love to have your regards, eric. >> that's it for us. see you tomorrow. the carrot and the stick. as the u.s. tries to coax iran into a nuclear weapons deal, u.s. warships are there and what are they authorized to do? this is "special report." good evening and welcome to washington. i'm bret baier. american diplomats are preparing to resume work on a nuclear deal with iran to try to delay the ability to build a nuclear weapon. this as american naval vessels are keeping a close eye on iranian ships, which may be trying to add more weapons to the mix in the chaotic houthi

rebels. the u.s. is under strict orders of what they can not do. we have an eye-opening look at the iran nuclear timeline and how the u.s. has adjusted the assessment of how long it would take iran to get a bomb. we begin with jennifer griffin at the pentagon. >> fox news has learned that the white house is not even close to making a decision about conducting a search of the iranian vessels carrying arms to the houthis. the atmosphere at sea remains tense off the coast of yemen on this high stakes game of brinkmanship. nuclear negotiations resume as the military standoff between the u.s. and iranian warships in the waters off yemen serve as a backdrop. the saudis announced they are

ending their air strikes in yemen for now perhaps in response to president rouhani's plea. >> translator: we hope a proposal is realized for an immediate cease-fire. >> there's an opportunity for us to effect a political transition in yemen. >> reporter: meanwhile, the "uss theodore" is now shadowing the nine ships in the iranian convoy in launching aircraft including f-18 hornets to fireman reconnaissance near the iranian ships. >> what we just did was push all of the chips into the center of the table. now, if the iranians are dumb enough to call that, then we have to act on the hand because we have the winning hand. >> reporter: the state department tried to downplay

u.s. intentions. >> i think there was a lot of misreporting, a lot of cable tickers today ships going there to intercept iranian ship. that is blatantly untrue. so this discrete movement of u.s. access is for a discrete purpose. >> reporter: nine u.s. navy warships and three support ships are now operating in the area stretching from the southern red sea to the arabian sea and are enforcing a u.s. embargo against yemen last week. they deny that their convoy contains weapons. >> the king of saudi arabia announced, quote the military objectives of operation deceptive storm have been achieved in yemen. houthi leaders say a political deal has almost been reached but the iranian convoy is steaming towards yemen and towards u.s. warships. bret? >> thank you. president obama's public position for much of his administration that iran was a year away from having the

ability to build a nuclear bomb is being called into question tonight. cropped kevin corke looks at new information about what the president apparently knew all along. >> reporter: the doubt between what the white house says about the nuclear capability is significant and the public tone about tehran's program became more urge jebtnt leading up to the p5+1 negotiations. bloomberg reported this week that the u.s. had believed for that iran was two to three months away from having the material to create a nuclear weapon. opposition stated by the president himself on april 2nd the day the nuclear framework was announced. >> today estimates indicate that iran is only two or three months away from potentially acquiring the raw materials that could be used for a single nuclear bomb. >> reporter: but that didn't seem to square with what the administration said about iran's

nuclear capability as far back as 2010. quoted in "the new york times" as saying, "we think that they have roughly a year dash time" and an idea repeatedly challenged by benjamin netanyahu who, in 2012 suggested the regime was much closer than that to a nuclear threshold. >> so only a few months, possibly a few weeks before they get enough enriched uranium for the first bomb. >> reporter: but the president insisted that iran was still a long way off. >> our assessment continues to be a year or more away and in fact, our estimate is probably more conservative than the estimates of israeli intelligence services. >> reporter: then, in 2014 a major shift in language and emphasis. gone were expressions like a year or more away. instead, administration officials began using words like months away. the difference, emphasis on the amount of time it would take to

acquire materials for a nuclear weapon instead of how long it might take to create one. listen to secretary of state john kerry in april 2014 nearly a year before the framework was announced. >> i think it's fair to say that i think it's public knowledge today that we're operating with a time period for a so-called breakout of about two months. >> reporter: a plan carried forward into this year by the president. >> well, currently the breakout times are only two to three months by our intelligence estimates. >> reporter: the administration made a political calculation and changed the way it framed the iran nuclear timeline in order to make the case for its iran deal to congress and the public. >> once the negotiations with iran started and a nuclear deal started to emerge, i think it had an interest in reducing that timeframe to suggest that the nuclear deal was a good deal and that would help sell the deal. and i think in that respect it's

similar to a used car salesman turning back an odometer on a car. >> reporter: asked about the discrepancy between 2013 and 2015 white house press secretary eric schultz said there are separate assessments for the amount of time it would take iran to acquire enough fissile material versus how long it would take to weapon upon niz. he is clearly talking about the time to develop a weapon and not acquire the material for one." >> reporter: it is a i agreed that it could only be a couple of months before iran could have the materials to create a bomb but it's the prime minister who continues to i can ma the argument that they could go all the way to weapon uponizing a bomb in less than a year. >> kevin corke thank you.

catherine herridge reports. >> reporter: the chinese government may not be satisfied to steal american secrets in cyberspace. this november 2014 fbi affidavit shows the investigation of a state department contractor for her admitted contact with individuals she believed were chinese intelligence officers. it says the interpreter was paid, quote thousands of dollars to provide information on u.s. persons and a u.s. government employee. >> from 1999 -- >> reporter: the state department confirms that this woman translating here on capitol hill worked with the office of language services over a four-year period beginning in june 2010. >> she was an employee of the contract interpreter until february 2014 and not employed here anymore. for any additional questions on this, i'd refer you to the fbi. >> the fbi is referring us back to the state, though. >> reporter: the documents were

filed to agents could search this storage unit in suburban washington and the translator lived rent-free with a state department employee who held a top secret clearance and high-security embassies including this compound in islamabad, pakistan. another citizens told the fbi he was interrogated by the intelligence officers during a trip to tibet and a member of his family was thrown into prison. the u.s. attorney's office in washington oversaw the case and recently declined to prosecute and offered no further comments. a former justice department official says the decision is perplexing. >> it's not clear to me, based on the court files that were unsealed, how a prosecution of this person could have compromised u.s. intelligence gathering. if it jeopardizes or threatens to disrupt relations with another country, so be it. this activity will not be tolerated. >> but the documents don't fully explain her side of the story.

the justice department has opened a federal investigation after a man died of spinal injuries he suffered after an arrest in baltimore. we told you about that last night. right now, hundreds of people are marching in baltimore holding a vigil. freddie gray was rushed to the hospital after about 30 minutes being arrested on april 12th. he was taken into custody after police made, quote, eye contact with him and another man in the area known for drug activity. he died sunday. again, protests ongoing in baltimore. we'll bring you the latest as we get it. the head of the drug enforcement agency, the drug enforcement administration rather, the dea, is retiring in coming weeks.

michelle lenhart testified last week about allegations that dea agents attended sex parties with prostitutes paid for by colombian drug cartels. hillary clinton continues her outreach to the first in the nation primary voters of new hampshirire. but her sights and those of her campaign and supporters appear centered directly on the author of a new book alleging financial impropriety involving her foundation and her husband. chief white house correspondent ed henry has that story from the white house tonight. >> reporter: hillary clinton would not take questions from reporters today about specific allegations that she did favors for foreign donors for the clinton foundation, stealing a page from her husband's playbook by again saying she's focused on voters and the new book "clinton cash" is merely a distraction.

democrat on democrat violence tonight at least in the rhetorical sense at least when it comes to politics. it involves giving president obama fast-track authority on a new trade agreement. mike emanuel tells us what has the democrats at other's throats. >> reporter: after announcing a bipartisan agreement on fast-track trade promotion for president obama democrats are split with the senate democrat

leader being the most vocal. >> they are not good for working men and women and puts us at a disadvantage so the answer is not only no but hell no. >> reporter: the deal was struck between orrin hatch house ways and means chairman paul ryan and oregon democrat ron wyden. it would give the president authority for a pacific trade deal. >> i would not be doing this trade deal if i did not think it was good for the middle class. and when you hear folks make a lot of suggestions about how bad this trade deal is when you dig into the facts, they are wrong. >> reporter: hatch took on attacks from critics who say he's moving too quickly from the trade deal, pointing out lawmakers know where they stand on trade. >> i stated that u.s. trade with foreign countries is a good thing and i said that the tpa is the best tool congress has in its arsenal to help influence

russia. president obama was in a word, flabbergasted. an official at the meeting told buzzfeed, quote our reaction was, you've got to be kidding. seagal told the moscow times in 2013 that putin was one of the world's great leaders. finally, a journey comes to an end. a dog tag lost on a massachusetts beach has been returned 70 years later to the family of the soldier. a metal detector operator found the tag after a storm and tracked down the owner's family. with the help of purple hearts reunited, an organization dedicated to returning lost or stolen metals. there's a report tonight that jeb bush will use a cutting-edge strategy in his presidential campaign delegating many of the nuts and bolts tasks to a separate

organization that can raise unlimited funds. of course, that is all predicated on the notion that bush will actually run. senior national correspondent john roberts tonight on what is taking so long. >> reporter: at every step along the undeclared campaign trail, jeb bush is quick to remind people he is not a candidate. >> i'm not a candidate. >> what are you going to do? >> i don't know yet. >> reporter: part of the reason, say supporters, is campaign finance rules. bush can't keep raising unrestricted millions for his pacs if he declares and it allows him to run a powerful campaign organization. former chairman of the south carolina republican party and a bush loyalist says jeb's exploratory committee is the best he's ever seen. >> nothing has been spared in building this foundation. it's incredible and it's nationwide. >> reporter: despite the perceived delay in delayering for president, push's supporters are 100% certain he will jump

in. >> i think is he right on track. in my mind, i have no doubt that he's going to pull the trigger pretty soon. >> reporter: while no numbers have been released, his financial organization is described as broad and deep and even includes some silicon valley heavyweights who previously supported president obama. >> it would be nice to get some checks from those people as well but victory is impossible for the republicans unless they get some people who said, you know what, i gave the young man from illinois a chance and either after one or two times to vote for him i soured on him. >> with ted cruz, rand paul and marco rubio already in and others getting set to jump how soon might bush declare? a summit of supporters at bush's miami home is seen as a final piece of the puzzle before an announcement. >> they are having a big conference next week and my guess is that at that point you're going to be able to see sort of a countdown to an announcement in the not so distant future. there's been talk about how much of the campaign operation will

be outsourced to bush's pacs but that bush's actual campaign will take the lead. they say his campaign organization is in a much better position to fund without outsourcing than many other candidates will be. bret? >> john, thank you. two major public health issues tonight. millions of chickens and turkeys in iowa will be killed in order to maintain the bird flu there. there's a recall of a popular ice cream for a potentially deadly bacteria. gary is live. hi gary. >> reporter: this is the worst single incident and doesn't appear to be slowing down. one of the largest farms is forced to kill nearly 4 million hens after the highly infectious and deadly bird flu confirmed at sunrise farms. that farm alone is responsible for nearly 10% of the state's egg-laying hens and joins the

dozens of other farms in 13 stays that have already been hit. the usda estimates tt the vir virus has killed 6.5 million chickens and turkeys in the last month alone. it's expected to impact how much turkey is available at the market and what you will pay for it. there are reports that china has banned the imports of poultry from iowa as well. on the dessert side blue bell ice cream one of the nation's most popular ice cream brands, is now recalling all of its products. more than 8 million gallons of ice cream. that's after discovering the potentially deadly bacteria listeria in several samples. the company had already recalled several product lines after the cdc linked a string of deaths and illnesses to the ice cream. >> we feel like it's the right thing to do for the customer

about how close they are. >> whether it's precise or not, you have an obligation to be honest about what your estimate is and it's the lying about the estimate that is at issue right here. >> okay. as long as we agree it's a guess. >> the bottom line here is, the administration now has settled on this two to three months. >> yep. >> and they say this deal is the way that the -- delay at least, iran getting a nuclear weapon. israel is saying, that's not good enough. >> no. israel would rather live within iran that is two to three months away from a bomb but has crippling sanctions on it. the white house would rather live with an iran that is stronger economically, could cause a lot more problems in it it and if it could stretch the breakout time. that's the difference. the president really believes if you bring iran in and lift the sanctions, maybe the regime will change. that's a very big bet. >> he probably also believes and maybe doesn't say it publicly that iran will eventually get a

nuclear weapon at ten years 12 years 15 years and he's just delaying it. >> if that happens, saudi arabia will, too and turkey. >> just to understand the position policy makers are in, do the same intelligent agencies know that we are within two or three months are they going to know when they start to close that gap and go to two months or two weeks? >> how will we know when they rush to daylight or rush to breakout? >> we have a pristine record of being wrong. and if you don't know precisely then you do the only thing that could possibly delay them from achieving their weapon which is crippling sanctions in an atmosphere where they have already lost half their revenue from oil because of the oil price. >> and russia already abandoned it. >> russia has abandoned -- >> the sanctions regime. >> no it hasn't. it has agreed to supply them

with missiles. you apply what you can apply and continue the sabotage which clearly helped back over these years and you deploy the credible use of force if not american, then you let them know that you would approve. obama has done precisely the opposite. he's removed all of the incentives that iran has to hold back. >> nice work. >> in 2007, the u.s. intelligence agency said iran had abandoned its nuclear weapons program and in 2013 president obama said we had halted their program. neither was true. >> you can see, two to three months is much different than a year if you're making public pronouncements about what your assessments are privately? >> yes. stipulating confidence in the intelligence estimate that can distinguish between three months and 12 so nine months difference. what is happening with american naval ships in yemen

is exactly under the same rationale to ensure against piracy. there's one issue in yemen. iran is extending and announcing over yemen and that's a huge expansion of its claims of influence in the region because it is not in any way adjacent with iran. it is adjacent to saudi arabia and it is a threat to all of our sunni allies. so it's doing this with a show of force. the eight houthis. remember, the iranians were supplying the houthis by air but the saudis are now interjecting that so the houthis are probably low on weapons and this is a test. that's why we have the u.n. resolution. that's why we have a carrier in the region and if it's just going to stand and allow the
