the curfew in baltimore is about to kick in. tell me whether you think that folks will abide by it. thank you for watching. i'm megyn kelly. our coverage continues now with "hannity." the curfew so far is holding in baltimore. officials there say the city is safe. hello, everyone i'm eric. >> and i'm jackie. 2,000 national guard troops and 1,000 police officers are on the streets of baltimore enforcing that curfew that started three hours ago at 10:00 p.m. it runs until 5:00 in morning. we have about four more hours there on that curfew. maryland governor who says the combined forces quote, will not tolerate violence or looting, and so far, the city's police commissioners say there were ten arrests last night. you're looking at some of that video from last night.

speaking to media late last night, commissioner batts said the citywide curfew seems to be working. he said he's also pleased with the efforts of dozens of community organizers clergy and neighborhood activists, getting out there, urging people to remain calm. >> jackie the protesters were mostly peaceful on tuesday. but the tempers would flare after the sun went down last night. sporadic looting started. at least one officer was injured by flying rocks and bricks. protesters were throwing bottles at police and the officers tried to disperse the crowd shortly after the curfew went into effect after 10:00 p.m. police responded by firing pepper pellets at the crowd. >> the rioting injured at least 20 officers. boy, was that wild stuff there. 200 adults arrested on monday. 150 cars were burned of the the

city just completely on fire it looks like. the violence began hours after freddie gray's funeral. this was monday. he's the 25-year-old who died after suffering severe unexplained injuries. his spine we're told nearly severed while in police custody. >> city officials urging people to obey the curfew saying no one should be out on the streets of baltimore right now unless they're going to work overnight or they have a medical emergency, of course. joining us now from the streets of baltimore, mike has been reporting on this all night. mike of the arrests so far, it strikes me only two were for looting. that is quite a contrast to what we all witnessed last night. >> reporter: what we're looking at now is a contrast to what we saw a couple of hours ago. gone are the rows and rows of protesters the crowds of protesters gone are rows and rows of police in the riot gear. this is north avenue. we saw all of that happening.

it is now empty. replacing the police are the national guard. you can see there's one trooper out on the street right now, next to his humvee. another humvee here taking up position. and further, east down the street one more humvee. these are just what we can see from our position. we saw a large column of the armored humvees coming up to this position armored because of their time in combat and they use the same vehicles to bring them out here not because of the threat out here. we see a few people disobey the curfew if you will coming out in the street hanging out close to their house. but just a few pockets of people. nobody's really doing anything in particular. it's largely quiet here. >> it seems people are taking back their city from the looters and criminals and those who tried to exploit the tragic death of freddie gray for lawless purposes. do you have a feeling standing there right now that this will

hold? that we've gone through the worst of it so far? >> reporter: well one would hope. but it's just a tough call. because it only takes a few people to get a crowd fired up when there's so much emotion out in the crowd. as there is right now, particularly following the death of freddie gray. and so much emotion has been injected nationwide with these police related killings, and all of the tension we've seen in a number of different cities. there are a few people out on the street. i think you've got more people clowning around to the extent that you have anyone out in the street at all here. >> it's one thing to stand out on your stoop and take a look and see what's going on. as you can see. be curious, as opposed to try to engage in real mischief or mayhem. certainly not the likes of what you saw earlier tonight, just after 10:00 p.m. which involved about 200 protesters so far. now, mike finally, the baltimore police say they'll have a report on may 1st, that's

friday on at least the preliminary report on what happened to freddie gray. he was arrested for supposedly looking at a police officer, then running. the family said it's not against the law to run. they say he was arrested because he was running while black. the police say they found a pen knife on him, and somehow, suffered some horrendous injuries the family lawyers saying his spine was 80% severed. we've seen problems with the baltimore police before. do you think this will finally lead to some type of changes that will last in that city? >> reporter: you know that is really a tough call. that's what everyone said. from the mayor on down. we saw from the police commissioner -- wait a second we've got a car coming this way. we saw it from the police commissioner promising systemic changes will happen within the baltimore police. you've seen national leaders saying that changes need to happen with the relationship with police and the public

across this great nation. as far as the injuries that happened to freddie gray obviously they don't have a lot of answers, that have made their way to the public. and that really feeds the tension out here the public doesn't know. they tend to fill in the narrative on their own, and, you know generally the narrative they fill in is nefarious. that adds to the tension you see on the streets, if you don't get the information out. and if someone needs to be charged, then you get that person charged. >> mike it's jackie here. we've seen the 15 16-year-olds out there looting. what did you see in terms of that at 10:00 tonight? did you see mostly adults or teenagers as well? >> reporter: you certainly saw a number of teenagers before 10:00. you saw teenagers after 10:00. that really presents a conundrum for the police. we heard the commissioner say

earlier in the day, when you have 14 15 16-year-olds out in the street they are old enough to know better but do you really want to have a scene where the police are getting rough with them. that's the scene they're trying to avoid. effectively the police did avoid that tonight. they did come out, use some intimidation tactics. when you have the police marching forward with the riot shields and trenshons to advance that line. they came out with the smoke first, and a little bit of tear gas after that. they effectively got the streets cleared without a major flash. >> today we saw the city of baltimore really coming together helping clean up. also when that curfew hit around 10:00 p.m. we saw community members helping some of the police officers, and officers there in riot gear. from your perspective, being down there on the ground how important were those community members to helping this curfew go into effect at 10:00? and as of 1:07 right now,

streets are looking pretty bare. >> reporter: yeah they are looking pretty good. there is a helicopter up overhead right now. as far as the community leaders, i think particularly the religious community later played a key role. because they can speak directly to the people. and they can speak from within the community. person to person. when you have the police officers on the loud speaker telling them they need to clear the streets, then you get back into that same sort of dynamic where you have authority pushing around the little guy who's just trying to make his way. you can debate all day whether that's accurate. but i'm saying that's the perception that you have the authority figure pushing around the little guy. so when you have someone particularly from the religious community reaching out, that tends to be more effective. i know from talking to some of the religious leaders out here tonight, what they were doing is reaching out to their congregation encouraging the parents to know where their kids are, know where their grabbed kids are. they were doing it with phone

banks and in person. it seems to have been effective. a lot of people did respect the curfew. we saw large numbers of people out here prior to 10:00. about 9:00 the numbers started to drop off. it looked like a lot of people were going to hang. 9:30 9:45 the numbers dropped to around 200, 150. and then after 10:00 deadline they didn't enforce it right at 10:00, the numbers kind of dwindled. those hanging around eventually got forced off the street. >> mike tobin, been there all night, appreciate your coverage. you've been doing a great job. thank you so much. just over an hour ago, the police commissioner of baltimore addressed the latest demonstrations saying there were a handful of arrests. but many participated in peaceful protests. >> our first night with the curfew curfew with the help of many agencies state police the national guard, we have deployed throughout the city as a whole, no major events over here in the

evening. we had a group march down into the downtown area to city hall. we had no major issues with that. we had a small group within that group of about four to five people that we stopped and had a conversation with. but allowed them to proceed on. that group had no issues. very proud of them. they came down did a first amendment right and went back and returned to the area that they had come from. you saw the activity that took place at pennsylvania and north. again, very pleased with the community and the citizens and the residents there. policing themselves. there was music, there was dance, people had their conversations. we had officers stationed out there. but it was a very good event for the day. congressman elijah cummings was out there. he talking to the 300 men, out talking to the crowd. the mayor was at different places throughout the city today, making sure that she was seeing and having a number of different meetings with

community people. just a background after the events today, we've had one -- or correction two arrests for looting in the central district. we've had one arrest for disorderly conduct in the easterling district. an officer had a drive-by brandishing of a weapon in the eastern district within the last 30 minutes. in the western district that's north of pennsylvania in that area we've had approximately seven arrests. in totality in the city after curfew went up we've had about ten total arrests. i get reports from the organization that we do not have a lot of activity or movement throughout the city as a whole. so the curfew is in fact working. >> that was the police commissioner there in baltimore just about an hour -- a little more than an hour ago with a news conference for us. it sounds like they're feeling like this curfew is working as

of right now. it's 1:11 in the morning. we've got about four more hours of curfew until 5:00 a.m. former homicide detective, he's been spending a lot of time on the streets there in baltimore during the past few days. thanks for joining us tonight. >> my pleasure, jackie. >> all right. so we've got about four more hours of this curfew. and things seem to be looking pretty bare there on our streets. didn't look like many people were out. are you surprised? >> well i am somewhat surprised. but i'm also very optimistic. i saw mike tobin out there tonight. i can tell you, i was out on the streets there, right around 7:00 doing the greta van susteren show. and mike was there with us. and at that time we had just mobs and mobs of peaceful demonstrators out in the streets. and we also had law enforcement. and i thought that there may

very well have been more trouble around the 10:00 curfew trying to clear all of those folks from the street. but i can tell you, i think that the baltimore city police as well as all the other major law enforcement agencies that assisted them to include the national guard, did an a-plus job of clearing the streets of baltimore tonight. we are witnessing the night, the beginning of how the leadership in baltimore has taken back their streets. >> monday night police didn't do much to stop the violence and the looting. last night, i guess monday night, it's a totally different story on what we saw. it looked like the city was up in flames last night. but tonight, not so much. we have the 2,000 national guardsmen there with additional 1,000 police officers there. you think having that extra

presence really made a difference tonight? or do you believe people after day two, they were saying you know what we're heading in tonight? what do you think? >> no i don't think they were going to head in tonight. i think the presence of the law enforcement agencies are en masse, made a stark difference. if you remember on monday which was a very dark day in the annals of the history of baltimore, is where the young kids got on social media and made representations that they were going to meet for a purge at around 3:00 this afternoon. and at 3:00 in that afternoon they came out of the subway station in the area of the mondawmin mall and with rocks

did injury at least 20 police officers. one, as you know, severely. it's a sad commentary what those law enforcement standdown, back away from what i defined as common thugs. and they were not able to take control. but tonight they were. they took control of the streets. >> there has been this video that's really gone viral of that mother that -- the single mother of six children who saw her child out there, in all of the chaos and rioting and she went and she really laid in him and said no you're not doing this not right now. how important is that? or would you say that's important for parents to be taking part in their children's lives, especially right now when we have -- let me rephrase that. the effectiveness of a parent versus the effectiveness of law enforcement. >> jackie i am so happy and

elated that you brought up tonya graham. tonya graham observed her son acting like a thug. and tonya graham went and took control of her son. and made sure that he was taken home. now, we need more tonya graham's out there. because some of these young people really more than anything else need the guidance of a parent. tonya graham to me is my hero. i want to see more tonya grahams. law enforcement are not the parents of some of these young people. the parents need to take control of their child, or their children and make sure that they respect law enforcement. >> tad, unfortunately we're running short on time. we appreciate you being here with us. i think a lot of people would agree with that. >> my pleasure. >> tonya graham there she is

fox news alert. protesters are ignoring the 10:00 p.m. curfew in the city of baltimore, as our own geraldo rivera. what's going on geraldo? >> reporter: they started throwing bottles. i won't want to say it's indict the entire crowd, but i saw at least a dozen, at least 10 or 12 bottles being thrown at the

police. but malik has gone through a met a more to sis in his own life representing black lawyers for justice. and others. so malik, describe what you're seeing here now. >> well what we're seeing is -- i'm legally observing to see what i'm seeing. you see some pain and suffering. it's just some lightweight bottle throwing. i don't think it's nothing serious. >> lightweight bottle throwing? >> people live here. >> sean hannity said there's no such thing as lightweight bottle throwing. >> it's just a few bottles being thrown. nothing serious. and what i'm saying is the -- >> how would you like a few bottles thrown at you? >> they don't want to be told to be going home. what you still see here is tension and frustration around the issue. you've seen intelligent young

black men who are expressing the statistics of the socioeconomic decay in this community. >> i get that. >> it's a legal on vervance. >> sean asks you would not like someone throwing bottles in your backyard. >> and others do not like the national guard occupying the community. you know this is a national antagonism all of the national guard here. if they weren't here the people wouldn't be out here. >> which is the tail and which is the donkey i'm sure that's true. the message that i urge people to adopt is that mom who smacked her teenage son up the side of the head and said you get off the street get that mask off your face you get home you're 16 years old. >> they would do that if there wasn't so much poverty here. those mothers would do that if there wasn't so much abuse here. they've lost touch with this generation. i haven't lost touch with them. but they have lost touch with

it looks like tear gas canisters have been fired, mike. mike can you hear me? >> this isn't tear gas. you hear us? that's not tear gas, that's just a smoke grenade that came out, some kind of smoke. or i wouldn't be able to stand here and talk to you. the effect it's created now, is you can't see the line of officers and their tactical gear. it has effectively moved the crowd back. off in this direction, here's a lot of the demonstrators, they've backed off the main section of the street. now, as we get out of the smoke, you can see where the officers are in all their tactical gear. they have managed in that smoke to move up the street a little bit. there's another one of those smoke grenades that came out. look at all the people who moved. and one guy trying to kick it back. yeah see that? a kid came back and tried to kick it back in the direction of the officers. one more trying it as well. there's a bunch of stuff firing

out now. i can't tell what it is but i think it's more of these flash bang bombs. >> is that being fired by the police department? >> reporter: yeah. there's something coming out of the lines. it looks like they've got maybe pepper spray, guys. and a bottle just went at them. a kid is close to them. it looks like they've got the guns with the pepper balls inside of the guns. that's my observation. i could be wrong on that i can't get a real good look at them. but at the front of that line i can't see it that well through the smoke, sean. >> yeah. mike tobin is on the ground here. as we're watching all of this i want to bring in former new york city mayor rudy giuliani who is just literally shaking his head. a little lightweight bottle throwing no big deal going on. more importantly, i want to go back to yesterday. i have known you, and i watched you take control of new york city. and when you took control of the city you had a rule. it was one bottle is thrown one

rocket's thrown those people are arrested immediately. yesterday, what we saw in baltimore was the exact opposite. police in retreat. they kept backing up and backing up. empowering those people who were attacking them. >> i don't understand how 20 years later, 15 years later, we're still making the same mistakes. i took over new york city after there had been two riots, four days each, in the last four years. including crown heights, where jewish people were killed. a jewish boy was killed and other jewish people were beaten up. i vowed there were not going to be any more riots as mayor. the biggest thing that was done wrong in maryland was a cooling off period. giving them a period of time to just vent. kind of like what the mayor here said something like that. >> the mayor said she wanted to

give them space to destroy. >> i think she would want to probably take that statement back now. >> she denied she said it. the reality is she did say this. this happened on saturday, camden yards. >> you can't create a cooling off period for rioters. so here is the rule i had with my police department and my police commissioners. first rock get arrested. second rock, get arrested. third breaking of a window you get arrested. we always had more than enough police. if we didn't show them all, we hit them. if my police commissioner would tell me i need 1,000 people to contain this demonstration, i would give them 2,000. >> but you'd always strategically, you would put 1,000 up front and then have 1,000 reinforcements all over the place. >> hidden in the places we thought we would direct them. you protect the buildings. as a consequence, i had eight years of no riots after two riots in four years. >> they knew better. >> i also had a community in new york called washington heights

that had a terrible riot in 1992 and a blackout in 1999. >> i remember that. >> that community went from being very high crime community to being a good community. i would ask all those politicians you saw there talking about the terrible conditions -- >> the economic development, yeah. >> they've been in charge of baltimore for the last 30 years. this is a democratic city. >> since 1939. >> o'mally was the mayor for eight years. o'malley was governor for eight years. if they're suffering from economic deprivation, what have they done that he's complaining about. what has that state senator done for the city. what kind of economic development have they done. did they do for that city what i did for harlem or brooklyn. take a look at brooklyn today, and look at it after the things that i did. take a look at harlem today.

>> we're running up on the clock here. i want to ask you this. saturday night they saw this was coming. they did nothing on sunday. yesterday, afternoon, early -- early they saw the rocks thrown at the officers. the officers retreat. they didn't even put a curfew in effect last night. they didn't even call in the national guard last night. >> cooling off period let them vent that's totally insane. >> do you see what's going on tonight? >> i'll tell you another thing. when it got to be 10:00, that's when they should have cleared off the streets. we shouldn't be at 10:30. working on this. when i said a demonstration was going to end at 4:00 and i'm thinking of one in particular the million man march, which ended up being the 20,000 man march, and they had the court gave them until 4:00 in the afternoon, about ten minutes before the head of the demonstration came over to one of my police and said can i get

fox news alert. police are trying to enforce the curfew in baltimore that was supposed to start at the top of the last hour. mr. moesby i read your comments. i saw what you said to leland vitter here. and i'm a little concerned about, where is the responsibility of the city? you saw what happened outside of camden yards on saturday. and you weren't ready for what happened last night. why were you not ready? >> i think unfortunately the proper tactical operations weren't in place. i totally agree here. i think that at the end of the

day, we should have been much more prepared. you know rlgs the attacks associated that the children decided to do yesterday, you know was planned out. it was real scripted through social media. we knew it was coming. unfortunately, you know when it came time it really took a course that i believe the police did not expect. and it's really about being ill prepared. >> well you went on to say that this is about decades-old anger, frustration, in a system that has failed them. but i look at the city of baltimore, and it is a majority/minority government. and the majority/minority police force. are you saying that liberal democratic policies have failed your city? >> just to correct you, it's not a majority/minority police force. i want to make sure we set the record straight. what i did say was that you know we could continue to look at it from what happened but it's also important to dissect why it took place.

at no point did i excuse or say that what took place last night should be tolerated. we should continue to go after it. i think we have to aggressively defuse and de-escalate the situation. >> but that's not what you said sir. >> not to look at it -- >> that's not what you said. sir, i'll quote you. you said this is about the social economics of the poor. are you suggesting by saying that that because people are poor that that causes them to throw rocks and to loot and to burn down buildings and to riot like they did last night? is that what happened? >> no not at all, sean. i think, again, you're taking one small snippet of my quote and changing it into the content of my statement. what i was saying if you allow me an opportunity to talk is at the end of the day, the why occurred based off of those systemic issues. what happened was wrong. it's inexcusable. it should not be allowed. and we must go after that after we calmed the city after we arrested the

criminals that have caused this damage to our city that could potentially impact if not for years, but decades, we also have to examine the qualitative impact of it and why the kids were out there doing what they were doing. that's what i was talking about. >> i'd like to know you're a leader in the community, and you saw as of 2:00 yesterday afternoon, you saw rocks and boulders being hurled at police officers and their cars being broken up and still the city did nothing to prepare for what happened last night. does the city therefore, bear the responsibility to those business owners whose entire life savings were burned out last night? >> just to set it straight it was like 4:00 5:00. >> no it was 3:00. i was watching it on tv. >> sean it's in my district i was in the area. i was stuck in the intersection of pennsylvania and north avenue for 25 minutes when it originally erupted. the kids decided to meet at

mondawmin maul at 3:00. at 4:00 is when the police pushed them down south to north avenue. i was right in the thick of it. >> let me say this. we have video of all of these people throwing rocks at police officers. we have videos of all of these people looting these stores. i would expect that as somebody that works in government that you would support the idea of identifying each and every single person that was lawless in the last couple of days and arresting every one of them. do you support that? >> sean totally. that makes total sense. at the end of the day, no matter what cause of your actions, you should be held accountable. the folks who have been looting or burning up private property it's critically important we address that we go after that. this is something that can't be sustainable. we can't see this ever again in the city of baltimore in our history. we must attack it. >> my last question -- >> but again, we've got to stop talking about the what and focus on the why, once we de-escalate
