"happening now" glynns right now. jon: a chilling new warning from the fbi about the threat from isis right here on american soil. welcome to "happening now" on this friday. u.n. jon scott. jenna: i'm jenna lee. fbi director james comey says there could be thousands of isis followers among us of the that the terror group is setting a new precedent. jon: the precedent involves using social media as recruiting tool. there are quote other elton simpsons out there, referring to one of the gunmen in garland, texas. leland individual live at the

white house with more. >> reporter: jon, it is our understanding that the fbi knew about elton simpson's intentions in the hours before the attack in garland. three or so hours before the attack the fbi says they had a picture what was going to happen and forwarded an alert to local law enforcement in garland. the garland police department is not really saying when they knew what when but they do say that the officers there on the scene had not gotten any warning that simpson was headed their way. the fbi thinks though that there are hundreds if not thousands of people in the united states being self-radicalized by isis and it is very sophisticated social media platforms. taking at face value, i fbi is saying isis is getting better and we're having tougher time to keep track of them. in a quote from james comey, the old paradigm between inspired and directed breaks down here.

pete snyder, former pollster to rudy giuliani and ceo of disruptor capital. both are fox news contributors. to you first, pete. looks like we'll get another gop senator into the race. how do you assess lindsey graham's chances? >> you know, jon, i really don't. i don't think this will set off the richter scale in any way, shape or form in the republican presidential primary. look there are rumors in conservative circles that lindsey graham has one mission and one mission only. that is to take out rand paul and to really represent a lot of the hawks in the republican party. i don't know whether or not that is true or not. i don't really expect a lot of fireworks coming out of senator graham. jon: to you joe, the announcement or the statement i guess from jeb bush that his brother former president george w. bush is his key advisor on israel-u.s. relations jeb has made it clear

he will be his own man in this campaign. why did he make such a statement? >> look it may help him in his own party primary but i don't think it is much of a help long term in the general election. look, i think a lot of people have problems with both bush foreign policy and obama's foreign policy. w's foreign policy. i think jeb's i thought had done a smart thing by talking about him being his own man and then he went with wolfowitz and in a lot of advisors around his brother, george. now he is saying he is going to be his top advisor on israel. i think like i said, it may help him in a republican primary. pete might have a better view of that. but i think in the general it is not helpful at all if he makes it there. jon: sticking with you for the moment joe, a lot of people say that, you know, a u.s.-israel relations under the obama administration have really hit

rock bottom. therefore maybe if you flash back to the george w. bush bush 43 administration, maybe you pick up some votes or some support? >> i mean i think there is some logic to that but, look there is one person in the race that doesn't have to go for bush foreign policy or even obama foreign policy despite the fact she was his secretary of state that is to project clinton foreign policy. >> please, joe come on. she was the secretary of state. she owns barack obama's foreign policy give me a break. that is just not, that is just not credible the problem for hillary clinton is, right now she is oddly, running away from her husband's legacy on domestic affairs and is really married to barack obama's foreign policy as his secretary of state. >> pete, i think that is true just as jeb bush will be tied into george bush's foreign policy on israel. i'm saying hillary clinton is

seen as a friend of israel by, i mean this is not somebody who has, doesn't have her own standing and probably may even reflect be viewed more pro-israel than obama has been obviously. and that is going to all i'm saying she is the one who i think has some room to move, if jeb bush goes with george bush, i'm not sure that is going to work very well in a general election. >> i think as it relates to israel it's a very good thing. jon: pete, let's talk about the prospect of any of these republican candidates against hillary clinton. lindsey graham as we said appears to about to get in the race. jeb bush everybody expects to get into the race although it is not official yet. all the republican candidates are trailing hillary clinton in the polls right now. how much as a republican does that worry you pete? >> not a bit jon. i actually love the fact that hillary clinton is going to be anointed by the democratic party. i think there is going to be great consternation because she has a glass jaw.

she is not a very good campaigner. she is going into many contortions running abay from her husband's domestic policy agenda is just ludicrous. she will be wed tightly to the disasterous foreign policy of the obama administration. it is tough. it is not a credible candidacy. she is running away from the media. she is holding these odd town halls where everyone is forced to read off of talks points. she runs out of there with a press screaming after her. it is an odd candidacy and i don't see her becoming the next president of the united states. jon: joe you know, a lot of candidates don't particularly like the media but this count of questions that hillary clinton has actually answered of reporters, i think seven of them since she announced her campaign, what do you think about that? is that dangerous or is it helpful? >> well, she look, we've got

16, 17 months moving forward she will get asked a lot of questions and answer them from the press. i don't think there is any anxiety on all in the democratic party right now about the kind of campaign she has been running in terms of basically i think you're going to see a lot more town halls and things like that interconnecting with people. i'm not sure you will see a lot of press availabilities. >> joe, at this point in time, tom brady has answered more questions from the press than hillary clinton who is running for president. it is ludicrous. >> pete, i like, i know, this is same stuff that was happening in the obama 2012 campaign. he republicans were going to roll him. he wasn't popular. there wasn't going to be turnout. every, if hillary clinton is the horrible candidate you guys think she is, then it will be a great november 2016 for you. i just don't it is going to work out that way. i didn't think it was going to

governor chris kissty, south carolina senator lindsey graham ohio governor john kasich, florida senator marco rubio and wisconsin governor scott walker. there will be activities to try to stand out with donors. much of the republican weekend will be in south carolina trying to sell their conservatives credential in the first in the primary state. meanwhile texas senator ted cruz is coming off a strong showing in strong polls across the palmetto state last weekend. he will look to build on it. former florida governor jeb bush will be at liberty university to deliver the commencement address tomorrow and sit for his first television interview in several months with our colleague megyn kelly. as for today, chris christie is on the stump in a critical state for him, new hampshire. >> i've really enjoyed coming up doing town hall meetings and meeting folks. everyone is so engaged and really interested in the process and what everybody has to say about the future of our country the kind of things we need to do

jon: fox news alert. tragedy underway in atlanta right now. a small plane has crashed on i-285, right there at peachtree road. four people apparently were on

road that small piper. all four are deceased. there is a huge traffic tie-up. i-it 85 is shut down in both directions. i would note that the peachtree airport is not far from the crash site about half a mile or some this may be a case where the pilot had engine trouble on takeoff, tried to set down on the highway and couldn't successfully set the plane down of the plane impacted the media. that apparently cause most of the damage. there was extensive fire. suggesting a lot of fuel were onboard. four people are dead. people are asked to stay away from i-it 85. the traffic -- i-285. the traffic tie-up is enormous. jenna: threat level is raised at u.s. military bases across the country. jennifer griffin is live. she first broke the news. jennifer what you dough know? >> reporter: we know the force protection level has gone up to

bravo. it was decided by u.s. northern command based on unspecified terror threats on isis online as well as threats to military personnel. i'm being told by spokesman for dod and northcom. this is prudent measure. this is not due to a specific terrorist threat but a general terrorist threat based on the current situation with isis. remember the fbi director james comey yesterday mentioned that there are isis cells here in the united states and they have made threats online against u.s. military personnel. so this was a prudent measure. what it means in real terms there will be more guards at bases more identification required to enter the pentagon as well as military base. it is going to mean long lines outside of bases with people showing two forms of military i.d. there will be random exercises and drills. but what is significant about this jenna, this is the highest threat level since the 10th

anniversary of 9/11. so it does show there is very real concern about the isis threat and, that it basically the commander of northern command, norad, who is in charge of base protection here in the united states feels that it is wise at this time to raise the awareness and threat protection level to bravo and that what he has essentially done today. jenna: just to be clear jennifer, is it just domestically we're looking at military bases or is this wordwide? >> reporter: well right now the order came from u.s. northern command, norad, northcom, and so it affects u.s. bases. domestically. i'm not sure at this moment in time whether it also applies to bases overseas. they may have already been at a heightened threat assessment level because of all of the events that have been happening in europe and elsewhere overseas. i think what is knew about this, is that the domestic u.s. bases

have been raised in terms to level bravo. jenna: it has been a fast moving week. a shooting in texas on sunday. a lot of reports about isis and their presence in the united states. a lot of news to take in and continue to report on. jennifer, thank you very much. jon: well, police say the serial stow away is at it once again. now she is caught on camera trying to sneak through airport security. we'll show you how she pulls it off. what a judge is ordering her to do this time. seat of honor at a major russian celebration next. we'll look how the close relationship between those two powers could affect the rest of the world.

why china and russia in this particular event? >> china and russia have been coordinates their foreign policies and they have been forming an enduring partnership. we saw this back to the syrian civil war where they cooperated on four security council vetoes. both their ships were sorting together in the eastern mediterranean to oppose us. across the world they see their interests converging. they see themselves in the same terms and they are like-minded. jenna: what is their ultimate goal? >> i think the ultimate goal is more power for each of themselves. nevertheless what they're doing to trying to undermine the liberal international system and specifically to frustrate american objectively in the world this is whole issue of peace and stability. they're both trying to rewrite the maps of their territories through the use of force. because of that, you know we can't live in peaceful world if we allow them to continue on this path. jenna: you called them the dragon and the bear, meeting of the dragon and the bear this weekend. part of their relationship is financial and that's crucial, you say without china's help,

essentially russia may not be as able to go into ukraine or do some of the things that russia wants to do. what is that, that partnership? >> yeah. since the end of 2013, we've seen three major oil and gas deals where the chinese are going to be taking hydrocarbons from the russians and paying decent price. this really gives putin the ability for his adventures in eastern ukraine and crimea. otherwise he couldn't afford it because his economy is contracting right now. so he really needs resources and beijing has stepped up, not only given him financial help but also diplomatic support. jenna: interesting. if china was to back away from the deal we know what is going on with the russian economy right now, it is not good. russia wouldn't be quite as powerful. >> they certainly wouldn't. they wouldn't have the money to continue to these misadventures abroad. clear lit russians know that the chinese have their back. so they don't have to worry about things going on in asia. that is very important for

jon: fox news alert. the funeral of officer brian moore getting underway now on long island. one of new york's finest killed in the line of duty. he died on monday after he was shot over the weekend. a career criminal who moore and his partner had stopped for carrying what they believed was a concealed handgun was in fact carrying such a weapon. he opened fire. and this youngster was killed. he is also the son of a

new york city police officer. it is believed that thousands and thousands of police from all over the country are here for this funeral. obviously it is standing room only inside of the church. and thousands more are still outside of the church. his, his hearst was led to the to the parish about 15 minutes ago by a marching contingent of new york city police officers. just one of the saddest saddest police fun we have seen in ages heork. this youngster, just 25 years old, trying to do his job, confront as career criminal who pulled out a gun and shot him once in the face. our julie banderas is covering the funeral for us. she will have full report in the second hour of "happening now." jenna: new england patriots quarterback tom brady saysihe hasn't had enough time to digest

decided. molly line, thank you. jon: to the fierce debate over terrorism and free speech following the attack outside after prophet muhammad cartoon contest in texas. now the debate is expanding. critics are calling out news outlets, fox, supposedly blaming victims when they exercise free speech. op-ed in "the washington post" write, quote a judgment has emerged that preaches compliance with the notion that particular form of expression means you're asking for it. that viewpoint has trickled down from the bosses of these news organizations into the coverage as pamela geller, the organizer has discovered. once the media draws a line it is tough to undraw. talk to our media panel about. judy miller is pulitzer prize-winning investigative reporter author and fox news contributor. lynn sweet is washington bureau chief for the chicago sun seems times. does that editorial judy have a point? is it the, have the media been complicit i guess in blaming the

messenger for the event that apparently brought on the attack? >> yes i think some have. and if you listen to chris matthews on msnbc or chris cuomo on cnn, chris matthews actually said he wondered whether or not pam geller is draw muhammad contest had to cause the events that had unfolded in garland texas. i want to be very clear about this, jon. i'm not objective on this topic. i went to jail for 85 days to defend the first amendment. i am a first amendment absolutist. there is no but after that. but they were provocative. i am aware of pam geller's group. i know that the ad l brands them a hate group. so does the southern poverty law center. their event was a draw muhammad cartoon contest. the winner of which was a former croatian muslim who said, i'm

drawing this because muhammad says i can't. that is not offensive speech. i don't care whether it is offensive. what happened in garland is unacceptable. if we don't condemn it absolutely the jihadists win. that is the stand megyn kelly took. i agree. jon: we're having audio problems with lynn. are you able to hear us now. >> now i am. jon: terrific. what do you think, about the entire premise that, cable outlets have been blaming the organizer and other news media, blaming the organizer for what happened? >> well, first of all agree with judy about the first amendment absolutist but i think the issue isn't so much whether the cable outlets are to blame or not. they're free also to put forth their points of view. i think what's interesting is that geller is trying to pivot and make this a first amendment issue when, no one is saying she didn't have the right to have

that exhibit, which as judy says the adl southern poverty law has labeled that organization as hate mongering. keep that eye on issue hate speech. certainly any cable outlet any newspaper, any outlet has a right to do whatever reporting they do. you know, let's keep our eye on the ball here. that right now when you look at the web page, the website of geller's outfit they are trying to raise money off of anti-islamic images. and, let's decide as news organizations, if you want to just report on the news, event do more than that and in a sense help somebody fund raise. that is kind of the issue here. jon: lynn, i'm a christian. i could go probably half of the galleries in new york and find you know, some artwork exhibit that i as a christian find you know repulsive or abhorrent but that doesn't give me the right

to go in to shoot up the place. >> we all agree. hold on. that isn't even the issue. here. i don't think. of course violence, do we even have to say again in which case i will, that, that kind of violence and shooting is abhorrent? everyone every reasonable person should be against that. no matter what but let's not falsely get distracted as to thinking this is free speech issue when question right to put on hateful speech exhibit. do you remember many years ago there was suburb of chicago skokie. many holocaust survivors lived there. the then neo-nazi party wanted to march. a lot of court battles happened over that. just because in the end they had a right to march which eventually they did in another place doesn't mean you have to go to that march. so let's keep our eye on the ball here. jon: so, judy, if i hear you correctly you're saying that pamela geller had every right to put on this exhibition, you just

disagree with the way in which it was put on? >> no, i don't disagree at all. i wouldn't attend it. i don't particularly like the way in which she approaches political islam. i think she she blends she conflates mainstream islam with radical islam which i think is very dangerous and wrong. but that being said, the amount of airtime spent on analyzing her group and what they're about versus the amount of time spent on two bar bear rans who marched in there and fortunately were killed and tried to disrupt it through violence that is where the focus should have been not whether or not she provoked it as some people said, brought it upon herself, that means that if you have that kind of argument i believe jihadists win. their goal is to shut down debate in this country, for many cable news networks that would be fine because they don't

approve of pamela geller. i don't approve of her, but i will fend to her death the right to hold a you muhammad cartoon contest. jon: if it woman wearing provocative closing gets raped do you say she was asking for it. >> of course i won't even go there. that is not the point. we know that. the way judy described it is something that is a way maybe we should be thinking about it. one, the bad guys are the bad guys. let's not take our eyes off that ball. jon: so why the focus on pamela geller? >> right exactly. >> well if it were up to me i might not even have done this segment. >> owe i think we desperately need this segment. jon: we appreciate you for coming on. >> thank you. i think you take it i hope in the right spirit, that is, that she perhaps doesn't need more attention than she has. i mean i understand that the issue we're discussing are important. >> her life is now threatened.

fred tecce joins me with criminal defense attorney eric gunster. she was 17 at the sometime this happened. >> right. jenna: she is only witness still alive. one of the questions we're raising for prosecutors who continue their cross-examination is, how do they cast doubt on her telling of this event without coming across like a bully, and making sure that they say, they proved that the fact that she was part of this not just a victim? >> well, couple, three basic points. first of all when you're a trial lawyer in the courtroom you have to use the right demeanor for the right witness. this woman is charged with being part after homicide that killed one police officer and seriously wounded another. and when she takes the witness stand the judge will instruct the jury, she is like any other witness. so your job is to painstakingly show she is not telling the truth. they have already shown she was less than truthful and less than candid about her relationship with the guy. jenna: how so, fred?

>> show she was only one there. jenna: how have they proven she was less than candid with the relationship with the murderer? >> they look the at her cell phone records. they got her cell phone records showed them to the jury, buying wedding addresses looking to place and told people that she would mary the guy and move to mexico and told the jury that was not the case. jenna: how see effective is that. >> very effective. when we are examining young people we have be clear to not come across as bullies. she can't say the easter bunny made her do it. she blames it on the guy who is deceased. they may buy it. it will be a very tough case. she drove away. had a good relationship with this guy. officer was killed and people take that very seriously in this age of almost lawlessness we're seeing around the country. jenna: we see video where they both get out of the pickup truck. here behavior fred, didn't look

like someone cowering. that is part of the issue. >> right. jenna: but what her story as she tells it. fill as narrative you see play out in the a movie. this guy was obviously a bad guy. he was 10 years older than her. getting to prosecutors. how do they go through the list of charges? there are 11 charges against her including first agree felony aggravated murder. these are a lot of charges. will they be able to prove them all? >> they only need to prove one of them, prankly the aggravated felony murder which she was a part of. compelling testimony from the police officer at the scene when her boyfriend was actually shot and killed who said her conduct was not consistent with someone who was kind of being, being someplace against her will. i think that testimony will carry a lot of weight. look, it's a tough case for the state. it is not an easy case. they're doing the best what they have to work with. jenna: if anyone ever has been angry at their phone company this will be the case for you during the 1:00 hour. >> let me beat up on fred next

♪ jon: well doesn't get anymore electric than new york's times square. now the billboards and neon signs placerred along it are not going anywhere. this after some worries in the big apple over a federal law that threatened to force them down. the law is intended to restrict signage along national highways. turns out that includes streets near the crossroads of the world gregg jarrett live in times square with an explanation.

gregg? >> you said it, jon. crossroads of the world or the great white way which is so named for the brilliant lights that illuminate times square behind me. take a look at it, especially gi-normous billboards. that is the problem. under a 2012 federal law the streets that run through times square are highway arteries. that means under the 1965 highway beautification act billboards are limited to 1200 square feet. but see this american eagle outfitter billboard? that one is 15,000 square feet. so way over. and city officials were worried that the feds would withhold $90 million in highway money unless the billboards came down. urban planning experts say bureaucrats in albany and d.c. are trying to impose their view of beautification. >> if it were a mix-up, it would be simply innocent. i think this was a clear case of excessive regulation by people who were trying to meddle in the

great part of new york times square. >> tourists here can't imagine two things sirens, no sirens, and of course the lights behind me. they can't imagine it without it. >> i think it is just the government trying to run everything like they always do, you know. this is, this is like a national monument having this stuff here. >> this is why people come to times square, for this color and action and the bright lights. and, i just don't understand why they would have to take them down. >> well now the federal highway administration trying to tamp down the outrage saying it never wanted the billboards to come down never threatened to withhold the money. they talked about the possibility expanding the streets run you through times square as highway. that should be a no-brainer. as you can see you usually travel about five miles per hour
