one seen here. it hit the ground and burst into flames. the cause is still under investigation and comes just days after six marines died when their helicopter crashed in nepal during relief efforts there. this morning, amtrak is back on track. resuming full service in the northeast corridor for the first time since last week's derailment in philadelphia. there's an automatic train control system that's in place. its point is to slow speeding trains to 45 miles per hour. the fbi and ntsb will meet together what if anything hit the train's windshield causing the track. look at that right there. before the crash. senator lindsey graham may be one step closer to the white house. the south carolina republican says he'll give an important update on his potential presidential candidacy later this morning. fox news confirms graham is

ainsley earhardt is here with the latest for you. >> good morning. the helicopter from the 15th marine expeditionary unit based in camp pendalton went down in hawaii. this new video just in to fox news shows the aircraft up in the sky moments before the training exercise turned deadly. the mv 22 osprey hit the ground bursting into a ball of fire. killing one marine whose identity is unknown. 21 others were rushed to the hospital with injuries ranging from critical to minor. witnesses say the crash happened without warning. >> no explosion. there was no noise. we didn't hear any sound. we saw the smoke and that's what caught our attention. >> the flames were coming up at least 20 feet high. and a lot of people were rushing in trying to help as much as possible. >> the cause of that mishap remains under investigation.

the crash coming on the heels of a marine tragedy last week. >> good morning, hard to watch that video. this helicopter from the 15th expeditionary unit based in camp pendleton went down at bellows air force station in hawaii. this new video in to fox news shows the aircraft in the sky moments before the training exercise turned deadly. the mv 22 osprey hit the ground, bursting into a ball of fire. killing one marine whose identity remains unknown at this hour. 21 others were rushed to the hospital with injuries ranging from critical to minor. witnesses say that that crash happened without any warning. >> no explosion. there was no noise. we didn't hear any sound. we saw the smoke and that's what caught our attention. >> the flames were coming up at least 20 feet high. and a lot of people were just rushing in trying to help as much as possible. >> right now the cause of the mishap is under investigation.

we've got friends and family there ourselves. i think most americans looked at this as justice is done. now we hear about the appeals process. what's the justice in that? >> an appeal is guaranteed. it should be. apparently the defense will appeal largely on three grounds. one was the refusal to remove the trial out of boston. the judge kept it there. the majority of boston residents were against the death penalty. a second ground for the appeal is going to be on the jury instruction that the judge gave. the judge did instruct the skrury they had to be unanimous for death. the defense wanted the judge to go further. suppose there's a hold out or two. they wanted the instruction from the judge to say that the jury is not unanimous for death then

it would be life. he refused to give that instruction. their claim on the appeal is most likely to be that a juror who was holding out for life, would have caved in because he would fear or she would fear that there would be a whole new trial with a whole other jury. >> look at the stats. people say it's good he'll get the death penalty but he won't get t. no one has been executed since 2003. mcveigh gave up on his appeals. we won't get to kill him? >> i think it might. this is a crime that involves the united states where we won't forget and forgive. >> lawyers astute like you will find a way to keep the happeal process going? >> because this is a federal case you skip a whole round of state appeals. it still takes too long and it

throughout this morning. a big story really has been over the last couple of weeks how much rain we've seen across parts of the plains, texas, oklahoma and louisiana. some areas picking up 8-12 inches of rainfall that's within the past 48 hours across parts of the southern plains. you can see the forecast calls for areas of heavy rain rolling through. expecting that flood threat to continue out there temperature wise, ahead of that storm system across the center of the nation, you are very warm in the eastern half. take a look at that. currently this morning it's 71 in cleveland, 70 in raleigh. cooler in the northeast. we have a back door cold front that brought in cooler air and dense fog. the high temperatures should be feeling summer like across the southeast. 88 for raleigh. 90s in tampa. cooler in parts of the northeast. 40's in minneapolis. let's head back in inside. looks like the jv team as the president referred to isis just graduated.

militants taking the key iraqi city of ramadi. now the iraqi security forces are running scared leaving behind their weapons, including humvies and missile launchers. it looks like the president's policy has not runned out. joining us is our panel of generals. thanks very much for joining us. according to the news reports today, dick, sent com says they're not ready to concede it's fallen. they say it's contested. >> there are mixed reports coming out of the middle east. we're awaiting what the department of defense will announce what the conditions are in ramadi. it's been a mixed bag. with the killing of abu sayyaf. with the fall of ramadi that is a significant set back. >> the operation in syria proved that when you put boots on the ground, you get good results

because we sent in our guys and they killed one of the bad guys. it was hand to hand. belly button to belly button i read one report with hyperboly. it makes it look like if we want to win this thing in iraq, we're going to have to have people with boots on the ground. >> well, i'm not sure of that. there's no question that if we put u.s. ground forces in we could put isis out of business in three weeks. there's no question. but then you have infidells defeating radical islam. we must have muslims defeat radical islam. that's why i say no ground forces. let's use air power. we did not use air power to stop them from taking ramadi. why i do not know. >> is our policy clear what we're supposed to be doing over there? >> i don't think it's clear at all. i agree with tom, we don't need massive ground troops on the ground there because ultimately this has to be a fight that they

win themselves. in the long term, that they can sustain. i do think the kind of thing we saw in syria which was bold and odd audacious is a model for whe should be looking at in terms of boots on the ground. that's a misleading term. we have special forces in there right now training with these people. we have boots on the ground. we're talking about large troop formations. i agree with tom, i don't think we need that. >> when you look at what happened in syria, you know, and that did work. you got the problem in the ramadi area and in anbar province where the guys who are supposed to be helping us, see isis coming over the hill they park the humvy and run. >> the challenge is with the iraqi security forces being taken out of ramadi left behind a cachet of weapons. let's put a broader context here. to defeat isis. it's not just a military issue.

there must be a lot of responsibility in the home which is great for the older ones. tell us about that. >> we have a pretty good routine. it starts first thing in the morning because we're making eight lunches to be able to get that going and get everybody off. and then, with the sports schedules practices and different kids being different places at the same time. the older boys really help out. you know, driving and things like that. we have a good routine down. we couldn't do it if the big boys weren't around and able to help a bunch. so we manage. >> we all work together. >> how about raise your hand if you're so excited that baby francisco is with you? can you get them to raise their hand? >> who is excited that francisco is here? it took a lot of coaxing because they want ed a sister. >> i feel blessed to be talking
