they are urging you to be on alert. chilling last words from a pilot killing all four people on board just moments after having problems during takeoff the pilot reports on the radio "we're going down." greg bird and two of his sons were killed along with one of the men's fiancee. he was flying his other son's graduation in mississippi. police say it's a miracle that other drivers were not injured. >> that plane was so low it wasn't even higher than the truck. part of the plane on the left side hit my truck. i looked to my left and the plane was up against the wall burning. transportation safety. >> a single juror causing a mistrial in the aton murder case. juror waived to reporters wasn't sure if pedro's mental state and couldn't find him of murdering that

slammed with golf ball sized hail look at that. how would you like to be hit in the head with sthavment forcing the university of oklahoma commencement program. you would not want to be outside when that happened. >> now would not. all the heavy rain leaving nearly a dozen counties totally under water. rick reichmuth is tracking today's threat and we're going to check in with him. hey, rick. >> imagine a foot of water for a couple of days. some places can handle that that's not one of the spots. there is a lot more rain to be had there. severe weather. severe watch across the panhandle of texas. this is just the preamble of what is going to happen later on in the day today. the severe threat exactly the same spot that it's been for the last three days. day after day of this weather. imagine you have a tornado to go through your area and

more rain and more severe weather threatening. right here you see that bulls eye. that's where you could be he seeing the tornadoes today. kansas maybe the panhandle of oklahoma and little bit of oklahoma as well. that's where we could be he seeing large and very long lasting tornadoes. those are the ones so incredibly destructive. tornado threat as you go farther down. almost all the way i down toward the big bend. tomorrow, mother's day, take a look at this. much of iowa under the threat again down through arkansas and texas. then go into the start of the workweek and it varies slightly off to the east. in general you notice that in the same area especially across oklahoma and texas and arkansas. over the next few days we will see potentially over a foot of rain in a few isolated spots. that means that threat for continued flooding. one other story we will be watching very closely today are the tropics. we have a tropical storm. three to four weeks away from the official start to hurricane season. later on toned we will be

looking at a landfall of a tropical storm 50 to 60 mile-per-hour tropical storm south carolina. really rough weekend of weather for most of the country to be honest with you. >> wish them all the best. thanks rick. >> here we go again. attorney general loretta lynch newly installed at the dea announces an investigation of the baltimore police department is it an attempt to federalize the police departments across the country. here is the attorney general in other own words explaining the rationale watch. >> the issue goes beyond the interaction between the police and the community. because we are talking about generations not only of mistrust but generations of communities that feel very separated from government overall. and so you are talking about situations where there is a flash point occurrence that coalesces years of frustration and anger. >> that, if you are

ferguson and baltimore. four other cities that have been investigated by the doj as well. >> awful these investigations, of course, have resulted in compulsory diversity frank which is basically an attempt by the federal government to control the minds of local police departments and you wonder will this result in safer communities? does the federal government have a right to come in and run your police department? >> some members of congress hoping that will be the case. i think al sharpton is also calling for that as well. >> of course he is. >> this was all covered by this weird moment yesterday when this was rolled out these announcements from the doj. this came as the nypd out on long island was burying one of its own, of course a police officer, brian mooar who was shot in the head last week and then fatally died a few days later after confronting a suspect who had a gun in his belt loop and said hey what's in your belt he was shot in the face

inside the police car. this announcement from the doj about baltimore happened just as this funeral was unfolding on long island. >> that's the problem here. couldn't they have waited a few days? we're burying one of our own. here in new york city and all over the country officers from all the five burrows attending his funeral. across the country array of officers. officers from canada showing up. all of our local newspapers have his mom and dad and sister sobbing. and the doj has to do this on the day of the funeral who did the right thing. >> peter king of new york was on the kelly file, watch. >> to me, it was the height of irresponsibility to be doing that at the same time that this brave cop a neighbor of miami mine brian mooar being laid to rest. shot to the face and through the brain and they're talking about investigating cops. the fact is everyone in america should be giving

operatives over the past few months and importantly james comey has alluded to quote unquote tracking radicals. about 100 isis individuals who are under investigation. so again the fbi should be much clearer about this i think be putting out incredible threat we all have to be aware of. down playing it for political purposes. i think so much pressure ising being put on them to basically not admit that we have an isis problem and i think that's what -- it's almost criminal. >> the fbi director is saying that there might be thousands of isis fighters here in america. >> and i'm saying that they have actually identified a number and are taking action and not telling us. i think this is where saying that there may be out there and they are doing it is two different things. there is a credible threat. that's why dod is finally i think, about raising its threat level. this is more about protecting our military installation. >> how are you learning if

they are not telling us? >> come on i have sources and i talk to folks. another organization i work with, you know, judicial watch is actually going down and doing their own investigations on the border. this is another issue. i don't think they want to highlight the fact that the southwest border as much as the president wants to allow free immigration is a real problem. people -- isis folks are coming across and i you think this is another area where they don't want to see people actually pay attention to because it's very bad. >> i don't understand how we doo we combat this though? how do you get into the mind or change the mind set of somebody who really believes kill kill, kill. >> two things you have to accept there is a sinner group drawn into this. they are. what you then have to do is essentially monitor and isolate them as long as you can. and then anticipate what's going to happen. i'm not saying you should round up people and put them in prison. i'm saying certain patterns are apparent and become apparent right before they become ready to radicalize.

done about government overreach into local school boards across the united states of america? this apparently is being compelled upon us by the office of civil rights through the u.s. department of education under the office -- the u.s. department of justice. and they are saying that title 9 which was passed in 1972 somehow includes gender identity. and the notion that the federal government could reach into the 14,000 school districts across the united states of america and tell 90,000 school board members that you must comply or we're going to take away your federal education money is preposterous. that money is meant for the needest children in our communities for the hungriest children, for children with disabilities. my federal government telling me that if i don't comply with whatever, this language or any other language, that i have to comply with their language or they are going to take away our children's lunch

the argument of course is that you go through protracted primary season, mr. mayor and they are duking it out. it exposes all of their war wounds so to speak. hillary clinton gets to sit back and watch all of this unfold is that bad for republicans? >> if we do it the right way it should be good for republicans. it means we are going to have interesting debate over ideas. over things that are important to the american people. while we try to get hillary to answer a single question. it's really hard. we like to know why the heck she wiped out half of her emails while she was secretary of state. i find that extraordinary. i find it extraordinary that the media goes crazy over what mr. brady allegedly did with patriots and hillary rodham clinton is wiping out half her emails while she was secretary of state is considered by the mainstream media to be like a parking ticket or something. >> i was in the government most of my life. i don't remember keeping government records in my house and i don't remember destroying government

tropical storm ana was? >> she is her own tropical storm but in a good way. the new attorney general loretta lynch announces that the department of justice will investigate the baltimore police department. the question is will police there be able to do their jobs under the scrutiny from washington? >> well, perhaps not. because they already are. reports out of baltimore this morning if you read "the baltimore sun" and other reports you hear police officers quietly talking to reporters saying they are seeing guys who are go getters go out there and get guns and bad guys and drugs and sort of hands off now. because as some are saying they have never seen so many dejected faces down there. this is loretta lynch the attorney general on friday talking about frustration and anger in the police force and the community. listen. >> the issue really goes beyond just the interaction between the police and the community. we are talking about generations not only of mistrust but generations of communities that feel very

separated from government overall. so you are talking about situations where there is a flash point occurrence that coalesces years of frustration and anger. >> i'm sorry. i just -- i'm really bothered by that for one simple reason. the attorney general is the nation's chief law enforcement officer. her jobs is to enforce the laws by definition. it's not to rectify generations of bad feelings or make people feel closer to their government or aalleviate anger and frustration. it's to enforce the law and whenever a attorney general decides her job is to make america a warmer better, friendlier place you should be worried and we should be worried about this. >> federalizing of the police force when there is not epidemic of excessive force violations and that's specifically what she was talking about excessive force. there is no exact definition of excessive force. it's really in the eye of the beholder and police department. a number of reports over the past few years have looked at excessive force and it ends up being a fraction of 1% where there are convictions of excessive

force. is it an epidemic? is there a reason we have to rid our nation's police departments and have the federal government step in? i don't think so. >> the civil rights division is going to go to baltimore and meet community leaders and meet with law enforcement and try to determine if excessive force was used. if there was any discrimination. if violations were found the practices will change in that community and they will be enforced by the court. >> like i said earlier it's already happening. you have a number of police officers going "on the record" talking about how there a all these feel like the swift hammer of justice is lording over them and not going to be able to go out there and do their jobs. >> that's a good point. >> i think are there are some bad cops out there. i covered the cops. but. >> there are more good ones than bad ones. >> of course. the federal government can swoop in and take control of your police department and the underlying assumption on the part of the obama people is bias is the biggest single problem in america's cities.

that's not true. they are caught in 1955. different america. very complex problems and to reduce it just to big tri is insane. >> clouding over all of this is that yesterday's now. announcement was odd timing came almost literally to the moment as the nypd was burying one of its own. brian mooar out in long island huge, huge service there for him. really heart-breaking service there as bill bratton was at the funeral holding up posthumously a new detective shield paid to brian mooar posthumously and he he had to hold back tears, listen. >> as brian's death comes at a time of great challenge in this country, police officers across the country we are increasingly bearing the brunt of loud criticism. we cannot be defined by that criticism. what is lost in the shouting and the rhetoric is the context of what we do.

that? 25 people murdered you? think the white house would be upset with that instead lecturing the police department for bog bigotry. >> 20 higher than at the same time last year. and there are a number of city leaders who have come out and said look we see a slow down, we are seeing a slowdown in arrests. uptick in violence. >> officers reluctant to do their jobs like you said. >> one man kenneth butler who represents black police officers go getters go out there and get the guns and the bad guys and drugs. they are hands off now butler said. i have never seen so many dejected faces they are reluctant to go after crime. >> you want to get hauled before diversity panel and get electric tiered by the feds of course not you don't pursue the criminal. >> other headlines to start with this morning. a fox news alert. overnight 40 inmates escape during a mass prison breathe break in iraq. some escapees believed to be jailed on terrorism charges. at least six guards, 30

prisoners are now dead and officials say it started with a fight between inmates and when guards went to break it up they were overpowered they had their weapons taken. the prison is about 50 miles north of baghdad. killing all four people on board. moments after takeoff the pilot reports on the radio quote, we're going down. greg byrd and two of his sons were killed along with one of their fiancees. byrd was flying to his other son's graduation in mississippi. police say it is a miracle that other drivers on the highway were not hurt. that plane was so low. part of the plane hit my truck. i looked to my left and the plane was up against the wall burning. >> the national transportation safety board will investigate that crash. tom brady will reportedly face the music for deflate gate next week. one report says that he could be suspended for up to 8 games. but it will likely be lower than that, we're thinking or

many reports are saying. investigation found brady was at least generally aware that staffers were deflating footballs. brady dodged questions about the report during a public appearance on thursday night says the scandals did not take away from the patriot's super bowl win. spanish police getting a major shock when x-ray uncovered that. a young boy in a suitcase. a moroccan woman is caught struggling 8-year-old in a spanish territory in north africa. the boy was scared but unharmed. his father reportedly paid the woman to carry that suitcase across the border. the woman is in custody and the boy is with authorities. those are your head lines. >> thanks a million ainsley. now to your extreme weather. there is a lot of it. more nasty storms expected to slam the midwest today. that comes a day after four townders touched down in the state of texas. >> there it is. >> there it is a tornado. reported from last night wants tornadoes but there have been two deaths following storms this week. >> then in norman, oklahoma, pummeled with hail. look at that, a size of a tennis ball. rick reichmuth is tracking the threat. >> crazy. >> two of the fatalities this week have been from flooding. not even from the tornadoes that have caused some of that destruction but people in their cars when you go into some of those flooded roads. we will see a lot more of that over this week across much of texas. and oklahoma and into arkansas. again, it's all part of this kind of stubborn system out across parts of the rockies. bringing a lot of snow. we might see two feet of snow in the black hills by the time this is done. as that cold energy makes its way in here towards the planes. this morning severe weather going across the panhandle of texas. mostly some strong winds and we do have hail going on this morning. as the day heats up and things clear out a little

bit and then we start to see the energy pick up. we will see the severe weather. the bulls eye for tornadoes is going to be southwestern kansas and far eastern colorado but we might see some of that extending down in across the panhandle of texas and oklahoma. overall, much of the same areas seeing that severe weather today. tomorrow stretches a little bit farther off toward the east and throughout the day on monday. talking about it here across pars of the mississippi river valley. overall though we will continue to see that tornado threat. certainly the hail and wind. the incredibly heavy rain is going to fall here where you see this red probably is going to be the bulls eye in the north dallas area models picking up on excesses of 10 inches of rain just by the time we get to the day on tuesday. another disturbance moves in wednesday to thursday and southern texas gets in on that. going to see a big area that sees 8 to 10 inches of rain and that's going to cause a lot of flooding across the area. bad drought the last couple of years and get a lot of rain right now cause problems. >> boy the drama. >> drama whether is

alert. overnight 40 inmates escaped iraq. some of those escapees convicted terrorists. six guards and 30 prisoners dead. all started with a fight between some of the inmates. when guards went to break it up, they were overpowered and had their weapons taken from them. prison is 50 miles north of baghdad. fbi ramping up 24 hour surveillance terrorist suspects in the wake of the shooting in garland texas. one of the gunmen in that attack was known to the fbi. but wasn't being watched at the time. more than 100 people in the u.s. are considered possible terror threats. all of this coming as security is heightened at military bases all across our country. the threat level was raised to bravo which is the highest point in nearly five years. the feds say there are no specific threats but they are urging all of us to be on high alert. >> a single juror causing a mistrial in the aton patz murder case. the lone juror waived to reporters saying he wasn't

obama. overall the winner was angelina jolie. she has nothing to do with politics so she appealed to everyone. that's a message that these candidates need to take here very seriously. the challenge for republicans in 2016 how are they going to win the female vote against likely democratic nominee hillary clinton. i'm going to be listening to the words phrases and styles that they employ to reach out specifically to female voters. >> i know that south carolina is a very important state when it comes to the primaries and these elections. who is it most important for out of all of the g.o.p. candidates? >> i think the surprise here is going to be former texas governor rick perry. now, i have been walking through the state working through the state over the last couple months and perry has a surprising level of support. he spent a lot of time here. he has significant grass roots here. it's not a name that you hear that often as being one of the frontrunners.

in south carolina governor perry is doing quite well. so he is the guy that i'm going to be focused on here in about two hours. >> what about marco rubio? you know, talking about the elections and these candidates i'm hearing from a lot of people many like him. they love his story. they love his platform and coming from not much and then rising up in the ranks. but many people are saying it's not his time yet. they see him more as a v.p. or a number two guy. what does he need to do to appeal to the voters? >> well, each state -- it's important that we remember that south carolina is the third state in this whole primary calendar so that it really matters. scott walker, the governor of wisconsin is doing quite well in iowa. there's no frontrunner in new hampshire right now. here in south carolina, candidate like marco rubio. and your own fox news poll has shown it, since he announced he has gone up in every survey. i think the two reasons why rubio has been doing quite well number one is american exceptionism. he talks with great pride about being american, about

his great back story of his parents coming from cuba and, second, is that he has such good positive effective communicator. and that's exactly what republicans are so anxious to see. i'm going to be asking them in a moment do they want a governor or senator? and what's more important to them? the candidate's ideology or ability to defeat hillary clinton? marco rubio seems to have what they are looking for. so early at this point. >> frank i know you have a poll if the primary were today who would win? what do your polls say? >> so our polls show that rubio and walker have the advantage right now. you can't count out jeb bush. is he going to have more money than top two candidates combined. he has been around for a long time. rubio and walker seem to have struck a positive chord in these early states. it's not just the message it's the messenger. that's going to be the key. it's their back story and how they communicate it. >> well, we'll be following

in baltimore? are the streets safer in baltimore this morning after this? not quite. there's new reports that police officers are hesitant to go out and do their jobs. here are some statistics since the freddie gray arrest and the investigation that we're now about to see. 25 homicides since gray's arrest. 25. >> wow. 40 people shot since april 27th since the riots. that wasn't too long ago. >> i didn't notice any of that in loretta lynch's statement. i wonder if she would describe all of those as quote, situation where is there's a flashpoint occurrence that coalesces years of frustration and anger. is this all legitimate protest? no. it's criminality and it hurts people and the department of justice ought to concern itself with upholding the law. that's their charter nap's what they do. the job of the doj is not to make communities feel good. it's to enforce the law and it's scary when they don't do that. >> lieutenant kenneth butler is the president of vanguard justice society, a group for black baltimore police officers.

unconstitutional behavior by the baltimore police department. >> right. so it seems to be though, a pattern where the obama administration swoops in in the wake of news stories that suit its political ends and starts investigating a police department. some believe this is an effort to in effect federalize police departments. do you believe that? >> i don't think so. although i think there's that risk. i agree with you that there's been an optics problem with this department opening a pattern and practice of investigation, response to the public outcries to do so. in particular baltimore, i think, this investigation is warranted based on the history of this department. but in the context of i mean, for example, ferguson i was skeptical that a pattern and practice was needed there. other places i've been skeptical. and i do think there is some risk that the public now expects every time there's a high-profile matter the feds will swoop in and help. and i don't think that's a healthy attitude to have. >> so here i have no trouble believing the baltimore police

department is corrupt. i know that the inmay notes literally ran a jail in baltimore so the city is obviously troubled and badly run. but you have to compare that concern to the concern of having a state's attorney in maryland moseby who clearly was doing the bidding of the mob. my question is what's more dangerous to civil society, a couple bad cops or a prosecutor who's clearly out of control? >> i think there's a good argument that the individual officers are likely overcharged and that the decision to charge them was made in haste. that's something that's outside of the jurisdiction of the department of justice, but in general it is not a good idea to charge as quickly as she did and i think more concerning are her public statements at the press conference where she charged where she essentially said she heard the calls for no justice, no peace and told the crowd she was working for justice for freddie gray which i think in the context she made those statements did not make her seem like an impartial prosecutor.

i think there's a big risk there, again, of setting expectations high and it may be a great win for her in the short term politically but the question is what's going to happen if the verdicts go the other way, will it be even more unrest. i look back at ferguson and i was skeptical then that i thought everybody from the department of justice made it seem like that was an open and shut case and that will needed to be justice on behalf of michael brown, and i think that contributes to the public's reaction when a verdict goes the other way as opposed to letting everyone know in advance, hey, look i'm the prosecutor i'll present the facts, where they lead and it may well be that there's some police officers that have some liability here but also it could turn out the other way. and i think no one is saying that and i think the public will react badly if the verdict goes the other way. >> and you'd think that law enforcement officials that see their job as protecting the rule of law and not affecting trendy social changes. >> that's what they should be
