to justice. we understand, judge, he is currently on suicide watch, is that right? >> you know, he is on suicide watch. but even his own lawyer says he's not suicidal. he's not crazy and he's not incompetent. you figure that one out. what's going to happen this morning in this courthouse, the orleans parish criminal district court behind me, is the defense will make an argument that durst should be released because he was illegally arrested because they claim that the last episode of the hbo jinx series was meant to coincide with this arrest. and therefore, the arrest is illegal. doesn't make a lot of sense given the fact that this defendant is already wanted on a murder charge in california, as you say. for the murder of his susan bermman in the year 2000. so whether or not the judge innew orleans says we'll let him

go, they shouldn't have arrested him even though they have him in possession of a gun and drugs, especially being a prior felon. he's waived extradition and he'll have to go to california anyway. i think the bigger question today is the competition between new orleans and their charges and l.a. and the murder charges. who gets robert durst, who gets to try him. that's what i think will be the fascinating issue. >> what's the mindset if you're in new orleans? do you want this case or do you not want the problems that come with the case? >> you know what? i know this defendant, i know his history very well, as you say, in the year 2000 i focused on him and started this hunt. but i think that the prosecutors will each sit down and say my case is better than your case. he can get more time on my case than he can on your case. mine is a definite conviction, yours isn't. it will be a back and forth.

there is no requirement that one jurisdiction gets him or another jurisdiction gets him. the way i see it, possession is nine tenths of the law. he's here in louisiana. they've got charged against him. the d.a. is serious about this case. my sense is durst will not be released today and that louisiana is going to hang on to him for a while. >> because they caught him red handed, the gun was in his room? >> yeah. they caught him red handed. he had the gun, he had 40,000 in cash. he is facing a minimum of ten years here. that's without any stress without worrying about witnesses, memories fading. all of the issues that will occur in california. the susan berman case needs to be addressed. she was shot in the back of the head in her own home.

i believe that -- a lot of people, obviously, the l.a.da's office believed he had motive, means, opportunity. and with this hbo documentary, "the jinx" that found and unearthed a letter that is almost an exact match of only the killer could have written in the susan berman case. >> it's not just the berman murder, it's curious other situations have happened around him, like the disappearance of his wife and the dismemberment of his neighbor, which he was acquitted for. do you think he's going to be able to skirt this again if that, you know -- not to jump to any conclusions there, but will this be the final nail in the coffin, what do you think? >> i think robert durst will finally meet justice. i opened the cold case involving his missing wife. i came into it 18 years later. looking at it then, it was clear to me that there was very little investigation that was done. it was not thorough. it was not sufficient. that's when i started this ball
