through the wreckage in the community of van, texas. going door to door searching for the injured and the missing. this as a nasty snowstorm blankets south dakota with more than a foot of snow creating dangerous traveling conditions. in the meantime you have tropical storm ana downgraded to a depression but dumping heavy rain and creating windy conditions along the north and south carolina coasts. millions of americans in 12 states have been suffering through these severe weather conditions. we have fox team coverage with jonathan standing by this myrtle beach, south carolina. but we begin with garrett, who is live in delmont, south dakota where a tornado ripped through weekend, garrett. >> reporter: yeah jenna, first look at the damage that that tornado left in its path here yesterday morning. winds of 130 miles per hour ripped through this small town of 200 people. and this is what it left behind. not a whole lot here. more than 20 homes and businesses were completely

levelled. many of the ones that are remaining, you could see, they're damaged. the entire town had to be evacuated last night even because of propane tanks that were damaged and were leaking gas. and today, they still don't have water, power, or telephone service here in delmont. so folks are starting to come back in pick through what's left of their belongings and try to see what they can gather up but it's it's something they say they are going to be doing. they do have ae in the center of town that's the main staple point. it's more than 100 years old. there were children there in sunday school as that tornado sirens began to go off, they rushed down into the basement just moments before that tornado hit, they all walked away in total, nine people were injured, two of them seriously injured, and they remain in the hospital. but we're told they are not life threatening injuries at this time jenna. >> wow, what pictures garrett, thank you very much.

now we want take you east to the latest tropical depression ana, jonathan live in myrtle beach, south carolina with that jonathan. >> reporter: the sun's back out, people are taking back to the atlantic ocean, although most of the swimmers seem to be staying very close to shore, that's because the lifeguards have issued a warning that there is still a slight slight possibility of dangerous rip currents. not enough to keep people out of the water, but they do want to keep people apprised of this. also any time a storm system comes through here they worry about again a slight possibility that the storm has pushed jelly fish closer to shore, but so far, no problems. it looks like a typical day at the beach, a far cry from what it looks like here more than 24 hours ago when ana made land fall as a tropical storm. look at this video, although the winds were not particularly my strong the storm system moved slowly that it dumped large amounts of rain over parts of the carolinas, causing localized flooding in some areas. this was the scene in north myrtle beach, this is not

overwash from the atlantic that you're looking at but fresh water accumulation from the several inches of rain that fell over a very short period of time in this area. the storm did not cause any widespread power outages, many businesses stayed open even through the height of the storm, and we saw a few intrepid tourists who were more than happy to get wet patronizing the businesses. the issue was not so much the furry of the storm, but the timing. ana arrived several weeks before the beginning of the atlantic hurricane season which officially begins on june 1st but emergency management officials say what happened over the weekend serves as a reminder that people need to be prepared at all times, jon, back to you. >> jonathan from myrtle beach, thank you, jonathan. now we're going to turn to politics. jeb bush says he would have authorized the iraq war in 2003 ginn the intelligence -- given the intelligence available at the time. the former florida governor sitting down for his first major

a new wall street journal nbc news poll finds 21% of voters say national security should be the government's top priority. an increase from 8% back in 2012. that's similar to the results of a recent fox news poll showing terrorism as the second most important issue to voters after the economy and jobs. this is the columnist for the hill and kim kearny for the washington examiner. a.b. when you look at world events you have russia gobbling up crimea invading, you know potentially invading the rest of ukraine. you've got the rise of isis it's no wonder that all of the sudden foreign affairs are front and center for a lot of americans. >> right. this is going to be much different from the 2012 election. and it is going to be a challenge to the republicans running. none of them have the experience that hillary clinton has in matters of foreign policy and national security. they can be critical of her

time but she was the secretary of state. what they have to do besides what they're doing now, which is rousing audiences with tough talk about combatting isis is really come up with a plan. when they go up one of them up against mrs. clinton, they'll explain to americans worried about the spread of isis why we weren't able through a bombing campaign that's taken place over the last year to stop them from tripling their territory. what will put them into retreat, and how, since we're beyond occupying wars we plan to actually send them into retreat without boots on the ground? so this is something that after the rhetoric which is going well for them now, they are going to be challenged by in terms of real plans that can go up against clintons. >> what about that tim, is hillary clinton's list of achievements so substantial that republicans will have nothing to attack her on? >> i think she actually has a number of foreign policy weaknesses on which she should be attacked. the question is, can she be attacked better from the hawkish

side of what you're seeing from jeb bush and marco rubio or better from the dubbish side from rand paul? there was the sort of the high point of republican dubbishness was actually president obama went into libya witut congressional authorization, and it was looking like and there was the drone, anti-drone filibuster by rand paul. republicans were starting to sort of push back on the idea of the united states being very aggressive in foreign policy but if you look at the gop field, they're seeing the same polls you're putting up there, that more and more these republicans are moving in a hawkish direction, and from that perspective, it's not as clear to me that hillary has some weaknesses that she would if you come out here from the dubbish perspective. >> let's listen to some republican candidates and perspective candidates as they talk about some of these foreign affairs issues. listen. >> we watched our president, we watched him end a war without a plan to keep the peace. we've watched him issue tough

experience like i said that secretary of state has. this is the americans know that isis is a threat and that the threat is rising. even here in the homeland. just talking about bombing isn't going to work. people want to hear what are we going to do to stop this? to keep it from coming here and from building a caliphate over the sea? this is something like i said it's great to quote movie lines, we all want to defeat isis but the question is how. they're going to have to come up with something that soon and the candidates who do will rise above the others who were just using property tuds that candidate will distinguish themselves as someone who's serious and ready to take on mrs. clinton. >> worth pointing out when barack obama was running for the presidency the first time around he had virtually no foreign policy experience either. the reason that he brought joe biden on board is because of his perceived expertise in foreign policy. when you look at the fox news polls, when asked what the most important issue is facing the

country, this is among republican registered voters 24% say economy and jobs is number one, but 20% say terrorism is number one, you just heard jeb bush talking about immigration with megyn kelly. that's of a concern to 10% of republican voters. so again, this is going to be a huge issue, tim, in the campaign ahead. >> i think that this is part of a luxury of growing and improving economy. one of the reason in 2012 people didn't care about foreign policy is because they were more concerned about their own jobs. about their own neighborhoods state economy. and as the economy improved people have more of the luxury to worry about what's going on onseas. again the world events have changed things. brief dubbish period in the gop was brought to an end by vladimir putin and the russian aggression in ukraine, as well as by isis. it's when they stopped just being a regional force and there were americans getting beheaded. that really changed the focus.

sky lift airlines flight 43 people on board makes an emergency landing at los angeles international airport this morning. this brand new video just into the fox news room authorities say the plane was having mechanical difficulties with the left landing gear it collapsed. the plane did land safely. no one was hurt but you know that those people on board had to be mighty scared at all the sounds of that landing. the flight had taken off from monterrey, no immediate comment from the airline as to what went wrong. >> looks good if you're going to make a landing like that wow. right now the defense rests in the penalty phase of the boston marathon bombing trial after calling their final witness. a nun made famous by the movie "dead man walks." the prosecution rested and the jury can deliberate the fate of dzhokhar tsarnaev this week. either life in a super max prison or death.

the jury set to decide how he will pay for killing three people and injuring more than 260 others. molly line is live in boston with more on what's ahead, molly. >> reporter: jenna, exactly, the prosecution and the defense have both rested their cases in the boston marathon bombing trial. the feds calling their final witness to the stand, famed death penalty opponent sister helen presean. she was permitted to visit dzhokhar tsarnaev in prison and testified that he expressed his feelings about what happened to the victims. telling her, no one deserves to suffer like they did, under defense requesting she confirms she heard pain in tsarnaev's voice and shared her perception that he was genuinely sorry for what he did. prosecutored called the warden of the super max prison where he will likely be sent if sentenced to life behind bars. john oliver heads up the prison facility in florence colorado where he says new inmates under special restrictions imposed by

right now, new developments in a story we've been following. a jury is sent back into deliberations in the case of a north carolina police officer who is suing starbucks over hot coffee. the officer received a free cup and then spilled it in his lap. he admits driving home to photograph his burns before going to the emergency. the starbucks defense team says that's proof his injuries were self-inflicted and not severe but the officer claims he suffered other medical issues related to the incident. the jury has been having a hard time reaching a verdict in this case we're going to continue to follow this story and bring you the latest from the courtroom and that jury decision. now another interesting legal case legal battle pitting arms control against free speech

in the digital age. perhaps, it focuses on this a 3-d printable gun made mostly out of plagsic. two years ago the creator of the liberator posted what may be the first online instructions for how to build it. how to print your own 3-d gun. the state department wasting no time and threatening cody wilson with criminal charges. and massive fines for possibly breaking the rules on exporting military information. now, wilson is suing claiming the feds are violating his right to free speech online. let's talk about it with rebecca and lawrence freedom of speech attorney as well. nice to have you both. lawrence why is this a free speech issue? >> it is because 3-d prints are works that protected by the first amendment like all other software code. and the government is trying to

use their export regulations in an attempt to block the distribution of this otherwise protected speech. they're not providing any sort of judicial review or any kind of procedural safeguards which would required in order for the government to sensor or block other forms of communication. this is essentially a textbook prior restraint on speech. >> you said the cad files. that might come up what are cad files for our viewers? computer system design files. essentially it tells the computer how to design an object or assist in designing an object. it's really no different than a source code that's used by a computer to display something on a screen. >> all right. rebecca, the state department says listen this isn't okay. this is essentially the same as trying to sell guns to mexico because you're giving people within their own ability, with a computer and maybe a click of

the button, the possibility of printing their own gun and we have to limit that. that's what the state department says. does the state department have an argument and what about the argument back about limiting free speech online? >> absolutely. the government has an interest in restricting this sale and distribution of guns overseas. they have a real interest here. and the question is how do you balance that government interest? it's quite legitimate against the right to free speech. and i would question whether posting a blueprint essentially online is expressive speech. i would argue probably has an element of that but it has an element of straight manufacturing. it makes it different than about expressing a vooupt. the government has a real interest in regulating it. >> one of the property lawyers quoted in a few of these pieces that we have on this says that the ability to download a file press print, and have gun parts come out could tip judges towards calling gun cad files as you mentioned, functional

things. and allowing the government to regulate them. so the argument is that this is not about free speech and being able to express yourself online it's a functional actual thing that you're putting online and therefore the government has a right. what do you think to that? >> if the government makes that argument i would suspect that the response is that there are plenty of instructional things like textbooks or instruction manuals given the anarchist cookbook which is protected by the first amendment and taught people how to construct guns. there are plenty of similar instances where these instructional manuals have been found to have first amendment protection and just because we're dealing with something in a digital format in a new medium should not deny first amendment protection. >> and that's one of the arguments, rebecca, from specifically this young man who came up with the 3-d gun saying this is kinding after high profile shootings, the government's trying to crack

down on him specific kplip there are so many other things bad out there on the internet that this is this is not right too to just go after him because of a 3-d gun. there's a lot of bad stuff online why would the state department focus on this? >> they're enforcing a regulation that they think applies here. i think a file for a 3-d is different than the anarchist cookbook. what's the viewpoint? what's the expression in something that's a straight piece of code? >> is that the same as a recipe? i mean for argument's sake because essentially now off recipe online and more or less follow it and making something. that's the argument that 3-d prints you can plug into your computer you have a gun, rebecca, but listen rebecca, same as the recipe you would say what? >> it is a continue no doubt. it may be minimal or much less than the kinds of things that would require a complete

>> well recent example of virginia woman who was just sentenced to four and a half years in prison for lying to investigators about supporting isis. chief intelligence correspondent catherine herridge live with more catherine. >> good afternoon. investigative source tells fox news that credible threat information targeting military ine installations was part of the threat stream that led to last week's decision to increase force protection to the highest levels since 9/11. the intelligence was pushed out from the fbi office in phoenix with a two shooters in the garland attack had shared an apartment. with the source adding threat information was also being received from regional intention collection centers also known as fusion centers. despite repeated requests the fbi has declined to comment. right now, there is a steady drum beat of warnings from the administration coming out of washington beginning with the fbi director james coneny last week. there are hundreds even thousands of americans who are connecting with isis online and other related groups.

he also confirmed that the bureau sent a bulletin warning that one of the shooters might be heading to texas, and now the garland police chief confirming he knew nothing about the fbi warning, but he said it would not have changed the security posture at the cartoon contest. meantime after officials described the spike in threat activity the secretary of homeland security jai johnson says it has entered a new phase, as a republican chairman who has oversight for the homeland went further. >> we're seeing the directives like on a daily basis, and it's very concerning. we had this phenom 911 in the united states where they could be activated by the internet and really terrorism has gone viral. >> and just this morning as you mentioned, jon, the justice department unsealed a plea agreement with a 29-year-old virginia woman who wanted to get her boyfriend to syria to become a martyr for isis. she pled guilty to lying to the fbi, but this case out of virginia really fits a pattern where women are being used by

crashed in the bunk next to him but the sea lion he names gilligan. >> i woke up at 2:30 in the morning to the sounds of a snoring and sneezing that were not my own and i looked around the boat and i didn't see anything. and it went away. and right there curled up just like a dog on one of my bunks was a tiny little baby sea lion. >> sea lions already like hanging out in many california docks and marinas highly intelligent, trainable and acute hearing and in this case clearly comfortable with people. >> just kind of started shoeing him out of the boat. and he -- he followed my directions like it was a dog. and then every once in a while he would look back and he didn't look like he wanted to leave. >> you got to go buddy. >> he's got a tag on him. he looks relatively healthy. i just got to move him out of here. it's best for me not to play with a wild animal.
