german wings flight 9525. according to the "new york times," one of the pilots of the passenger jet left the cockpit before the crash and was unable to return. an investigator describing evidence from the cockpit voice recorder reportedly told the times the pilot can be heard knocking on the door but there's never an answer. the crash in the french alps kill all 150 people on board, including three americans. a violent storm system turns deadly after spawning several tornadoes near tulsa, oklahoma. the worse of it hitting a mobile home park near there. one person died. i'm patricia stark. "hannity" starts right here right now. welcome to "hannity." the united states military has charged sergeant bowe bergdahl who walked away from his base in afghanistan with desertion and misbehavior before the enemy. fox news's jennifer griffin is at the pentagon tonight. >> army colonel for -- at fort bragg did not face questions. >> sergeant bergdahl is charged

under the uniform code of military justice with one count of article 85 desertion with intent to shirk important or hazardous duty. and one count of article 99, misbehavior before the enemy by endangering the safety of a command, unit or place. >> after a preliminary hearing a general court-martial hearing could be convened. the judge has the ability to send the case to a general court-martial, a special court-martial or dismiss the charges altogether according to the army spokesman. for desertion sergeant bergdahl could face punishment of dishonorable discharge, -- for a second charge of misbehavior before the enemy, he could face a maximum penalty of confinement for life. he left his base in afghanistan in the summer of 2009 and was held captive by the taliban at times in a metal box for five

years. in the wake of the prisoner swap and statements from the white house about bergdahl's heroism a chorus of criticism erupted from soldiers in bergdahl's unit who spent much of their tour looking for bergdahl blaming the loss of some of the members of their unit on these search efforts. >> the point is he's back. he's going to be safely reunited with his family. he served the united states with honor and distinction. >> now the case will wind its way through the military justice system. bergdahl's lawyer has told reporters that he has not yet decided how his client will plead sean. >> jennifer, thank you. the obama administration sent five taliban prisoners back in exchange for bergdahl. so what are these five up to now? fox ease own catherine herridge is in washington with an update. catherine. >> thank you, sean. a government official familiar with the intelligence says three of the five taliban commanders swapped for sergeant bowe bergdahl have tried to plug back into their old terror networks describing it as re-engagement.

a defense official emphasized one of the men has come close to providing advice council or inspiration while the other two taliban commanders have not crossed that line. with the men under house arrest in the gulf nation of qatar in a deal set to expire in may, a member of the house intelligence committee says their intentions are clear. >> these folks will be released from their constraints at the exact moment when american western interests are most at risk in afghanistan. i've seen nothing that causes me to believe that these folks are reformed or changed their ways or intend to reintegrate into society to give me any confidence that they will not return to trying to do harm to america. >> a state department official disagreed saying the taliban five's activities did not meet the strict criteria for reengagement laid out by the u.s. intelligence community which takes into account the motivation and intention of each communication. the statement given to fox news reads in part, none of the five individuals has returned to the

battlefield. and none of the five have left qatar, the official said. since their transfer, many actions have been taken to restrict the actions of these individuals. and they are also being closely monitored by the united states and qatar. fox news is also told there are other options under discussion to get bergdahl back beyond this controversial swap. they included a so-called snatch and grab rescue mission paying a contractor to locate and recover bergdahl as well as working through the pakistani intelligence service. sean. >> catherine i know the president has released a lot of the prisoners, a lot of the terrorists that were in gitmo, do we know what the estimate of percentage these people return to the battlefield? >> it's pretty consistent. it's about one in three are confirmed or suspected of returning to the battlefield. but i would point out in a case of the taliban five there's clearly a disagreement between people who are looking at the intelligence on the state department's side and some people on capitol hill as to what it all means and whether they totally are committed to

reengaging. but the bottom line, sean is that the only people who know what their intentions are are those five taliban commanders. and we'll shortly learn once their house arrest finishes in may. >> all right. catherine herridge in washington tonight, thank you. in the weeks and months after bowe bergdahl was released by the taliban, well several of his former platoon mates joined me right here on the show to explain how they felt about him. take a look at this. >> to say that bowe is honorable is -- it's a spit right in everybody's faces. and it is frustrating. >> he is a deserter though. he left his fellow soldiers, leadership and country behind when he left leaving all his gear on the o.p. with us just out to seek the taliban. >> the army needs to do what's right here and they need to abide by the army values. and he needs to face consequences for his actions. >> and joining me with reaction the author of warrior diplomat, former commander of special forces in afghanistan who led

the search for bergdahl, lieutenant colonel michael waltz with us also best selling author foreign and domestic retired brigadier general tony tata, and the man who killed osama bin laden o'neill. you were there colonel waltz, you were part of the search for bergdahl. i know we lost at least six soldiers, is six the number? and how many others were injured in the search for him? >> well, sean, thank you. first of all, you know i refuse to call him sergeant bergdahl. he was promoted because he was incorrectly classified as a p.o.w. rather than deserter. secondly, i would like to commend the army for taking this bold move. yes, we led the search for him. we knew at the time that he had walked off his post and he had put us in this position. the disturbing thing was that the taliban knew we were pulling out all the stops to look for him and were feeding false information into our informant

network. so they were baiting us into ambushes. in one case they baited us into a house rigged to explode. thank god it didn't. but soldiers died looking for him. and importantly much more difficult to quantify are the number of soldiers and marines that didn't have the things they needed, helicopters predator drones, re-supplies, because they were all diverted to search for bergdahl for a period of months in 2009. >> but people died, as many as six and maybe more and many others were injured, that is a fact, right? >> that is a fact. in fact, i testified next to the father of one lieutenant who died last june. >> and everybody i interviewed and met with many of his platoon mates and they all said the same thing, they knew from the very moment he was gone what had happened here. so then that raises the question about the judgment of the president and his team releasing five gitmo high ranking terrorists in exchange for a deserter who put his entire

platoon at risk. did they pay any attention to any of the people that actually knew what had happened? >> well, sean, i can't explain the administration's decision on this. but i certainly question it. >> clearly they didn't. >> clearly they didn't. but we knew at the time that he was under investigation. we knew he deserted and then there was a follow on investigation for that desertion. the only reason it wasn't completed was that you have to investigate the soldier -- you have to interview the soldier himself. and obviously that couldn't be done and was done this past fall. so, i mean, the facts were out there. and we all knew on the ground that he had deserted. >> general tata let me ask you. because i think this is an important question. the administration acted like this was a huge benefit, that they were going he served with honor and distinction and this was a coop for them. but his platoon members saw the announcement and said that's just not true. so the question is why would they do this? why would they put those men at

risk and similarly the rest of the country at risk by releasing the gitmo terrorists? >> well, you know sean, what they released was essentially the general staff of the taliban, the intelligence operator, the operations officer the communications officer and you know, the political officer of the taliban that have been released from gitmo. and that's like giving back the resources -- it's very hard to develop that talent within an enemy force. and i just want to say that mark mill li, general mark milley shows great fortitude here in the face of really tremendous pressure. and i think last time that you and i talked about this i expressed great confidence in mark milley that he would make the right decision. and the court-martial decision is the right decision. very simply, you know, going to an article 32 -- >> but was the trade the right trade? >> obviously not, sean.

the trade to give away the general staff of the taliban for someone in best case had deserted and left his post and now he's also charged with misbehavior before the enemy, it's a bad trade. >> all right, rob let me go to you. interesting you were telling me before we came on the air that you were even involved in this. and it had gotten back to you the circumstances under which bergdahl left. >> right. we were on the forward operating base. and he was sort of on that base on an observation post just outside. and we were conducting mainly kill capture operations against high value targets, al qaeda and taliban and vehicle interdictions as well. when he walked off the base we were instantly given the intelligence we had a deserter we were going to get him back we stopped everything we were doing. the war stopped from very highest levels of special operations and we started hunting him. my team and i would say 20 operations trying to find this guy. we got so close to him at one

point we had the ransom money where he was turned over to the taliban. and we tried to pursue all the way to the border of pakistan. we were unsuccessful. >> we were willing to pay for him? >> no, the ransom from where whomever turned him in sold him to the taliban. >> one of the things the platoon mates said they heard radio transmissions saying locals saying this american guy walking around seeking out the taliban. he wanted to find them. >> it was something like that. >> you did hear that too? >> the taliban were in disbelief. what do you mean you have an american? yes, we want him. so they paid some ransom to the locals who grabbed him. we did find the ransom. we went to one of the houses. we were risking ourselves, we're not going to fly right up to a dangerous house and be out front knocking on the door. but we were basically doing that at this point trying to get an american back. >> that raises the question should we be willing the way he deserted, seeking out the taliban, everybody knew the circumstances, the white house didn't want to hear from the guys on the ground what had

actually happened. they were frustrated as could be because as you pointed out all operations stopped. so the question is, is that the right thing to do? was this handled properly? >> i think in the beginning it was simply because we knew he deserted but there's a chance he didn't. we got to get our guys back. >> a chance he has ptsd. >> something happened or he was on the operating post and maybe he got tricked by some locals. we confirmed later he in fact walked off, sent his stuff home. and the locals on radio saying this guy's looking for the taliban. >> right. >> so he sought them out. what should the -- what should we do in the future? because, i mean, you're active in the search here, colonel waltz. what is the right thing to do if this happens and you know somebody chooses to leave? >> sean, if i could just jump in. you know, we go through survival and resistance training. both rob and i and anyone in the special forces community we know if we're captured that our

government is not going to negotiate with terrorists. they're not going to offer a ransom. and i'd certainly pray to god that they're not going to offer a trade. >> they negotiated with the terrorists and they gave five high level, you know, al qaeda taliban terrorists in exchange for one deserter. that's what we -- that was the deal we got. >> and they shouldn't have. not only that, i want it to be clear that these five were the ones that the taliban chose. not that we chose. so they essentially got their top five draft picks. >> they got their top five guys back. real quick, what should the penalty be? was this the right penalty? we have on the one charge desertion five years, misbehavior life. should he get life? >> no i don't think he should get life. i'm happy with the decision today they admitted he deserted. we finally admit that. i'm not a legal expert. i know that this guy definitely realized very soon he made the wrong decision. he was abused and tortured. >> he was in a cage. >> that needs to be considered, life in prison or life of hopefully psychiatric help.

>> general tata, what should the penalty be? >> sean, i think it's important to point out that this is a trial. and so the burden of proof is on the prosecution. and so just like a civilian trial things have to be proved beyond a reasonable doubt, which is why it took general milley so long. he wanted to make sure he had everything nailed down. so as this progresses, you know there's innocent until proven guilty. and that burden of proof is on the prosecution. >> the evidence seems incontrovertible and if he's found guilty what should the penalty be? >> sean, if he's found guilty from my perspective i think he should get life. because the men and women who aren't coming home who died looking for him or who didn't have the assets they need they're dead. and they didn't get to come home. i think he should get life. absolutely. >> appreciate it. thanks. coming up ainsley rides along with the police in panama city,

it may take me a lifetime to earn it let alone deserve it but i'm committed to trying. >> joining me now executive director of teaparty.net, niger, juan williams, deroy murdock. deroy, what stood out to me, he wasn't the only one. where are the other ones? >> i will say that i watched most of this -- most of his statement anyway. and it didn't sound like something written by a lawyer. it wasn't the old i regret. i regret that somebody passed away. that doesn't mean i'm sorry. he said i apologize i'm deeply sorry. >> he asked, i beg your forgiveness. >> correct. if you're going to apologize you do it like this. >> i hate when they do i apologize if i offended you. >> i regret that something happened, i regret a ship sank it's not my fault. >> words mean a lot what i've done, who i've hurt and the repercussions i've brought to the university. so he's taking responsibility.

>> he sounds deeply remorseful. >> juan, what do you say? >> you know, i'm all for it. i think this is a season of lent, so it's a season of penitence. for me it's not about giving him a thousand lashes in public or somehow demonizing him by having him stand up there and say mea culpa. it is about a culture where as you point out, sean, he wasn't the only one. and he knew the lyrics to this song. it's something that had been repeated. so there's a culture revealed of young people and some of our smartest young people at the university of oklahoma you know, just kind of accepting this racism so easily as part of their upbringing. and i think we have to think about that for a minute. but i don't want to hold onto any kind of anger at him. >> but, don't young, juan, as repugnant and awful as it was, i don't think most kids are like that. i would not want to publicly start listing every stupid thing i've done in my life, especially when you're young and 18, 19 years old.

you do a lot of dumb things. this is a little bit different. two things i observe one was where are the other kids? >> right. >> the second thing, he on his own had reached out to these members, state legislators and other people in the black community and went to them which i'm sure wasn't easy to do. apparently went to the football team at ou and elsewhere. so that interested me. what'd you think, niger? >> oh, i think this is a day of celebration. i mean what your viewers may not know is that senator pitman who's the head of the black caucus, is the one who introduced him and actually said that, you know, the kid made a mistake but his life should not be ruined. this is an outstanding young man who's been on fox, isaac hill head of the oklahoma university student union says we have to fight hate with love. to me this is an episode of what real civil rights is about, real civil rights is about healing it's about reconciliation, it's about bringing people together.

and not this type thing that masquerades itself as civil rights today when it's used as a political weapon. so i think this is a moment of celebration. i think levi made a very good first step. and i think he's going to continue to make up for the injury that he caused. >> i really want to second a lot of what niger said. i think there's a lot of positive about this. i look at this at 5% empty, 95% full. these guys said awful disgusting hideous things. fraternity shut down kicked off campus immediately. national denunciation this young man came forward and apologized. there was something racist but the response was complete rejection coast-to-coast. >> people chanting those idiotic stupid chant, do you think they actually believe and have that anywhere their heart? or was it something we can say we're cool or, you know, we're irreverent irreverent, i have no idea. >> all the p.c. stuff perhaps or too much to drink.

city beach? >> well i don't want to pat myself on the back. i'm here to make a big change in panama city beach. there's nothing wrong with spring break. there are a lot of good kids here. but there are about a handful of nightclubs and two large hotels that make millions and millions off the accounts and strife that are going on. the violence and so forth is not good for our community not good for our property values. that has to change. >> what about the parents that want to take kids to the beach and they can't? look what's going on. >> it's a terrible thing back there. you're right. the parents who live here take their kids for spring break elsewhere. >> i feel strongly about spring break. i feel strongly about the reputation that panama city beach is getting. i feel strongly about protecting the residents and small businesses that live in this town that have made it their home. this is not the reputation i want our city to have. we have to do something. it's getting -- it's accelerating every year. it's getting worse and worse and

worse. and like the sheriff said last year we were one beer can away from a riot. and when it happens, what are we going to say then? i think we ought to listen to everything the sheriff tells us. if it takes no drinking on the beach, that's what it's going to take. i think that had we done this this year that they would have been drinking in the club and that would have the club not just the club but the bar's responsibility for keeping the peace. we can handle it once they get off the street. >> do you hear a lot of reaction from your voters, your constituents that say good job, keep going? >> i do. let me put it on record i'm not against spring break. spring break is fine. but this spring break is not spring break. this is a. i can't even liken it to anything. >> what's your message to parents watching? should they allow their kids to come here? >> not during spring break. >> why? >> because it's not safe. the police are doing the best they can, but it's not safe.

>> they're outnumbered. >> they are so outnumbered. and it's so dangerous. >> the party does not end when the sun goes down. for these spring breakers who have been drinking on the beach all day, at night it's time to hit the clubs. what is the worst thing you've ever seen at spring break? >> just when i say that i see something worse. >> really? >> you name it i've seen it. i've been out here 20 something years doing this. and violation of, you know, any human moral you can imagine we've seen out here. >> what have you seen this year that shocked you? >> this year the guns, the amount of guns is getting worse. we've already got a couple today. >> i was expecting you to say like girls taking their clothes off or people urinating on the beach. i was not expecting guns. >> no. >> so we're about to drive up to the beach where all these bars

are. tell us what to expect. walk us there what you're doing when we walk up. >> we put our what we say undercovers on the ground. i've got our takedown people also in the area. we've got some uniforms that are going to stand around to help us. and hopefully we try to bring it all together when our undercovers make a deal or come up on something, they'll call it in to us and then our takedown people come out and deal with it. >> so captain bell what just happened? >> okay, we just made an undercover purchase from the suspect. right now what doing is we have money we know is ours and we gave it to the suspect. so we're looking for our money in their money. >> you've marked it? >> we've marked it and we know the serial numbers. the marking is to quickly locate the money so we're not looking through a bunch of serial numbers. so then when we find our money then we compare the serial numbers. >> so when these guys are

carrying this much cash around, is that evident that they have done other drug deals tonight? >> we bought from this guy last night. we might find money from last night. >> you've got molly off the street drugs off the street is that a difference? >> not even a dent. small drop. >> here with more fox and friends co-host ainsley ere heart. you were there for three drug busts. >> exactly. >> marijuana, molly, do these kids even know what's in that? who manufactures that? >> she says it comes from overseas. and much of these drugs are components of all these other different drugs. she said the last four years she's seen a lot of heroin, but she's seen a lot of synthetic drugs. she said drug dealers are changing mole kuls so when you take a drug test at the police department the drug tests don't pick it up anymore. >> in other words they don't know what they're taking.

>> exactly. >> and these people don't care about the kids. >> very dangerous. >> what about the violence you were talking inging inging about with the deputy with the gun violence? >> she said on that day she'd already arrested several people with guns, and it's very terrifying she said because if there's a riot on the beach someone can easily pull out a gun and it escalates into something very dangerous. >> the one councilwoman that did talk to you. >> josie. >> talked about we're one incident away from a riot. >> one beer bottle. >> and then not listening to the sheriff. now, i spoke to the sheriff. is that true? the sheriff has one plan and they have their plan and they're giving in to the money and the lure of letting the kids drink on the beach? >> she and the sheriff are very tight. and she was one of the councilwomen that decided to talk to us. we did get a phone call from a councilman today and i spoke to him on the phone, his name is john reachcurt. he thinks everything is a lot better than what josie is painting it out to be and what
