you don't handle it okay. >> also ahead once again clinton eastwood causing some controversy. this time over the jenner situation. gutfeld mcguirk all over that. >> so adorable. >> caution. you are about to enter the no spin zone. the factor begins right now. ♪ ♪ hi, i'm bill o'reilly. thanks for watching us tonight. the war on cops. that is the subject of this evening's talking points memo. it was inevitable whenever you have a media frenzy, things are going to get dicey for those under scrutiny. racially charged shootings all over america have received enormous coverage on television with certain liberal cable news programs hammering american police agencies over and over again. rioting and looting are big stories and all the carnage is now filtering down to

young americans influencing how some of them interact with police. case in point. last friday evening a troubling event took place in a suburb of dallas. about 130 teenagers, most of them black showed up to a pool party. overwhelming the security which was in place at that party. about 7:00 p.m. the mckinney police department was called citing a disturbance. additional calls rolled in saying there was fighting, general chaos. police officers quickly arrived and began trying to impose order on the scene. but, that did not turn out very well. [shouting and screaming] >> after the frakus, one mckinney police officer david case bolt was suspended. he was the man that drew his gun and threw the young girl to the ground. one adult male was arrested on charges of interferes

with the police. nobody was seriously hurt. video of the incident has now gone worldwide again casting a giant shadow over american policing. some people believe the cops in general are oppressors, especially towards people of color. the 15-year-old who took this video you are watching right now seems to be one of them. >> i was scared that someone was going to get shot and possibly killed. i was like one of the few caucasian people at the party, so i think it might have had something to do with racism. >> but other witnesses see it differently and are criticizing those who are condemning the police. >> they didn't see the kids running all over the place not complying with the the officers. they didn't see them cussing the police officers, becoming unruly to them. >> what did i see before the cameras or the video store going is that teens jumping over the fence after security was telling them they can't come in to swim, not because they were black it's because they didn't

live in this community itself. >> the truth is that some of the kids involved in the pool party obviously didn't comply with police commands. they did not hit the ground. they did not stop arguing with the officers. now, that doesn't justify brutal behavior and talking points is not going to try the case on tv. but it's clear that there is a growing disrespect for police officers in some american neighborhoods and that attitude is going to lead to violence. if citizens don't obey the police and law and order completely breaks down. the authorities have the power to compel us, the private citizens, to act in a certain manner. if the cops are wrong that should be taken up later. but with tv news demonizing police officers, the law enforcement contract we all have starting to break down. talking points sees big trouble on the horizon. trouble that is being fueled by hysterical media

antipolice zealots are given wide latitude to spew their hatred and irresponsible ravens. that kind of rhetoric sinks. in finally and this is only my opinion the mckinney police officer who was suspended should not should not have drawn his firearm. he was not in any danger and neither was any civilian. he simply overreacted. and in doing so, made this an international story. but cops are human too. and in the heat of conflict, bad things are going to happen. every tee sent person should understand that and that's the memo. now for the top story tonight, reaction. joining us from cleveland keene tony, retired canton, ohio police sergeant. now runs a law enforcement consulting firm. here in new york city jonathan gill yum former fbi agent and navy seal who also consults with police agencies. do you believe respect in general is dropping. >> i think it's apparent. i think when you have what you have talked about for the longest time parenting

when you have the parent of the one girl who was really the most disrespectful coming out and playing the race card, what you see is a direct correlation between her behavior and his behavior. and that's the first part of this. the second part is that the community itself is not respecting law enforcement. when you look at the coming out and i don't know how they still have, this but for the advancement of colored people, and instead of coming out and saying something that advances them by saying, listen, young people, if you are of color stand up and be known for somebody who is upright and respectful. they don't could that they come out there and playing the game again to blame the police and that again just burns this into the community that they don't have to respect law enforcement. >> mr. tony, how do you see it? >> do i have to agree. there has been a change in the attitude regarding police in some minority communities across the country. it's unfortunate. we support the police. i support the police when

they do right. but, when they do wrong police have got to be held accountable to a higher standard because of the position they have. with that said, most limitations that have occurred that have led to the position that we have now in the have been brought forward by decisions that the police made right or wrong in a split second. those decisions can be reviewed for years or decades by institutions such as the supreme court. we have got to realize the police are here. the vast majority are fine, outstanding men and women. >> yeah. and mistakes are made as i said, everybody is a human being, but, if you are going to have an attitude in certain precincts in americaed that the cops are oppressors, they are bad you shouldn't respect them, you should give them a hard time then you are going to have conflict. now, let's take the police officer who was suspended.

>> sure. >> would you have drawn your gun in that circumstance, mr. guilliams? >> it's interesting because we are talking about the officer last out of all of this. >> i wanted to get the bigger, set the table here. >> what we have here is an officer that showed up at 80%, 90%. i don't think it should have gotten to the point where he drew his weapon. but, i can't judge him because i don't know what threat he was feeling. what's important to realize is that this officer when he drew his weapon, he dry it and had it at the ready he didn't go pointing it at everybody saying i'm going to shoot. >> you that's true. it doesn't seem to be any imminent threat it seems to be chaos. mr. toney, would have you drawn your weapon? >> no, i would not have. >> the threat was not there. >> mr. toney, if the girl was disrespectful and didn't get on the ground and she didn't. i don't know whether she cursed the officers but certainly other kids did how would you have treated that? >> well, i think that, first of all if we look at this

video, the start of the video shows another officer was actually communicating very well with the teenagers present. then we have the corporal. it's not unusual for people to get loud, obnoxious swear at the police and not to comply, but in the case with the young lady, once she was compliant, she was seated, on the ground, the officer disengages her and goes after the two that took off on foot, goes back to her and that's when he actually laid hands on her and put her face down and knelt on her. >> was that -- is he going to be punished for that or is that a legitimate technique? because the girl clearly did not want to be on the ground. >> right. and i think the department took the right steps. they did suspend him. >> all right. so you are not saying that that was -- are you saying that the police officer -- was that a legitimate thing if a person doesn't go on the ground when ordered you can force them to the ground? >> sure.

in certain. >> mr. gill yam. >> in certain circumstances he showed up there with the attitude there was some real violent crime going on there. he didn't triage the situation. >> i don't know what that means. >> he didn't look like in a hospital he didn't look and assess it and then react. he just got there and started reacting. >> do you think he overreacted? >> i think he overreacted. >> you too mr. toney. >> yes. >> let's play devil's advocate. you have 150 kids. if you are a police officer in the middle of that chaos and you are being disrespect ed and don't show power and authority that situation could get a lot worse, could it not mr. toney? >> it could. disrespect is one thing. what officers have got to realize is first thing is, recognize the threat for what it is. when i speak of departments i tell them to think about is it a stick or is it a snake? our bias, our fear will make us see things incorrectly and we will overreact. >> the number of kids involved last word,

unresolved problem segment tonight keeping charities honest. a group called pro-publica which investigates things nor "national public radio" and others has issued a scathing report criticizing the red cross. pro-publica charges raised half billion dollars for relief and promised to builds 700,000 homes. the problem is only 6 homes were built. so where did the half billion go. joining us from washington chief public affairs officer for the american red cross. so walk through this, okay? first of all pro-publica was that an honest report they did on you guys? >> well, bill, i think it was a taker mischaracterization of all of the work that the red cross has done in haiti.

we have been there five and a half years. we are still there and we certainly did more than build six homes. it was a disservice to our staff and volunteers, 90% of whom are haitian. >> your documents because we had to back some of this up said in the initial fundraising that you were going to build at least 7700 homes. this was in late 2,011. six homes is what you built 6 out of 700. can you explain that? well sure. i mine, we wanted to build brand new communities in haiti. we had plans to do so. but those plans had to be cancelled when we found out that we could not get clear title to land. that's been a problem from the get-go with haiti. >> so, let me stop you again. you wanted to build the 700 homes but you couldn't can because the haitian government wouldn't give you the title to the land. do i have that correct?

>> well, what they did was they allowed us to come in and build temporary temporary homes. >> not permanent homes. >> right which is what the pro-publica story. the temporary homes we built thousands of. >> did pro-publica say that the haitian government wouldn't give you the titles to build permanent homes? did they say that? >> no. >> all right. so that's one for you. secondly, if you can't build the homes shouldn't you have immediately issued a press release saying we know we promised 700 homes at least, we raised $500 million. we can't build the homes but here is what we are doing so that it would have been transparent. why didn't do you that? >> well, we have released numerous reports about our work on haiti. >> but you didn't do that specifically. >> web site and find all of them. >> you didn't do that specifically. >> we talked about the number of temporary homes we

did build. and the other solutions that we found this land problem remember. a lot of people in haiti didn't have homes. they were renters. they didn't paid rent for a long period of time to get people out of the camps they were living in and into a place where they could have a roof over their head. we also taught them how to repair their homes which was important to them and that was mocked in the story. >> i know the red cross partnered up with hab at that time for humanity which does that out of the 500 million, and this is the crux of this matter because americans donated generously as we always do. out of the $500 million you raised for haiti, how much have you spent? >> well, we had spent and committed all of it probably 80% of it is spent the rest is committed to projects that are still ongoing. we are still there. so and all of the money that was donated, 91 cents of every dollar that was

donated was put in a segregated account and used specifically for haiti. >> all right. if you go to haiti ms. dedefrancis have you been there lately. >> not lately. >> i donate to a fund call the haitian health foundation. can i tell that you country is probably worse off now than it was before the earthquake of 2010. and $500 million should have been an improvement but it doesn't seem to improve over there just an observation. >> well, bill, i would say was about $13 billion poured into haiti in money of the red cross' share, we were about 4% of that we did not raise enough money to rebuild haiti. >> know i know. >> we did make it a lot better than had it been. >> all right ms. defrancis is, we he appreciate you steapg stepping up and answering questions tonight. >> up ahead.

28-year-old south african olympic runner oscar pistorius was convicted of killing his model girlfriend. the verdict came down last september. pistorius was sentenced to just five years in prison. now he may be released from prison good behavior in august after serving just 10 months. how is that possible? attorneys and fox news analyst. how is that possible. >> sentenced to five years. african law one sixth of that time. >> for good behavior. >> good behavior. doing well in prison, right exactly. >> here is what is happening though. the prosecution is appealing to an appellate court this decision. now, you i know that sounds weird because here in this country the prosecution, if you -- that's it, you can't appeal. but here in africa you can appeal so what they are trying to do is get that conviction overturned. >> this is very disturbing because that's not justice. i mean, the guy shot is his girlfriend. everybody knows it. it was ridiculous that he didn't get first degree murder. they lit him off -- i mean
