the patriot act which temporarily expired sunday night. phone companies will still keep records of customers, but the government would only be allowed to access them with a warrant. earlier the patriot act permitted the bulk collection of phone data by the national security agency. a man under 24-hour surveillance by terror investigators has been shot to death by law enforcement in boston. an officer and fbi agent claimed that 26-year-old rasim charged at them wielding a large military style knife. when he refused orders to drop the weapon they both opened fire. they arrested another man in connection with the investigation. but it's not clear yet on what grounds. i'm patricia stark. than me because they look different, or have a different religion. that's a core principle. that's not something i would violate. >> of course republicans want dirty air and dirty water, and all the other comments that he made. joining me with reaction rudy giuliani. so he says he turned america into the most respected country on earth. he also said he doesn't believe in using device in politics. and he said i'm the closest thing to a jewish president the u.s. has ever had. >> hard to react, sean. i went back and took a look at the last 12 months i made 23 foreign trips to 16 different countries. including some of the countries that are most deeply involved in this situation. and i would say, without almost contradiction, in each one of those countries, i find america is less respected, completely disregarded in some cases.

we know about israel. i spoke to two high-ranking officials in saudi arabia and one in jordan who basically said america with obama as president, we are out of the equation. in other words, they now have to put together their own -- which is why they didn't send anybody to his summit. that's respect? same thing is true recent trip to germany. and then a few months ago in poland i was asked by some members of the polish government if i thought that obama would defend poland if poland were attacked by putin. and i said i can't believe you're asking me that question. they said well we think your president wouldn't use military power, you know, to any extent. look what he's doing in iran. the plan he has makes iran a nuclear power ten years from

he's been demonized by many in the party. i want to play a cut from you, from jim sensenbrenner, he's making the adjustments with the usa protection surveillance act. and this is what he said the patriot evolved into which he said is against the law. listen to this. >> is it fair to say that you suspect that every american's phone has been tapped by our government in that se was data mined conversations? >> yes. >> is it fair to say that you believe every american has electronic information that they thought was confidential intercepted by the government? >> yes. >> i am stunned. and what are they doing with this information? >> well they're storing it in a huge data warehouse that is west of salt lake city. and the point that i keep on making is what good is all of this done besides being an intrusion of privacy on a scale no one imagined. there's not one terror strike

exposed as a result of the data that has been mined. >> i supported the patriot act. and i still believe we need a patriot act. but we've got to balance fourth amendment constitutional rights private si rights. what he's saying is the government has been breaking the law by data mining which the patriot act specifically prohibited. what is your reaction? >> my reaction is that's his interpretation. it is a fact he's the author. but, you know more than one person sets the intent of congress. >> but the second circuit agreed with him. >> okay. there may be a disagreement if it went to the supreme court. there's always disagreement. >> that's a good point. >> believe me there would be others that came to a different conclusion. the plain language of the statute is not really violated by what the government is doing. the second thing i would say is the government has not misused the information. there's no evidence that under either president bush or

president obama, that it's misused by the government. i happen to know the information is helpful. the government has its hands tied behind its back because it can't defend itself. that information has been helpful. in a situation where you have five minutes to get the information, because there's only five minutes to go when you've got information, and that place is going to be bombed you've got to start hitting computers and getting information, you want that at your fingertips. so i know what they're going to do. they're going to leave it in the hands of private companies. that's what's going to -- >> you agree it shouldn't be used as domestic prosecution? >> never be used for domestic prosecution. the government has handled it responsibly. they'll put it in the hands of private companies. there may be a day we get a bombing that we don't pick up fast enough. it will take a while for the government to get that from the private company. and people could die as a result of that.

and i think congress is making a mistake here. >> okay. appreciate you being with us. thank you. >> thank you. joining us now with more reaction colonel david hunt is with us the author of warrior diplomat retired special forces officer. and former adviser to vice president cheney on counterterrorism. and steven hayes is on board. steven here sensenbrenner, very very clear in laying out his point that he thinks yeah this has been used improperly specifically against the language of the law. he's trying to correct that and still balance national security and civil liberties. thoughts? >> he's had a long evolution on this subject. as you and the mayor pointed out, he was one of the primary authors of the patriot act. having said that though i don't buy his criterion. if you look at the criterion he's using, this information had to have prevented a certain attack to be valuable. that's not the case. >> but you're missing the point.

he's saying the patriot act specifically prohibited what the government is doing now. >> right. as the mayor said that's his interpretation. i certainly don't see it that way. >> if you go into the act, the act actually says to look at an american citizen, there has to be some foreign specific connection and communication going on. >> well look if you look at the way that it was authorized by the fisa courts and go back to the way that it was briefed to congress i think the way that it was implemented did comply with the law, sort of down the line. now, you can say that there's the potential there for abuse. but i don't think that we've been shown that it has been abused. i think that's rand paul's strongest argument. where he makes the mistake in my view is claiming that we've seen this abuse or there's this abuse all around us. >> michael, i would argue the same government that targeted conservative groups by using the power and intimidation factor of the irs would be capable of such

abuse. rand paul wanted two specific amendments in this. that would require the warrants only to be issued to individuals, and the evidence collected under the patriot act be used against terrorists not for domestic prosecution. thoughts? >> sean i think we have to make the distinction here from the nsa and other organizations, collecting the data and collecting the metadata and going to the courts to actually look at individual specifics, and specific individuals and see what it says. that distinction isn't being made number one. and number two, i do take hum braj with the statement that this was taken here and overseas. we're heavily reliant on the signals of intelligence e-mails, all of the pieces of the intelligence apparatus that analysts can pull together to help us. and i agree with the mayor that the congress is making a mistake. >> sensenbrenner believes it has been helpful. he doesn't dispute that. he's saying the letter of the

law that he wrote is not being followed by the government. and therein comes the rub between civil liberties and national security. we all want national security. colonel hunt, let me get your thoughts. >> i totally disagree with the mayor. the intelligence used is not metadata. this is the same government who has abused veterans put our economy in the tank. it's about a government having way too much authority, and incompetence. it's not about bad americans listening in on us. this is way, way overreach, way over fourth amendment. i'm not even a lawyer. this has got to be pulled back. we were scared after 9/11. we did some dumb things like make homeland security and tsa. and we've overreached with this. we really need to be targeted on our intel. i don't trust them on it.

>> steve, your reaction. i'm sympathetic to rand's argument on civil liberties. i think there is a balance there. he's got us in more political trouble by saying isis grew stronger because of the hawks in the party they created these people. what do you think the long-term ramifications are for him as he navigates through the campaign? >> i don't think they're good necessarily in part because of the politics on the ground. i thought the media overstated the extent to which republicans had swung in a libertarian direction. to the extent republicans had, they've clearly swung back at this point. he's sort of doubling down on this. you pointed to the real problem for him. if he makes a principled argument in favor of civil liberties on issues like this i think people can say we have our disagreements, and hash it out. but that's not what he's doing. he's impugning the motives of the people he disdegrees with. >> all right. >> john mccain, you know all of the hawks, he doesn't give them

welcome back to "hannity." crime is skyrocketing in major cities all across the country. alarming new data shows sex crimes have spiked really large here in new york city. misdemeanor sexual assault as of sunday night increased by 20% over the same period in 2014. from 1,003 to 1,203. they shot up 75% for the week ending sunday compared to the same week last year from 45 to 79. they also reported quote, felony sex crimes such as forcible rape predatory sexual against a child, sex trafficking, sodomy up across the board. this is part of a disturbing trend called the ferguson effect. former nypd detective bo deedle and sheriff, you've been a guest many times. you know our buddy bo right? >> certainly.

>> i want to talk about the ferguson effect. i'm going to put up baltimore crimes statistics. 40-year high in murders now. and a 55% increase in nonfatal shootings year to year. and a 70% increase in homicides year to year. 2014 to '15. what's your reaction to this? is this because, what? >> as you well know they're calling it the ferguson effect. we've been seeing a huge increase in crime in maryland. i was in south carolina last week. they have seen a huge increase in south carolina as a direct result of what's been going on in the last several months under the obama administration. he's been insendcendiary against law enforcement, as you well know. >> 40-year high in murders in baltimore. and 66% reduction in arrests. >> it's the feeling in new york

baltimore. every time the cops try to take police action millions of interaction with the police and the public. all of a sudden something doesn't go right, you get your sharptons, jesse jacksons and everything like that. and that's why we have such a surge in crime. people know there are gang members are able to carry guns. they're shooting each other back and forth. in new york we have 77 precincts. 10 of the precincts are where 50% of the homicides are. you're supposed to flood the area go out there and we call it toss. i know that word doesn't sound good. but toss means you've got guys hanging out there, acting suspiciously go over pat them down find a gun, that's what happens. >> sheriff the president said many times that african-americans are being stopped by law enforcement at a disproportionate rate. trayvon, michael brown, et cetera. is he in part the cause of some of this?

and statistics. utah has allowed teachers to carry concealed weapons into schools for years. they've never had an incident. there's a school district in texas that trained teachers to carry weapons in schools that haven't had an incident. in colorado where they have concealed carry, they haven't had an incident. there's going to be all these accidents, it's just not true. >> if your kids were ever in a school that got forbid was attacked would you want an armed guard, armed security guard, retired policeman? >> i want a trained teacher, with a concealed weapons permit to be in the classroom. here's the thing about armed guards. they still can't be in every classroom. if you have an active shooter in a classroom, they're not going to make it in time. concealed carry for teachers could take the option. >> let's talk about reality. >> we are talking about reality. >> you're asking for us to deputize teachers around the country to have armed shootouts over the heads of 6-year-old --

welcome back to "hannity." over the past 24 hours, a couple of videos have been taking the internet by storm, including one that is really really shocking with a toddler. ainsley erhardt is here with all the details. i don't know if we should tell people ahead of time, it turns out okay. >> there is a warning that the first video we're about to show you is extremely hard to watch. but i assure you, it does have a positive outcome. it took place yesterday afternoon in brooklyn where cameras actually captured the driver of this gray sedan jumping a curb knocking down that tree and running over that young child as he was walking down the sidewalk. miraculously this little boy escaped death without any

serious injuries. according to local reports he allegedly fell into the gap between the car's wheels just as this vehicle was barreling across the sidewalk. and that likely saved the little boy's life. unbelievable. following that crash, dozens of locals rushed to the aid of that young boy. they tried to lift up the car as he remained trapped underneath that vehicle. new york city firemen were ultimately able to free the toddler, learning that he suffered only minor injuries. >> thank god for that. i used to buy cheap cars i had no money, buy $300 cars i would be underneath them. and there is no room. the car is jacked up. it would crush an infant and toddler, anybody. thank goodness the height was enough -- >> we don't know what caused that driver to drive out of control. when you look at the video, it definitely looks like that child, the tires ran right over it. that was not the case. >> no injuries at all.
