"special report" is next. good evening. this is a fox news alert. i'm bret baier in washington. the search is on half a world away for survivors of the second major earthquake in as many weeks in nextpal. among the missing, six u.s. marines providing search relief. the six marines were aboard a helicopter assisting in relief efforts. national security correspondent jennifer griffin is joining us from the pentagon with the latest on that search. >> six u.s. marines and two nepalese soldiers are missing after the helicopter they were flying disappeared while flying earthquake items to nepal.

it was deployed from camp pendleton outside san diego and an indian helicopter heard the american marine pilot complain of a possible fuel problem. it had just dropped off supplies and was en route to a second location when it went down but there was no indication of a crash, according to pentagon spokesperson. no smoke or signs of a degree field. the marines did not issue a mayday signal and the emergency radio beacon has not been detected. those signals could be blocked due to the nature of the ter rain. earlier today, the 7.3 ma nagnitude sent off landslides east of kathmandu. the u.s. has sent 300 u.s. military personnel from the command to assist with earth earthquake relief efforts.

marine aircraft will be airborne again over the search site at first light according to u.s. military officials. in the meantime nepalese soldiers are making their way on footwear they believe the american helicopter went down. bret? >> jennifer thank you. a major setback tonight for the president's plans on trade as senate democrats vote to block consideration of the bill on fast track trade authority. chief congressional correspondent mike emanuel is joining us on capitol hill with why his own party turns his back on him and what is next. good evening. >> bret good evening. this boiled down between a fight in the senate and white house. when oregon democrat senator ron wyden shifted from voting for it to against it it changed the proposed trade package.

this is a sign that president obama no longer has clout with his fellow democrats. >> the democrats are doing today by trying to block us from even getting on this legislation is throwing their own president under the bus. >> reporter: the president travels to nike's world headquarters in oregon wyden's home state to make the case for free trade. he said it would help him and future presidents provide access to new markets for american farmers, ranchers and manufacturers but his liberal critics say repeatedly that american workers have taken the brunt of bad trade deals and suggested that it would be tilted even more in favor of big multinational corporations against workers. >> elected representatives need courage to not just work for the lobbyists and lawyers but for the american people bhowho sent us here. >> the secrecy seems to be based

assad regime so weakened it could soon fall leaving the door open for groups like isis. and thesigns of strain between the two powers that under president obama have frayed to a point not seen since the cold war. >> and it's to the point where the reach-out with russia putin's idea was to humiliate the united states and reclaim russian greatness. >> reporter: further complicating the issue, russian's part in the p5+1 talks that on the one hand you sanctioned them and on the other hand you'll need to complete the complicated agreement. >> we have a broader agenda with russia. they are part of the p5+1 talks. >> reporter: all of this comes as iran and the nuclear issue are expected to be major issues when the president hosts the summit on thursday at camp david. and there are still lingering questions about how much might

get done at that summit at camp david as four of the six leadsers' leadsers' countries are choosing not to attend. >> kevin corke thank you. ahead of a humanitarian cease-fire a saudi-led coalition continued air strikes near yemen's capital of sanaa. ten strikes pounded that area. the air strikes were targeting the yemen shiite rebels the saudis and arab coalition cause to expand the power throughout the region. mike morell said last night to fox that the white house passed the line putting politics over national security and misleading its own reporters about the benghazi attack. today, the fallout. chief intelligence correspondent catherine herridge has the

story. >> reporter: for the national tv appearances, to blame a video and not a policy failure six weeks before the election. > i think that that is crossing the line between national security and politics. >> reporter: rather than respond to the interview with bret baier, the white house spokesman referred back to morell's book. >> my reaction is that mr. morell makes clear that the talking points surrounding the benghazi attack were not politicized. he wrote there is no such conspiracy. >> when the e-mail became public after a federal lawsuit by a judicial watch, jay carney insisted it was narrow in scope. >> in fact this was not about benghazi. it was about the overall situation in the region. >> reporter: morell told carney that it was misleading. >> were they intentionally misleading i don't know. you'd have to ask them. >> reporter: morell denies lying to congress. he now says he made mistakes and

was careless with his words during congressional questioning. more morell says it was also a mistake after requested by denis mcdonough to escort him to capitol hill. and when he retired, he told "the wall street journal" he was interested in advising future presidential campaigns but anonymous officials close to the secretary of state -- >> are you advising the hillary clinton campaign? >> no. >> will you? >> i see myself bret as an intelligence professional. nonpartisan. i am not going to be working for anybody's campaign. >> reporter: but morell is now a paid consultant whose leadership includes mrs. clinton's principle gatekeeper. he's willing to testify in front of the benghazi select committee but he hasn't been officially

asked forward. after the break, jeb bush admits to a mistake while hillary clinton remains mum on the campaign trail. here's what some of our fox affiliates are covering around the country. guns recovered from both parties in a road rage shooting incident involving george zimmerman acquitted in the death of trayvon martin. the suspect was involved in an ongoing dispute with zimmerman. zimmerman's attorney says he was hit by flying glass but not seriously hurt. charges have not yet been filed. fox 25 in boston where new england patriots quarterback tom brady says the mvp will appeal in the deflategate scandal. the new england patriots have said they have unconditional support for brady. this is from our affiliate fox 5. they are covering a record-setting sale on a pablo picasso. it sold for more than $179

jeb bush is walking back comments he made about the iraq war one day after they aired. this is hillary clinton continuing to play hard to get with the media. we have fox team coverage tonight. chief correspondent ed henry with how long hillary can evade reporters and their questions. first, jeb bush is trying to get himself out of a sticky situation while a potential rival courts voters in new hampshire. hey, carl. >> you're talking about the megyn kelly interview last night. this is the kind of controversy that he has tried to avoid for years. he tried to kor correct himself. >> knowing what we know now,

would you have authorized the evasion? >> i would have and so would have hillary clinton and so would have everybody confronted with the intelligence that they got. >> reporter: but the world now knows the intelligence was false. the left and right both pounced on the gop front-runner this as radio host laura ingraham a conservative bush critic. >> you can't still think going into iraq now as a sane human being was the right thing to do. that's an ability not to learn the mistakes. >> bush tried to clean it up on sean hannity's show. >> i interpreted the question wrong, i guess. i was talking about given what people knew then would you have done it? rather than knowing what we know now. yeah i don't know what the decision would have been. that's a hypothetical but the simple fact is mistakes were

made. >> reporter: in new hampshire today, new jersey governor chris christie blamed the sluggish economy and middle class squeeze on obamanotics. >> we have a weak economy for the middle class. he this president, has worked through his policies. >> reporter: christie ran six polls over the last month, leaving policy to make until voters are engaged but christy proposed this last month and today slash the marginal income tax breaks to three and cut rates and eliminate payroll tax for workers under 21 and over 62. christie aimed this line at hillary clinton who has been

lurching left. >> have they turned so left that they oppose every growth initiative even ones that their own party has supported in the past? >> christie bush clinton and all of the rest have political vulnerabilities and they will be slicing and dicing pretty soon but the long knives won't come out until later this year. >> carl, thank you. one month into her campaign and still hillary clinton is barely speaking to the press. chief white house correspondent ed henry with a running tally of the questions answered and just how long her silence may last. >> reporter: hillary clinton has not taken a question from a reporter in a full 21 days whereas "the washington post" noted today, over 30,000 minutes, which translates into about 2 million seconds. >> can you comment on the specific allegations, though? >>. >> reporter: that means no questions on the clinton foundation or on substantive issues like where the candidate stands on the trans pacific

partnership, which is why it's not just journalists trying to keep the heat on clinton. as democrats bill de blasio and elizabeth warren unveiled a leading democratic contender. >> we'll be calling on leaders and candidates to address these issues to stiffen their backbones, to be clear and to champion these progressive policies. >> reporter: republican jeb bush estimates he's done 20 press cagles with reporters. >> i don't have a protective bubble like mrs. clinton has and don't have round table discussions where i get to pick who comes and stream the questions and the press has to behave a certain way. >> reporter: the only female candidate on the republican side carly fiorina, needs to do more interviews yet the numbers are still staggering with fiorina conducting 21 press

interviews while hillary has taken zero. top clinton officials tell fox she'll eventually take questions from the media but for now has been taking queries from actual voters. >> i was wondering what were the policies that you had for children with disabilities. >> reporter: many of the voters have been carefully selected by the clinton campaign why is why the only democratic candidate has been far more accessible. >> bernie sanders has had 31 encounters with reporters since he announced and hillary has had zero and that's not sustainable for someone who wants to be president of the united states. you have to take questions from reporters, whatever you think of it. >> she may not be taking questions but hillary clinton is playing defense. the rapid response group that went after the "clinton cash" book is morphing into a super pac. >> and the invite is open for

a white police officer will not face charges in the death of a biracial 19-year-old in wisconsin. the officer feared for his life and was within his rights when he shot and killed tony robinson back in march. tonight, correspondent mike tobin is joining us live from madison with how the community is reacting to the announcement. the protests continue on. good evening, mike.

>> reporter: good evening, bret. you can hear the crowd chanting what's his name? tony robinson. that's the individual killed on march 6th. we heard from the family members calling for a peaceful demonstration. that's what they are getting, very calm from what we are hearing across the nation. the bombshell announcement that matt kenny will not be charged and the use of force was justified. >> i conclude that this tragic and unfortunate death was the result of a lawful use of deadly police force and that no charges should be brought against officer kenny in the death of tony robinson jr. >> reporter: that decision related to the death of biracial tony robinson shot by matt kenny. march 6th kenny responded to multiple calls that a man was running into traffic, shirtless in the winter air, that he had attacked one person and attempted to strangle another.

robinson's family would later say he was under the influence of hallucinogenic mushrooms. even though he was unarmed, the lawyer says he was lawful in shooting tony robinson. >> the officer was confronting a deadly threat and acted accordingly. >> reporter: demonstrations followed on the streets of madison. large low uneventful they resulted in only four arrests. demonstrators have doubted that charges would come and accused the district attorney of being part of a corruption system. and the question mark kenny is not on the job and will remain on administrative leave to see if he violated police procedures separate from the criminal investigation. police say they have received

and now the political grapevine. you know that moment honoring soldiering during nfl games? it turns out, you might have been paying for it. as part of a contract with the new york jets last season the new jersey national guard paid the nfl for a salute to service, which included the members of the guard being honored in pregame activities. the defense department from 2011

to 2014 paid nearly $4.5 million for sponsorships. a blurred line between advertising and community outreach at a time when the defense budget is being stretched. arizona senator jeff flake says this practice is wasteful "when everybody assumes when you have these feel-good moments, these salutes, that it's because the nfl team just felt good about the military or about service and to find out, no it's really the taxpayers paying for that that just leaves you with an empty feeling." the defense department says it will be reviewing the practice. more of your tax dollars hard at work spending $500,000 to observe pregnant women walking. nih says the goal of the project is to see if a gentle workout regimen can prevent women from being depressed.

the grant argues that the project is necessary because, quote, no study to date has evaluated physical activity as an intervention for depressed, pregnant women. the cdc recommends aerobic activity such as walking, because it's good for the overall health of expectant mothers. finally, some good news following the unrest in baltimore. an outpouring of support for a baltimore business ransang the protests over the police custody death of freddie gray. a local radio person reports matthew chung was heartbroken to know that his parents' wig job was destroyed. that's when chung and his friends stepped in. they have raised $21,000. congratulations. presidential contender, hillary clinton, who says religion is a for her own

beliefs, voters should change theirs when it comes to abortion. shannon bream has those comments. >> reporter: a point at which supporters say unborn babies can feel pain hillary clinton says it's time to push back against those who have faith-based objections to unfettered access to abortion. >> deep-seeded cultural codes religious beliefs and structural biases have to be changed. >> reporter: over the years, though clinton decided her methodist upbringing for a basis for her own beliefs. as a senator in 2004 she said this -- >> i believe that marriage is not just a bond but a sacred bond between a man and a woman. >> reporter: so why her insistence now, as a

presidential candidate, that people of religious convictions, relinquish their beliefs. >> i was troubled by the fact that she said you have to put your faith and convictions in a lock box and not be able to act on them. >> reporter: hillary's remarks have been blown out of proportion. >> i think it's really important to stress that it's not asking religions to change their beliefs. it's actually just asking them not to impose their views on other women through laws. >> reporter: yet whether the issue is abortion or same-sex marriage religious freedom supporters believe the equation is the other way around that americans who want not to impose their beliefs on others but simply the freedom to practice them for themselves are the ones facing crippling fines and social os stratism. >> when the government forces me to change my views in order to submit freely and run my business. >> mrs. clinton referred to last year's supreme court hobby lobby

we want to send around the world. that america can't be dependent upon that america can't deliver trade agreements. >> isn't the core of the problem here that prominent -- some of the most prominent figures on capitol hill are simply not with him on this? >> there are a number of democrats who do not intend to defend the budget vote and should not be interpreted as a change in position on the substance of the bill. there is a republican majority in the senate but it's not a filibuster proof majority which means that for anything to become law, party line votes are not going to cut it. >> well, the procedural situation that josh earnest was talking about was a vote that went down 52-45 and democrats abandoned the president on this trade deal. so what happens now and why did it happen? let's bring in our panel. steve hayes, a.d. stoddard and

charles krauthammer. it wasn't even close to 60. >> no. there are pro trade democrats with the republicans and with the president and they are going to support this ultimately but they stuck with their liberal colleagues today on this sort of procedural question of whether or not you would have all four issued in this or just two. these enforcement languages that liberals feel must be attached were attached and then that fell apart. so i spoke with senator nelson today. he's a pro trade democrat who voted no but intends to vote yes and he's hopeful that it will come back to the floor pretty quickly. it's exactly what the reporters were questioning josh earnest about today. it's a difference in the party. it's a democratic food fight. do they have the votes? is it likely they will get out of the senate? yes. the house is another matter. >> steve, does this show that president obama doesn't have juice up on the hill anymore? >> i think it does and i would argue that this, in combination

from what we've seen from hillary clinton, her dramatic move to the left on one issue after another after another suggests that elizabeth warren may be the most powerful democrat in the country right now. she is managing this stoppage of this and spearheading the effort against the president. she was writing letters months ago when this was barely covered and she's responsible for hillary clinton tacking to the left. i think one of the reasons she was able to be as successful as she was on this is that president obama doesn't have a lot of goodwill among democrats up on the hill. he's not buddies with them. he hasn't spent the time talking with them socializing with them. a lot of people outside of washington roll their eyes and say, is it that big of a deal? it matters like this. that's when it can have an effect. >> this is senator barrasso and senator warren talking about this issue today.

>> it's the democrats standing in the way of what is the president's prime domestic policy plans for the economy of this country. it's the democrats who are blocking this. >> over and over american workers have taken the brunt of bad trade deals. if we show a little backbone a little gumption that we can rebuild america's once invisible middle class. >> it was amazing to see the white house. and specifically the president, confront elizabeth warren saying she is dead wrong in a number of interviews. >> it would help if when the president is there and says she is dead wrong, he would make a case as to why rather than say, i never would sign any deal that's not good for the working american. trust me that's what he does with iran and with everything. trusting him is a little hard after what he's done with obamacare. if you like your plan keep it.

what he said about iran this is going to prevent a nuclear weapon it's going to do the opposite. trust is not an argument. it sort of interrupts the sort of median where americans are involved in a civil war and have to look at that morning democrats. the party has moved radically left on most stuff obama likes that. he likes it on issues on social issues on drug laws all that kind of stuff. in acting on the national interest he knows that in the end free trade is a good idea and this agreement, in particular is extremely important. geo politically as a way to hold our pacific rim allies who will cut loose and enter into china's orbit if we don't. he never states or puts out there any political capital. has he made one national address

on television about the importance? if it's his number one priority where has he been? he never does that. if he says i like this trust me people are to follow what the answer is they won't. >> senator reid said this the simple fact is that they must have strong democratic support nearly every bill has enjoyed the support of 90% of democrats. senator mcconnell needs to work with democrats for our votes. i hope he'll reconsider his approach. a.b. that's pretty rich from senator reid. >> well he does not mince words. he's having a wonderful time anytime mcconnell can be blocked. but this is really a senator reid versus the president wings of the party and senator reid has more numbers.

elizabeth warren has more numbers and hillary is absolutely critical. president obama is indulging in her silence when house speaker boehner says she's embarrassing him. she's either going to do a huge flip-flop or go back on the argue many the that charles just articulated, that this is a foreign policy tool and it's very important going forward across many platforms. and so we're waiting word from her. >> the exact argument she made while in office. >> i want to play one sound bite from the president today. he was at a poverty event talking about poverty and this is what he said. >> the effort to suggest that the poor are sponges, leaches, are -- don't want to work are lazy you know are undeserving,

got traction. if you watch fox news on a regular basis, it is a constant menu they will find, like folks who make me mad. i don't want to work. i just want to a free obama phone or whatever. and that becomes an entire narrative. right? that gets worked up. >> charles? >> well the president speaks for authority on what is on fox news. he said if you watch fox news on a regular basis, he seems well-acquainted with what we do. i think fox should welcome obama into the viewership of the number one network. he should be proud of us. >> he does seem to have us on his mind a lot. >> i think he does more watching than people would suspect. you know this is something he's

done before. and it's actually interesting that if you look at what is going on with mayor de blasio senator warren president obama, you know there is a big question about how much to indulge with the left right now and where was hillary clinton at the poverty conference. >> come on if he actually watched fox news -- remember back to the number of people on this network who criticized mitt romney for his 47% comments it's a distorted view of fox. it's not the first time and surely won't be the last. >> mr. president, if you're watching us right now, you've got a tick. it can be cured. next up the fallout over cia veteran mike morell's contention that politics trumps security with the benghazi talking points.

mislead the public and reporters in suggesting that that memo was not politicized. was he lying then or is he lying now? >> well, again i you think that the point that mr. morell makes in his book is the relevant one, which is that it is false to suggest that this thing has been politicized. this tragedy had been politicized by the administration, i think unfortunately we have seen some again as mr. morell says, some who have sought to rather cynically try to score political points by politicizing what is a legitimate tragedy. and that's unfortunate. >> well, the reaction to mike morell's interview he has got a new book out talking about benghazi. and there specifically about the talking points and the white house version of the talking points that stirred susan rice to those five sunday talk shows. we are back with the panel. steve, overall the interview and this specific point? >> i think on that specific point you get sort of a window into the problem with

mike morell what is he trying to do now. mike morell is trying to rewrite history on benghazi particularly with respect to his role. frankly if i were mike morell and i had his history on benghazi i would want to rewrite it too. the problem is what he has done in rewriting it in his interview with you and interview elsewhere and in his book his original role was on benghazi. we can talk about this for an hour but i don't think greta wants to give up the next hour. >> she doesn't. >> two examples. one he complains bitterly in the book about cherry picking. my critics are cherry picking and taking some information that supports their case and leaving out stuff that doesn't support their case. he does the exact same thing and he does it throughout an entire two chapters on benghazi and did it in his interview with you. one specific example is when we were talking about or when he writes about whether this was a preplanned attack or not. well, you interviewed the cia contracts had who wrote the book 13 hours. they said there had been surveillance of the facility. and in their book they said

that sent them into high alert it was a big deal. they were casing the facility hours before the attack. it doesn't appear in mike morell's book. he simply leaves it out. you can have questions about what they say. you don't have to agree with what they say. but you can't just set it aside. that's what he does repeatedly. the other example is your exchange with him on abu khatallah on the indictment and whether this was a preplanned attack. he seemed utterly unfamiliar with the specifics of that indictment. he says well, it wasn't clear that they were attackers. wasn't clear that they wanted to hurt anybody. wasn't clear really what they were doing. the indictment very specifically and repeatedly five different times says they came there to kill. abu khatallah knew this was a cia facility. they knew the other was a cia cover. he wanted to go in and kill americans because he thought what they were doing he thought their intelligence activities there were illegal. very specific language. presumably based on intelligence that we have gathered. and he sort of shrugged that off when you asked him about it. you can't shrug it off.

the final question i would have is don't we deserve something better in this country than to have intelligence professionals who mislead as a matter of course who did it at the time who do it in their book who do it in interviews and shouldn't we expect that our intelligence professionals would tell the truth and be straight with the american people? >> okay. a.b.? >> well, i mean, steve is right. this man's credibility has been questioned now going back years. he was accused by republican senators of lying in his congressional testimony. and it is true that it's -- it doesn't make a lot of sense that he sees it both as a spontaneous event but one that was a terrorist attack. so, that was sort of confusing. i think going forward if nothing else happens to hillary clinton on benghazi, the fact that an obama administration official said that the state department failed to protect that ambassador and those three other men is a big deal and will follow her in the campaign. >> you weighed in last night but the biggest thing out of all of this? >> he comes out as an unreliable witness. a man who appears to have

they are expected to begin that investigation sometime in the morning. it was a horrific scene. you can see the train cars search of them that p went off the rail including the engine a mangled mess of metal. 238 passengers on board along with five crew. at least five killed, 6 critically injured and more than 130 hurt. many of them bloodied. many injured were able to climb out of windows but others had to be helped out by first responders some of them carried out on stretchers. here is more from the deputy fire commissioner describing the scene. >> i have never seen anything so devastating. they are in pretty bad shape. you can see it completely derailed from the track destroyed the aluminum shel
