they can donate. their website is southernbaptistchurch.org if you wish to give and help online. southernbaptistchurch.org. thanks for being part of a busy story. here's shep. in baltimore, this is the hour just as school was ending when it all came undone yesterday. there are rumors of another so-called purge, another round of violence. we looked online and found no real evidence of such a plan. of hours, this time the national guard is in place. a curfew is set to take effect and today we have reporters around the city. we'll have complete coverage right here. you'll hear about a link between last night's riot and the violence that rocked ferguson missouri last year. analysts say social media shows that professional protesters may be trying to stir up the crowd. and other major news including a landmark day at the united states supreme court as justices hear arguments on same-sex

marriage. let's get to it. >> good afternoon from the deck. national guard troops from the thousands are patrolling the streets of baltimore now as leaders there promise to keep the peace. police warn they are hearing rumors of a so-called trouble on social media. now, it's been about 24 hours since the rioting first broke out. we've seen some protests in the same areas where violence broke out yesterday evening. so far, the demonstrations appear to be peaceful. crowds have grown through the early afternoon. a live look in baltimore now. baltimore city schools were closed today and a curfew is set to take effect tonight at 10:00. heavily armored cars are lining up to box in protests across the city. the demonstrations come nine days after freddie gray died in police custody.

the officials there say they have not explained how he got hurt or why medical treatment came so slowly. but freddie gray's twin sister says that violence we saw last night is not what her brother would have wanted. >> i don't agree with the violence that they are doing to the city. it's too much. >> in all, police have now arrested more than 200 people. and new today, 20 officers hurt. riders they say burned close to 50 vehicles. still, the distrust between the police and community has a long history. a problem our nation must face. >> i think there are police departments that have to do some soul searching. i think there's communities that have to do some soul searching. but i think we as a court have to do some soul searching.

this is not new. it's been going on for decades. >> the president repeated there's no excuse for violence. he said his thoughts are with those hurt in the riot and the gray family. and now a gang plot to take out officers. in fact a man who says he's a member of the crips gang says he stood guard last night at black-owned businesses to protect them from looting. he says in fact they sent rioters instead to chinese and arab-owned stores. he told "the new york times" that rival gangs are now joining forces and, quote, i rolled over here on a truck and i was the only crip and everybody else was bloods and they didn't do anything to me. we're together in this. we have team fox coverage. rick leventhal but first to

leland vitter. >> reporter: shep we are here at the cvs and the law enforcement -- >> i'm sad to state the obvious, technology is failing us at the moment. they use equipment that works over not satellite but over wi-fi connection and it's a very good one and normally as we were last night, were able to see them moving in and out of the crowds live without being tethered to a satellite truck at the moment that that technology is failing us. our technicians, though are mighty good. they will get it fixed and we'll get back to him immediately. everybody is getting in on the security. there has been a national response team activated. the team has state-of-the-art equipment and the most qualified agents available. as i mentioned, rick leventhal

is in baltimore. >> reporter: we're at the scene of the massive fire that destroyed a $16 million senior center that was being developed here along with 60 units of affordable housing for seniors. the pastor of the church building this place says he believes it's arson. a man was seen running away before it went up in flames. more than 144 cars were torched, some 15 buildings. it was a wild scene as police and firefighters are being attacked with bricks and cinder blocks and bottles. i want to show you what we encountered last night at the corner of north and fulton. there are a couple of cars burning in the intersection and we were there to cover it and locals began throwing bottles at our direction so we had to get out of there pretty quickly.

we can tell you today that 500 national guard troops have been activated. thousands more are on standby. governor larry hogan says he's getting this situation under control. >> criminal activity will not be tolerated. we're going tone sure we're going to bring whatever resources are necessary, whatever assets are necessary as much manpower is necessary to let the citizens of baltimore know that their neighborhoods are going to be safe that they are not going to be in danger and that their property will be protected. >> and baltimore's mayor says this was a dark day for the city shep but it will not define us. >> what are people who live there saying in general, about last night, rick? >> well they are upset but they are also sympathetic. they say they understand the anger that sparked the violent protests. we encountered a fire at a

corner store that was looted and then burned. it's just one block from where freddie gray was taken into custody on april 12th. today that store was boarded up and we spoke to randy howell who has owned the home next to that store for 50 years. >> i believe in protesting can make changes but we don't need to burn down this city to make the changes. >> reporter: your family home here was badly affected? >> yeah. it's all burned out. so i took the hit. my family took the hit and i hope something is done. >> reporter: randy says he's hoping for the best but knows the anger is still here shep. the curfew goes into effect at 10:00 p.m. only people with work or medical emergencies are supposed to be out on the streets and the city hopes that curves the violence. >> rick let's hope so. rick leventhal. i mentioned leland vitter.

the equipment that they use is live google and they've been using it for a few years around here. sometimes it works well and sometimes it doesn't. leland is on the phone with us. how are things there, leland? >> reporter: shep i'm looking at about 50 or 60 riot police lined up here at the cvs that was urn was burned out and we have video of when police moved in to take an arrest. this was shot about 45 minutes ago. there was a lot of pepper spray and then police moved back to their line and a number of protesters lined up to put a buffer between the two groups. the police seem to think something is coming. there's reinforcements that are moving in here and as much as we talked yesterday at the police doing absolutely nothing to stop the looting we were seeing and the other lawlessness, there is

decidedly a new tone to the police action here and you might say there's a new sheriff in town although the national guard is here certainly the sheriff is giving different orders in terms of how things are to be handled and there's enough reinforcements that they can rotate out here the number of people on the riot lines. it's a lot hotter today and it's just about 3:00. this is when school let out and when things kicked off yesterday throughout the afternoon. whether this stays largely peaceful as it has, with bottles or the cinder blocks and looting returns. >> leland what's your sense of things in what's your gut here? >> reporter: the gut says that the teenagers who were home last night watching on television saw all their friends and heard from their friends on social media getting free sneakers and the five finger discount on liquor and leather jackets and jeans that we saw everyone looting and we along with the people at

home watched the police just stand by. so if you're a teenager and you want to create mischief you don't have an incentive to stay home. you have an incentive to say, i can do whatever i want. you heard from the governor and he said yesterday is yesterday and today is today. whether anyone tests this or not, it's hard to tell. it does seem, though that there isn't a huge number of people who are interested in violence. but as we saw, from the video we just showed you, these things kick off very quickly. >> they do. my thought is your gut is wrong. my thought is that today they will have heard from their parents, some of them they will have heard from their neighbors and they will see destruction all around them and they will be reminded of 1968 and they will stay wrong. prove me right, children. and joining me now is neill franklin. i hope he's flat wrong and gets

to eat his words. i hope that isn't true. i hope that cooler heads prevail. do you have a sense of things neill? >> well i hope the same. this is my home city. i grew up in this city about half a mile from where all of this started at mondawmin mall. the resources that we have today with the national guard, maryland state police local police department i think we will prevail. i really do. i think we'll get ahead of this and we'll be able to deal with the small uprising later today. >> sure. the cops have admitted they were not ready yesterday yet they went to mondawmin mall and the kids pushed them back. was that a mistake? was that show of force a mistake yesterday? >> well it really depends on the level of intelligence that they had. there were a couple hundred officers initially deployed there. i was on the scene there and,

you know they had enough officers to form a line a line which would be used for moving the crowd and in a particular direction. however, they didn't have any arrest teams at that time. these students came from everywhere. hundreds of students came from local schools and schools nearby and the police were just overwhelmed. all they could do was stand ground hold the ground that they had until reinforcements arrived. then they were able to make arrests and show that they meant business and able to disperse the crowd at that location. unfortunately, as fluid as this is the crowd then moved five or six blocks south to northern avenue and pennsylvania avenue and fulton avenue where the cvs store was burned out and cars set afire and it's a difficult thing to keep up with when you don't have the resources that you need. >> it's great to talk to you. i hope you'll come back.

great to talk to you. >> absolutely. thank you. just getting word on the orioles. this gives you a sense of perspective here. the orioles were scheduled to play for may 2nd and 3rd in baltimore at camden yards. they've moved that to tampa. the orioles are going to be the home team but they are going to play in tampa. there was a game today and yesterday and it's been postponed. but tomorrow there was supposed to be a game at camden yards against the white sox, the third of the three-game set. they are going to play it at 2:05 in the afternoon, they are going to look the gate and play it to an empty stadium. the public is not welcome. schools will be closed and the orioles will play to an empty park. coming up a look at other accusations of baltimore cops takes suspects on rough rides. freddie gray was not the first to be hurt in a police vehicle. and then the message from baltimore and beyond race

15 minutes past the hour and there's relative calm in baltimore. the city has faced lawsuits in the past over accusations that cops took suspects on rough rides in police vans. of course freddie gray died after police put him in a police van. his family says his spine was nearly severed.

police did not buckle his seat belt but they are investigating whether it was a rough ride. according to one previous lawsuit, baltimore police arrested a man for public urination in 2005. they didn't buckle him and the suspect's spine was dislocated and died two weeks later. the jury sided with the victim's family. and a woman says the cops buckled her in and drove recklessly to the police station. the driver was slamming on the brakes to ram her inside of the vehicle. the officers admitted they did not buckle her in either but deny driving recklessly. again, no verdict yet in that case. today, the president called on the situation in baltimore a -- he called it part of a slow-rolling crisis in our nation while reminding us there

is no excuse for violence. ed henry live at the white house, what is the president saying about his role in all of this ed? >> reporter: shep he really seems to be trying to push this off on local and state officials saying that they are dealing with the crisis on the ground and walk this very fine line of saying look, he cares about the police officers who were injured in baltimore. he wants to make sure they can get back on the job quickly but also chastised other police officers for allegedly mishandling a lot of these cases. not just the one in baltimore. the president at one point saying there's practically one new case of allegations against the police every single week. but when you ask about his role the president said look there's only so much he can do. listen. >> the challenge for us as the federal government is that we don't run these police forces. again, federalized every police force in the country and force them to retrain. but what i can do is start working with them clab

collaboratively so they can begin this process of change themselves. >> reporter: the president is saying that's not going to happen overnight and the nation will have to go through some soul searching. shep? >> he has a new attorney general. this is going to be a big test for her. >> reporter: no doubt. loretta lynch was finally confirmed and sworn in by vice president biden. she was briefing president obama on the situation last night. when you talk about the president's role and attorney general's role the president was saying that this ties into his second term agenda that tied up on capitol hill and was talking about this really as a long-term issue of fatherhood in urban america, other problems like early childhood education. but obviously there are people in baltimore right now who understand the long-term issue but are really hoping the federal government can help the state and local officials deal

like. but this isn't it. this is not going to change what is going on. baltimore, get off the streets. kids go home stay home. you don't have -- you don't have no right to do what you are doing. too many hardworking people built this city. we put this city together. we put this city on our back. we're with you. we know what is going on. we know the problem. we know there was wrong done. we know we're not getting it right. we know all of these answers. but rioting in our streets is wrong. it's dead wrong! >> rioting in our streets is wrong, it's dead wrong! i know. it's ray lewis. got to mention. he went to court for his role in a deadly stabbing. first he faced murder charges but pleaded guilty to obstruction of justice. that's how a lot of us might remember him. but in baltimore, make no mistake, ray lewis is larger than life and says violence is not the answer. maybe they will listen.

we're learning about social media connections between yesterday's riots in baltimore and the protests back in ferguson. a data mining firm tells fox news it looks to them, like so-called professional protesters might be stirring up trouble. what are these data mining companies saying about this situation? >> the data mining firm that asked to remain anonymous because of the government work found between 20 and 50 social media accounts in baltimore that were also tied to the violence in ferguson missouri. while the data is being reviewed it's being described as surprising suggesting professional protesters or even anarchists taking advantage of freddie gray's violence to take advantage of it. this was collected through 6:00 p.m. last night. here's the baltimore county

the first witness said she was due to give birth within days when she went to the midnight showing of "the dark knight" rises with her husband. a gas canister sailed over her head and -- >> it was almost like it was in slow motion as the canister was going over. he appeared in the doorway and i knew something was wrong. >> she escaped the shooting and gave birth a few days later. their son, almost 3 years old now, her husband took a bullet in the head but he also survived. he testified next sitting in his wheelchair. our producer in the courtroom says he still has trouble speaking. prosecutors say 12 people dayed in that shooting and dozens more hurt. the defendant pleaded not guilty by reason of insanity. a cable is harnessing him to the floor in court. a live news press conference from baltimore is next.

there will be a news conference within the next minute. cops have been lining up to manage groups of protesters around the city. huge difference from this time yesterday. that's when we saw the rioters first throwing rocks and bottles and other stuff at police and in some cases we saw police picking up those rocks and whatever and throwing them back at the rioters. amid all of that one woman made her case for mom of the year when she saw her son on television doing some of the rock throwing and that is apparently when she decided to put a stop to this herself. watch. >> [ inaudible ]. >> get over here! did you hear what i said? >> i wish we didn't have to

berm achl n has been speaking to employees, right? >> reporter: that's right. people are deciding on their own right or being told by their employer to stay home today and that as you might imagine, is having a big impact on businesses. we were outside of city hall in baltimore. just to give you a few stories from today around the city hall area at around 9:15 this morning, we went into a breakfast spot. normally at that time they would have 100 customers up to that point. today it was at about 35 to 50. at lunchtime we went to another restaurant and their customer 50% today. as you probably know that curfew goes into effect for tonight and the next week starting from 10:00 until all the way until 5:00 a.m. in the morning. a pizza shop a manager we spoke to said that is his big worry. he said as they go on into the weekend, as they lose hours

after hours and day after day, that, he fears, is going to catch up with them. >> baltimore was the site of some of the worst demonstrations that we've ever seen. >> martin luther king was killed on april 4th 1968. that was a thursday. riots broke out in a number of cities across the u.s. but in baltimore it was mostly peaceful at first but april 6th things became violent and lasted for about a week. you can see from the smouldering buildings how rioters burned liquor stores and corner stores. nearly 6,000 people were arrested in all. officials declared a state of emergency in the city and over the next few days between national guardsmen, army soldiers and state and city

troopers more than 12,000 forces lined the streets in response to the riot. now, to put the damage in perspective, over the course of those few days six people were killed and 700 injured and 1,000 small businesses were destroyed. a baltimore university professor told slate that she's concerned that the aftermath could be similar to what happened after 1968 in terms of more than just a physical destruction. she said quote, the perception of baltimore that outsiders had, that baltimore was a dangerous place, it was a place you'd never want to live that was the effect of the uprisings in 1968. the city's population did drop going down 13% in the decade after the riots. property damage was at $13.5 and in today's economy that would be around $90 million. >> wow. lea gabrielle, thank you so much. we're expecting a news

conference. it was supposed to begin five minutes ago. we'll go back to that. but we'll go back to some of the top stories of the day. a landmark case that could legalize same-sex marriage across the nation is now in the hands of the united states supreme court. justices heard arguments today and in a rare move they released the audio from court today instead of waiting until friday. we'll hear some of that in a moment. the supreme court hearing that outlawed same-sex marriage. the justices will decide and whether the states that ban same-sex marriages have to ban same-sex marriages from other states. shannon bream is live. what did you learn, shannon? >> whether any states have an argument for refusing to permit that chief justice john roberts started by saying this to the attorney who was representing the same-sex couples who brought

this case. >> we're not seeking to join the institution. you're seeking to join what the institution is. fundamental core of the institution is the opposite sex relationship and you want to introduce into it a same-sex relationship. >> but several other justices talk about a fundamental right to marry and question how any state should be able to deny that for same-sex couples. shep? >> shannon, justice kennedy could be the swing vote. >> you know, he's been very supportive of the lgbt rights but today his first comments were that marriage was defined as one woman, one man and he also expressed skepticism about the state using procreation and not recognizing same-sex marriages.

here's a bit of what he said. >> same sex couples, of course we understand the nobility and the sacredness of the marriage. we know we can't procreate but we want the other attributes of it in order to show that we too, have a dignity that can be fulfilled. >> the rights of states to make their own decisions on marriage and the right for their children to be viewed as full citizens. a decision from all nine justices expected by late june, early july. >> shannon, thank you. we're still waiting for the news briefing from baltimore. they are running behind. as it happens, we'll take you there. the crowds are growing and they have been throughout the afternoon. remember there's no school today but we have a number of correspondents and teams on the ground and they tell us no violence. as we wait there is word that iranian forces have taken over a

. . troops have helped hundreds of girls from a forest in nigeria. no word if these are the same girls that boko haram kidnapped last year. meantime hundreds of men, women and children were found after troops took it back from boko haram. life in prison for the captain of the ferry that capsized and killed more than 300 people. the court found him guilty of homicide and saving himself without giving any evacuation orders. most of the victims were teenagers on a school trip. and two bumblebee managers

are facing possible prison time after a worker cooked to death at a tuna plant in los angeles. it happened in 2012 when someone mistakenly turned on an oven while the victim was working on it. bumblebee is facing charges and a fine of more than $1 million. the company reports it is disappointed by the charges. >> a u.s. navy destroyer hurrying to the persian gulf. iranian forces boarded a ship and took it over. state media there report that they directed the ship to one of their ports. the pentagon sent a reconnaissance ship to find out what is going on. the u.s. navy answered the distressed call this morning from the cargo ship which belongs to the marshall islands. the united states government is

responsible for the security of that island nation. a pentagon spokesman calling iran's act provocative and inappropriate. and let's say this could complicate talks to try to stop the regime from getting it is hands on a nuclear weapon. secretary of state john kerry says a nuclear deal is closer than ever after more than a year and a half of talks but admits there are key issues that still need to be hammered out as the june 30th deadline fast approaches. world leaders announced a framework deal earlier this month. the senate opened debate this morning on a bill that would give congress the power to review any deal. let's bring in a former deputy assistant secretary of defense and deputy assistant secretary of state and director of u.s. policy forum at george washington university. good to see you. thank you. >> nice to be with you today. >> how are you feeling about

this deal? >> i'm actually feeling on the optimistic side. i think the secretary was right in saying that we have a ways to go and lots to be done and issues that are still not clear. but i was also hopeful about some of the things said out of tehran knowing that both parties are using the rhetoric to strengthen their own positions. but you know when the supreme leader says i'm not for our against, it's all in the details, we heard that last sentence it's all in the details from the other capitals as well. >> what do you make of the politics in washington? >> i always believed that the president needed to acknowledge that they have a role to play and will play it and if he's actually going to be able to implement an agreement, it's a good agreement. and then he's going to need some support on the hill. so i'm in favor of the agreement that he's reached and i hope they will go ahead and pass it. >> that makes sense. do you have any concerns that there might be some who would want to say, no nothing for

obama's legacy i don't care what it is we're going to say nope? >> i have a concern. that's been a tragedy of our situation now for some time. you know this particular case is far too important to let those kinds of things dominate and torpedo the process. so i'm really hopeful that they will let this deal go through as was agreed to but the vote as a committee was 19-0 which meant all of the republicans and democrats voted for it. that should say something. >> this mess with the iranians they have their fingers in a lot of ties because they know they can get away with it doesn't it? >> i notice the iranian revolutionary guard which they are always on the extreme and there are plenty of people in that guard who would like to sabotage things. whether this is that case i don't know. but i wouldn't be surprised if there aren't some people there that provoked this. and again, it was provocative. the pentagon is right. because the right of innocent

finland's military reports it dropped depth charnels after spautding a suspected submarine off the coast of its capital city. the navy first detected it yesterday in the shallow waters off its southern coast. finish forces fired warning shots. they could not identify the object that spurred the search. back in swedish navy hunted for a former submarine in its own watersment defense analysts said russia was likely to blame.

a russian official did not say whether one of its subs entered the waters. another mud sideline and avalanche hit a popular trekking route and up to 250 people are missing as fox reports this hour. that's according to the officials north of the capital city of katmandu. they say tourists may be among the missing and bad weather is making the rescue effort a lot harder. police in nepal say more than 4,600 people are confirmed dead after the earthquake on saturday. another 8,000 reported hurt and tens of thousands more believed to be homeless. chief correspondent jonathan hunt joins us now. what do we know about the mud slide? >> it happened in an area that is popular with tourists. it's very popular for those who want to go hiking and see some of the peaks without tackling

[ inaudible question ] >> we have reports of people gathering together in various parts of the city. we're investigating those right now. it doesn't appear there's any concern about any of the gathings. there are people that have gathered together. no indications of lawless activity. right now everything appears to be calm and peaceful. there have been some tension in northern pennsylvania avenue. by and large it remains peaceful right now. [ inaudible question ] >> right now we know there's a large gathering of people there. that is the only road closure in the city right now. we're continuing to be in the area. it's been largely peaceful very few arrests and we're very grateful for that. >> are you shifting additional resources in that region? >> we've had resources coming in throughout the day. we'll continue to have resources that come into the area.

we're thankful for our partners for that. we will shift resources as necessary, when we see areas of concern we will have the ability to respond rapidly. we have already predeployed forces where people are likely to gather. [ inaudible question ] >> we have representatives of everything organization that is on the ground here in baltimore coordinating our communication and deployment response. the police commissioner is in the watch center. he's directing the response for the city right now. we are working with our local state partners the national guard, our officers from washington, d.c. but we are maintaining sources of communication. we're using an instant command structure so that orders are relayed from our operations section and then given out to officers all the way down to the ground level. that's how we're communicating with everybody from all the

different jurisdictions. [ inaudible question ] >> so at our roll calls officers are given briefings on what the expectations are, what the hope is. again, our overriding hope is to be able to provide for peace in the city to make sure that any areas of concerns are addressed quickly. to prevent lawless activity and that's the overriding mission. that's the mission that officers are given at our roll calls. we want to preserve the peace, safety of the city and protect people's lives. i will tell you as a means of closing out, we're going to continue to do these briefings on a regular schedule as close to every hour as we can get. the next briefing will be at 5:00. at that briefing, the mayor, the police commissioner will brief on where we're at and have some more information for you. until then we urge you to continue to follow our social media feed. we're putting out information as

of sorts today. we've seen none of the violence if you remember it was during this hour yesterday that it all began. it didn't begin with massive crowds and then massive lines of police. it began from our view at least, with a few school children who came out of school apparently the buses weren't there and the trains weren't running because the train station was closed down. there was an armored police vehicle there and they started throwing rocks at the thing. police made a big line and they began attacking the police. it was ugly. and nobody will deny that. they had also prepositioned at the mall but the kids overran the cops. and the cops retreated. and hours later they remained in retreat. they said they didn't have the man power they did what they could do. today they have the man power. today authorities vow they will keep the peace. we'll be watching. we'll have coverage throughout the afternoon. i'm shepard smith in new york. final bell is ringing oint wall
