own swept away during a water rescue. >> one of our firefighters fell into a storm drain. we believe one of the other firefighters attempted to help him out of the storm drain and got taken in as well. we suspect that he drowned. got caught in the storm drain itself. >> that firefighter, identified at captain jason farley and nearly 20-year veteran of the clair more fire department. we have team coverage. janice dean live in the extreme weather center and let's begin with will carr following the story live in the los angeles bureau. will? >> that incident with the firefighter an example of just how dangerous the weather is that we're seeing this weekend. this is a region that's really been pounded by bad weather over the past couple of weeks and it just has not let up. yesterday, central oklahoma parts got more than 7 1/2 inches of rain in just a couple of

hours. it created flash flooding hazardous situations. we have pictures of some of the viewers on twitter. cars look like they'resome swimming pools. a gas station looks like the middle of a raging river. the storm slammed parts of texas. according to the national weather service parts of central texas got four inches of rain overnight and continuing to rain in the course of the day forcing some to evacuate their homes. >> went to bed probably around 11:30, 12:00. i don't know probably -- heard the power go out. wasn't worried and then strange noises from down stairs. there's probably an inch of water on the ground. >> two people are now in the hospital after a possible tornado set down in southwest houston. and as i mentioned, it's continued to rain in texas and oklahoma and today and supposed to continue to rain tomorrow. you have to keep in mind that this is an area that's just very saturated so the potential for

more flooding in the next 24 hours. gregg? >> will carr we'll check back with you. thanks. >> let's find out where the storms are headed and when the midwest could dry out again. turning identity ever to janice live in the fox extreme weather center. jd? >> goes to show you it doesn't take a tropical storm or hurricane to do damage. i mean we are talking about record setting historic flooding. for oklahoma city the wettest month ever on record with over 18 inches. typically in the month of may, they receive about 4 1/2 inches. we are setting records all across the southern plains. and it's not over yet. within the last 48 hours, easily 6 to 8 inches and some of the areas. saturated ground. the water has no place to go. and so that it just acts as runoff so flooding is imminent. it is happening right now across portions of texas and oklahoma. in towards arkansas louisiana, kansas and missouri. now, the weather is going to

clear i would say in the next couple of days but we still have inches of rain to go as we head into tuesday and even into wednesday. it moves a little bit more to the east but still in the bull's eye here of areas that received incredible amounts of rain. other than that we have the threat of severe weather. including tornadoes. tornado watches here stretching from the gulf coast all the way up towards the upper mississippi valley. we have severe thunderstorm warnings in effect moving towards the little rock area. no tornado warnings right now. tornado watches meaning that conditions are favorable for tornadoes. there's the severe threat. parts of texas, mississippi river valley. tomorrow the threat of texas in towards oklahoma and then heading into tuesday, the tennessee, the mississippi river valley, under the gun for the threat of large hail damaging winds and tornadoes. not over yet. of course the flooding is going to be the main concern over the next couple of days. heading into holiday monday another batch of moisture moves

in. tuesday and wednesday we start to clear out a little bit. but looking ahead to friday and saturday, it looks like more wet weather for the plain states. that's the story. a quick look at the memorial day forecast. cooler than average across the west. central southern plains on guard for potential of more flooding and nice along the east coast. back to you. >> okay. janice thank you. >> okay. cleveland officials thanking the protesters who kept demonstrations mostly peaceful after a police officer acquitted yesterday for the shooting death of two unarmed black suspects. 71 people were arrested but the chief of police says the majority of folks out there were respectful. garnet tenny is live in cleveland following the story. garret? >> reporter: it was clearly entirely peaceful and not until the crowd marching nearly eight hours throughout the city yesterday that a couple of bad apples in the group acted out

and officers moved in. according to cleveland's police chief, one point several demonstrators pepper sprayed bystanders and one threw a sign at someone silting in a restaurant. they were the exception. one point, police determined at that point, rather police determined that it was a risk to public safety and arrested 71 people in all. almost the entire crowd for failure to disperse and unlawful assembly. this morning, though the cleveland mayor thanked the vast majority of demonstrators who have peacefully taken to the streets. >> they served as an example of peaceful demonstration and dialogue that will help us to move forward to a positive and substantive reform and forge better relationships between the police division and the community. >> reporter: now that the trial is over and internal

investigation is under way by the cleveland police department to determine if the 31-year-old officer who was found not guilty in this case determined if he will face any disciplinary action from the shooting. five other police supervisors have been charged with dereliction of duty in the case. no trial date has been set. meanwhile, the fbi, the u.s. trch's and the department of justice said that they will look at the evidence and testimony in this case to determine if any additional legal steps should be taken. protests are scheduled tonight outside quicken loans arena where the cavaliers are set to have a playoff game. gregg? >> all right. garrett tenney live in cleveland, thank you. we'll talk to the legal panel. a closer look at the judge's decision to acquit the officer in the case. what the next steps might be as the feds step in. could they charge separately and avoid double jeopardy? we'll debate it coming up. the syrian army is

reportedly deploying troops for a counter attack to retake the ancient city of palmyra. they've reportedly killed civilians of women and children since capturing the city on wednesday. connor powell is live with more. connor? >> reporter: yeah isis fighters raised the black flag and according to syrian state tv killed hundreds of people including some even by beheading. now, a syrian officials said that they'll begin a counterattack to retake that an shebt city and not giving a timeline nor have they said how they're going to do this. the army is stretched thin and losing ground across the country and doubts about how effective a fighting force they could be trying to retake that city from isis. in iraq pro-government forces have launched a counterattack to retake the city of ramadi. initial reports suggest the

fighters and iranian-backed militias making some progress seizing smaller tounls. inside the city though insurgents like they're doing in palmyra reportedly executing local tribal leaders and anyone accused of links to the government. now, tens of thousands of civilians are fleeing ramadi and many are trapped inside the city and pro-government iraqi troops and not letting civilians out of al anbar province. today iraqi officials took offense at something that secretary of defense carter said which was that the iraqis security forces lost the will to fight in ramadi. iraqi security officials and other politicians inside baghdad said that simply wasn't true. they said that the pentagon simply needs to provide more military equipment and this isn't about whether or not rirk

beautiful mind" has been killed in a car crash along with his wife. they say the couple was riding in a taxi yesterday when it crashed on the new jersey turnpike. brian ennis is following the story from the new york city newsroom. >> reporter: john forbes nash jr. considered one of the great mathematicians of the 20th century killed saturday with his wife of 60 years alicia. when the taxi lost control and hit a guardrail and another vehicle on the new jersey turnpike. they were pronounced dead at the scene. it appears they were not wearing seat belts. john had just accepted the prestigious able prize for math me ticks in norway, eccentric, considered a founder of modern game theory. the mat mathematics. a battle in the film of "a beautiful mind" winning oscars with russell crowe. nash struggled with hospitalizations and delusions for three decades before

recovering and receiving the 1994 nobel prize in economics. on twitter, crowe who portrayed john saying stunned, my heart goes out to john and alicia and family. an amazing partnership, beautiful minds, beautiful hearts. nash spent much of his life at princeton university. first as a graduate student and then a senior researcher. princeton university calling both john and his wife alicia quote, very special members of their community saying the remarkable achievements inspired generations of mathematicians economists and sign tests and describing nash as a genius and even that seemed to fall short. >> i like to think of myself as a genius. but i later on sort of realized it's meaningless in a sense. you are using a popular word. >> and an original thinker for sure. he was 86. his wife 82.

new signs that the house select committee on benghazi is stepping up its investigation into the terror attack on our consulate in libya. democrats had criticized the committee months saying it's moving too slowly but the

republican-controlled committee led by representative gaudy saying that the clintons were able to decide which e-mails were turned over and which were not and they would like to have a hearing in which former secretary of state hillary clinton testifies at the hearing but first they want to get as much information as they can. democrats on the flip side are saying that republicans are playing politics trying to drag out the process as we get further and fourth sbeer the 2016 cycle. >> let's go there for a second. for clinton critics, could the panel move too quickly? i mean if there is something in the e-mails to be potentially politically damaging to the former secretary of state, wouldn't the opponents want that to happen closer to the election? >> that's a great point. in fact secretary clinton accused to testify before the committee. they said that they would only do it once though. and so originally there was a may 18th deadline. that deadline is extended to june 3rd. everybody's in recess next week

but i expect to see former secretary of state on capitol hill and in another hearing environment and interesting to see if anymore e-mails or new details emerge. >> a casual aide as he's described to secretary of state clinton is going to testify, as well. before that june 3rd deadline you mentioned. who else might we see being deposed? >> we have seen the top state department official and could be sidney was the one i think that emerged when those e-mails were released and pretty much trey gaudy said he wants to interview anyone and everyone in communication. thousands of pages of e-mails and bet that staffers are working this weekend to try to put more pieces to the puzzle together. but the documents clearly show arthel secretary clinton was very well aware of what was going on in libya and communicating about the attack on the day of as well as afterwards and how the white house was talking about the

attack and so there's a lot of evidence to suggest that she was very well aware. but now, republicans are still pushing for more documents about that server. >> kevin, finally, is it possible that in the end the discovery does not derail hillary clinton's run for the white house? >> you know, i think that's a great point and we saw her campaigning this week. she says that she wants to put all of those e-mails out there. you alluded to it in your previous question about kind of an earlier the better to get all of that information out there. her supporters are adamant there's nothing in the e-mails and been forthcoming. obviously the politics of this still continuing in the next couple of weeks, though on capitol hill. >> i know you'll be following it and talk to you again. kevin, thank you. >> thank you. this year marks 70 years since the end of world war ii but today some of those veterans are fighting a new battle to give their fallen brothers the

every memorial day, jack and roy decorate the memorial with american flags. >> we think about all of our friends. they gave up their lives for us. >> reporter: the memorial needs restoration, a ramp accessible bathrooms, elevators, plumbing and air conditioning. >> a full renovation close to $70 million. what we are looking at is all the public has access to and closed and that's it but inside it is a treasure trove of rich history. the names of those that lost their lives. >> we would like to look at all those names that are on the wall. >> i'm not here today to have this interview. but i can still see their faces. i can still see their faces. i can still see them throwing touch football in the street. this is my neighbor ernie. he went into the marines. i went into the navy.

ohio judge yesterday acquitting a cleveland police officer in the shooting deaths of two unarmed black suspects. officer michael brelo one of 13 officers involved and only one to face criminal charges. but the judge finding him not guilty of voluntary manslaughter saying that the state failed to prove that he fired the fatal shots. the department of justice headed by attorney general loretta lynch is reviewing the case. let's bring in david schwartz and keisha evans. they're fine attorneys and former prosecutors. before we get to causation because that was really the judge's decision he also

decided that this was self defense. keisha a total of 137 shots are fired by police at the car. all of the cops except brelo stopped shooting. brelo jumps on the hook of the car and fires 15 rounds. does that sound like self defense? >> not at all. i think if he really thought that these individuals were shooting at him he would not stand on the hood of a car and continue to shoot. he would have been concerned about his own i have asafety and this was excessive force in any opinion and shooting. it's ridiculous. i can't see it being self defense at all. >> the judge said he reasonably perceived a threat and jumping on the hood of the car and firing his weapon said the judge is protected by law. really? >> we have to look at the surrounding circumstances here. i'm going to say something that's going to shock people right now. i'm going to -- what i'm going to say is when you're traveling at a high rate of speed through the great city of cleveland for

22 minutes, alluding with 60 police cars following you, and putting yourself at risk and putting other lives at risk there's a great chance that you're going to die in that act. >> wait a minute. wait wait wait. wait a minute. >> someone else is going to die. >> rodney king led police on a high speed and slow speed chase and then beaten by police. are you suggesting king deserved to be beat snn. >> i'm talking about the surrounding circumstances and not just a simple somebody jumping on to a car. when you're in that type of intense situation, and you start firing look. you know? it's a very intense situation. could it have been criminally negligent homicide it could have been. >> there's no reason to shoot that many rounds and the high-speed chase and shot at the individuals because they thought they used the weapon towards them there was no proof of that. there was nothing that was hit or shot. >> self defense which the judge agreed with seems a little fishy

but that's not why he decided to acquit. >> right. >> he focused on the cause of death. take a listen to the judge. >> the state did not prove beyond a reasonable doubt that he caused the death because it was not proved for both counts. i therefore find the defendant not guilty of counts 1 and 2 as indicted. >> basically, david, the judge is saying the victims were shot so many times we can't tell who killed them so i cannot legally find brelo guilty of killing them. >> not only that, in a criminal case it's did d.a. that has to prove guilty beyond a reasonable doubt. they have to prove beyond a reasonable doubt that those shots are the fatal shots. and the judge decided they failed to do so. >> one thing in criminal cases is there's always a lack of

direct evidence. this is circumstantial evidence. i think that there was enough to say this police officer standing on the hood of a car -- >> 13 cops in all and the judge said i can't single out this one guy. look. i want to ask you about something else. prosecutors cannot appeal a not guilty verdict. double jeopardy. but the feds could try him under civil rights charges. the very same way the feds tried the four police officers in the rodney king case who were acquitted in state court. right? >> absolutely. >> david? >> yeah no. they absolutely can review the case and they can bring civil rights charges if they deem -- >> don't they -- >> tough burden. >> don't prosecutors have to prove that the motivation of the that man brelo is racially based? >> they do. one of the things in my opinion to help the state to prove that is that there's some studies -- >> you mean the feds. >> the feds. there are studies that show there's racial profiling and force among -- >> relative to the defendant in

a federal case. >> impossible to prove in this case. >> i don't see how you can do it. >> look at the history of this particular officer or officers involved and you have to look at how many people they pulled over. there's statistics that they can look at. >> two of the officers were convicted in the rodney king case and might be able to. >> again, you know just because the police officer fired his whole weapon doesn't mean it can't be self defense. it happens a lot. >> ridiculous. >> they convicted in the crown heights case nelson. on civil rights violations. so it does happen. keisha david, good to see you both. >> good to see you, too. >> thank you. >> all right. motorcyclists riding together in our nation's capital today to honor america's veterans. it is the annual rolling thunder ride for freedom. thousands of bikers revving up their engines to show respect and to say thank you to all of those who have served our country. doug mckellway is live in d.c.

with the story. doug? >> reporter: hey, you know rolling thunder is happening every memorial day weekend in washington, d.c. since 1987 and there's some indications, we don't know it for a fact it may be the largest gathering to date. the largest here to fore is 2008 with 350,000 people on motorcycle here. today, we learned that the north pentagon mall parking lot which is massive, expansive, was overfilled with motorcycles today. we had not seen that before. that coupled with three spectacular beautiful days may have brought more out. we'll wait for the final tally of that. the mission of rolling thunder transformed through the years. you know we saw one motorcycle today pulling along a little top of the trailer was a bamboo cage with a skinny old man as if to symbolize the p.o.w.s.

few think there are american p.o.w.s held in north vietnam. so the mission has changed somewhat and a woman expressed what it's become to us earlier today. >> i feel like rolling thunder is as much of a living presence of the reminder of the people that really did give their all for a country they believed in they had patriotism. they had a love of god and family and country that is a really hard thing i think for younger generations to understand. that these were people that were willing to sacrifice all. >> still, the fundamental mission of rolling thunder is true to the spirit of this organization. some chapters have been active and spurring the return home of remains from soldiers from world war ii the korean war, vietnam, even if the remains are nothing more than a few bone fragments.

defense secretary ash carter with very tough words for the iraqi forces as they struggle to drive isis back. isis militants now control roughly half of syria and last week of course captured the strategic iraqi city of ramadi. the capital of anbar province. secretary carter blasting iraq's military for losing the city and blaming it on their lack of will to fight. listen to this. >> the iraqi forces just showed no will to fight. they were not outnumbered. in fact they vastly outnumbered the opposing force. and yet, they failed to fight. if we give them training give
