tonight. in new york our coverage continues live throughout the night. megyn kelly and her team will be here seconds from now. sean hannity will be here 1:00 eastern time and we'll continue throughout. from the news desk good night. >> and breaking tonight, baltimore is burning. rioters try to destroy the city a destruction that seems to be without purpose. there are serious questions about whether this violence could have been prevented at least in part. after the mayor imposed a curfew that does not begin until tomorrow. welcome to the kelly file. we're live tonight, folks. scenes looked like something out of a war zone. people fanning flames that stretch across city streets.
9:01 pm
others have seen cars presumably stolen. and others see frustration after the death of freddie gray the 23-year-old who died from injuries believed to be sustained while in police custody there are real questions about what is being accomplished by the lawlessness we're seeing tonight. rick levnithal is live with more. rick what can you tell us? >> we're at the corner of fulton and rigs. you can see the police have set up care bayeds and they're own lines. there are cars burning. we came under attack from locals who are throwing bottles at us chasing it down the street.
9:02 pm
and in these situations we want to be there to report on what's happening. in this situation they didn't want us here. one police officer told us to with careful. there are many parts that are quiet tonight. this is in a lot of trouble tonight. we have not seen national guard troops yet. state police have been activated. police are standing their ground ground tonight. >> we just heard a press conference from the mayor and police captain saying calm is on the way.
9:03 pm
there are a couple fires. yet, when looking at reporter live shots, rick we don't see a lot of calm. from what you're seeing what is the truth on the streets? >> there is calm in the city. there have been other attacks on media. i have spoken to a cameraman friend of mine he got out of the car to get video. he said he got beaten on the head and someone took his camera. they got the camera back. some other colleagues have had rocks thrown at them and been chased out of areas. >> is there an explanation as you have heard it for why the
9:04 pm
police appear to be standing down in video we have seen? yet, authorities came to the cameras not long ago and said this is the situation there? >> well these officers here aren't authorized to talk to us. what we've seen is police standing their ground. we've been trying to get from one point to another because of road blocks. so we see them keeping people out of dangerous areas but inside, there has been lawlessness. >> you can see that. and there is a request made to the state, the governor for
9:05 pm
help. whether they should have been more prepared to handle this given what we have seen unfolding so far, mayor and state officials seem to be presenting a united front. and there is sure to be some finger pointing there. >> it sounded like he was frustrated the mayor hadn't reached out to him. he said they're trying to get in touch with the mayor. he said it takes time to get them staged and so there is a delay. >> she didn't do it. as rick is speaking these

9:08 pm
members of your industry decided to mischaracterize my words and try to use it as a way to say we're inciting violence. there is no such thing. >> her words stand. viewers have to listen with their own ears. >> when you listen to words, it's very clear she said that and was trying to give these pro testers-rioters a chance to blow off steam and stop. it didn't happen. but she is so far over her head when it comes to leadership. she is not taking any leadership role in this city and i'd just like to bring up one thing here. freedom to assemble does not mean you stop traffic and stop

9:12 pm
she said it. she's got to own it. that is not a miscalculation. she said it. i'm allowing people the space to destroy. that means do you not understand the english language? >> i understand english language i'm only saying the point i'm trying to make here mark. is that there is no mayor in the world that is the best way that, would want people to destroy the city they're in charge of. so it's bafoonery. >> i think the question is whether out of a desire to be politically correct, to bend over backwards to let these protestors have their say, not understanding the risks of what i mean, it's not like we haven't seen this. it's not like we didn't see recently what can happen in protests that go wrong.
9:13 pm
she knew we all knew we'd just seen this. so did she have a responsibility to follow the rudy giuliani rule? the first rock that is thrown you're done and arrested you send a message to everybody else. that will not be tolerated. . >> i want to make a distinction here. there is a big distinction from peaceful protestors today. people protesting were not throwing rocks and between the two, where you get to this you know headlines saying protestors are rioting. rioters are rioting. thugs are looting. >> unfortunately, when you sign up to go on these protest mars you don't always get only boy scouts >> well that is true. listen, richard is correct.

the police officer he would be arrested immediately. we have not had one arrest. no matter what anybody wants to say, fact is that he his vertebrae wasn't broken l being shackled by police and into custody of police they made a mistake and someone should go to jail for it. >> but richard they may. they may. >> he was shackled when the vertebrae was broken. >> you don't know yet. they're investigating. >> exactly. if the opposite way around the person would get arrested. that is what they're saying tonight. >> which you're implying what? that there is a race element here? >> no. that no such thing. i'm saying is that this is the opposite way around. if the police were hit by someone the person would get immediately. >> that is not what you said earlier.
9:17 pm
you said if this were black men who had done this to a white man, there would have -- >> you said that before our 9:00 show. >> megyn we've done this a couple times i think there is a big problem between community and policing. and we've got to resolve it. it requires everybody saying we're going to have a conversation about what is not working. and clearly, all across the country we're seeing this happen week after week. this system we have set up here is not working. >> we you see it -- >> this is -- >> last two incidents we saw, those cops were placed under arrest. and are awaiting trial. that may happen here. there has been no decision not to charge the cops. >> freddie gray is in the ground and buried and we don't have the
