiations t is essential to national security in my opinion. >> pointing out trust is a big factor because iran has gone back on its word many time. you pointed out un inspectors have been prevented from looking

at sights in the iranian mines over the development of nuclear weapons. >> can i give you an example how gullible the administration has been on this. we are talking about the subject of inspections, and in the middle of this negotiation some months ago we caught iran developing a new super sonic center fuge that spins even faster so their undetectible break out ability would be ever quicker. this is how it was interpreted by the administration, well, the negotiator on the iranian side didn't know this was going on so he didn't understand this was a violation of the current agreement we have with innran. obviously his boss knew, the ayatollah knew, he's their supreme leader he has the ability to decide. if he decides "death to america"

or if he decides to go forward with a nuclear program and we don't have verification on it then we have a big problem in the united states. this is the message that the french are sending to the administration and that we as members of congress are sending and this is what has the senate members concerned as well who feel this should be a treaty, obviously, in which congress has input rather than the united nations making the decision of lifting sanctions that were put there by congress. >> with all of the evidence you're putting on the table here, where is the push back going to come from? do you think the senate will say, whoa, before any deal is signed we need to see it first? >> it's coming from the house of represent itches, foratives foreign affairs committee. from the senate. also from the foreign minister and head of state of france. they are all saying enough. let's get an agreement with

he's expecting to speak via tele conference about the deteriorating situation as peace talks are seemingly going nowhere. the u.s. has been encouraging u.n. talks saying there's no military solution hoping all sides in yemen can come to a power-sharing agreement. president is hoping for a robust response from the u.n. something going beyond the call for security, ideally a resolution that would entice the rebels to stop their offensive. the situation in yemt yemen has rapidly declined as they have control of 9 cities and today seizing the third largest city. yesterday president demanded the

rebels withdraw and they responded by calling for offensive against all forces loyal to the president. meanwhile al qaeda seized the city near the air base causing all remaining u.s. personnel from the country including 100 special forces and troops stationed at the base, with no u.s. presence in yemen, some lawmakers are worried about the increased risk of attacks here at home. >> when we pull out like this, we have no intelligence foot print and no intelligence capability and no way to stop that kind of attack. good intelligence is what defeat defeats these types of plots. >> and all of this coming after isis took credit for suicide bombings on friday in two mosques. >> thank you. we'll see what happens in yemen.

troubling development now with new threats against our military isis hackers calling for home grown jihad. calling for home addresses for 100 service members that took parts in bombings across the area. this is the latest of threats they have made against the troops and their families. last month i spoke with wives who received online threats from isis. >> obviously we're concerned and vigilant but i think the message is not to be afraid. fear is choice. we can be aware of the dangerous without being afraid. >> in this last threat fbi now

federal judge says he feels like, quote, an idiot for taking obama administration at its word. the bomb shell statement came at a hearing over immigration late

last week. dozens have filed lawsuit on the topic that effects millions of illegal immigrants. judge stopped the changes but now questions about if the administration is listening to the judge or keeping their word. the man taking on the president, texas attorney general. appreciate you being here. what did the administration do ha got the judge so angry. >> as you know, the president issued executive action in november, we went into court and fileland our brief in december and had our chance for a hearing in january and we asked the court to enjoy the action by the president, we were told in court that they were not beginning to implement until february the 18th. so the judge timed his preliminary injunction which we asked for to be preceding that

implementation implementation. shortly following that the administration filed with the court information that they had actually implemented and as it turned out in the hearing last week we found out implementation has begun and it has effected over 100,000 people. >> so they allowed those people in the united states. they said they wouldn't do it. >> they said they wouldn't implement anything until after january 18th and we believed them. it's effected at least 100,000 but we're not exactly sure. >> where does it go from here? do you have to take the administration at its word or is there a check and balance. >> we have difficulty taking them at their word now. we asked for further discovery so we can get more information on what they have done. because so far they have volunteered this information recently. we don't know if there's been more implementation.

we hope the judge will rule next week and let us know if we can get further discovery to find out what the administration is doing. >> essentially that's where the injunction is. where do we stand on the lawsuit? there's an appeal going to fifth circuit how will it affect what is going on at the border. >> the appeal is to the fifth circuit on the prelim anywhere injunction where the judge planted it correctly. it is just a matter of where that preliminary injunction can stay in place. once we get through that process then we go back to the trial court and have a trial on the merit of the actual case. >> when could that happen. >> we're hoping it will happen fairly quickly to have an opportunity to try to case in the next few months. >> obviously we have the macro

view of what is going on in texas, it feels there's a larger macro view in terms of new regulation on fracking this week, we have neutrality coming out what does it say to you and how fearful are you that the administration is starting to ing toing to circumvent the law and takes things into action. >> that's our concern. the fact he's going around congress violating federal law and going around the constitution is actually our biggest concern. you mentioned many of the issues we're concerned about. in is just one example. this is really the reason we filed this lawsuit to stop the president from going outside his constitutional duty because if he can do it on this issue, which some agree with some

netanyahu saying the new government must serve all israelis, jews and arabs this coming after netanyahu warned arab israeli's were voting in droves dangering his party's chance of staying in power. that comment drew a lot of criticism from the international community and in israel where he was accused of raceism. the white house was deeply concerned about the comments. president obama congratulationed prime minister netanyahu over the weekend. he was concerned about the two-state negotiated solution to the conflict here. netanyahu has since backtracked. the relationship between

now americans face prospect of another republican-manufactured crisis to shut down the government. >> again that reenforces the concerns of the deep polarization continues to reenforce congressional gridlock. one senator offered his concerns. he's been in office since the 70s and has worked with lots of white house administration says he can't remember a time when the tone has been this tough. compromise on heated issues is something that running scarce on capitol hill. and he shared more of his views on obama subsidies now in the hands of the supreme court. >> ted kennedy and i worked closely together, so did i work closely with chris dodd and a number of other more liberal

senators. they were willing to come across to the center right to make good legislation with me. but we also, one of the most important bill that's been passed in history was the hatch waxman act. henry was liberal as could be but was willing to sit with me and that created the modern drug world that literally has saved trillions of dollars to the american consumers. we can do a better job than what we're doing. i have to say this has been such a partisson administration, if you're going to be partisan, you're not going to be very effective. >> overall would you say there's no solutions until there's a change in the administration? >> if the court comes down the way i think it should then we're going to have to make the changes and i would like nothing better than to have that responsibility. there's a number of us already working on it to see what we can do. we're going to do that whether the court comes down or not

because i think there will bea change in '16. if the republicans keep the senate i think we can hold on to the senate. i think the americans are waking up that my gosh at least republican are responsible to governoring. that's my goal. we're going to fix this so it works for every american and many of the things they cherry picked, will be in whatever bill we do. so you know the people are not going to lose by having this knocked out. they're going to win by having it knocked out. it is a pathetic over exercise by the left in this country that really is trying to drive us into what really amounts to socialism. >> and you can hear more of my interview with the senior senator online. senator hatch happens to be celebrating his 81st birthday.
