highway. dozens of police have surrounded the protesters. now stay with fox news for the latest on this breaking news. thank you for being with us. see you all again right here tomorrow night 7:00 p.m. eastern. good night live from america's news headquarters i'm jackie ibanez. it is 3:00 in the morning in the city of baltimore and all seems calm. this is the third night there was a curfew. people lingered minutes after but only minor disturbances. a slightly different scene in philadelphia last fight as demonstrators scuffled with police. several hundred marchers took to the streets to protest the death of freddie gray who died while in custody of baltimore cops. authorities say there are no plans at this time to impose a customer fie -- curfew in their town. at the same time baltimore
12:01 am
prosecutors are preparing to look at the police report into the death of freddie gray. they urge the public to be patient. baltimore's mayor says they are already cracking down on police misconduct. >> what they don't tell you is police shootings courtesey excessive force lawsuits against the city we are finding more officers found -- accused of wrong officers guilty. they don't want to tell you that part, because they don't want us to be in the victory. we will get justice. >> in other news, traces of normal life trickling back to the streets following saturday's magnitude 7.8 earthquake. many residents are returning home. gas stations and stores are reopening, but the search for bodies is far from over. the death toll now surpasses 6,000. and finally president obama has chosen his hometown of chicago to host his future presidential library. the university of chicago where obama once taught law
12:02 am
will develop the library along with the barack obama foundation. i'm jackie ibanez. "red eye" starts now. for all of your headlines log on to fox news.com. you are watching the most powerful name in news, fox news. >> hello everyone. i'm tom shillue. let's look at our guests. >> he is patting himself on the back. >> this is the year i am making your birthday. >> is there anything wrong with that? peeking in and seeing handsome teenage boys? >> they have to be good at performing their own stunts. >> and now the thrilling conclusion. >> welcome to "red eye." hello, everyone. i'm mike baker and before i forget remember once again please turn your phones to airplane mode. including you at home. let's welcome our guests. i don't support her role as pageant queen because i am a fan of democracy. i am here with the lovely joanne nosuchunsky. he is a thomas edison, and by that i mean i am brilliant and
12:03 am
he is a no good a-hole, thieving son of a bitcha-hole. look at that. he deserves an urban outfitters. it is andrew schulz. >> that's it? >> and finally -- oh good. another libertarian. sitting next to me is the man who knows a lot of big words because he is the reason magazine editor-in-chief, matt welch. >> a block. the lede. that's the first story. >> it is true. he knows a lot of big words. is nonviolence nonproductive? in baltimore smashing a police car is not an act of vandalism. it is the start of a revolution. salon.com, that's where i get all of my news. they published an article defending the riots as a political strategy. they defended the riots as a
12:04 am
legitimate political strategy. during the mayhem in ferguson, "time" magazine ran a piece titled and i quote in defense of rioting with the writer claiming riots are a necessary part of the evolution of society. andy, i can't believe he wrote that. chaos does draw more media attention as this protestor claimed to msnbc. >> my question is when we were out here protesting for six days straight there were no news cameras and no helicopters and no riot gear and nobody heard us. now that we burned down buildings and set businesses on fire and looted buildings now all of a sudden everybody wants to hear us. why does it take a catastrophe like this for america to hear our cry? >> good question. meanwhile, even cbs workers support burning down -- cvs workers agree with burning down the cvs store. here is an employee in new
12:05 am
york city. >> what do you think of the cvs burning down there? >> i love it. >> that's good news to you? >> why wouldn't it be? >> i don't know. it just seems like it is not the best directed kind of rebellion. it is rising up against the man though, right? >> in some form, it is. it is basically what they want to do. >> it is good or bad? >> it is good. stand up, fight the man. >> stand up and fight the man says the cvs employee about burning down the cvs. do you admire the young man's can dore? >> i am confused as to why gavin's brother is french. what was up with the weird beta male accent? did gavin steal the masculine genes from his brother? to be fair there are masculine french men. >> it could be gavin playing a character. >> oh i thought it was really his brother.
12:06 am
he is a good actor. daytime emmy. >> were you surprised by the young man's candor? >> no, he works at cvs making $7.50 an hour. >> that's a very smart comment. i'm impressed by your low expectations. >> i hang out with andy, don't i? >> are we witnessing a revolution, or are we just watching some people an element of this larger crowd just burning down. >> the most insightful comment so far is that the woman talking about the press coverage there she has a point, not necessarily how you cover riots but people don't cover police violence. the reason we feel there is a sense of revolution happening and riots happening and demonstrations in new york is that communities where there hasn't been media coverage for a longtime now can get it because they got cell phones. they have twitter and facebook. newspapers stopped covering poor communities and cop on
12:07 am
poor community violence a longtime ago. >> just newspapers or media in general? >> media in general newspapers. the exception of competitive markets of new york where the tabloids will get into it. other newspapers are nah that's sensational us stick and we are not going to do it. it is areas not covered forever. so we feel like it is at riotous activity, but it is probably better than it was. we are just more aware of it now. >> that's a fair point and expanding on that, do you think this is a credible angle to take to say the problem here is that we don't cover the bigger issues. we don't cover the reasonable and obvious frustrations in the community because we are waiting for the next riot. >> we all have a different narrative that we are trying to serve.
12:08 am
i have seen a lot of liberal sites saying that. why is no one covering the peaceful protests happening or the community members who are are helping the others. you can then say -- you can turn it around and say to the liberal media okay, so why don't you cover people who peacefully own and bear arms and you cover shootings. it is the narrative. what do you want to read? the romanticized from the left or the nonfiction from the right? >> how do you get to a point where -- say you turn it around where there is -- do you actually get to the point where there is a balanced coverage and we think even though we are not getting the viewer ship because it is not a building on fire dsh dash. >> no advertisements. >> no advertisements. >> very simple. >> no advertisements and you can put whatever you want if cv. >> and then how do you pay for it? >> it is impossible. >> wait, wait, wait! we need a reverse engineer.
12:09 am
>> the only way you can do a balance is if no one is paying for it. peaceful protest is great but it is also boring. change the channel. >> that's also -- you can not condone riots but also understand them. there doesn't have to be -- it doesn't have to be -- i hate to say it, but a black and white situation. there is absolutely a point as the woman made without rioting there is no media and without media there is no change and what you've had in baltimore is -- there were great articles in the -- in "the sun," the baltimore pd was violating the rights of citizens and the number of police brutality lawsuits they settled. the other was freddie gray not the first to come out of baltimore police van with serious injuries. they have a name for it. it is called a rough ride. if you have a name for it, it is a systemic problem.
12:10 am
if the police are acting in a lawless manner, why are we mad civilians are doing it? i don't condone burning businesses but a government treating citizens like a wartime enemy is worse. >> this will surprise you because i know we are fiercely competitive in the business, in the private sector, but there are times when your intelligence surprises me. i want you to give me one sentence from your perspectiven capsule lates what is going on. you can range anywhere. one sentence about what is important of what is coming out of baltimore. >> pressure. >> exactly. anything that comes to your mind about what is happening in baltimore. i will go with you first. >> it does -- doesn't necessarily have to be about race. baltimore has a black mayor and a black commissioner. it is not. it is power class as much as anything else. >> i don't know how to make it
12:11 am
into one sentence. >> run ons are allowed? >> got it. just because something isn't right doesn't mean it is not surprising. for example them burning buildings down and stuff like that because of the injustice of freddie gray is not surprising. if i cheat on my girlfriend and she burns up my car it is not right but i can't be like -- >> why would you do it. >> oh shock. right. i will be like, oh my god, i can't believe this. >> you have a car? >> it is actually just a metro car. >> it is a van with to windows. joanne? >> i think we have seen through all of this how strong the community really is. the best course of action next is not to depend on your government, but to look within yourself and to develop community programs that foster development of the youth and community there. >> the war on drugs is a blatant failure and it caused
12:12 am
all of this. >> let's move on from there. that's a powerful one. let's get to other stuff shall we? the baltimore oriels -- okay we are still on baltimore but other stuff. the oriels played today. you may not have known that because the stadium was empty. here is a tape of a player signing a fake autograph. >> i love that. >> and the first base man tossing a ball into the empty stands. matt in your opinion was this necessary? was it necessary to keep the fans out of the stadium? >> no, there were fans out of the stadium. they were in the gates on utah street saying hey that game looks interesting there. they were being kept outside to protect the fans. we will protect them by not having fans. it is very creepy. this is the the first time in major league history this has happened. major league baseball has been around a longtime. they were scared. it is amazing they couldn't figure out to play at a national stadium or open it up. have a little faith that you can have humanity go in and watch a baseball game.
12:13 am
>> i think it was an overreaction from the previous screw up on sunday leading into monday. >> the lock down. >> yes. i know we should be talking about the big picture but do you think the lack of fans may have hurt the players' performance? >> maybe. i think the real -- i don't know how to say this in a kosher way. i think the real silver lining to this whole freddie gray thing here is that they didn't have to watch a baseball game. that's how horrible baseball is. it is such a boring, awful sport that finally the people who went through so much tragedy in the last few days were relinquished of that horrible duty to watch baseball. >> awful. >> joanne i was going to ask you a question, but realized you were a girl and don't know anything about baseball. >> i was at a ways ballgame. >> i am joking. some of the biggest fans i know are females.
12:14 am
>> the best chicken fingers are from nathan's, and don't buy the souvenir beer cup. it is a waste of money. waste of money. >> i am moving on to the next topic. >> hold on -- >> oh now you have something to say. >> now? i have been talking the whole time. all sporting events should be played without fans so the players can concentrate better. that's my opinion. >> good. i like it. i like it so much i will move to the next topic. drones. drones are not just for delivering tacos anymore. by tacos i may be referring to an atm missal or jdm laser guided -- i can talk about this for hours. the "wall street journal" reports president obama gave the cia more flexibility to conduct the drone strikes in pakistan. after approving tougher restrictions in 2013. yes, the agency didn't have to prove the targets and that they pose a threat to the u.s. that's basically it. that that was the only leeway
12:15 am
they received for pakistan. the journal says if the cia was held to that standard as an imminent threat to the u.s. they may not have carried out the strike that killed two hostages. defenders of the program say the exemption was granted because we had troops in neighboring afghanistan. that rule still requires -- the rules still require a near certainty that that civilians were hurt. they didn't change that. all right matt. i'm steeling myself you you cia basher, you. what do you think? >> do you think the near certainty standard will ever not be big enough to drive an entire fleet of trucks through? like in terms of a loophole? in terms of what people -- >> oh i turned around to make me answer the question. >> you will never get the risk down to zero. >> you will get to a certain point where it is risk versus
12:16 am
gain calculation based on the target you identified. you will do everything possible to ensure that you are within these guidelines. you know what, the world works in such a way you have to make a decision. >> i will say this about that. obama before the 2012 election did an incredible thing. he said you know what, may not win re-election. a republican may win. we better change the rules about drones and assasinations and warfare. a bad guy may take the reins of these things. they started to work on the rules until a month and a half after the election. we are going to see the same damn thing happen with drones and with all of the aspects of the war on terror that obama campaigned against and then adopted for the most part as president. you will see him try to rewrite the rules as he leaves office. andy, i am stealing myself for your traditional bashing, do
12:17 am
you think? >> let me ask you a question. do you think adam and the other americans that were killed -- that was killed, do you think -- the other one killed recently, do you think they were not the targets as the president said, or do you think that was a way to get around the whole -- >> he can't tell you. >> what is my personal opinion? >> based on no insider information or anything? >> yeah. >> yeah, he was the target of opportunity residing with a very high level legitimate target. by association he got whacked. again we all want a zero risk world. it was tragic these two hostages were killed. you can't imagine the hoops -- i am pontif pho indicating that they have to jump through.
12:18 am
it is insane. they miss targets because of the regulations they have to go through. sometimes things happen in this world and we all want a zero risk world. >> let the record show that the defendant did not answer my question. >> here is my question and we discussed it earlier in the green room. there is all of this animosity toward drone strikes, right? they can kill innocent civilians. when we end is a seal team in there they can also kill innocent civilians by sent, right? it is only when we do it by drone we don't risk any innocent americans in the strike. shouldn't the animosity be toward the strikes in general but not drones specific ones? smart schulz. smart schulz, every once in awhile. hit commercial. no answer. >> joanne had a good point in
12:19 am
the green room. it has altered our ability to go out and capture the high level detainees. i thought that was an important point. >> i had more pontes and you said all of them in your answers to these two. >> we are like this. coming up what is the most racist place in america? i'll tell you what, it is to the idaho so why should i care? more "red eye" after the break. stick around.
12:20 am
12:21 am
12:22 am
we are still reeling from that brilliant answer of andrew schulz's. >> every once in awhile. >> and don't forget air lane mode for your phone. bigots can't hide from google.
12:23 am
sorry, joanne. the most racist places in america are the rural northeast and the south. the south in quotes. that's based on the volume of google searches for the n-word. the study intentionally omitted times the n-word was spelled with an "a" at the end and the racest" er." they say google searches are a better measurement than surveys because and i quote google searchers are on-line and likely alone with their pants down. both of which make it easier to express socially taboo thoughts. according to the results the area surrounding the appalachians a mountain range, have the most bigots followed by northern michigan, the gulf coast and donald sterling's house. andy? >> yeah. >> are white people the only racist group? >> absolutely. >> i threw you a softball. >> obviously the first
12:24 am
question is do google searches for the n-word equal racism? that's hard to determine. and is it white people searching? black people? another ethnicity searching for it? matt searches for original ku klux klan. joanne likes to search for nazi silverware. i don't know if that's racist. she could just be a collector. there is no way to know. >> i host dinner party. dinner parties. to that point andy so cleverly made what racial slurs do you typically search for on-line and please be specific. >> i can never spell them correctly so google can't judge me. you know, i think a lot of this is rap music is very popular in the northeast. >> there you go. >> i search lyrics all the time to post on social media. >> remember the area is the appalachian mountains leading into the south. >> what else do you do in the
12:25 am
mountains but to listen to rap? >> down in the hollers of west virginia they are listening to rap music? >> racism is more prevalent to older people. mill 11 y'alls are more open and experienced the inclusion. old people don't like the internet. old people don't say i will go and google that. like andy said this is not a good way to determine by searching who in fact is racist. >> andy, i'll get to you in a second, of course, but think about this. as the oldest person here in the table how do you feel about what joanne said? according to the study much less than the average -- >> tell me when you have your point. >> much less racism exexists on the west -- exists on the west coast. do you buy that? >> yeah, legal weed. any place the weed is legal is not racist. you are too high to hate. you know what i mean?
12:26 am
that's clear. also, i didn't know people in the appalachians had the internet to google. that's surprising to me. if they were like. >> they have dial up still. >> maybe that's what the internet dial up sounds like. >> matt, what do you think? we always have to do a disclaimer. >> what if they beat me out and make it look like it. no fun up there. >> matt, what do you think of this whole thing and the credibility of the study? >> do the thing that was a flashing red light is when they said the more tallent was like 8% higher than the mortality rate elsewhere. as april paw lay shaw. this is the most pour place in the country. the mortality of healthy
12:27 am
people everyone there is 80% more. >> it is not though. >> it is not? >> no, they accounted for that. i actually read the study. >> wow. >> i may be old but the eyes still work. >> there is a point. in your position as a senior citizen here. >> yes. >> have you ever been to the appalachian area? >> i have. beautiful country. >> you hiked it at one point didn't you? >> beautiful country and people slandered by this study and andrew schulz. >> not by me. >> far too many people think "deliverance" is the entire appalachian experience, and it is not. >> was it for you or no? >> yes but that doesn't count. >> thank you. that was a very interesting thing. everybody should go out and read this study. what i liked about it is i moved to idaho -- i won't bore you with this, but i moved to idaho a few years ago. wonderful place fan --
12:28 am
fantastic state. but most people -- hold on. hold on. never mind. i was about to go that my idaho rant. >> tell us. >> most people think about a place like that and out west and they say it is racist and you have militias. according to the study no. we are much less. >> that's because it is only white people. it can't be racist if it is just you. >> come on out to boys see. -- boise. don't stay with me, but come to boise. >> i sit back in my chair and fold my arms. first, how can emojis turn from cute to cruel? i don't know. now somebody is losing their job and a word from our sponsor. >> tonight's sponsor is shammy rags is perfect for cleaning up blood stains. sentinel shapmy rags. do your due diligence and choose sentinal.
12:29 am
12:30 am
12:31 am
12:32 am
live from america's news headquarters i'm jackie ibanez. it has been a third night of relative quiet in baltimore and officials say 10:00 p.m. to 5:00 a.m. curfew will continue through the weekend. baltimore's police commissioner says he is expecting large protest marches this weekend. the city has been on edge since the death of freddie gray who was arrested earlier this month. mysteriously suffered a
12:33 am
serious spine injury. a special prosecutor hasn't given a time line for when she will decide whether to charge the six officers involved in gray's death. a police investigation has so far revealed the van transporting gray made an additional stop. that was captured by a privately owned camera. it was one of the unexplained stops after gray it was arrested. valerie amos is in gnaw poll to meet -- that you -- nepal to visit victims of the earthquake. scenes a heartbreaking. more than 130,000 homes have been destroyed. we are also hearing an up lifting story of survival. in one case a teenage boy was pulled from the rubble still alive. >> when i made light to him i saw his face. it was really -- he was screaming and when i told to
12:34 am
him, ask his name he get softer and we told him we are rescuer. >> it is only the beginning of the legislative process but the house has adopted a compromised budget that promises to speed repeal president obama's health care law. the proposed plan will also give the pentagon an additional $38 billion next year. a house vote is expected today. the senate will take up the matter next week. i'm jackie ibanez. now back to "red eye." despite the past couple times we warned you about putting your phone on airplane mode andrew is getting text messages. >> i'm sorry. i will put it on airplane mode. >> it could affect the circuitry. >> which is airplane mode? >> the one with the airplane. >> oh that's airplane mode?
12:35 am
oh okay. there is a moon one too. >> did emoji go too far? the houston rockets apologized for a goofy symbol on twitter. it is the subject of tonight's -- >> all right. you may have heard about this, but i will tell you about it again. during the maf vehicles and -- mavericks game they tweeted horse emoji and gun emoji just close your eyes and it will all be over soon. >> you said that before. >> that's terrifying. >> some people on twitter were offended. they apologized write and i quote -- the tweet was in poor taste and not indicative of the respect for the dallas
12:36 am
mavs and their fans. and they found the guy who manages their twitter account. andrew did the tweet go too far? >> i don't think they should fire him because i think it was educational. i wasn't the only one that didn't know that a maverick is a horse. i thought a maverick was like you play poker well. >> what is that tv show? that's absolutely right. >> there was a mel gibson movie and he was good at poker. okay dallas. >> james garner was the original maverick on tv. >> this is not the smart schulz. >> do us a favor and put your phone back on active mode and go over there and make some calls. >> i need my wi-fi. >> should the rockets have apologized? >> no, my god, it is texas. that's not the texas i was raised to loathe in california. that's how we are supposed to
12:37 am
act like in marin county or something like that. the world is getting ridiculous. trash talking will be illegal by 2020. >> on the playing field? >> on the playing field. it is too bad. >> surprised peta hasn't weighed in yet? >> no, they all died. >> peta died? >> didn't you hear? >> did you send out a note from sent that will? >> i'm so sorry. >> i am no longer referring to anything as the dumbest example of twitter outrage ever. every time i do that i am proven wrong within a week. this is so stupid. this guy should not have been fired. he should have got a promotion. this is a great tweet. this is sports trash talk. you are supposed to do this. it is an emoji. he didn't kill a horse. i would have been fine by the way if he killed an actual horse. >> society frowns on killing horses now. >> that's the thing i would
12:38 am
expect from the sentinal ceo. i would expect the blatant -- you know why he was fired? it was because he didn't actually use the emoji. he typed horse emoji. gun emoji. do you think there is a reasonable time for a gun emoji? >> you are going to a gun show and the real one not the muscular one. >> show us the gun show, joanne. >> you know, i think -- >> that's me cocking the gun. >> i feel threatened. chad was fired. chad is a very funny and clever humor should never be punished. it should be rewarded like andy said. but i think with the emoji use it would be great if the mavericks came back with emojis like a poop or a baby bottle. i didn't have a lot of time to
12:39 am
think this through. >> no, but i see where you are going. chad would have a great response. >> i didn't know his name was chad. i take everything back. he absolutely should have been fired. >> as his parents as well. you were upset about this earlier. we were chatting about this. you said i'm going to sign a paw session to get him his job back. >> i did sign the petition. now he should get a better job. >> people should go out there. if you are listening at home and theoretically we hope you are, you should get on the petition and sign it. >> why didn't he fire a rocket into the horse? just leave me hanging guys, thanks a lot everybody. >> let's wrap up the emoji story, shall we? coming up -- this is great. we love these things. the worst predictions ever. first here is what is coming up tomorrow on "kennedy." >> on the next "kennedy" johnny liton from the sex pistols. i don't know if it is john or johnny. we will find out. the last time i interviewed
12:40 am
him he ripped off his mic and walked off the set. hopefully it goes better for fox news network.
12:41 am
12:42 am
12:43 am
we're back. i predict this story will be amazing. the atlantic magazine asks journalists, academics and scientists and more to submit their pick for the worst prediction of all time. some of the terrible prague nos locations including the statement in the "new york
12:44 am
times" that apple would never produce phones. profit gene dixon's prediction that in the mid80s a massive comet would strike the earth by which time the u.s. would also have a female president. and another journal claiming mice and rats would become extinct. and the english language would drop the letters c x and q. obviously not a scrabble player might i point out. did they miss any? >> a couple. one when you predicted this story would be amazing. >> that's ridiculous. it is a great story. >> the worst prediction ever obviously was from president john f. kennedy on september 12th 1962 at i believe rice university where he said we choose to go to the moon in this decade. we didn't and to this day never have. it is a horrible, horrible prediction. >> wait, wait, wait. every time -- on this show every time andy comes up with
12:45 am
one of his complete theories we call him on it. you say we didn't land on the moon? >> you called gene dixon a prophet, not me. >> what is your absolute favorite worst prediction? >> that we would ever have a female president. i mean, come on. jk. >> jk? >> i do think we will have one in my lifetime, but it has to be the right one. i loved all of the y2k parties. that was great. i loved when predictions like these create parties. as long as we have more of those the world will be in a good place. >> matt, what would you like to add to the list? >> a merger. when aol and team warner got together -- time warner got together they said this is the end of internet freedom. we won't have freedom of speech on the internet
12:46 am
anymore. it blew up and was the worst merger in history and the hysterical idiots supported net neutrality. >> i know where you stand on that. we are simpatico on that one. >> it is not past predictions but what is -- >> a future. you have one for us? >> i do have one. may i amend something about jfk's worst prediction? his first -- his worst prediction is convertibles are fun. >> it is too soon. not enough time has passed for that one. >> predictions for the future. >> mike used to be in the cia and they are touchy about that. >> yes. in fact, i honestly just made a note to myself. >> no more convertibles, bye-bye. >> what was the thing he said so well? >> let's move on. >> we will have to take you down now. prediction for the future.
12:47 am
i think the i watch is going to be a flop. >> really? >> a bold move on your part. >> if it is not a flop nobody will remember i said that and if it is i am a prophet. >> we will revisit it every week. we will close things out -- >> i know, right 1234 we are at the end already? gronk reading erotic caw.
12:48 am
12:49 am
12:50 am
12:51 am
coming up tomorrow on the next "red eye." will ron and ely bratton. >> e block. last story. that's the last story. >> his muscles ripple in soft light and splash of water coming from the shower head. dang, that's sexy. his buttocks are sublime. gronk has a six pack you can wash laundry on. i lick my lips thinking about it. >> good night everyone, drive
12:52 am
carefully. we will wrap this show up five minutes early. that was the new england patriots tightened rob gronkowski or "gronk." it is called "a gronkend weekend to remember." an ohio couple featured on the couple is suing the author -- probably not her real name -- claiming their engagement photo was used without their permission. it was -- it caused them to be rid -- ridiculed. i don't know what they are ashamed of. there is nothing like a housewife getting off when the gronk does a spike in the end zone? right? right? maybe it is just me. andrew, would you be humiliated if your lady friend or whatever gender your partner may be was on the cover of this book?
12:53 am
>> if i was on it with her are you saying? >> it would be more humiliating if it weren't. >> it would be humiliating. i get humilidated. i wouldn't be humilidated because if somebody made fun of me for being on the cover that means they read the book. that is way mu -- way more humildadating to know you purchased the book than to be on the cover. do you think? >> i do think. that was a nice answer. >> my man. >> pablo escobar. >> the answer is not as humiliadating. joanne, you are writing a soft porn book. gronk is your muse or someone else? who? >> there are a lot of pro athletes to decide between. i combined them all into one character, but i chose gronk
12:54 am
