obama knows who hagel is. >> i'm bill o'reilly. please always remember that the spin stops right here because we are definitely looking out for you. emotions running high in cleveland after a judge e quits a white police officer in the shooting death of two unarmed black suspects. hello, everyone. i'm arthel neville. >> and i'm gregg jarrett. protests taking place in cleveland but so far the demonstrations are peaceful. the department of justice says it is going to investigate all of this and review all the legal options. >> iraqi forces launch a counter attack in anbar province recapturing a town from isis militants. and honoring and remembering those who have served.

the nation thanks its veterans this memorial day weekend. but we begin in cleveland where tensions are simmering just below the surface following the acquittal of a white police officer in the shooting deaths of two unarmed black suspects. demonstrators taking to the streets in the hours since the judge announced his decision. no violence has been reported and cleveland's police chief is asking citizens to be patient. prosecutors say michael greenlow was one of 13 police officers who shot into the suspect's car back in 2012 after a high-speed chase. now inside that vehicle were timmy russell and melissa williams. now the justice department says it will look into the case. kelly wright is following the latest developments from our new york city newsroom. kelly? >> reporter: arthel, good evening to you. the justice department says it will review all options in this

case. meanwhile, as you mentioned protestors are looking into peaceful demonstrations against the verdict and do not agree with the judge acquitting a white police officer who is charged with killing two armed african-americans. cleveland police officer michael greenlow hugging his lawyers for helping him get through a very tough criminal case. very emotional indeed. the judge finding him not guilty of voluntary manslaughter and felonious assault. the charges stem from a 2012 deadly police chase and shooting. greenlow was charged in the deaths of tim put russell and melissa williams. on that day police were in hot pursuit of russell and williams after hearing what they thought was a gun being fired from the car, the high-speed chase went on for 23 minutes ending in a high school parking lot where police fired more than 130 bullets into the car. prosecutors saying the fatal shots coming from brelo who

jumped onto the hood of russell's car and fired 15 additional rounds into the bodies of russell and williams. but judge sean o'donnell concluded the prosecution failed to approve beyond a reasonable doubt that brelo was responsible for their deaths. >> brelo's entire use of deadly force was a constitutionally reasonable response to an objectively reasonably perceived threat of great bodily harm. >> we regret and we acknowledge that two people died. the tragedy was brought about by conscious decision making and lifestyles that those two individuals, we are respective of their mental states voluntarily took throughout their adult lives. >> but timmy russell's sister begs to differ. she believes justice was not served in this case in the death of her brother. >> i do not believe that tim and

melissa ever used their car as a weapon. i do not believe that they ever had a gun. it is outside of my brother's character to be a violent person. >> there is anger in cleveland at this hour but protestors as we mentioned are continuing to remain quite calm. police chief calvin williams says violent acts will not be tolerated in the city and would only set the city back. arthel? >> kelly wright thank you. we are learning that prosecutors now are zeroing in on additional suspects in the murders of four people found inside a burning washington, d.c. mansion. daron wint is the only suspect named publicly so far. he was arrested thursday night and newly unsealed affidavits show the affidavit show more than one person.

win wend tortured the 10-year-old boy before setting him afire. we have much more in ten minutes on this unusual and horrific case. first it was ramadi in iraq and then the ancient town of palmyra in syria. isis fighters are gaining ground capturing towns across both countries. iraqi forces are taking back one city in the anbar province. here's more from jerusalem. >> reporter: iraqi forces regain control outside of ramadi indicating the start of the major ground offensive or the effort by iraqi forces to stop isis' momentum. the terror group stormed the town of husaybah yesterday, but iraqi forces with held from iranian-backed shea malitia fighters and launched a counter attack today taking it back. an estimated 50,000 people have

fled to safety so far. and in the ancient city of palmyra, there are reports now of isis hunting down government soldiers and executing them in the streets, shooting or beheading them. isis took over palmyra this past week. fears are growing about militants destroying the city's archaeological sites like they did in mosul, iraq. palmyra is a city of historical relevance and strategic military relevance as well. it's a crossroads linking damascus to cities in the eastern and northern parts of the country. taking palmyra is a huge gain for isis and a huge loss for syria's government and president bashar al assad. here's an observatory for human rights says there are reports that isis militants broke into the museum in mall whypalmyra were removed and were taken to a safe

place. we are taking moments to honor those americans who have given their lives in the name of freedom. and at arlington national cemetery soldiers are fanning out this week to place more than 200,000 american flags on each and every grave stone. not far away at the national mall the world war ii memorial has a brand new way to honor our fallen war years and those who continue to serve. rich is live at the freedom bell. rich? >> reporter: here at the national bell at the world war ii memorial this is the beginning of the celebration of the memorial weekend. we have had thousands of tourists veterans folks here to commemorate memorial day. you mentioned the freedom bell as a new symbol that really casts through steel according to organizers from the world trade center. they say more than 1.5 million have rung the bell to honor service members who have fallen in the service of the united states and touring the country.

>> response has been phenomenal. between little kids coming up and unsure asking their parents and just the adults and the crowd has been fantastic. >> reporter: while this is a special weekend on memorial day weekend, there are other commemorative ceremonies ongoing at the world war ii memorial that go on mostly throughout the year. we are talking about the honoring flight that brings world war ii veterans from around the country here to the world war ii memorial to commemorate that fight from 70 years ago which ended 70 years ago this month. >> rich hepson thank you. the forces of nature not kind to folks in texas and the plains after dumping more than 12 inches of rain in parts of that region this month alone. storms will bring more heavy rain this memorial day weekend. and meteorologist janice dean is live with all the details. >> hi arthel. we are dealing with not only the

heavy rain but the threat for severe storms. tornado watches in effect for texas, parts of oklahoma and into colorado where we have snow in the higher elevations. so colder air across the west. mixing in with the warmer unstable air across the south. it gives us the recipe for strong to severe storms. we don't have any tornado warnings. however, several thunderstorm warnings south of dallas and south of lubbock. now this area has been saturated by rainfall. we're going to talk about that in just a second but here's your severe threat as we go through the evening. so the areas that were under a tornado watch, overnight tonight, parts of colorado down to the southern plains but they will continue into tomorrow into sunday with again, the threat for strong to severe storms stretching into the midwest by monday. but this bulge eye across texas for those strong storms. what's happening here? we have had this pesky low pressure center that has not moved. all of this moisture streaming into these areas that have seen over a foot of rain in the last couple of weeks. and there's where we have the flash flooding concerns for

parts of texas, oklahoma and in towards colorado. and our forecast radar shows more rain in the forecast sunday into monday. and then things start to calm down a little bit. but man, we have seen record-breaking rainfall in this area. this is what we're expecting over the next couple of days. and in some cases, four to six inches on top of the record-setting rainfall that we have seen for the month of may. so records were set in parts of oklahoma and texas. and that will continue unfortunately for the next 24 to 48 hours. your memorial day forecast cooler than average across the west. we're going to be dealing with the potential for strong storms across the plain states. and then for the east coast, looking really nice. i mean the temperatures will be really lovely. along the coast, the water temperatures as well, however i want to caution those who want to go into the water because we have strong rip currents because of a high pressure just anchored off the east coast. so be aware of that if you're headed to the beach this memorial day weekend. arthel back to you.

>> we need something to lookout for. >> j.d. has the white stuff going on. >> first day i can officially wear white, right? >> well, technically monday but we can cheat a little. >> we don't follow the rules anyway. you wear white whenever you want to. >> i have st. patrick's day colors on so who am i to talk okay? >> see you later. let's move now to california. there's an oil spill there that is raising deep concerns about the marine life. veterinarians reporting they have found dead animals in the area. this after crude oil spilled into the ocean from a leak in an underground pipe very close to santa barbara. will carr is live in california with the latest. will? >> reporter: greg they just wrapped up the latest press conference. on the outside of the press conference there were a number of protestors around 50 to 60 here. they are against big oil and don't want disperse isn't as going into the pacific ocean. on the inside of the press

conference we learned the same things we have been hearing, that the recovery effort here could take weeks and months. it could take even longer to figure out the cause of the oil spill. there's also a lot of discussion on the impact to wildlife. as of right now, the numbers are relatively small in terms of the wildlife that have been taken into rehab centers. ten birds, three marine mammals and five dead birds on nearby beaches. rescue workers are continuing to try to look for more animals impacted by this spill, but at the same time some members of the community have told us that they have been trying to clean the beaches. and while they are doing that they brought in more animals who have been suffering. >> pelicans covered from bill to tail in oil. you know they are having a hard time flying due to their wings being saturated with oil. i saw a field puff on a rock two mornings ago with oil on his rear flipper and it was -- it was visibly trying to get it

out. >> reporter: authorities say that members of the public do run into animals who were impacted by this spill, the best thing you can do is to call the experts to come in to handle that. they say it could be dangerous for the animals and for the public. as for the oil recovery effort crews are working around the clock. at the same time the federal government wants to make sure there are no more accidents. so they have ordered the oil company plains all american pipeline to shut down its pipeline operation in this area. and as for how much all of this will cost we don't have a dollar amount as of right now, but the oil company will be on the hook for that money. greg? >> will carr live in the santa barbara area. not the first time they have had an oil spill there. will thank you. greg isis is making big gains in syria and iraq while president obama stands by his decision to keep american boots off the ground. so what does this tell us about the white house' strategy? and bullets fly. and bodies fall in one of the

at least 43 people are dead in mexico following the standoff with police and a suspected drug cartel. a security raid turning into an all-out three-hour gun battle between federal forces and gang members. police say a truck full of armed men opened fire and then tried to flee while they were chased to gates of a ranch. police faced off with more armed men and the shoot-out is taking place in the western city of h tanhuato. authorities in henry county are saying officers fatally shot 47-year-old james horn two days after the bodies of the victims

were found. he was accused of holding his ex-girlfriend captive in a wooden crate. police charged him with kidnapping but never held him in custody. police in washington d.c. say dna evidence on a pizza crust helped them track down the prime suspect in the murders of four people's whose bodies were found inside a burning mansion. daron wint was charged with four counts of first-degree murder yesterday. and now authorities believe he had to have had help. killed inside that northwest d.c. home were savvas savopoulas his wife amy son and housekeeper. apparently held them inside the mansion for many many hours. ordered pizza to be delivered. ate a lot of the pizza and left half a slice, well, you know

the dna experts took a look at that ran tests and that's how they nabbed the guy. is that reliable? >> that's extremely reliable. dna evidence these days is how we are linking a lot of crimes to the culprit. we think about aaron hernandez. that was bubble gum. now we have a pizza crust. this is a is a lie virginiasaliva dna to the accused. >> the jurors put a lot of stock in dna evidence. now, this guy wint's former attorney says police clearly have the wrong guy because this is a lovely person. he wouldn't hurt a fly. well you know this former lawyer seems to have forgotten the 30 brush-ups with the law and convictions. multiple charges of beating a woman. stabbing a man. he pled guilty to threatening to kill a woman and her infant and he threatened to murder his own family. so is this lawyer just spinning

it or incredibly naive or gullible. >> i think he may be naive and gullible. the nice guy defense doesn't work given the criminal history. not to mention the brutality of the crime he is linked to. it is really unbelievable. it's almost as if it's not real. it's a movie script. it's so terrible. >> well, the victims were tortured including the 10-year-old boy who was stabbed and set on fire. police suspect that this guy, daron wint had one or more accomplices. does that sound likely to you? >> absolutely. when you get into the facts of this case we're talking about 18 hours that the police suspect they were held captive in this home. three adults and a child. bound, gagged held there for that amount of time. in order to even pull this off, it seems that one person could not be in control of this entire family. >> well, evidence indicates according to authorities that wint was attempting to extort money.

in fact he succeeded in extorting $40,000 from the husband and wife. does that make this felony murder and why is that significant? >> oh absolutely. this is a felony murder case. that's when a murder occurs when during the commission of an underlying felony. that means we don't have to prove that he had a predetermined intent to kill these people. it's just that this killing occurred during the commission of that extortion. during the commission of that felony. during the commission of that kidnapping. that's going to be very relevant especially if there are accomplices because they will be able to be held to the same standard of murder as wint himself. even if they didn't actually kill the victims. >> now wint was on the run for several days but they nabbed him into custody of two men and three women. they may or may not have been involved. they might have been accomplices, maybe not, but what do you bet they know something incriminating? >> oh absolutely. i think for one thing we can say they were an accomplice after

the fact. how could they possibly not know that this man was on the run from the law? we all knew that. it was a widespread. so if they are taking him and trying to get him away from the police, they have liability in that aspect. not to mention, $10,000 in the car? my guess is this guy is not usually walking around with $10,000 in his possibility. >> they connected the $10,000 to the $40,000 extorted. look you think there's an interesting angle here with the assistant who dropped off the $40,000. >> i absolutely do. because he recanted on his initial statement almost immediately to police. he first said you know i received the call on thursday but then a text message shows he actually was contacted by the victim on wednesday night. he's gone back and forth. he doesn't remember key aspects of when he found out he needed to deliver this money, where he delivered the money to what the money was contained in and i think that's going to raise a lot of questions. they are going to be looking into this for sure. >> and this was the assistant to the father and husband who died

a cleveland judge acquits a white officer in the shooting death of two unarmed suspects. emotions are running high as demonstrators take to the streets shouting no justice, no peace. officer michael brelo was one of the officers who shot and killed the two following a 22-mile car chase in 2012. today's protests have been peaceful so far and police say they will not tolerate any violence. >> we are definitely going to monitor this for as long as it takes. and make sure that there is no violence or destruction in the city. the city will not tolerate any violence or destroux.

>> officer brelo breaking down in tears while the verdict is read. 13 officers fired in the car but only brelo was criminally charged remaining suspended without pay pending possible administrative charges. the department of state releasing the first batch of hillary clinton e-mails while she was secretary of state. the roughly 300 e-mails shedding light on how she handled the benghazi terror attack back in 2012. chief correspondents from washington have more. >> reporter: in the 296 e-mails uploaded then secretary of state hillary clinton was seeing updates on benghazi for weeks after it took the lives of chris stevens and three others on september 11 2012. this dismissed the idea of

very well. and to warn clinton that we continue to fend off questions about the unclassified talking points. >> in general, why would -- why would sort of saying it went fine why would that be inappropriate? >> i'm just not clear on the necessity of the senior intelligence official communicating to the secretary of state's chief of staff about these. >> i'm not clear why you're suggesting there's inpropriety? >> finally, the e-mails show on september 15 2012 four days after the benghazi attacks, mrs. clinton who famously asked if barack obama was ready for the 3:00 a.m. phone call herself, slept through the meeting where she was to receive the president's daily brief. the most sensitive classified document that the intelligence community produces. in fact on that day mrs. clinton awoke at 10:40 a.m. at the state department james rossen fox news. >> james, thanks. iraqi forces claiming they recaptured a town four miles from the key city of ramadi. the capital of the anbar

province fell to isis militants last week. the loss is devastating and another reminder that the terror group is on the move. well isis now controls parts of syria and has taken over much of northern iraq. now the white house strategy for dealing with these extremists is under fire. but the obama administration is standing behind the decision not to deploy u.s. troops. >> two years ago the information on the ground may have changed and may require some change in the way that strategy is carried out. but that's something that we'll leave to the next president. >> rick is here a former ambassador to the u.n. rick hi good the see you. >> thank you, arthel for having me. >> absolutely. we'll start here. leave any changes on the ground for the next president. would this be viewed as the right move considering the next commander in chief will have what at least four years to

deal with this thus he or she should set the ground strategy accordingly? or rick will the president's littics say that mr. obama is passing the buck? >> look, i think that it is very clear now that the obama administration is taking the threat for military action completely off the table. we have heard over and over again that the president is not going to start a war, that he's bringing all the troops home and now we have the president's spokesman saying you know what? the next president, whoever that may be is going to have to decide what to do about the syria and iraq. in essence, what josh is saying is they are not going to do anything about this. it is really shocking to hear the president say this. and you know who is really pleased with this pronouncement? it's isis and the taliban and all of the other enemies that we have around the world. they like hearing the fact that the united states for the

remainder of the obama administration is not going to have anything about the terrorism that develops. that's the shocking promise, it's a campaign promise, it's not a national security strategy. >> ric, i understand your point. but to put it in more context, the obama administration is saying that the reason that they want to give the -- hand it off, if you will in terms of ground decision there is off to the next president, is because it's a changing war, it's a changing battle and so -- i wanted to ask you, so that's their clarification on that part of the argument there, their position. but when you look at this battle against isis as it stands now, ric, is it a lost cause or is there new strategy or tactical approach that could be effective at this point? >> yeah you hit it on the head there, a tactical approach. of course there are things we can do. what is really frustrating is we keep hearing the white house

really talk about either going to a war, going to war or ignoring the situation. they don't know how to do diplomacy. there's no in between middle ground. they keep telling us well, we don't want to start a war and go there in. they are targeting strikes with intel officers on the ground. look we have the best military in the world. we should be -- >> i'm sorry to interrupt, but they do plan to put the folks there on the ground who can help them pinpoint the current air strikes. >> look let's be very clear. we have been droning, we have had a drone policy. we have been droning our enemies since the beginning of the obama administration. we also have pulled out most of the intel officers over the next several years from the targets. we are droning without specific information. matter of fact we have sent in special op forces who tried to free an american. we went to the house where we

thought the american was located, and the special ops forces got to the house only to find that the house was empty, that the entire crew had moved on two or three weeks before that. we have old intelligence art. we are not up-to-date with our intel. you cannot fight a war, you cannot drone appropriately if you don't have pinpoint accurate information. you're generally droning with -- in what that means is that you're hitting targets multiple times and you're not sure what you're hitting. >> just to be clear, give me ten to 20 seconds on this. what is the strategy now? how do you move forward to make this more successful? >> i think the president has to come clean to say, i have to put more boots on the ground. i have to put intel officers. we have to defeat isis. after all, americans are watching through a youtube video literally christians being beheaded. this is an islamic radical group that has to be stopped.

bipartisan in the u.s. senate and to some extent of the house, which is a rare commodity in washington? >> it sure is. you and i are so used to the republicans being over here screaming on one side and democrats screaming on the other. to have the two groups of combined republicans and democrats on both sides screaming at each other might be funny and amuse inging. but the topic is not so concerning be it the patriot act. one way or the other, there's going to be a compromise here. because one way or the other, i can't see the government stopping its access to important information that can be you know very valuable in preventing terrorism. >> right. and, in fact the new attorney general, loretta lynch on friday by the way, she's prosecuted terrorism cases and said the u.s. will be less safe if they fail to extend this thing.
