>> yesterday's ruling sparking immediate protests in the streets. most of people peaceful but police issued a stern warning to the public. >> we also want to make sure that our parents out there are aware of where their children are. we don't want anybody caught up in an unnecessary situation, especially our kids. >> now the doj is getting involved with the case. they will review all of the testimony and evidence in the trial to determine what if any additional charges should be file. of course this police officer is still on unpaid administrative leave at this hour and those administrative charges could depend on his fate. >> you remember the department of justice had done an investigation into the cleveland police department. found some wrongdoing. remember this car, the chevy malibu police thoughts were fired. turns out it just back fired. 62 police cars got involved in

this chase. now, this morning, the city is on edge after these protests. it started out peacefully yesterday. walking down the street. people carrying fake covens with sayings will i be next. >> it looks like from the pictures we've seen overnight, people who are getting in the faces of police don't have their faces covered and what i saw in baltimore and from what we see in ferguson it's when the guys are have their faces covered that's when things escalate. before all this all, cuyahoga county common pleas judge put out a staple says look whatever i'm about to rule don't riot and don't celebrate. is that now the normal thing? where these judges have in the back of their mind while they are trig to figure out whether someone is guilty or innocent will this cause a celebration or a riot?

>> and this is not the way the judge is supposed to be ruling. this is apparently what the judge decided to do. >> you remember the rush to judgment in the ferguson story. celebrities like lebron james coming out wearing the t-shirts. i can't breathe. that was related to the new york eric garner story in new york. but celebrities coming out and saying hands up don't shoot cht. >> and lebron -- he was telling people that he wants -- hey, you are all work up about this save your energy for tomorrow night because we've got a game. and -- >> go protest. just watch the cleveland cavaliers, and put all your energy into that. don't riot in the streets of cleveland. >> he wants people not to freak out and target police officers and not cause any property damage but is he saying that a protest over somebody dying is the same as a game against the atlantic hawks? >> i don't think he's saying

we're going to get right to this fox news alert on sunday morning. cleveland on edge this morning. a dozen under arrest when mostly peaceful protests turned violent. more than 100 people swarming the streets after a judge acquitted a police officer in the 2012 shooting death of an unarmed black couple. timothy russell and melissa williams were killed in a barrage of 137 bullets after leading police on a 22-mile high speed chase. officer michael brelo was the only one charged. he shot 15 times after they stopped the car. the judge said there's no prove he caused the deaths. >> for some reason they didn't pull over. we don't know. they did not deserve to fleeing and alluding. that's not a death sentence. >> yesterday's ruling sparking immediate protests in the

streets. a mayor issuing a stern warning to the public. >> it's my expectation that we will show the nation that peaceful demonstration and dialogue is the right direction. >> now, the doj is getting involved in the case and investigating whether any additional charges should be filed and police officer brelo has been on unpaid administrative leave and continues to be as officials try to decide whether additional administrative charges need to be filed. the judge ruled in those 137 bullet holes to determine, he was unable to determine if he was the one responsible. he climbed up on the car and continued shooting. >> that judge seemed to know and this is something that i'm sure potentially be a legal problem, he seemed to know while he was determining this officer's guilt or innocence, he knew there could be riots. he put out a statement while he was reading a 35-page long decision which was very deliberate. he went step by step through

explaining why this officer got off, but he said guilty or not guilty the verdict should be no cause for a civilized society to celebrate or riot. that's something, judges you would hope are not always thinking about what a verdict is going to do. they are there. they are the impartial arm of the law to say here's the facts of the case. i'm not thinking about anything that's happening outside or anything that could happen but that's the case here. >> not simply to quell the crowd one way or the other. we saw that in baltimore as well. we're going to have rob wheeler on a little bit to talk about it. a big win for ben carson overnight at the southern republican leadership conference. a new straw poll out this morning. he handily won with 25% of the straw poll results at 25%. scott walker checking in with

could perhaps face federal charges to some degree and actually clayton that is the doj's responsibility to look into cases like this. not every case like this but a number of cases like this and especially right now, clayton because of what's going on around the country, i think they do have a duty and an obligation to do so. >> david, do you agree? >> do they have an obligation? they can. i think it's a good idea especially with protests and things like that. we've seen this happen like in the ferguson case where the doj came in and issued a report clearing the police officers. is it a good idea? yes, i do agree. >> what do you guys think about what the mayor said last night? >> i grew up on the streets of cleveland. as a matter of fact i have several relatives that's members of the cleveland police department and i can tell you, clayton, that people there as

well as all around the country are very frustrated right now. look the verdict yesterday was obviously a significant blow to that community. there's no justification for the officer's actions even though we have to respect the decision of the court. so i think what we're going to continue to see in this country are uprisings such as what we saw in ferguson and baltimore until we can find a way to come together to try to get rid of some of some of these issues that we have. we have to deal with it. ns not going to get any better. you understand some of these emotions 137 shots fired. 13 officers involved in this. a 22-mile chase. it all started when their car back fired in front of police headquarters. no shots were fired. their car back fired. that led police on a high speed chase. was this acquittal appropriate? >> i believe it was. for those who disagree and don't understand. i would invite people to read

the 43-page opinion by judge o'donnell. there's two real substantial legal issues in this case one of of which was causation and what shots caused the decedents' deaths. there were 137 shots fired. four fatal to the male and seven shots to the female. the judge couldn't determine what shots killed them. that was the basis of the acquittal. >> are we afraid we're going to face this same problem like baltimore, ferguson new york all over again? >> absolutely we are and not just with cleveland. i think with other cases as well. let's face it injustice anywhere is a threat to justice everywhere, and until we start addressing these problems clayton, we're going to continue to see riots all across this country.

what you are dealing with here is the character who finds a magical pen who transports her to a mystery world called tomorrowland and elements in that world are affecting this world. she teams up with george clooney clooney's character to try to save the world. i'm trying to wrap any mind around what happened in the movie. you are dealing with a movie that is so under whel ming. there's really no emotional pay-off and i never felt connected to the characters overall. it's visually amazing. the effects are incredible. that does not work. for the kids i would not recommend it for the whole family. i gave it 2 1/2 out of 5.

the i max version of the movie has 16% more of the movie. >>. if you are looking for a great kids movie by the way, rent "paddington." and poult ter gieft, this is a pointless remake. it's the almost exact same film. it's well-made from a production standpoint but why see is it? there's no point. this movie. it's way too fast paced. a gave it 2 1/2 out of 5. the only movie you should be seeing are mad max, pitch perfect 2. >> and avengers.

and go to an extreme weather alert. an oklahoma firefighter drown overnight after being swept away during a water rescue in claremore. also in oklahoma a suspected tornado damaging several buildings on a small farm. no major injuries reported. flooding of historic proportions across much of texas. they have had had so much rain in the last of weeks. we've got these upper level disturbances across areas of the west and it funnels it across the south. incredible rain. austin area picking up 8 inches of rain. that caused some of the rivers to go to their record stages in athe matter of an hour. in some cases rising around 40 feet.

it wash out one bridge in the town of wimbarly. the floods you see where we have these concerns where you have the red color, that's flash flooding going on right around the austin area same across dallas and oklahoma. severe weather a little bit farther to the east. a few more tornadoes could be seen. maybe another three or four inches of rain there. >> three to four inches of rain in texas. >> some spots had 8 inches yesterday and some spots have seen up to 20 inches in the last three to four weeks. and on to some other stories making headlines. new court documents reveal three workers raced against time to arrange the ransom.

i'm trying to get a flight tonight, for tonight from miami to new york. >> so can you sue your boss for having to answer those late night emails? here now to debate. nice to see both of you. welcome to the show. >> good morning, clayton. >> do you have a right to sue your boss if you get late night emails? >> well in my view probably not. in the world of employment law, there are always a lot of rules and exemptions and everything of that nature but at the end of the day, these kind of cases fall under a federal law known as the fair labor standards act and that's the federal overtime law. there are several exemptions to that that drive people out of overtime qualification. for example, to give you an idea of how low the threshold is if someone is salaryied at $24,000 a

year or month, they are an office administrative they would fall under an exemption. it sounds unfair. that's really the state of the law right now. >> it seems there are not enough legal opinions out there. we're in this new digital frontier where 44% said they regularly perform their work and job outside of work often on their smart phones at night. we have this idea that at 5:00 p.m. you should be able to shut down. those days are gone. >> it's a very unfortunate situation. the hours and wages is on the forefront of people right now, the minimum wage stuff and as far as this is concerned, this is not a matter of labor versus business. this is enforcement of the law. it's the law of the land. last generation of workers, employers would allow them to have time off at night. it was very sacred to spend time with your family. all of that has changed because

of the new technologies but that doesn't necessarily allow employers to not pay people for working after hours. >> that's the issue. they are expected to be always on and if they are not paying them for overtime and yet they are expected to always be responding. i email you last night, it was 8:00. you didn't respond. what were you doing? i was home with my family. >> it was unfair. this is really what i would call kind of a modern fact of life. i agree with everything that you are saying but the modern fact of life is these days we carry our emails with us and there are a number of things that employees do that they don't necessarily get paid for. this is a low threshold which the president has expressed great frustration with. even this they are not nonexempt, they don't get paid for commuting time. >> first of all, i look at this

employers, for example, you come in early on the job and you are doing prep work you get paid for it if you are an hourly worker. i had cases where i represent, you know overtime clients. recently i went -- i sued a franchise, a pizza delivery person. he only worked there a month. i settled the case for about $50,000. you know this is a secret for you viewers. labor lawyers like myself who represent individuals, we used to sue for discrimination but now the burden of proof is so difficult, but in overtime cases, it's easy. and you are entitled to get not only the time and a half if you are not paid but you are entitled to get liquidated damages and interest and attorney fees. if you work in the middle of the night and they want you to do something, it's akin to coming in early in the day. >> only if you are nonexempt. >> don't give up your rights. we appreciate you joining us tomorrow. should you be paid for those

>> i love the lineup that the republicans have because it shows america the depth of what the conservatives are trying to accomplish. i think ben carson is great. i think we would all agree. he's a real good role model for so many people. he campaigned for this. at the same time one of the things that he really need to do is know about what he's talking about on foreign policy and understand the dynamic of what's happening in governing. those are his weaknesses. he can clearly win straw polls. he won't be a player in the long had been ---term dynamic. it good fun for him. >> who does he remind you? >> i think he's turning into rand paul a little bit when it comes to straw polls. >> i may agree with you in terms of the straw polls aspect of it. i think ron paul and rand paul i think are the two candidates previously and current who can

actually transform the republican party. actually take the grassroots and bring them a little more to the center. i don't think dr. carson can do that just yet. >> i don't think abandoning the entire foreign policy dynamic is bringing the republicans to the center. there is plenty of time for that. we've also seen republicans are turning on each other right now. listen to this. >> this debate that we're having right now about the paytriot act and whether we should have strong intelligence around the world is a very dangerous debate because it's being done by people having no experience dealing with what i've dealt with. >> understanding through practical experience doing business shouldn't be discounted we see what people have no experience in anything other than in government we see what the result is. >> there are some people there are some of those folks, particularly folks in washington who are really good fighters. they are fighting the good

fight. they are waving the flag they are carrying the banner but they haven't won a whole lot of victories yet. >> are voters at this point so invested in certain candidates that they want to see this kind of in-party fighting? >> what's really marrying right now is name recognition. jeb bush there's baggage with the name. he's got to differentiate with himself. walker has to explain to people what makes him different. so does ben carson ted cruz marco rubio, all of them have to explain themselves to the american people and why it matters. the key is going to be is not to eviscerate everyone else and focus on -- >> do you think it matters that they are fighting now? >> it does matter that they are fighting now. we're pretty far out. they are just going to go negative on each other for a long period of time and hillary clinton just sits back and watches. >> that's the key thing.

san antonio to swell. >> overnight in oklahoma a firefighter killed after being swept away by flood waters during a rescue. more severe weather, rick. >> that river going to its all time high level ever. it washed out a road. one of the bridges in the area. all kinds of water rescues going on. a lot of it rain happening through the overnight hours. you get an idea of how scary that is. that much rain falling that quickly. this is also an area that's seen that much rain over the last few weeks and the bulls eye of it is just here to the southwest of austin and radar estimates for that may be up to 8 inches of rain just in a matter of a couple of hours. we still have the rain going on. it's pulling to the east. we are drying out around oklahoma city. dallas is mostly moving just to the east at least for today. all this rain will pull off toward the east. tomorrow it redevelops in texas and brings us the threat for

severe weather. we have all kinds of flooding concerns going on. believe there's still a flash flood warning going on. it's not popping up on that map there. rivers all of them out of their banks toward dallas. just to the east of oklahoma city. interstate 40. all that flooding will continue to be there as well as a threat for tornadoes today and tomorrow. more tornadoes. three or four inches of additional rain fall tomorrow after everything they have seen. we still have a long road ahead of us. >> now to other stories making headlines. new court documents revealing three family workers race to deliver the $40,000 in the d.c. mansion murders. he arranged the drop on the morning of the murders while being tortured by suspect daron wint. the first worker picked up the money from the bank of america branch. the second took it to a house and gave it to an assistant that

put it inside a red car in the garage. hours later the mansion was on fire. savopoulos his wife son, and housekeeper killed. >> they'll be paying respects later today. one day before going on maternity leave, she was gunned down in a shoot out that also killed the suspect. the omaha community has come together in the wake of her murder showing support for the family. the viewing takes place today and she will be laid to rest tomorrow. >> iraqi forces now launching counter attacks against the islamic state marching toward ramadi. this is some u.s. special opps troops want to fight isis on the front lines but the obama administration policies is restricting their mission. >> no one is interested in rolling tanks from baghdad to

damascus but sending raids in to disrupt the enemy's command structure to keep them off balance would go a long way toward hindering their ability to operate. >> in a new interview one unnamed special operator says we're doing everything through cell phones. it's hard to do much when you can't go outside the wire. and a very straightening accident. a military sky diver hits power lines at a memorial day event in tennessee. >> well he appears to be blown off course by the wind. he was one of three men all military or reserve parachuting saturday evening. he was alert and conscious after he hit the ground but suffered serious injuries. he is expected to be okay. the other two men were not injured. those are your morning headlines. >> we want to get right back to the fox news alert now. we're listening to the mayor of

cleveland, frank jackson. he's speaking at this police press conference. we'll hear from chief of police in a short time. >> yes, they were peaceful although aggressive at the end of the day but still peaceful. in the evening there were some that crossed the line and as a result they were arrested and they crossed the line in some cases by assaulting bystanders which again we will not tolerate. so i'm going to have the chief come up and talk to you about -- give you an update as to where we are and where we anticipate going today and give you some indication as to the number of arrests that were made yesterday and why. >> thanks mayor. good morning. first of all as the mayor stated

the majority of the protestors and protest activity yesterday remain peaceful although sometimes aggressive but still peaceful and within the bounds we expect from people here in cleveland. we made sure that we allow people to express their first amendment rights. to express their anger and frustration about events that occurred here and around the country. throughout the early part of the day those activities remained peaceful. as we began to go toward the early afternoon hours, things got a little more aggressive. protestors actually blocked one

of our major thorough fares. this is a dangerous activity and we try to discourage it and prevent it because a highway with cars going 60 miles per hour is a lot different than a public roadway with a 25 miles per hour speed limit. so at that time officers moved in and basically dpaif warningsgave warnings to the protestors that dispersed and got back on to the normal roadway. protestors after a certain time period on the west side of town came back downtown and entered tower city center. they became disruptive. the officers of the division of police was able to get those individuals out of tower city at which time the businesses in tower city closed for the remainer of the day. just as a precaution.

i stated earlier the protest basically remained peaceful until the later part of the day when people began to get more aggressive and at times started to cross the line. as i stated yesterday we would not allow people to commit acts of violence either against property or persons in this event and officers moved in as soon as those things began to happen. on east 4th and here one of the protestors actually picked up a sign from one of the restaurants on the sidewalk and threw it at the patron enterinjuring the protestor and hitting him in the head. some interfered with the arrest and three people were arrested. the main protestor for assault

and the other protestors for crimes ranging from obstruction of justice to aggravated rioting. >> the protest continued and moved to an area of east 9th and euclid where we had them pepper spraying patrons seated at restaurants or patio areas down the streets. officers again moved in and made arrests. later in the night we had an incident that happened at east 4th street and euclid where protestors attacked bystanders. officers moved in and the order was given to disperse the protests. they were becoming increasingly violent not so much about officers but against normal every day citizens enjoying

downtown. officers made several arrests at that time and orders were given for the protestors to disperse. most of them refused at which point we made several arrests as the night went on and we attempted to disperse the protest. this all culminated later on that evening in another confrontation on west 6th where protestors were ordered to disperse. they refused. at which time we brought in enough officers to make several arrests. those arrests were as follows. 71 total individuals were arrest arrested. there were 39 males arrested. 16 females arrested.

and there were also some juveniles arrested and other adults. we only moved in to make arrests when things got violent and protestors refused to disperse. we wanted to make sure that people understand we're going to help you in this process but if things turn violent as we stated in the beginning we will take action to preserve safety in this city. thank you. any questions? >> it is hard for me to see you -- >> you're listening to -- this is now the mayor. we were listening to the chief of police there, calvin williams in the cleveland police department saying that 71 people were arrested in those protests. they were mostly peaceful. he said that the police department there was allowing protestors to come out and express their first amendment rights and protest their displeasure with the acquittal of michael brelo.

>> but they wanted to give them space to protest not only what's going on in cleveland but also what's going on around the country. so you would presume if they're trying to give them space to protest what's around the country they would have beef with police but he said these protestors started attacking bystanders so it makes you wonder if the people who were arrested were actually there when the protests started. if someone up et state's exhibit that picked up a sign at a restaurant and hit someone in the head. >> it's similar to what you saw with cvs and the small mom and pop shops. they're innocent. they did say it started out peaceful and turned violent and that's when police officers decided to start taking action.

house aid and guy trying to do business in libya at the same time he was peppering the secretary of state with bad intel about libya, all of that works to her benefit. >> how about on friday when we knew the documents were going to come out. it seemed like a lot of deep sea reporters were laughing. they said classic holiday news stuff on a friday. the clintons are at it again. they had to record the history of it and stop giving them a free pass and say wait a second you guys are up to something. >> i don't think i would say free pass because it's the new york times which is a left leaning organization that broke the original story about the private e-mails as written by the clinton foundation as well and the role of bloomenthal

which is disturbing. there's going to be more releases of e-mails if there are any of these batches damaging information showing hilary was being politically calculating or wasn't telling the truth. that will be a big story but so far we haven't gotten there. >> is she being smart in all of this? everyone is saying she's not talking to the media. she's answers a few questioning. her poll numbers are going up. what advantage is there for her to talk to the media. >> i know the conventional wisdom is she is rolling for the nomination. why deal with the possess kesky reporters. it's important for her to be seen engaging answering questions, not letting this build up so that you have one of these explosive news conferences with her, 45 negative questions in a row. this is part of running for president. she has to demonstrate she can do it and do it with finesse and humor and she seems to be avoiding journalists like the

speech. do you think their priorities are in the right place on that? >> i think it's probably not surprising that they both would focus on this topic. president obama's speech was at the coast guard academy. climate change was a subject that will be of interest to this year's class. >> next up we have mitt romney. let's take a listen at this one. >> learn the sbienterprise that employees. you don't waste time. don't skim by with the minimum of effort. dive in. get more from your job than a paycheck. >> so how did he do? >> well you know i recently read two anthologies of commencement speeches. one by liberals and one by conservatives. liberal speakers will often give big sweeping advice. change the world kind of stuff which is inspiring but not terribly actionable.

what romney is doing is what a lot of conservative speakers do and that is to give more specific and actionable advice. he's talking about navigating the work place. >> get more from a job than a paycheck. news you can really use. actionable guidance. next up let's watch this one. >> i wanted to begin by telling a story. i was deeply impressed because i thought to myself if she cares enough that she made this mistake to cry about it she is precisely the kind of person i want working with me at special reports. >> talking a lot about character and being emotionally attached to your job. how did he do? >> one thing i found is that conservative speakers will try to connect with personal stories. not everyone may feel the story resinates with them but that's a good effort. humor is also useful and that's

when their taxi hit a guardrail. he was 86. his wife 82. they had been married nearly 60 years. clayton? >> so sad. i used to live in west virginia where he is from. i'm sure the people are mourning his loss. thanks peter. a reunion almost two decades in the making after being put on one of saddam hussein's kill list. awaz bawawi and their newborn daughter attempted to plea iraq but were stopped at a checkpoint until an american soldier stepped in and saved them. 18 years later, she was able to track down her hero and the three were united at her high school graduation. joining us now are those three. lieutenant kernel greg pipin and the family he saved. nice to see all three of you. what was it like getting together at this graduation after 18 years of not seeing each other?

>> nerve-racking, actually. a lot was going on through my mom and greg's mind. >> what was it like to see them for the first time since that border checkpoint? >> it was absolutely amazing to see them safe in america and how they have embraced america and how america has embraced them. it was a fantastic experience. >> awaz take me back to that day. you were on saddam's kill list because you were kurdish, working for the americans at the time trying to get your new baby out of that country. take me back to that day when you spotted greg. >> yes. we had already checked by the americans to pass the border and to move to the united states. when the iraqi soldier came in he asked me about my name and who is with me. so i gave him my name and my husband and my daughter and he said you and your husband can leave but she can't, because she

is not on the list. i told hem i was pregnant during when we submitted the list and now i had her. i had her birth certificate. he said, she can't leave. when we start arguing, he said you can give her to somebody to deliver to your family if you want to leave. otherwise, she is not leaving. i said if she can't leave, i can't leave either. he pointed out to the door and said just get out of the bus. so we got out of the bus and we were about to turn around and leave and that's when mr. pepin saw us and came in and asked us what's going on. >> you got them out, greg. you always wonder what happened to the 7,000 people that you managed to evacuate? wasn't this on your mind? what happened to those people we got out that day? >> you always wonder. they assimilate in america? where did they go? how are they doing today? >> to see a family like the

baharis, so successful and truly american is just a great experience? >> it must have made it all worth it, right greg? >> absolutely worth it. this is what i think the military is about, not only saving and protecting our homeland but helping and getting other people to a free and democratic country to let them live the american dream. absolutely. >> how did you track him down? >> we were doing an assignment in my language arts class. i was telling my friends the storley about it. they said, you should try nd aget in contact with him. my mom and i looked him up. what ended up happening was she didn't think i could get in contact with him after finding out he was the vice-president of boeing and the president of boeing international. >> you found him. sadly, we are up against a hard computer break. thank you for your service to this country. thank you for sharing your story on this memorial day.
