those notes don't have to disclose the illness. it can just say he is sick this afternoon. it could have no evidence that he is suffering from anxiety or something. but six years ago in flight school he was found ultimately not suitable for flying and former classmates were told stories for him timing time off for burnout syndrome. >> so he trained here in phoenix, arizona. and the big question here is what is it like here in the united states? well a captain with the u.s. airline was asked this and he said there is no mental health vetting. if you had a mental health issue, you certainly would not tell your flight surgeon because it would go straight to the faa.

here is debate is our contributors. jenna, i'm going to start with you. yes the woman may be facing felony charges, but there is a big difference between felony and murder charges. >> that's right the prosecutors want to throw the book at this woman but unfortunately the book does not include murder. in colorado, one of 12 states, they don't consider the killing of a fetus murder spop if she was only charged with the unlawful killing of a fetus, the maximum charge would be for 32 years. in california you could face the death penalty. a huge difference there. >> tamron, you say this is a legal issue, not a political issue like some are making it? >> yes, and a lot of people believe that abortion is wrong and bad, and i get that. and there are personhood issues here that did not pass muster with the voters.

i understand those things. as your other guest said the fact is that the law on the looks right now does not say that a fetus that does not breathe one single breath of air is a person and therefore they cannot have murder charges. and prosecutors made the right decision. as terrible as it is he made the right decision because he knew if he took the case to a jury the defense attorneys would say there was not one single breath by the innocent baby. >> there are laws on the books, but should they be changed? >> you know is really a tough call. when you look at this particular case of course you think the laws should be changed. a seven-month old fetus can survive outside of the mother's woman in certain circumstances. we don't anticipate a crazy lunatic is going to try to cut

out a baby under the ruse of i'm going to try to tell you baby clothes on the internet. but every other state, 38 states, say it is murder if you kill a fetus especially after it is viable. should the laws change? absolutely. if they change now this woman will not come under them because they're not retro active. >> the shortest and longest period of time this woman could be behind bars? >> the minimum would be not guilty to all charges. that's not going to happen. she is also charged but attempted murder. the mother of the baby survived this tragic incident up to 100 years in prison, and we'll see also what happens if she is found incompetent, insane, or any other those defenses. but again i want to stress the

with 150 people on board. >> amy kellogg is tracking it all for us this morning in france with more on the secrets he was keeping. good morning, amy. >> reporter: hi clayton, tucker and anna. as we piece together bits of information about andreas lubitz's life one thing that has come up in the last 24 hours and resonates a lot with the local population is that andreas lubitz trained here for his gliders license, and he used to come to this area for many years as early as the age of 9. he came with his parents. according to one friend who has been quoted in print, loved the alps to the point of being obsessed with the alps. and now to the issue of his mental well-being there are reports now that there were two different doctors who signed off on those sick notes excusing him from work the day of the crash. no confirmation it was two doctors but an ex girlfriend interviewed in the german press said he did disclose to her he

was receiving psychiatric treatment. and, of course germanwings has said that it was unaware of these issues. these medical issues which now we presume are mental health issues. and this will be quite important when the dust settles a bit when the period of grieving and mourning and shock kind of sinks more into the background of this story. the issue of liability. lufthansa has said it will abide with all international regulations, but they could be up for unlimited liability in this case, because if it is proven ultimately and it seems quite likely that will be the case, that this was caused by a human, that this was not a natural disaster, it could be a very big sum for them to pay out. clayton, tucker and anna? >> right. thank you so much, amy, reporting live this morning in france. we should mention germanwings has offered up to $54,000 right now per person on that flight for the remaining families. but we're also learning some chilling details elaborating on what amy was just talking about. >> that's right.

in the final days before the crash the fatal crash, this co pilot andreas lubitz apparently had told his girlfriend, i'm planning a heinous attack that will be remembered forever. he said he wanted to do something that would change the entire system. she also said that, according to a german newspaper there, that he would wake up in these fits during nightmares, saying things like the plane is going down, or we're all going down. >> lubitz was apparently profoundly mentally ill and under a doctor's care for mental illness for over a decade. he took a leave from flight training to deal with his mental illness. we don't know details, though because german privacy laws have prevented his doctors from speaking out about the details of his condition even after his death. they apply posthumously. all of this raises the question, is the united states properly protected against the possibility of a mentally ill pilot at the controls? >> captain john gad zin ski, u.s. airline, he says this

there's really no mental health vetting in the united states. if you have a mental health issue you certainly wouldn't tell your flight surgeon about it. because it goes right to the faa. you would be worried about losing your job. the doctor talks about this, hippa laws can really hamstring some doctors if they know that someone is dangerous, it's a real tight rope they have to walk. take a listen. >> clearly, the doctors are under the pressure of obeying h.i.p.p.a. rule, privacy of the doctor and patient. but those responsible for many lives, if that person is suffering from severe depression or anxiety i think they should be in negotiation between this h.i.p.p.a. rule and saving the lives of other people. if i say to the doctor that somebody could endanger other people as a result of their psychological issues, perhaps we can break that rule and save more lives. that's a big debate and ethical issue that should come up and be up for discussion. >> so when we hear reports that

there were not one but two doctors notes that were torn up by andreas lubitz that would have made him unfit to fly, you wonder why it wasn't in place, the protocol of some sort, where the doctor would have to tell the airline tell the employer, not just leave it up to andreas lubitz, to self-report. >> and you wonder why the doctor wasn't moved by his own conscience to do that. somewhere along the way, the mentally ill became a protected class in america and western europe, and we're all for privacy, and nobody is for attaching a stigma to anybody else. on the other hand, if a person's mental illness puts the rest of us at risk whether a homeless schizophrenic or pilot we have to put our safety first. >> especially when lufthansa six years ago in phoenix when training labeled him not suitable for flying. and former classmates would say he would take himself out of rotation for flying, because he had burnout syndrome. he was burned out on a regular basis. so his friends knew about it his family knew about it, the only people who didn't know about it were his employer

apparently. >> and at one time we were questioning, is this terrorism. is this something that is islamic terrorism. after 9/11 everybody thinks about that as soon as there is a crash. if everybody worries about flight security period we wanted to take a look at a tsa checklist on whether -- how they screen us for where we are psychologically. and to many it seems completely ridiculous if we can put those on the screen for you. signs you might be a terrorist. exaggerated yawning excessive complaints about the screening process. whistling as you approach the screening process. gazing down, wringing of hands. >> so if it's a 6:00 a.m. flight and you're excessively yawning the tsa may look at you unfavorably and consider you a terrorist. >> or if you dare to complain about having some stranger feel you up in public. my favorite is pale face from recent shaving of beard. how about matted hair from recent removing of turban or

the germanwings crash has raised a lot of questions about airline safety. technology that may have prevented the tragedy is out there. but it's pretty controversial. it allows airlines to take control of the plane from the ground. so would that help or hurt? joining us now is justin green aviation attorney and president of the international air and transportation safety bar association and a licensed pilot. used to fly helicopters. >> yeah. >> nice to see you this morning justin. welcome to the show. >> thank you. >> would this technology, airlines delta and others, could grab hold of an aircraft? >> the manufacturers are basically coming up with something that would prevent terrorists from taking over an airplane or in the case like this, murderous pilot from taking over an airplane and automatically fly the airplane to a landing and land the

airplane. it seems obvious. in an age of drones, with the reduction of the amount of pilots, even the air force is using now and switching to drone pilots. it seems kind of obvious. >> well it is obvious. and the technology -- people have to understand in 1903, that's when the wright brothers first flew a flight. and now that the growth of aviation, the technology over the last ten years has been breath-taking, and since 9/11, the need for something to safeguard airplanes from being taken over and used as weapons or used for murder is -- has been a really impressive attention. >> why are we using? what's controversial about it? >> one thing, it's like aviation designers are like doctors. you do no harm. so you don't want to come up with a fix that addresses one problem but creates a worse problem. so people are concerned that hey, what if a terrorist group can hack a single and take over an airplane. but the designers are actually thinking of all these issues.

they're going to be cutting out the pilots from actually counter measuring the system. it's going to be hack-proof. but it's a very complicated system. and when people say the technology is there, they really mean that the technology is in the growth stages, and it would be 10, 15 years before it's actually deployed. >> it's interesting, when you think about the drone pilots sitting out in a an air-conditioned space out in one of those storage containers toward them, out in the middle of the desert, controlling what's going on in afghanistan. we can can do it. even your job as a former helicopter pilot, you said now controlled by drones. >> it's a huge huge change. when i started flying drones were really small issue. now it's the hottest issue and it's going to be really not just military, but in civilian use, as well. >> before you go i want to ask you about the mental illness side of this. and, of course, this was kept from his employer, they weren't allowed to know about it. the notes from the doctors weren't -- dent say anything

about anxiety, depression, just a sick day. what do you think should happen? should this be something that laws are loosened to allow for doctors to report this information? >> this is a huge, huge problem. because pilots are like athletes. if they have a problem with -- physical problem or mental problem, they may be out of a job. and so there's very big incentives for pilots not to report problems. and so you really have to talk about screening and how they're going to effectively screen pilots and make sure someone is not getting into the cockpit who has a psychological condition that's dangerous to the passengers. >> so could come down to screening. great point. justin green, we appreciate you joining us this morning with your expertise. >> thank you. a 7-year-old girl sent home from school with a note that said her body mass index was too high. now she's questioning whether she's fat. she'll join us live along with her outraged mom, next.

saw a wave swing wide and come in. i knew we weren't going to make it around it. typically in a potential maritime disaster it's the best idea to stay with the boat. i really didn't feel like getting smashed around like an ice cube if a shaker. i looked at my friends to the left and right of me and told them, i'm jumping. i just tried to distance myself. >> when we first saw the video we thought you were thrown, not you jumped. once you hit the water how did you get back in? was that a dangerous situation? were you all right? >> well, that was the biggest swell of the year for the west coast of california. whenever we go surf these big waves, we were riding waves much bigger than that during the days. we have a team of safety guys we are close with. they are on jet skis to rescue people. all those guys are right there. they picked me up immediately. i knew they would be there. >> that's unbelievable. what happened to the boat?

did it capsize? >> no. it actually didn't. it's a well-made trawler. it's built to take hits every now and then. it pulled it off. if that wave would have went wider, it could have been worse. >> unbelievable. what about the friends on the other side of the boat? what did they think when you jumped in? >> my friends on the jet skis who picked me up were crying laughing at me. i came up dying laughing. i checked to make sure everybody was okay on the boat. there's some damage equipment some cameras, but everybody was pretty much in good safe. >> this surfing award show coming up in may. this video is up for that. i never heard of it the xl big wave awards. are you hoping you win or not? >> i don't know. believe it or not, i've won a couple of wipe out awards in my lifetime. this event -- we'll see what happens. it probably won't go up on the mantle place, but might make it to the garage.

>> what's the biggest swell you ever successfully surfed? >> biggest waves i've ridden with assistance of a jet ski probably around 70 feet. >> what happens if you eat it coming down the face of a wave like that? >> you know that's an interesting thing. it's chaotic. you'll never have the same experience twice. if somebody is ten feet next to you, they might have a completely different experience. you can go down on a horrendous one and pop back up and another one half as big and life threatening. it's going to be violent, somewhat unpleasant and claustrophobic. >> it looks awful. >> i got pulled over by a four-foot wave and that was traumatic. glad you're safe and sound. good luck on the big wave award and see if you can win this one for being thrown off the boat. >> you're a brave man and lucky
