ainsley and then of course our friends on fox and friends will get you started in the morning we'll have continuing coverage throughout the night. on fox news this is a fox news alert. good evening. >> it is calm on the streets of baltimore at least for now. 2,000 national guard troops are in the city to help back up city police. >> the combined forces appear to have done its job so far. there was a confrontation late tuesday night between riot please and an unruly crowd of 200 or so. most protesters went home from the mandatory 10:00 p.m. to 4:00 a.m. curfew. the baltimore police commissioner says 10 people were arrested tuesday night and seven of those for violating the curfew and two for looting and one disorderly conduct. >> it is a sharp contrast to what happened on monday night.

that's when the rioters took to the streets looting stores and burning cars and buildings and pelting police with rocks and debris. that chaos triggered by the death of freddie gray, the 25-year-old black man that was mortally injured while in police custody. it prompted the governor to declare a state of emergency. >> the overnight curfew will remain in effect until the end of the week. as for today we have two more hours on that. and for the second night in a row the baltimore oriels were forced to can sell a baseball game at camden yards. wednesday's game will be closed to fans, a tiers in major league baseball. no audience at all.

it has been a long and. >> yet night and people are glad to have the long and quiet night. what you see here on the streets of ferguson now you have police officers who were out here changing shifts and some of them are coming to supplement the national guard troops who were out here for the bulk of the night they came to replace the rows and rows of police officers that we saw right here at this intersection of pennsylvania and north avenue. that's where it all went down tonight. the police officers were advancing on the crowd of demonstrators and ultimately dispursing the smoke grenades. there was a little ts gas which in common speak is teargas. it was an incident, but it

went on without a major ugly incident which is what the police wanted to avoid. it could have upset the people in the town more. they got away -- or go through the night without anymore major looting. eric and jackie? >> what do you think the main reason was. was it the national guard versus the police? did that bring it down a notch or did that raise it up? really people were expecting much more trouble tonight but thankfully as the police commissioner says the city is safe and it is stable and it is quiet. >> when you have the national guard come out you will see them take up roles like you see behind me. they will provide -- they will fill roles that the local police oftentimes can't fill because of their numbers or whatever. and then you have the local police with more specific training better equiped to

handle some of the local situations and the national guard can stand guard throughout the evening and provide the man power that allows the locals to do their other tasks for which they are more specifically trained. as far as why the evening ended up without major incident the out reach through the local community played a major role specifically the out reach through the religious leaders and talking to the pearnts and telling them to -- the parents and telling them to get their kids home and telling people to leave the streets when the 10:00 deadline hit. >> mike, what is the demeanor of the national guard there and the police officers now that it is 3:00 a.m.? are they still standing guard standing up? are they in their vehicles? what are they doing? >> they are sitting back in their vehicles. it is a little cold tonight. they are sitting inside and staying warm. when they are outside they look pretty relaxed. i don't think anybody is expecting any trouble over the next couple hours as the curfew has just a few more

hours. you can see that in the body language of the police, jackie. >> when you see -- do you see anyone walking the streets any individuals? if you do what are police doing? do they stop them and ask them what they are up to? i know the media is allowed to be out there and if you have obvious he any emergency you need to get out and get that taken care of that's allowed. do they stop and tack to them? stop and talk to them? >> we have seen only a few people. some people hanging around in front of an apartment building and a couple of people who have just been by themselves walking up and down the street. it looks like the guard and the police officers will leave them be particularly if there is not a large number and they are not going to cause any trouble. >> mike tobin we appreciate you being out there. you have been there all night and all morning. stay safe and stay warm. >> thank you. >> and this curfew will continue through the end of the week.

authorities there clearly taking no chances. late last night the baltimore police commissioner addressed the improved situation on the ground. >> our first night with the curfew along with the state police and the national guard we have deployed throughout the city as a whole no major events earlier in the evening. we had a group march down to city hall. we had no major issues with that. we had a small group within that group of about four to five people that we stopped and had a conversation with. we allowed them to proceed on. that group had no issues and they were proud of them. they had a first amendment right and they returned to the area they had come from. you saw the activity that took place at pennsylvania and north. again, very pleased with the community and the citizens and the residents there policing themselves. there was music. there there was dance. people had conversations.

we had officers stationed out there, but it was a very good event for the day. congressman elijah cummings was out there. the mayor was at different players throughout the city today to make sure there were a number of meetings with community people. just a background after the events today we have had one -- correction two arrests for looting in the central district we have had one arrest for disorderly conduct in the eastern district and we had one officer who had a drive by brandishing of a weapon in the same eastern district within the last 30 minutes. in the western district where it is north of pennsylvania in that area, we have had approximately seven arrests. in toe tall tee in the city after curfew went up we have had about 10 total arrests.

i get reports from the organization that we do not have a lot of activity and movement. the curfew is in fact working. >> that was the police commissioner speak together media late last night. one of those people was arrested walking on the street and said he had car problems and even as he was being put in the plastic handcuffs he said the police were just doing their job. jackie? >> eric, as we continue to monitor events in baltimore a disturbing report out of ferguson missouri this morning. word that at least one person and possibly two have been shot during a demonstration in support ofed freddie gray. we can confirm a victim is hit in the leg and a suspect is in custody. there is a report that some of the protesters may have been throwing rocks at police. that's something we saw in baltimore. the gunfire broke out where 18-year-old michael brown was shot last summer by a white police officer. the death of the black unarmed teen followed by the

exoneration of the officer touched off a wave of rioting in ferguson and across the nation. joining us now on the phone is ted williams, the dc lawyer and former homicide detective. he was spending a lot of time on the streets of baltimore and ferguson. you heard what we just said about ferguson. you spend a lot of time there. what is the difference between what we saw in ferguson and what we are seeing in baltimore? >> jackie, i think the distinction and the difference in ferguson versus baltimore is the actual response -- in both cities as you know we had large amounts of police officers but i think in baltimore what you had was police officers who responded more aggressively tonight than in ferguson. i think the police officers in

ferguson because they got off to a bad start eventually a threat of how the public would view them. baltimore tonight they meant business. as a result of that, i think that's the clear distinction of the two. >> we have a sound byte from president obama. he spoke tuesday afternoon about what is happening in baltimore. i want to go to that quickly and get your reaction. >> sure. >> when individuals get crowbars and start prying open doors to loot, they are not protesting. they are not making a statement. they are stealing. when they burn down a building they are committing arson. >> ted what do you think about what the president just said? how do you feel he handled both what is happening in

baltimore and ferguson? >> well, i think the president in what he had to say was speaking with can dore -- candor and i think that also he knew that baltimore was a local issue in the united states simply meaning that the governor and the mayor of baltimore had the ultimate responsibility. i think as the leader of the country he spoke out with candor to these thugs. jackie one of the things i would like to see is -- and it will be interesting. in one of the earlier segments we talked about the mother who went out and got her son out there. what would be very interesting now is the parents after identifying their children throwing rocks at police

officers would have and take the responsibility of grabbing them by their wrist and bringing them to authorities to show them that they cannot disrespect authority. that would be an amazing metamorphosis if it took place in baltimore. >> yes this video of the mother is going viral. a lot of people in her corner are saying she did the right thing with her son letting him know that this is not okay. this is not how we react to these types of situation. she is a mother of six children. i believe she is a single mother of six children and she is really wailing on him there. >> she should wail on him. you know, there was earlier tonight a rumor that child and family service may be taking a look at her. if she needed a lawyer i would certainly be there to defend her for what she did. kudos to her. >> interesting. how do you handle -- we heard the police commissioner come out and a couple of people

come out and say on monday a lot of these looters and rioters were 14, 15 and 16-year-olds. how do you handle those type of protesters and looters when they are so young? the police chickser saying he didn't want to -- the police commissioner saying he didn't want to use excessive force because they are teenagers but in the same breh they can kill and destroy and can cause a lot of harm, just as much as an adult can. >> you know, jackie, i thought that the police commissioner is trying to cover his butt and that that was rather disingeneral wise. disingeneral you us with. these are 14 and 15-year-olds if you want to call them that were throwing missiles that could kill individuals. as you know one police officer was severely injured as well as about 19 others. i think the police department used that as a ploy to cover their butt. the reality of it is suppose they all of a sudden had the

same scenario tonight. the question is would they also stand down? i doubt it. i think this is a public relation ploy on the part of the baltimore police department. >> what do you think needs to happen thousand? we have two hours before the curfew is up, 5:00 a.m. what needs to happen at 5:00 a.m. to get the city back to normal? >> i think at this stable nothing needs to happen other than what is already happening. the question mark is can there beacon sis sten see for the next -- be consistency for the next few days. the problem is you will have an influx of outside agitators coming in and it may not be as easy as it was here tonight for the police officers doing their job. >> and the kids are supposed to be back in school today. do you think that is gonna help out to have them in the classrooms and staying busy? i know sports avents are

taking place after school, clubs taking place after school something we didn't see on tuesday. >> absolutely, jackie. i think these kids need to be involved in more than just -- what is going on with freddie gray and what is going on with -- in baltimore. they need to get about the business of their life. i think school is certainly the place they should be. >> are these protests not necessarily here in baltimore but looking to the future, do you think it will get worse before it gets better? >> no, i think -- i am hoping and i am optimistic that this thing has petered out to some degree where now they will learn to accept what is going on. what could be an explosive situation is that on friday we are expecting a report in the death of freddie gray and the

question is will somebody be arrested? that could also set demonstrators off again according to what law enforcement comes up with. >> ted williams, we really appreciate you being with us this morning and sticking with us as the curfew goes into place. we have another week with the curfew and we will see how it plays out. we may need to talk to you some more. we'll see how it goes. >> pleasure. the next big step, the report from the police department which is expected on friday. not likely anything completely definitive in that because of the uncertainties surrounding this. what we do know is baltimore is peaceful. the curfew is now in effect. the police commissioner saying the city is safe and stable. this after riot police moved in about five hours ago just after 10:00 p.m. eastern time announcing it was time for the protesters to leave. some refused and hurled bottles toward the police line. the officers responded by

tells being thrown at the police. but formerly of the new black panther party, but malike has gone through his own metamorphosis. malik, describe what you are seeing here now. >> what we are seeing is -- i am legally observing to see what i'm seeing. you can see some pain and suffering and it is light weight bottle throwing. i don't think it is anything serious. >> light weight bottle throwing? >> it is in opposition to the curfew. >> sean hannity says there is no such thing as light weight bottle throwing. >> well i mean, come on. it is a few bottles being thrown. it is nothing serious. >> how would would he like a few bottles being thrown at him? >> what you see here is tension and frustration around the issue. you have also seen very intelligent young black men

who are expressing the real facts and statistics of the socioeconomic decay in the community. >> i get that and -- >> i am here as a legal observer. >> sean asked you would not like someone throwing bottles in your backyard. >> and others do not like the national guard occupying the community. you though this is a national antagonism all of the national guard here. if they weren't here the people wouldn't be out here. >> which is the tail and which is the donkey? i'm sure that's true. the message i urged to adopt is the mom who smacked the teenage boy on the son and said get off the street and get the mask off your face. get home. are you 16 years old. >> they would do that if it wasn't so much poverty here. those mothers would do that if there wasn't so much despair here. they wouldn't do it if there was not so much police abuse here. so really they have lost touch with the generation. i haven't lost touch with them but they lost touch with

you. >> innocent minority businesses were destroyed last night. we have innocent stores that were looted and buildings were burned and rocks were thrown at police and you are seeing innocent people. the community was destroyed last night. >> he is saying what about the shop keepers whose lives are destroyed? >> nobody in the black community wants to see the little we have [inaudible]. >> what happens to the community now? >> martin luther king said the voice of the unheard. >> i don't know what that is. it looks like, sean, that it is heating up. that's gas. that's gas of some sort. just hold your ground. we are okay.

>> at the geraldo. it looks like teargas canisters were fired mike. >> this isn't teargas. that is not teargas. that is just a smoke grenade that came out. it was some keened of smoke. i wouldn't be able to stand here and talk to you. a lot of the stuff has come out and the effect it created now is you can't see the line of officers in their tactile gear. it has effectively moved the crowd back. i can show you here as you come through the crowd in this direction, here is a lot of the demonstrators. they backed off the main section of the street. now as we get out of the smoke you can see where the officers are and the tactile gear. they managed in the smoke to move up the street a little bit. there is one of the smoke grenades that came out. look at all of the people who moved. one guy is trying to kick it back. the kid came up and tried to kick it back in the direction of the officers. one more trying it as well. there is a bunch of stuff firing out now.

i can't tell what it is, but i think it is more of the flashbang grenades or smoke grenades. >> is that being fired by the police department? >> yes. there is something coming out of the lines and it looks like they've got maybe pepper spray guns and a bottle just went at them from a kid close to them. looks like they have the guns with the pepper spray balls the pepper balls this the guns. that's my observation. i could be wrong on that one. i can't get a good look at them. they've got something at the front of the line. i can't see it through the smoke, sean. >> mike tobin is on the ground here. as we are watching this i want to bring in the former new york city mayor rudy guiliani who is literally shaking his head. a little light weight bottle throwing. no big deal. more importantly i want to go back to yesterday. i have known you and ouch whatted you take con -- and watched you take control of new york city. when you took control of new york city it was a rule.

one bottle is thrown, one rock is thrown and those people are arrested immediately. yesterday what we saw in baltimore was the act opposite. -- the exact opposite. they were baring up and -- backing up and backing up and empowering the people stoping them. >> i don't understand how 20 years later 15 years later we are making the same mistakes. >> i took over new york city after two riots four days each in the last four years including crown heights where jewish people were killed, a jewish boy was killed and other jewish people beaten up. i vowed there would be no riots while i was mayor. you are not going to get to riot in my city. i read the report that was done by governor cuomo of the things done wrong and the biggest was a cooling off period. giving them a period of time to vent like what the mayor said. >> she said she wanted to give

them space to destroy. >> i think she would want to probably take that statement back now. >> she denied she said it, but the reality is she did say it. this happened on saturday at camden yards right outside where the oriels play. >> you can't create a cooling off period for rioters. here is the rule i had with my police department and my police commission. the first rock, arrested. second rock, arrested. breaking a window, arrested. we always had more than enough police. if we didn't show them all we hid them. i need a thousand people for this demonstration i would give them 2,000. >> and strategically you would have a thousand up front and a thousand reinforcements. >> hidden in places where we thought we were going to direct them. you protect the buildings and as a consequence i had eight years of no riots after two riots in four years. >> they knew better. >> i also had a community

called washington heights which had a terrible riot in 1992 and a blackout in 1999. there was not a single crime committed that night. that community went from being a high crime community to a good community. i would ask the politicians asking about the terrible con -- conditions dark dash the economic decisions they have been in charge of baltimore. this is a democratic city -- >> since 1999. >> o'malley was the governor for eight years.years. if those people are suffering from economic depravation, then what the heck have they done? what has elijah cummings done for his city? what has that state senator done for that city? what kind of economic development have they done? you go. take a look at brooklyn today and look at it after the things that i did. take a look at harlem today.

joining us now is nick mosbey. you know, i read your comments and i saw what you said here and i am a little concerned about where is the responsibility of the city? you saw what happened outside of camden yards on saturday, and you weren't ready for what happened last night. why were you not ready? were you not redady? >> i think unfortunately the proper tactical operations weren't in place. i mean i totally agree, hannity. i think at the end of the day, we should have been much more prepared. the attacks that the children decided to do yesterday was planned out. it was real scripted through social media, we knew it was coming but unfortunately when it came time, it really took a course that the police did not expect. and it's really about being ill prepared. >> you went on to say that this is about decades old anger, frustration and a system that

has failed them. but i look at the city of baltimore and it is a majority minority government a majority minor minority police force. are you saying that liberal democratic policies have failed your city? >> just to correct you, it's not a majority minority police force, i just want to make sure we set the record straight. what i did say was that we could continue to look at it from what happened, but it's also important to dissect why it took place. at no point did i excuse or say that what took place last night should be tolerated. we should continue to go after and we have to aggressively diffuse the situation. >> that's not what you said sir. sir, what you said and i'll quote you. you said this is about the social economics of the poor. are you suggesting by saying that that because people are poor that causes them to throw rocks and to loot and to burn

down buildings and to riot like they did last night? is that what happened? >> no not at all. i think you're taking one small snippet of my quote and changing it into the content of my statement. what i was saying if you allow me the opportunity to talk at the end of the day the why occurred based off those systemic issues. what happened was wrong and should not be allowed and we must go after it. but after that after we calm the city after we arrested the criminals that have caused this damage to our city that could potentially impact us for decades, we also have to examine the qualityive impact of it and why the kids were doing what they were doing. that's what i was talking about. >> i'd like to know. you're a leader in the community and you saw as of 2:00 yesterday afternoon you saw rocks and boulders being hurled at police officers and their cars being broken up. still the city did nothing to

prepare u for what happened last night. does the city therefore bare the responsibility to business owners whose entire life savings were burned out last night? >> just to set the record straight it was more like 4:00 or 5:00. >> no it was 3:00, i was watching it on tv. >> sean it's in my district, i was in the area. i was at pennsylvania and north avenue when it originally erupted. the kids decided to meet at the mall at 3:00. around 3:30 it started to pick up. 4:00 is when the police pushed them down south. >> as a leader in the community, let me ask you this. we have video of all the people throwing rocks at police officers. we have videos of all of these people looting these stores. i would expect that as somebody that works in government that you would support the idea of identifying each and every single person that was lawless in the last cup canouple of days and

arrest them. do you support that? >> sean totally. at the end of the day no matter what cause your actions, you should be held accountable. the folks who have been loot inging or burning property, it's critically important that we address that. we go. after that. this is something that can't be sustainable. we can't see this ever again in the city of baltimore. we must attack it and go after it. but again, we have to stop talk about the what and focus on the why. >> what do you think about your mayor that said we have to give these people room to destroy. >> yeah i mean, i know the media has constantly focused on that. i'm not going to comment on my mayor and her sound byte. >> you don't want to comment on her irresponsible comment? why don't you say that was irresponsible of her? >> because right now throughout the city of baltimore, we were on fire. we're trying to get the city under control.

fox news alert, a tense scene in baltimore as protesters refuse to go home and abide by the curfew put in place at 10:00 eastern time. we go back to geraldo who is on the ground. it appears they are not listening. >> reporter: you know sean we think that we saw two youngsters two teenagers being grabbed by the police and taken behind the police line. i would say that they are under arrest. but as you can see, the street now is essentially cleared. that's a police vehicle right in if front of me now. the community activists have been urging everyone and we have heeded their admonition. i don't want to be the jerk who defies people's desire for this

to cool down. but the air now must have been cs gas because we were cry inging. it wasn't tear gas, it must have been cs. we're all kind of woozy. we cleared the tears and blown our noses and now the police line stays strong. the street as you can see, as compared to just 15 minutes ago, sean is clear. excuse me one second. we thought the police would start marching this way. they seem to be holding their ground though. i really must say fair and balance that the vast majority of these protesters have if not gone home they have at least have left this immediate area sean. >> geraldo, we'll get back to you. we continue with mayor giuliani in studio with us. had they done this last night, perhaps those buildings could have been saved. >> sure if they had stopped the
