>> we'll see you back here in one hour. >> "outnumbered" starts right now. >> a fox news alert as we await a verdict in the boston marathon bombing trial. jury deliberations are resuming for a second day and lawyers for tsarnaev made clear from the trial's outset that they are focused on keeping him from facing the death penalty as they admitted from the get-go that he did it. but that he was under the sway of his radicalized older brother who they claim was the mastermind. if convicted the same jury will decide whether tsarnaev gets death or life in prison. three people were killed and more than 260 were injured when twin pressure cooker bombs exploded near the marathon

age. nobody is going to disagree around me. >> keep it coming. this is lovely. we're usually in good moods but today i was specifically psyched to have you on the couch. >> so you could kick my butt. >> nope. nope. we'll see. all right. a police officer in south carolina now charged with murder for shooting an unarmed black man during a routine traffic stop. the incident captured on video. the images you may find disturbing. authorities are saying walter scott was shot eight times after he had already been hit with a stun gun. north charleston police officer you see him here being held without bond he faces 30 years to life or the death penalty if convicted. the officer's former attorney had said that slager felt threatened when scott tried to grab his stun gun. that attorney quit the case

after the video surfaced yesterday. the deadly police shooting comes amid the ongoing issues of trust between law enforcement and minority communities after such prominent deaths as those of michael brown in ferguson and eric garner in new york city. senior national correspondent john roberts joins us live from north charleston south carolina. john? >> good afternoon to you. the protestors will be back here at the north charleston city hall about 12:30 today. protests, demonstrations they had this morning were all very very peaceful calling an end to police action saying there's far too many incidents that go on. when you take a look at the videotape, in this particular case at least they make a salient point. it's about 9:30 saturday morning in north charleston. walter scott is pulled over for a traffic violation. he had a broken taillight. scott apparently tried to flee according to his brother. he had some delinquent child

support payments didn't want to go to jail for that after being pulled over for a traffic violation. slager tried to hit him with hiswatch what happened immediately after that. sleger fires eight shots, five of which hit walter scott. he died soon after that. slager was arraigned on murder charges. family of walter scott obviously grieving but according to their attorney, taking some solace in the idea that the wheels of justice are turning here in charleston. >> it brought a short sense of relief and joy that the distance we have to travel to try to get justice was beginning. and that for the first time in a long time an officer was going to be charged when something like this happens. >> what's remarkable is that the whole scene was captured on

camera. while we don't see what led to the confrontation, it's obvious that scott was running from the police officer and was shot in the back. north charleston mayor said that the video is crucial to the case. >> the video is very demonstrative of exactly what happened. without the video and that was the only witness there was, actually, it would be difficult to ascertain exactly what did occur. >> so what do we know about 33-year-old officer michael slager? he's been on the north charleston police force for five years, had a couple of complaints according to the charleston post lodged against him in that time. one was for excessive use of force in 2013. apparently he according to the witness, he tasered a guy and then threw him to the ground.

however, he was cleared of any wrongdoing in that case. we also know that he was with the coast guard prior to that. andrea, we're running tracks and we're finding out whether or not there were any disciplinary actions lodged against him in the military >> thank you. arthur, i want to go to you first on this. the video, very jarring. last night we showed the full video, of course there was the disclaimer that this was you know pretty harsh stuff to watch because you actually saw him go down. many and he was running away from the police officer. now, the police officer who has been charged with murder said that he felt threatened but as you see, he's running from the officer. i would love to get your thoughts on this case. >> well when i first watched the video and i watched it over and over and over again, nothing to say except it's extremely disturbing. we're watching a human being kill another human being. my initial reaction when i hear about him facing 30 years is one

thing. when i hear about him facing the death penalty it's something else. i don't believe that a police officer should face the death penalty under these circumstances because you cannot put him in the same category as the boston bomber who woke up that day the boston marathon bomber, who woke up that day with the intent of killing a lot of people. you can't put him in the aaron hernandez, if he gets convicted much someone who has an illegal gun doing illegal things and killing, premeditated murder. >> why? >> why this is not premeditated? >> it's not fast enough. you're talking about people who have guns going in a car to a location to either rob someone or -- and the alternative kill them. that's premeditation. when you're creating bombs to take to the marathon to blow them up these premeditation. here you have an officer who is acting -- you know, he's wrong. i'm sure he'll admit he's wrong.

it's horrible judgment. i don't possess the vocabulary to say how wrong this is. >> there's talk that the cop may have picked up a taser. >> i should say i saw that. i saw that. >> he put it by the body. doesn't that speak to me meditation? >> no. but that's pretty bad, right? >> the legal term would be a consciousness of guilt. he knows that he did something he shouldn't have. that's why he goes and picks up the taser from the original location and puts it next to the body and there were plenty of -- i'm not proud of this but there were plenty of police officers in the country, in the 1970's and 1980's who were prosecuted for corruption who used to keep an extra gun on their leg so if they kill someone, they would take the extra gun and lay it next to the body and say they were coming after me first so i had to kill them. >> what about the history of excessive force? this officer? how big of a factor does that play in this case? >> it shouldn't play any because we live in a country where when

you're exonerated, that's not supposed to count against you. it's not on your criminal record. from a legal point of view, it shouldn't play any role whatsoever. from a realistic point of view it will play a minimal role. this is new information you just gave me. i didn't realize there was no other witness. the only witness is the person who made this video. >> the cop comes walking up though another cop. >> okay. but it's a cop. what they're saying the only eyewitness -- there is no other independent eyewitness besides the person who used the camera. >> doesn't that speak to having body cameras on cops? had this good samaritan not taken this video and turned it over, we wouldn't know. this cop would be walking free today. it would be another situation where people have different stories and nobody knows. >> i think the police commissioner bratdone -- bratton in new york thinks it will help the police more than hurt z.

he's charged with murder but there's a difference between first degree murder and second degree. second degree you can't get the death penalty. first degree you wake up it's intentional. second degree, you did it. you're still charged with murder but it wasn't premeditated. it's still intentional but not premeditated. >> if i'm the prosecutor i'm not electing for the death penalty in this case. 30-year sentence in jail is pretty -- >> second degree murder or first? >> initially he's being charged with capital murder. that's death penalty murder. >> i want to sku, too, arthur this seems a bit excessive. >> a bit. >> whatever happened to shoot to wound? he could have hit him in the leg and stopped him. this seems so over the top. >> so my understanding is in the police department, you're taught to shoot to kill. i agree with you. and you have a person who is running away and another piece of evidence that's come out

are the damages caused by the president to fraternity? >> i will tell you. judge napolitano was very specific on "the kelly file" monday night this is what caught my attention. he said her going after the entire greek system with no proof. what happened after that, arthur there were protests outside of that fraternity house. there was vandalism. they were destroying property. all of sudden this fraternity phi kappa psi. has not reputational issues they're known as the rape fraternity. they have a branding issue. these boys were maligned. they were character assassinated. the fraternity president or university president has no recourse. the judge was very specific. he said, what she did was just as bad as what "rolling stone" did. >> i almost always agree with judge napolitano and i do.
