most americans are not entrepreneurs they are employees and they go and are hourly and salaried workers. republicans have figured this out and they need to speak to the americans, particularly in a time when the people feel the economy is rough, and put candidates up like marco rubio that might be able to do this. can they connect successfully in the election cycle in the way they were not able to in the last election cycle. we'll see who they put up and how they are doing their job. >> it is a question of whether the candidates will be in step. and i am listening to our viewers on twitter who are interested in what ben carson and carly fiorina has to stay. i am curious about the tension and how it plays out.

advising are acting more aggressively. considering we're very much at war, and on the offense in afghanistan, what is your reaction to that piece in the times? >> any time we have soldiers in a combat environment, you have to essentially recognize that they are at war. certainly on a war footing. 24 hours a day. 7 days a week. to think otherwise would be p pretty detrimental not just for us i think, at home but for the guys on the ground. that's when politics start to override kind of tactical common sense. >> you're saying wait a minute. the white house is telling us the war in afghanistan is over. but you're shaking your head. that's what time is doing as well. saying it doesn't seem like it. >> the taliban, every year there's a spring oh fensive thate offensive. we're at 70% fatality rates this time than last year. this year we're at 700.

if we want to say any progress that we've slowly made stay not devolve the way we see iraq fall apart we need to step up support. >> based on what you learned in three tours, what do you think we have to do. >> you have to keep pressure on the enemy. even though there are discussions taking place between the afghan government and taliban, the fact of the matter is, you always have to remember, at least something we need to remember afghan has pretty significant neighbors. it has iran as a neighbor and pakistan as a neighbor. those are very influencing partners in this but, you know to be honest. i think we need to keep the fight up. we need to reengage. let the rules of engagement ease off. we need to reengage with choice air support assets. it's one of the things we need to have the will to do it or not. i don't want to have our soldiers there, young men and

women. to sacrifice with one hand behind their back is a disservice. either do it or let not. >> interesting. my husband being among them in iraq specifically he has the same attitude which surprises people here at home who have not been on the battlefield. which is willingness for those in the fight to go back and continue the fight until it's done. talk to us about that. politically, count hear a lot of lawmakers say that. and also the public. you get a feeling, what about lives, and being able to protect our soldiers in the right way. we don't want them getting hurt over there for a purpose that we don't completely understand. what do you say to ha that? i think individuals like your husband and myself are probably biased. and it takes something to step aside and look at it from a bigger picture. it's hard to step away from the fact these aren't names and letters that we sign as a president. these are friends of ours that died. that's american blood on foreign

soil. to a certain extent that's hallowed ground. you're saying it's worth it to finish the fight. >> it's worth it in the sense if we want to stop afghanistan. we've got iran pakistan and you've got isis which is increasingly becoming problematic. i think if we want to ensure afghanistan as a country. they have to have a safe enclave. there is some work in that fight. unfortunately. politics at home. there's a lot that deploy. i don't think we're listening to anybody. to be perfectly honest with you. we have a president that doesn't want to call offensive operations. we have congress that can pass a budget and defense department under sequestration. you talk to anybody in the

investigators putting together the pieces of a shooting. the two gunman killed after opening fire outside of the event near dallas last night. the security guard was injured. drawings have sparked violence around the world. including the offices of the satirical magazine. those cartoons are used as an excuse for violence. investigators are looking into the terror links to the texas attack. katherine is just outside of washington for us now.

candidates for president. is that a good thing? don't miss my take top of the hour. five russian relatives of boston marathon bomber dzhokhar tsarnaev are traveling to the u.s. for the sentencing phase of the trial. tax payers are funding the trip. six fbi agents are hired to guard them while in the u.s. dan shore is a former prosecutor. talk about a fair trial. we the american people are spending this kind of dough to pay for protection -- first of all the plane tickets and protection of dzhokhar tsarnaev's trial. it can't be cheap. >> absolutely. we're paying for the whole trial. but the part that bothers me the most is is it not insane to bring family members of a terrorist to the country, number

one or number two? >> i assume they're not on the no-fly lift? >> probably not >> their testimony is not going to make or break the case. if your mother, brother, sister, brother can't say something nice about you, nobody can. he would be better off if independent third parties help you escape the death penalty. >> but it shows he has people who love him. >> it's about the criminal justice system asking the jury to agree to execute somebody. we have to give them every possibility to bring in people they want h that are favorable to them. none of these witnesses will say he didn't commit these crimes but the defense only needs one juror disagree with the death penalty and his life will be spared. if they get some sympathy through family members that's something the defense will pursue. >> this is a death penalty qualified jury they all said under the right circumstances

they could vote for the death penalty, right? >> they have to say that in order to get on panel. i believe the strategy is, as dan said, if they can convince one of those jurors to not vote for death. then you don't have a unanimous jury and he won't get put to death. just one. you don't have to convince all of them. >> so the attempt to present this young man is a misguided youth under the sway of his older brother. >> he's misguided and under the influence of his brother. that's why he did it. he was very deliberate. he knew what he was doing. he planted the bomb near people. now the question for the jury is do we sentence him to death or life in prison. the defense says we're not asking you to set him free we're just asking you not to execute him. >> let's turn our attention to colorado where the trial of james holmes is underway.

johnna while the prosecution really has to proveta this guy was sane at the time he committed these acts how are they doing on that score? >> first of all. this is really unusual. colorado is one of a handful of states i believe it's 14, that require the prosecution to have the burden of proofing sanity at the time of trial. versus all other states that have the burden to prove they are insane at the time. what the prosecution has to do here is show that all of the planning and all of what mr. holmes did the day he killed 12 people and injured 70 was not part of a psychotic episode air quotes but rather purposely done plotted and planned, so that he knew the difference between right and wrong when he committed the act. >> what about all of the planning. doesn't that suggest the work of a sane mind? i mean there was all kinds of pre planning that went into this. >> right. this is not a very strong defense. insanity is a defense of last resort where there is no other

legal or factual defense. he put himself in body armor. that shows he's thinking he is doing something wrong. he targeted specific moviegoers as they were leaving the theater. he booby trapped his apartment so law enforcement would get hurt. this is thought-out problems. >> i know in the boston case the prosecution asked the judge please let the family members testify quickly so we can put the fbi agents back on the street no longer protecting the tsarnaev clan. thank you. two former officials linked to governor chris christie appearing in federal court today, charged with shutting down lanes of the george washington bridge as political payback. what do they have to say about those accuseizations? that's just aahead. plus the coast guard pull these people out of the water but the search for a fourth one is still under way.

payback. what's the latest outside district court in new jersey? >> reporter: there were two not guilty please in federal court in newark. the lane closures on the george washington bridge not only caused traffic tie-ups for days but poll ratings for governor chris christie plummeted in the garden state. his fired deputy chief of staff bridget ann kelly appeared in court. she was the form he official who wrote that infamous e-mail "time for some traffic problems in ft. lee." charged with nine counts of fraud, conspiracy wire fraud, civil rights violations. she was arraigned with her top/pointee to the new jersey/new york port authority. kelly's lawyer says his court appearance is the longest they've ever been together and they did not conspire those lanes. he blamed the prosecution's star witness, david weilstein, the former christie political ally
