charity. welcome to "happening now." i'm john scott. >> i'm jena lee. that charity is the happy hearts fund. that charity rebuilds schools in areas hit by natural disasters. bill clinton was invited by the charity in 2011 2013 to be honored but declined. then in 2014 when the group offered a half million dollar donation to the clinton foundation he accepted. a chief white house correspondent ed henry is live in washington with more on all of this so ed the premise right now, what is the fallout? >> well what is interesting is this charity that you mentioned is run in part by petra nemcova, a czech model, who survived the 2004 tsunami and said she wants to do good work. as you note in this new york times piece this $500,000 fee that went to the former president, bill clinton, could have rebuilt ten schools in

indonesia. this smaller charity ended up paying a heavy price, about a half million bucks, to sort of mingle with bill clinton and you have to wonder what they really got out of it. this professor saying it was distasteful in the end. i spoke to hillary clinton campaign officials yesterday, generally about the clinton foundation. they insist there has been no permanent damage to her campaign from this whole series of negative stories. they say there was a lot of philanthropy going on for the former president as well as hillary clinton and that it is a good story to tell and over time in this campaign they will tell it. but very interesting that they're also saying she will have an official rollout event, big public rally on june 13th. bill clinton will be there, but that will be the first time in this campaign that has been going on for several weeks they have actually been together at one of her campaign events and

after that bill clinton will not do any solo events for the campaign for at least a few months. so they say that's because they want her to get out on her own, but given all the stories, you have to also wonder whether they're trying to keep them behind the scenes. >> that's a few weeks away. tomorrow we have martin o'malley he is set to launch his white house bid tomorrow. what do you think the impact is of him officially now entering the race specifically on the clinton camp? >> he has not really registered anywhere in a lot of the national polls, beyond one, two, 3% at best. so the big question is going to be whether or not he'll be a real viable alternative. he's been very close to the conditions endorse hillary clinton in 2008 in fact against barack obama. so what is different now? is he really going to throw some punches and offer a real alternative? or is he just sort of in this because he wants to raise his name i.d. and potentially get a cabinet post or something else

>> jetters on capitol hill ahead of a major obama care ruling. the supreme court will soon decide whether to strike down the law's tax subsidyies in 37 states a decision that could dismantle the financial underpinnings of the health care law. republicans are split how they would respond. jackie cucinich so what are the competing gop ideas, jackie? >> one is if the subsidies are struck down his bill would extend it for a certain amount of time so sort of a soft landing, for people who receive the subsidies. now, the house republicans don't really have one right now. there is a group of them about 30 who are very conservative members, who don't agree with what ron johnson is doing. they're saying it is a problem because it keeps the subsidies

in tact even for a little bit. there is going to be friction there. you have to imagine if you look at history here usually those 30 members have been sidelined and democrats come in to fill -- to fill that void. that's way far down the path now, we'll have to see what happens with the supreme court first. >> if the supreme court says hey, these things are unconstitutional christopher, how does the senate get by with saying okay we'll extend the unconstitutional provisions for a certain period of time? >> i think it is pretty likely that the supreme court is going to rule against the subsidies and got them. so republicans are in a lot of trouble. they're in a lose-lose situation, even though they're winning in defeating obama care. they don't have the power to replace it. they don't have the presidency. they're not ready and the battle has been launched too soon. so what they're going to try and do either the ron johnson plan which he has to do, he's up for re-election. and he needs to maybe say, come back to his constituents and say you're not all getting thrown off your health care insurance.

i think conservatives, their concern is that the republican leadership is starting the ball on the 2 yard line and they should start on the 50 yard line. they want the -- the conservatives want it to happen at the very end at the last minute and try to fight and draw contrast before then. republicans are really in a bind here. >> jackie part of the administration's argument when they went to the supreme court about defending subsidies, the administration said hey, you cannot invalidate all of this because it will throw the health care market into absolute chaos. >> it will. that's why there needs to be a plan at the end of the day if it is struck down. the obama administration hasn't presented one either. that we know about. we don't know if they have a plan if the subsidies go away. so you know if this happened it is going to be -- we're going to see a lot of action on

capitol hill. and it is going to be a mess. >> all right. let's talk about another issue that well, might be bedevilling the gop. republicans are becoming more energized in their bid to try to win over working class voters. rick santorum is the latest candidate making something of a populist pitch. listen. >> as middle americans hallowing out, we can't sit by as big government politicians make it harder for our workers and then turn around and blame them for losing jobs overseas. working families don't need another president tied to big government or big money. and today is the day -- today is the day we are going to begin to fight back. >> christopher, this is -- i guess a new framing of the argument republicans have long decried big government but they

haven't always -- well they haven't always practiced what they preach i suppose. >> i don't think they have. i think you're right. rick santorum has identified a problem in the gop, which as a party the people who give all the money at the top, the business interests and the base are not the big business interests. the working class, the middle class. that's a hard party to run. i think you're going to see more of a populist message from all the candidates in this presidential campaign because republicans are sick of getting tarred and feathered for supporting corporate interests and big business interests, while the democrats do the same and then people turn around and say you stand for the rich. in the meantime all the rich all the corporate, they're donating to the democrats, the republicans are getting screwed here for a long time. and you'll see much more of a populist message, much more of a let's figure out the income inequality and that free markets and small businesses not the same. it is big business and corporate america. and rick santorum has been solid, recently at least, in the last elections, solid on that front. >> i know republicans are coming out with an ad that shows

hillary clinton talking about, you know everyday people and working classscrolling a list of the millions of dollars. it is a potential point of attack for republicans against the democratic front runner. >> it is. i think that's why -- chris is rite. populism is so hot now. hillary clinton talking about it too. she's adopted some of elizabeth warren her -- she's not really a rival, but kind of a rival, she adopted a lot of her talking points on purpose, trying to push back against the hillary is in league with big banks and that sort of narrative. republicans have some fertile ground to hit her on until they have a nominee as we'll see if they can hit back once they have a nominee. >> jackie and christopher, thank you, both, for being here. have a great weekend. a lot of politics when it comes to the economy. we got a reading that wasn't so good today. u.s. economic growth is actually in reverse according to the latest report from the commerce department. the gdp is down .7% in the first

three months of this year. that's worse than the positive growth rate we all would like to see. and that the government had estimated. this decline marks the slowdown in consumer spending in part which economists say is probably due to harsh winter. but we'll see how this plays out over the next several months. wall street reacting a little today, along with other news the dow trading lower by 67 points. from the fox extreme weather center the death toll just rising to 25 in the devastating floods across texas and oklahoma. 14 remain missing in texas, even more rain sweeps across several states. check this out. this is dallas after seven inches of rain fell overnight. a helicopter plucking a man from a police car trapped in water in the middle of the street. another man drowned when his truck was swept into a culvert near dallas. authorities say they found his body this morning. look at this also in dallas loop 12 under i-30 closed in

both directs due to flooding causing major traffic backups. >> here we go again. more rain falling overnight and basically we just had the ground so saturated now. it had been so dry it was running off quickly. now the ground is so saturated from weeks and weeks of rain. you get one of these lines of storms to move through and that's what you got. you see this last 18 hours, yesterday afternoon, this moving through and a lot of these were very very strong storms. i'll let this play through one more time want to show you how this happened here in dallas saw this just continuing in dallas for a number of hours, and you get one of these cells to line up in one spot you can get some very heavy rain. last 48 hours, really an incredible picture here you can see a lot of areas from kansas to louisiana, and throughout much of texas, a lot of rain. you see these little purple areas and those are some spots that are over 12 inches of rain again, southwest of austin around the dallas area to the

southwest -- west of houston. there is more rain coming. we have our flooding concerns that will continue to watch here. little flash flooding going on now with the rain that is across parts of oklahoma. but there is a trend here over next weekend, jon. most of the rain across east texas, we begin to dry out a little bit. can't rule out flooding again for the next day to two things improve by sunday and monday and much of next week we're dry. >> i'm sure they'll be looking forward to that in texas and oklahoma. thank you. >> sure. this is interesting. america's biggest beermaker shipping six packs to relief flood victims and they're not sending budweisers though. the anheuser-busch plant halting production of its suds to can water. those beer cans. they say the cans of water will be delivered to the red cross to distribute to flood victims across texas and oklahoma. >> welcome, i'm sure. amid tensions with the west russia conducting a new round of military drills. we'll tell you where this was taking place and what the russians are assessing here.

david lee miller live at jfk airport with the latest on these incidents. >> let's start with this latest development, a shuttle america flight like number 2708 that originated in reagan airport and washington, d.c. was planning to land at laguardia airport when suddenly a drone aircraft was in its path. according to the faa, the shuttle america flight had to climb some 200 feet to avert colliding with the drone. this incident taking place at 2700 feet over what we are told is prospect park in brooklyn. that is a big public park. and faa investigation is now under way. additionally in the last 24 hours, at least five planes either landing or taking off, from jfk airport here in queens have been hit by lasers. there were no injuries and we

are told that none of the planes had to have their flight paths diverted by the tower. four of these incidents took place shortly after 9:30 at an altitude of 8,000 feet. one of those planes american airlines flight from los angeles, was struck by four separate beams. a shuttle america flight from cleveland also hit as well as a delta flight from boston and buffalo. the lasers originated we're told from a state park some 30 miles from jfk airport. a search by helicopter has turned up nothing. also last night, 14 miles southwest of jfk, a sun country flight was hit by a laser shortly before it landed at jfk. catching those responsible can be extremely difficult, two months ago you might recall a bronx man was arrested and he was charged with aiming a laser

more questions sur rounding a u.s. army facility that accidentally shipped live anthrax spores to labs across the country. after new reports that the same facility in utah also mistakenly sent live anthrax to a lab in australia in 2008. the lab is already under review for a series of mistakes in which live anthrax was thought to be inert was sent to more than a dozen labs in nine states. the cdc now says four lab workers are being treated for possible exposure. live anthrax samples also mistakenly sent to a u.s. air base in south korea. 22 people are now under medical observation there as a precaution. >> new information on a major diplomatic development. cuba is now officially off the u.s. state department's list of state sponsors of terrorism. today the announcement from the state department paves the way for full diplomatic ties. and the opening of embassies as

ribbon cutting ceremony taking place this morning at the tallest building in the western hemisphere. one world trade center opening its observatory to the public. and it is offering a whole lot more than just this spectacular view. rick leventhal reporting live from there. is it an observatory or observation deck? >> it is an observatory, jon. below are us are three restaurants and the 100 floor is the official observatory floor and the views are the same from all three floors roughly 250 feet in the air. you see lady liberty out there with ellis island a bunch of boats. we'll see sight-seeing helicopters and small planes flying below us across the horizon. the best view is this way,

interests as the fall of saigon did in 1975. the blow to u.s. credibility and the enhancement of isis' police prestige as a black flag rising would be incalculable. joining me now, kevin carol, serves as u.s. army officer in iraq and afghanistan as well as former cia case officer in the middle east as well. kevin, nice to have you on the program. how likely is it that this is going to happen? >> jenna, thanks for having me. i'm concerned. isis' spokesman said the leader will give the speech marking the end of ramadan in baghdad, that's coming up on july 17th. so we only have got six weeks to get this right and prevent that from happening. >> how vulnerable is our embassy there in your opinion? >> it is very vulnerable. i've been there quite a bit. it is smack dab in the middle of the city. there is no longer a green zone surrounding it. and the only steps that have been taken in response to isis' successful use of car bombs in ramadi is to sent some anti-tank rockets to the iraqis.

those things have a range of 300 meters rating until a suicide truck bomb is a few hundred meters away from you is not a good strategy. >> what do you think we need to do? >> i think we need to do four things. we need to have more air strikes. i read it has taken our pilots as long as an hour to drop clearance on ordinance on targets in the open. that's far too long. we have to let our special operators off the leash. they're chomping at the bit to get in the game. there have been a handful of raids. we have to have those guys out there every night as they were in 2006 2007 when they beat al qaeda in iraq. and when we send them out there, we need it allow them to capture and interrogate isis leaders. and finally, i think because of the recent performance of the iraqi army, we're going to have to look at having an american ground combat element in there of perhaps the brigade combat team and a division. >> my husband was in iraq in 2006. he said the same things as you. as i talk to other veterans who have been to iraq and have fought this enemy, there is not

only a willingness but also this desire to go back and take up the fight. when you talk to politicians, you get a different opinion, why do you think that is? why do you think there are some veterans not saying all that see this as a winnable fight, and want to take care of it? >> that's exactly right. i share your husband's view. we have been there. we know how this is done. this ain't new. it is heart breaking all who serve there knew betterare killed or wounded. and it is just devastating to see those gains reversed. and especially to see iraqis who sided with us be savaged by these people in isis. most of the men i know are eager to go back if necessary. if we're allowed to. >> it is a different opinion we're hearing from this administration from josh ernst as he talked about iraq holding his press briefing right now. one of the things you say in your article, i'll quote more

out some solutions for the problems i think a lot of our viewers are looking for solutions. nice to have you on the program. looking forward to have you back. thank you. >> thank you, jenna. the city of los angeles is about to enforce a minimum wage of $15 an hour. now, one of the measure's biggest supporters is reversing course the unions. they want an exemption for companies with union workers. why? >> it is about leverage and hypocrisy. here is the amazing thing. think of all the minimum wage protests you've seen at mcdonald's, walmart, about slave wages, those don't happen spontaneously. they're organized by organized labor. so here is one in los angeles, with all the local unions lobbying for the $15 minimum wage for all workers. >> we say don't leave anybody out, don't cut anybody out, a wage raise for all workers.

>> now comes the dirty little secret. unions here tried to back door their own exemption, demanding the city exempt them from the very same minimum wage they demanded for others. the council was stunned by the hypocrisy. >> the real surprise that in the 11th hour that labor was saying well we basically support a subminimum wage if a company decides to enter into collective bargaining. and that really is a complete contradiction to what they have been saying for the last several months. >> so why the double standard? here is the stated reason and the real reason which is that unions want to build membership and the exemption gives them leverage. say your restaurant is facing an increase in labor cost you can avoid that if you ub yohnnionize. it is not just l.a. there are ordinances that say if a company has an collective bargaining agreement, they don't
