this spring the cancer came back and he never recovered. the 46-year-old passed away last night surrounded by his family including his father joe biden. this is the second time that the vice president will have to bury one of his own children. his first wife and daughter were killed in a car crash in 1972 and beau was also in that accident. here he is talking about it at the democratic national convention in 2008. >> my brother, hunter and i, were seriously injured and hospitalized for weeks. i was just short of 4 years old. one of my earliest memories was being in that hospital. my dad always at our side. we my brother and i, not the senate were all that he cared about. >> now his father is saying the same thing about him. in a statement joe biden said "more than his professional accomplishments, beau measured himself as a husband, father son, and brother. beau embodied my father's saying that a parent knows success when his child turns out better than

he did. in the words of the biden family beau biden was, quite simply the finest man any of us have ever known." beau spent the last eight years as delaware's attorney general, and he just announced plans to run for governor in 2016. he was also an iraq war veteran and recipient of the bronze star. in a statement, secretary of state john kerry said today "i'll never forget what joe biden said to me about beau while he was serving his country in iraq. beau had just turned down what some considered the opportunity of a lifetime to be appointed to the senate seat his dad had held for almost 40 years. beau is just so good joe said he's so good." he leaves behind a wife and two small children. shannon? >> kristen, thank you very much. as kristen mentioned condolences are pouring in for the biden family. here is a sampling. tammy duckworth said "i was privileged to introduce beau biden at the 2008 democratic national convention. he was a patriot and public

boston to be treated by the same surgeon who did a prior hip surgery. his right femur is broke after hitting a curb. the secretary is an avid biker and rides abroad occasionally. french news service is reporting kerry was traveling at a slow speed on a flat ground near the beginning of an alpine pass that climbs more than 5,000 feet and he never lost consciousness. his travel schedule however is also derailed. secretary kerry has canceled his trip to spain and paris this week. he will however, still be a part of a scheduled anti-terror meeting specifically a counter-isis coalition meeting on tuesday remotely. doctors say it takes months for a femur to heal depending on the severity of the break. secretary kerry is expected to make a full recovery. leland back to you. >> elizabeth prann live in washington, thanks, elizabeth. shannon? well a race against the clock, in less than 11 hours, key provision of the patriot act

including bulk collection of americans' phone records will expire that is unless the senate can hammer out a last-minute deal before the midnight deadline. how are the final hours playing out? mike emanuel is watching it owl on capitol hill. hi mike. >> reporter: hi shannon. all indications are presidential hopeful rand paul will not allow the senate to move quickly to pass an extension of key provisions of the patriot act. let's take a look at what's due to expire at midnight. the most controversial the collection of phone records, the date time and phone numbers involved metadata. also expiring is roving wiretap authority which allows the fbi to track terrorists who throw away cell phones to avoid surveillance. third provision targeting lone wolf attackers that would also expire kentucky senator rand paul has talked about this fight on the campaign trail including this from davenport, iowa. >> had i not stood up and stolen the floor from him and kept the floor for ten and a half hours,

there would have been no debate on this this would have been slam dunk it would have been done and we'd have been gone but because i occupied the floor for a day, we moved them back we moved them into the weekend and now we are having this debate. >> the politics are awkward with two kentucky republicans at odds on this issue. so as senate majority leader mitch mcconnell tries to pass an ex-tense of current law, where the house-backed usa freedom act, rand paul will be in his way. senate republican from utah says eventually the usa will pass the freedom act which the white house supports and the house passed with huge bipartisan support. >> i do believe we have the votes, and so at this point, i think the question is not really about whether we'll get this passed but when. it will happen either tonight or it will happen on wednesday or sometime in between then. >> but the president is warning this is about national security and key national security officials both past and present are warning against a lapse.

optics here. is fund-raising off of some type of filibuster over this playing politics with national security? >> well i don't think he is the first nor will he be the last elected official that takes advantage of a political moment to generate fund-raising. i guess what's probably more troubling is this is a very very serious issue. >> this isn't a political moment about a pipeline. this is a political moment about national security. >> this is a big deal and while there's enough people who agree with him that just that bulk collection is inappropriate, there are more people that agree, 57 of his colleagues in the senate as well as the majority of the members of the house say look there's a way we can make sure that the liberty that you're talking about and the freedoms you're talking about and the privacy you're talking about are protected. so he's leaning over the edge on this one and i think personally i find it a little bit distasteful but everybody has their own opinion. >> is it as bad as rand paul seems to make it out to be when you listen to his speeches on the floor of the senate you

almost feel as though the government is listening to every phone call we take and every time my sister sends me a picture of her dog somebody at the nsa is going that one is okay. is it really that bad? >> there's enormous hyperbole. metadata is who made the call what time how long was the call. it's not about content. never has been about content. i think the concern that he raised justifiably is that bulk collection metadata can provide sensitive and revealing information but at the end of the day if you're truly interested? the constitution and he talks about the founding fathers which i find ironic they said one of the primary responsibilities for the federal government is provide for the common defense and the founding fathers figured out a long time their successors can walk and chew gum at the same time. we can secure ourselves and protect privacy and the act does that based on a timeless principle if you have a suspicion. it's predicated on a suspicion.

>> the freedom act as i understand correctly no longer is the metadata stored by the government. it's stored by the phone companies after the six-month transition period. >> right. >> it brings up an important point and you've written about this extensively. the patriot act was written in 2001. we're now applying 2015 technology to it. back in 2001 flip phones were cool and people had beepers. things are very different right now in terms of what happens. has the law evolved, is the usa freedom act we're going to see voted on does that update it enough? >> yes, it does. remember the freedom act is not an omnibus surveillance bill. it deals particularly with the measures we talked about and the controversy around bulk collection. there may be more work we need to do with regard to surveillance and with regard to those activities but at the end of the day, technology always moves faster than congress and regulators aenin this instance it has moved so fast that it raises the issue and the other challenge here frankly, as the

court said in new jersey 2015 and that interpretation is not embedded in the patriot act and what that court also said to congress if you want some form of collection out of metadata authorize it get a statute and what i think they've been able to find is common ground. mike lees talked about and no one is challenging his conservative credentials in this space but the notion that you provide for the common fence. how do we do that? go back to a timeless principle that says you can access that and it's not going to be held by the government you access it by the telecom. >> the idea is that the new law says the phone companies hold the metadata if there's reasonable suspicion, then the government can go get the metadata from the phone companies. they get the same thing they wanted before but no longer collect everything. >> right. >> i want to point everyone to foxnews.com foxnews.com, we have an opinion piece based on this issue, and a fabulous read. it explains it better than anybody else has and understandably so given your background. mr. secretary, appreciate you

at least five people have been injured after a crane accident in new york earlier today. construction crane at a midtown manhattan office building had some kind of malfunction, still not clear what happened. either the crane or the load it was lifting wound up hitting the building. before the load fell 28 stories to the sidewalk below, police say there were minor injuries in this case some streets have been closed as emergency responders work at the scene. we are just days away from remembering an event in china that was unlike any other. june 4 marks 26 years since the military crackdown on the pro democracy movement at beijing tiananmen square. china will not recognize the anniversary but in hong kong an island that enjoys more freedom than the chinese mainland hundreds of pro-democracy supporters are already taking to the streets. you can see them there, holding

a rally in remembrance of the violent crackdown. more events are expected in the coming days there in hong kong. the disputed manmade islands, china's reportedly militarizing in the south china sea are raising security concerns in that region according to defense secretary ashton carter who made that comment yesterday at a conference in singapore. china's pushing back though defending its right to build these islands. former senator one-time secretary of the navy jim webb is here to talk about that and more. great to have you today, sir. >> thanks for having me. >> this is something you have been warning about for years. the u.s. vat lated, we're so blame in some part for not taking more of a stand with regard to aggressions by china in that region. >> i have been talking about this and writing about it for 15 years. this is a classic case of aggression by an authoritarian and now expansionist country that has claimed sovereignty over territories that are not its own, and then slowly built

up a political structure which i wrote about three years ago in "wall street journal" and now incipient military structure, and turned around and we've seen this before in history where they're now turning around and saying if we say anything about it, if any other country says anything about it they're violating their territorial integrity. >> they say they are basically building up islands that are in an area that they control that it's part of their territory. we know there are smaller countries in the region no match for cry in a. you've written about concerns of that if the u.s. doesn't get involved in some level those countries are always on the losing end of the disputes. >> exactly. because the way that china assumes they're going to solve problems as a dominant country and a bilateral resolution but these are not their territories. take a look at the map. what they did in june of 2012 was to claim an area in the south china sea that is 2 million square kilometers larger than the land mass of the philippines, vietnam and japan

put together and put a prefecture structure on top of it and then claim that this is a part of china. these islands are in dispute. they should not be making the claims that they're making and if i were president today i would be directing my administration to be examining economic sanctions against china. it's probably the most effective lever that we could have focusing on defense-related trades and we will not allow our countries to do any further defense related trade until china comes to the table and tries to work with us for a diplomatic resolution in that area. >> want to read a little bit of what the admirals had to say in response to our claims they're doing something wrong. "in spite of the sufficient historical and legal evidence and its indisputable claims rights and interests, china has exercised enormous restraint, making positive contributions to peace and stability of the region and the world at large."

that's from one of the chief admirals there. >> one of their chief admirals. >> right. >> yes, and you would expect them to say that. again, this is a classic example of what happens when you have an aggressive authoritarian country claiming territory that is not its own, and then daring people to do anything about it. and we've had this nexus between our or this conflict actually between our economic interests with china and their growing military power, not only in the region but outside the region. china and russia are going to conduct naval exercises in the mediterranean this summer and we have to be firm or this is going to get worse. >> you said if you were president, you would want to bring about economic sanctions, get them back to the table. you have formed an exploreatory committee with a look at 2016 former secretary of state

hillary clinton, senator sanders and now former governor martin o'malley announced his intentions as well. he says it's about new lead irship it shouldn't be a crown passed and forth referring to the bush and clinton families. what would you bring to the race and what would trigger your decision yes or no. >> american people are so weary of the political system on both sides that doesn't get anything done. you look at a gallup survey 43% said they're independent, almost as many as with the combined number that say they're either democrat or republican. people are looking for leadership with a record of making decisions getting things done being able to work across the aisle in solving the problems. i think that's one thing we have worked very hard on throughout my professional career half of which has been spent in public service and half of it spent doing other things. >> how do you make up though for her enormous lead at this point?

we've seen it before when she ran two terms ago against a little known senator, barack obama. so it can be done but what would be your plan because as of now, pulling, you know she has r50, 60 70 points ahead of the rest of the democratic field. >> in making a decision like this very similar to the decision that we made when i ran for the senate in 2006 we tried to look at what the issues of leadership would be that icobring to the table and test them with the american people and see if they will respond. when i ran for the senate i announced nine months to the day before the election with no money and no campaign staff and on a good day we were 33 points behind. we put the issues out and got a car, went out and talked to people and we made up the, that difference in nine months. i know it's a lot different when you're talking about the entire country but we focus on what we can control and that is our message and talking to people and i wouldn't want to run a pro

test campaign. i don't think there's any reason at this point in my career to do that. that's why we're moving -- soon soon. we've been moving in pretty methodical way to try to test whether we can can actually run a viable campaign and also not have to get tangled up in this incredible financial process that has now overcome the political system that the superpacks and all the rest of that. we want to make sure that we can have a clear message, that i'm not owned by anybody. just trying to be honest about what the country needs to do. >> you said you wouldn't be a protest campaign but would you call the former secretary out on issues involving the clinton foundation benghazi other areas? some people feel like she's a little bit untouchable, but how important would it be to you to get her to answer those questions if you're running against her? >> well there are other people who can now be asking those questions. i think what -- >> if she'll take them. >> what i would be doing would be the same thing that i've always done raising the issues

that i believe are vital to the country and for instance when you look at the benghazi situation, one of the things that we have to face as a leadership leadership people in our country is that the invasion of iraq created enormous turbulence continuing turbulence in the region and the arab spring brought a different kind of chaos to the region. it wasn't just benghazi when you look at the arab spring. it was libya at large as one example. so there are a lot of issues to be discussed in terms of how we get better leadership to address these issues and that's where we will be. >> i want to ask you, too, i know you've been close to the biden family over the years. many parallel paths and shared interests. any thoughts on -- >> i just my heart goes out to the biden family the vice president, and actually i was going to start the interview with that. i can't imagine anything harder

the five taliban terrorists exchange for u.s. army sergeant beauowe bergdahl will be able to travel freely starting tomorrow. that means they could rejoin the fight. the u.s. is now in talks down to the wire hoping to extend the travel ban on them for at least another six months. connor powell is live in our mideast bureau with how the talks are going. >> leland the talks between the white house and the country still ongoing and just a few hours that travel ban is set to expire at midnight now on friday white house officials said they are trying to extend this agreement of six months is the number we're hearing but it's not positive they'll get that or the agreement extended but even if it is extended it's

likely only for a few months and that means the inevitable is likely going to happen at some point the taliban fighters will likely be released. the concern according to u.s. lawmaker answer afghan officials is that they will be released and head right back to the battlefield. qatar officials when the deal was agreed upon were supposed to monitor these taliban five but at least one of them has spoke on it other militants in qatar, former prime minister said today on fox news he expressed an uncertainty about the future. take a listen. >> how they will behave or how they leave, this is something which we don't know how they would brave. you cannot guarantee after he leaves the jail even in the united states what he will go and do the same things back or not. >> now under the original agreement signed last year the detainees were set free from guantanamo in exchange for u.s.

sergeant army bowe bergdahl who left his base in eastern afghanistan. the obama administration insisted the threat to the taliban five would return to the battlefield is very low, but leland there are a lot of concerns from lawmakers and afghan officials who think that it is much much higher than the administration has led on and clearly with the effort to extend the talks there is backtracking going on right now by the white house. >> and still a lot of folks here in washington not very happy that the deal happened at all. connor powell following in very jerusalem, we'll see what comes out as the hours count done in the middle east. thanks, connor. let's turn to congresswoman vicki hartzler who serves on the joint services committee. thank you for joining us today. >> you bet. >> we'll look forward to what happens next but i know looking backward that you all have tried to get answers about exactly how this deal went down. have you gotten the answers you were looking for?

>> no we haven't, both the state department as well as the white house have impeded our investigation and prevented the department of defense from fully disclosing a lot of the information that we've been looking into. we want to know why this still happened how it happened and how we can feel confident that americans are going to be safe with these five taliban leaders now released. it's very concerning because these leaders are, had major positions in the taliban government. one of them was in charge of their army another one was a chief intelligence officer, another one was a provincial governor others worked with terrorist organizations to coordinate efforts. these were very very serious individuals who were whose sole focus was to try to take out american lives. as of midnight they're going to be free. >> we've had a government official with knowledge of the intelligence tell us here at fox news at least three of the five are suspected to have already tried to reengage with some terror activities and terror

networks. i know that over the last few days there have been reports that our administration has been trying to negotiate something with qatari officials that would maybe in some way extend some type of surveillance or limits on these five traveling, et cetera. do you have any knowledge about whether we have come to any sort of agreement for extending surveillance here? >> we have not heard that as of yet, and it's very concerning we did not even hear that they were having negotiations until about a month ago, and that's very late in the process to start this discussion and now here we are at the last minute and we don't have this agreement yet and these terrorists could be released and potentially harm americans again. the white house has been very reticent to provide any information to us and a year ago failed to notify congress that they were going to even release this which is contrary to the law, and that's part of what my committee is looking into because they clearly violated the law. they went around congress and they worked out this deal to

release these terrorists without notifying us and that's wrong. >> critics of this administration will point out that in their estimation this administration often flouts the law when it doesn't work for its particular purposes or plans, and accusation that of course the administration pushes back against and says everything it's done has been within the president's discretionary and other executive powers but what accounting would there be? should you come to the conclusion that i mean the law does spell out these notifications that congress is supposed to get before these transfers or releases are made. it didn't happen here. what kind of accountability could you impose on the administration in that's the ultimate conclusion? >> we've already passed the national defense authorization act the major bill for my armed services committee a prohibition on the president being able to do this again, certainly without the secretary of defense certifying next time that these

terrorists would not harm americans and that they cannot go back to a country that is engaged in warfare against us, and there has to be assurances from that government that they're going to be able to restrain and detain these individuals. we've also put a restriction on the secretary of defense's budget 25% cut until he complies and provides us as members of congress with the information that we have requested. so we have the power of the purse, and question withhold funding, and we can pass laws to require the president to do certain things before he acts and we're going to fully do that because the american people deserve it. >> and some folks know this isn't simply a part son concern because one of your top democrat in the house intel congressman adam out of california has said his point all along has not been the first 12 months that these five have been monitored. he's always been worried about month 13 and what acomes out. we'll see as the hours take down to their release from the conditions. congresswoman, thank you for your time today.

security agency phone collection program, is just three votes short in the senate yet chances for an agreement are looking bleak. senator rand paul has said that he will force an expiration. senator dan coats member of the intelligence committee joins us now before he heads up to capitol hill. the white house has said this is a matter of national security as have others. if these programs expire and if god forbid there is a terrorist attack on u.s. soil in the coming weeks or months will those who voted against this will those who kept this extension from happening have blood on their hands? >> well there will be accountability for what our vote is and what we do. going dark using, losing a valuable tool that's part of the effort of gathering the intelligence that helps keep americans safe is something that we're going to be responsible for if we allow this to happen. i think it's tragic we've gotten to this point. part of it is misrepresentation

neither, all these other kinds of things. at the same time his presidential campaign is sending out fund-raising letters saying stand with rand and help me shut down the nsa program. is this in your mind about an ideological stand for senator paul or about a making political hay for his presidential campaign? >> only senator paul can give you the absolute answer to that. it certainly raises the question and i think he needs to address that question. >> is this distasteful what's going on? >> it's one thing to use hyperbole or excess words, not stating the facts if you're talking about an education program, common core funding highways. it's another thing when you're talking about the safety and life of americans who are threatened at a time when the threat has never been higher. how ironic it is that we are administration is letting five taliban jihadist leaders free and then we're taking down a program that could help protect us from a terrorist attack. something is amiss here and i think people like senator paul need to understand that we are living in a world of real

estimate. at least 31 people in texas and oklahoma have been killed as a result of these storms. 11 people are still missing. meteorologist janice dean is at the fox extreme weather center. there may be relief in sight here? >> absolutely the news they need however, they have received unprecedented amount of rain really within the last several weeks but within the last 48 hours on top of areas that have seen historic rainfall. we have reports of large hail and damaging winds and even tornadoes yesterday. looking at the last 24 hours, we saw flood advisories for the houston area and towards arkansas and louisiana, that system is now moving eastward which will give us a period of drying out for texas, oklahoma arkansas the southern plains breathing a sigh of relief. there's the forecast. it's going to push eastward giving much needed moisture to the southeast up towards the mid atlantic and the northeast where we could see pretty strong thunderstorms, especially across pennsylvania and new jersey
