"hannity" is coming up live with that. good night, everybody. thank you, martha. welcome to hannity. joyce mitchell the female prison worker who allegedly aided in the escape of two prisoners could be arraigned within this hour. mitchell who worked as a tailor smuggled power tools and other equipment to inmates, the pair of convicted felons remain on the run tonight. i will bring you joyce mitchell's arraignment as it happens. joining us from outside the courthouse is molly line. what the latest there? >> we're just outside the platsburg facility where she's expected to know arraigned. the closest time we're hearing

is 10:30, 10:45. she is the woman that's been at the center of the investigation since the beginning. the princenerssoners escaping saturday morning. which made today day seven of the search. in a press conference this afternoon, law enforcement officers admitted they do not know where these individuals are. they have no confirmed sightings, but tate thereat the same time there is no evidence they've left the area. joyce mitchell had befriended both of the inmates that had escaped. david sweat and richard matt. she has been charged with providing material assistance. the exact charges are promoting prison contraband and criminal facilitation. one of those is a felony. so she could face many years in

jail. she's slated to be arraigned wen a half an hour to 45 minutes. sean? >> molly line thanks for being with us as we follow this. we expect arraignment within the hour. joining us with more information on who the escaped convicts are from our la bureau tonight is trace gallagher. you look there, their backgrounds and records, you got one guy, sweat life with no parole he killed a sheriff deputy and matt killed a guy in 19 1997. >> he chopped up is boss. these are two men who broke through a wall. they crossed a cat walk and came out a man hole on the other side of the prison. the reason this relationship is so important here on the screen is because they believe she played a big part in this. joyce tilly mitchell. they believe she had a crush on

the man on the right, richard matt. they say even detectives who knew him and his friends he was very charming. he was a psychopath a killer but they say when he got cleaned up he was handsome and charming. when they got out of the prison officials wondered why the escape didn't know as planned. she was also alleged to have been the supposed get away drivers or give them access to a car. that's why they believe the two men are on foot. as far as the search goes all they have at this point, you saw the rain coming down behind molly, all they have at this point is the scent from the search dogs that found the scent in the nearby town and followed it into the woods. the woods are three mills away from the prison. in that area we are told there are tons of hiding places. at the same time, there are mosquitos black flies and ticks and people who stay in there say that they would have to be very

gritty to remain in there for an extended period of time. the search continues with 800 law enforcement people on the ground surrounding the areas along the river. they are also going through the stum summer homes which are now being used again going home to home checking everybody who goes in and out. if they are in those woods, it would appear they are surrounded. ads molly alluded to the authorities are the first ones to acknowledge they really have no idea where these two men might be. also think, they are still searching down by lake sham plain on the new york vermont border searching the camp grounds in hopes the men would turn up there. the search goes on day seven. we're awaiting for the arraignment of joyce tilly mitchell. she's facing up to seven years in prison. after 600, 700 leads,

authorities still do not have a single bit of hard evidence that could lead them to the two killer escapees. sean. >> trace, let me go back to this whole relationship between richard matt and joyce mitchell. she told investigators that he made her feel special, although she didn't admit being in love with him. look what she gave them over a period of time in terms of tools. lighted eye glasses, drill bits and much much more the hack saw blades and other items given to them was given over a number of months a period of time. do we have any idea how that she possibly got those tools, not only in the prison but in their hands? >> the people who have served time in that prison say over the course of months she worked in the tailor shop it would be easy each week or months to give them different tools and contraband.

that's the way they believe she snuck it to them. she denies she gave them any kind of power tools to break through the wall and cut into the steam pipe. as far as the relationship goes, you got to toss this in here too, she's married and her husband works inside the pris chblt. there is word the husband might be a person of interest involved in helping the escapees get out. the authorities haven't confirmed that. the relationship was with both david sweat and richard matt. she had a crush on matt but david sweat was actually taken out of the tailor's shop at the prison because people complained about the inappropriate relationship that mitchell had with david sweat. while she had feelings apparently for richard matt she apparently had some type of inappropriate relationship with david sweat as well willing to help both men. we should note that authorities say she is giving every single

detail about this story. she is chirping telling them exactly what they want to know about her involvement in this hoping it might lesson the sentence. she's facing up to seven years on the other side of the bars that she's been watching now for the past 15 or so. sean? >> it's pretty interesting the way you describe that. joyce mitchell was married to lyle mitchell. not only did he work in the facility but lyle mitchell according to reports now, apparently worked in the maintenance department at the tailoring block where joyce was employed. so he obviously would be at least a suspect, what did he know did he know about the relationship. what do we know about the cell phones? there was calls made on mitchell's phones by the inmates to their friends on the outside. do we know anymore details about that? >> it's unclear who made the calls. we're being told that maybe she

lent her phone to richard matt to call people. because all they know at this point in time is that certainly there were a lot of his contacts being called from her phone. the question is did she make the calls for him, did she let him use her cell phone. that remains unclear. that was for help on the outside. she was apparently again, supposed to be the get away driver and they were setting up this sophisticated plot to break out of prison. once they got out of prison they wanted help on the outside. the cell phone was enabling them to get help on the outside once they climbed out of the man hole. the question is who made the calls. you talk about the relationship. you got to go back to her ex husband who called her a serial cheater and said that she was not a very honest woman. she wore that tee shirt we've seen saying she's an air force mom and has a son in the air force calls herself a patriot. it turns out from a lot of people's accounts she was on the inside doing bad stuff and

helping these guys in ways we will hopefully find out as we get the details of this arraignment and find out what they say in court. unclear if they'll read the charges and eligationallegations we should find out a great deal more. >> we expect in this hour that the arraignment will in fact take place as of last night. she had not -- basically waived her right to an attorney. do we know if that had continued or does she now have an opportunity, do you know if she's lawyered up? >> well we would anticipate -- we have not heard she's gotten an attorney. if she's being arraigned it would make sense. constitutionally she has to be given an attorney for the arraignment a public defender. she did not want an attorney. she was talking in the earlaryy days. they didn't charge her was because she was cooperating. the more she talks, the more they waited to fill charges against her. it's my understanding now that

even though it has not been confirmed that for her to walk into that courtroom and to be arraigned, she will likely have -- i'm no lawyer so don't quote me on this she will likely have a public defender in there with her when she appears in court. that is my understanding of the law. but as of today, as of late this afternoon, there was no word at all from anybody on scene or anybody in the courthouse that she had actually been given a lawyer appointed a lawyer or retained some type of legal advice in the matter. sean? >> all right. trace gallagher thanks so much reporting from los angeles. we expect that arraignment any moment now. joining me now ted williams. >> anything i can do to help. >> thank you sir, good to see you my friend. let's go to the timeline. the last time the prisoners were seen before they left that night was 10:30. about 12:30 a.m. the next morning, they were discovered by two local residents very close to the manhole area after they

institution. >> when you think of the tools, they spent a period of months that joyce mitchell was smuggling these tools to these prisoners, but yet, all of that went undiscovered. we hear stories about drugs, you can get heroin and cocaine and marijuana in prisons today. but hack saws and equipment that they can literally cut through pipes and get out of the prison cell? it seems almost impossible in this day and age. >> it isn't. and think about this those hack saws and the equipment that they use to cut through had to make a lot of noise. you would think that would have alerted the authorities. but it did not. these individuals knew when they were supposedly construction going on in the prison. they used that. these individuals planned this. they used joyce mitchell and joyce mirchtchell should be lucky. because if she would have helped them to get away from that

arraignment of 51-year-old joyce mitchell who has been arrested and charmedged with helping two inmates escape prison. she worked at the tailor shop at the prison and allegedly helped them escape. joining us on the phone is geraldo rivera and from the fox news medical a team dr. keith ablow. dr. ablow, let's talk about the psychology of this. months in the making that she is smuggling into the prison all these tools supposedly with what's going to wait on the outside. but had a panic attack and went to a hospital instead. how would somebody be manipulated like this or sympathetic to somebody in both cases u murderers. >> psychiatry is all about why. there is always a why. i don't know her, i don't know her personal wife history, but i wouldn't be surprised if

something about this situation, these are murderers, and yet, she sympathizes with them. if someone were to tell me joyce mitchell sympathized with someone who was an aggressor in her life even an abuser when she was a young person and that that person was then jettisoned from the family you then would say wow, okay these are like tire tracks that people can swerve into. that capture them childhood stories that become alive again as adults where she can be recruited into a drama to save a bad guy. and you'd say why would she ever do that? sometimes in my office it can be 20 minutes into a discussion and it can be like this is an exact replaying from somebody's life story from five or seven or ten years old. >> geraldo, let me lean on your legal expertise and look at the charges we have.

we expect in the arraignment tonight. that is the charges of promoting prison contraband criminal facilitation. promoting prison contraband as a family. criminal facilitation and misdemeanor. we're talking about the possibility of maybe seven years in jailism. if these two were to kill again on the outside would there be legal culpability there? >> be that as it may, these charges are very lenient. she could have been hit with felony aiding and abetting. she could have been nailed with charges that represented a life sentence. it is clear to me that the authorities have gone easy on joyce mitchell. because she has been this fount of information once she realized that she'd been pulled into this incredibly dramatic scam. i think the authorities are going very easy on her. but felony -- >> geraldo, wait a minute could they jump in later and upthe charges? can they add additional charges

at a later date? what if these guys kill? >> they could and she could have criminal responsibility down the road. it seems to me they are going easy on her from the get go. it always -- this is a very unimpressive arrest sean. remember they have been telling us -- this is the longest -- the longest successful escape from the big houses upstate in new york history. they are always caught. almost always within 24 hours, 48 hours. you're now on the seventh day. it seems to me they know very little. all of these false alarms. they found a candy wrapper a footprint. they're in vermont. they're on the train in philadelphia. it seems to me they don't have a clue are these two dangerous men, richard matt and david sweat are. in terms of you know her husband's involvement, that i find intriguing. i want to say one thing about

what dr. ablow said. having been you know done countless stories behind bars there is a different reality inside a prison. you may have someone who is a vicious animal on the streets, but remember both these guys were honor inmates in the tailor shop which is a very very low security mellow kind of setting. they were charming this woman, sweat finally ejected from the tailor shop because the relationship was quote unquote, inappropriate or seemed inappropriate. matt then came and romanced this lusty lusty serial cheater. 5 51 years old. obviously needy. to her they weren't the vicious murders. they were charmers of the right age who paid a lot of attention to her.

i can see them drawing her in. when you walk around the prison on the inside. there is no coreration. >> i guess, what's so difficult for me to wrap my arms around -- you have followed a lot of stories throughout your career here these guys have nothing to lose. david sweat was sentenced to life in prison without parole. richard matt 25 to life. these guys are not going dogto go down easy. there's a possibility that other people are going to be hurt if not killed as this comes to a head. >> you know you're a strong personality. so am i. but imagine if the alternative to staying free however arduous was going back knowing that those guards are not going to let you out of their sight. you'll be in solitary be punished. in a way your life will be absolutely unlivable.

you will crawl on your belly through the black flies and pouring rain. you'll swim the lake you'll do anything you can to stay free. if cornered you will react like a rabid dog. you will fight and maybe die to stay free. because the alternative now -- now charm won't work. now the, you know the charisma that richard matt used will be ineffective. they are facing the draconian end of their lives. i think they are noted as extremely dangerous for a good reason. >> and from a psychological standpoint dr. ablow, we've got to assume 25 to life life no chance of parole. these guys won't end up back in a prison is a fairly strong likelihood. your thoughts on the psychology. >> i would say obviously they're all in here. and to think that they have it

in their mind we go back and get out again, highly unlikely. you know what? for some people i've noted as a psychiatrist when i interview them what would seem to me to be the end of the road in terms of my god, you're going to prison. i've seen people self-report for 20 year prison sentences, meaning they drive there. and i always think to myself. wow, they're driving to go and do two decades in prison. yeah they are. because to some extent when you lack empathy, enough to do the horrible things these two have done you also can be a steely character. who thinks going back to prison hey i'll make it through there too. maybe i will have another attempt to get out. maybe i'm famous now. maybe my life behind bars will be somewhat entertaining. so we don't know them or whether they really would see being ushered back into that facility as the end of their lives. they don't have the same emotional triggers that we have.

described as a fraction of this investigation. there is still so much that investigators want to learn and want to know. they did say, however they were satisfied with the information that had been produced out of her interviews and otherwise they would not have charged her today. this is day seven of the search a lot of these teams have been out in incredible weather. tonight's weather has been very bad. traditional rain a lot of wind. as we were pulling out of the prison heading this way. about less than a quarter mile between them and state troopers standing out on some of these rural roads in that perimeter where the dogs picked up a scent. even people on the edge of the perimeter that was lined throughout the day. the state police all along route 374. we took on the way out of town, seeing the folks completely dressed in their rain gear braving the torrential elements.

school has been canceled for the last several days. people would like to move forward with their lives. it's taking a toll on this community, not just on the investigators that are out in the woods, teams including forest rangers and corrections officer and state police officers that are lining up along the forest and just stepping in there doing the grid searches straight ahead through the swamps in this incredibly dense forest. there is so much swamp land. there are apple trees back there in that forest land. but the neighbors have been so concerned and, you know keeping all of their children close at hand. some describing sleeping in the same bedroom with their family. bringing the kids in with them and the family pets to insure they're protected. nervous to go the the grocery store because when they get home they have to search their house before they can feel comfortable. a lot of people would like to see this end, this arraignment in one point in solving the case

and moving forward in the case and bringing some sort of closure. the ultimate closure will come with the convicts who escaped are ultimately captured when david sweat and richard matt are brought into custody. that's what everyone is waiting for. >> i understand, obviously the fear of the community, it's justified here. it seems the one credible sighting we had goes back to the night of the escape. that was two hours after the last bed check. that was in the back yard of a couple that was near the man hole about 12:30 a.m. the next day. >> interestingly tonight at the press conference they held. they said there have been no confirmed sightings. at the same point, there is no evidence that these two men have made it out of the area. in that sense, they're continuing to search close to the prison and close to home and the areas in the region. the katieville area, a lot of folks in that area have seen

officers. tonight, we've seen a lot of investigators dipping down into the sewer system. essentially very close to the prison within sight of the prison walls. my producer earlier this evening saw a dog pull out of the covers and shake itself off. they're going underground in the neighborhoods that are adjacent to the prison and looking through those tunnels, looking for evidence. and we're not getting word that anything conclusive has been found to give them clue as to where these individuals are. >> molly, thank you. we'll go back to you momentitarily. we expect the arraignment to start any minute now. we go to david lee miller he is standing by with details on how these murderers were able to escape prison. this is like shawshank redemption and escape from alcatraz all wrapped into one. you would think this wouldn't happen in this day and age. >> you're right. it's all the movies you mentioned. there is a component of

ground-hog day. every day for the past seven, they have been searching intensely for these peen. it's worth pointing out seven days ago almost to this hour is when these two men presumably began their effort to try and break out of prison. they were spotted at 12:30 saturday morning in the yard of someone who lives near the man hole. this was an extremely elaborate plot. at one point i think has been glossed over is the level of expertise that these men used to break out of prison. mental experts have told me that the cutting of the wall the cutting of the pipe clearly does not look like the work of an amateur. it looks like someone who took their time and knew how to use the tools that they were given. now, about those tools, we have heard over and over that they were power tools.

and they made very well have had power tools. it is also possible sean they may have had hand powered tools primarily. that would explain why there was not great deal of noise, at least enough noise to alert the authorities in the prison. never the less the question remains, how did they get this contraband and the tools? earlier today, the district attorney said that joyce mitchell did not provide power tools. so the question on the minds of many who then did? it seems almost certain they had to have some power tool capability to accomplish the task. they're speaking with inmates and employees of the prison and also some of the contractors who worked within that prison. another point worth mentioning that may have been glossed over is that there has been a lot of work done in that prison by contractors, some of it extremely loud work. they were using very heavy equipment within the prison

doing some type of renovation. it is very possible that that noise may have masked the noise that the two inmates were making as they literally hacked their way out of the clinton correctional facility. a building that was first constructed as far back as 1845. so this is a very old structure. it is a structure with a labth and sewer pipes. i talked to a former employee of the prison it was his view that there's no way these two guys could have found their way from their cell to freedom without someone providing a schematic or blueprints of the prison. lastly i'll make this point very quickly. i want to be very fair when i say this and don't want to make it look like anyone is rushing to adjustmentjudgment. i did talk to the district

attorney today. and he did say to me that they are looking at joyce mitchell's husband. he described her in a news conference -- described him in a news conference as a person of interest. he was someone who worked in the prison and in some ways worked in the maintenance department. >> david lee miller. they had to have a blueprint of some kind. they could tell by the cut in the pipe. as a former contractor you know if that's a hack saw or power tool of some kind. thank you. we'll get back to you in a little bit. joining us on the phone is duane the dog bounty hunter. let me ask you, you've been out there on the streets chasing down some really tough criminals over the years. you have one guy, life in prison without the chance of parole. he killed the sheriff, got another guy, convicted murderer 25 to life. why do i believe this is not going to end well for them, and you've got to pray the community is safe in the time that it

takes to find them. i think they'll go down with the ship and not go back to prison. >> in my 35 year career the greatest prison escape i've ever seen. these guys i do believe we call it hold court in the street. you're right. what they're looking for right now besides food and drugs is a gun. so. >> there was a report that they may have gotten a gun -- go ahead. >> well i was saying, sean, with the elaborate escape plan they had, unbelievable. now we hear there's also another contractor that could be involved. that's how they got their information. i would give that lady you know immunity the district attorney right now, tell us everything you know about her. none of us care about her, we want these two guys. i believe they had plan b, i didn't know until today they had borrowed her cell phone. so you know you're talking the

two guys there, the two killers are talking. listen she's kind of flaky, she didn't get us when she should o. let's get another ride. i think they probably called somebody else. somebody you know would have spotted them. they've been in jail many years. somebody would have spotted them. as you know in prison everyone wears a prison you know jump suit. that -- some prisons, years ago would notch out the heel so they could track them. if they for sure, 100% found a footprint, all the speculation and the money and officer' time and all that, i hope they're not chasing two shooting stars. for sure -- >> dog, i've watched your show enough times that literally, you could be chasing somebody and they are right underneath your nose and you don't know if right

away. i mean so this is like finding a needle in a haystack. this is not an easy find. i know that one moment they thought they had the scent of a hound that picked up the scent of the prisoners. that didn't pan out. this is not an easy task. if they got in a car and got away. there is no telling where they could be. >> that's right. you know that every time it rains for a a bloodhound or a dog, it washes away the scent. so if there is -- if it's raining and wet, the dogs aren't doing any good. if that is for sure an inmate footprint, they got them. they'll stay on them and flush them out. if that's not 100% sure they got a ride and got out of there. i don't think they would hang around that open man hole for more than two and a half minutes to put the sticky note and bolt right there. they were very -- listen we're both there, you and i lets put ourselves in that situation.

mitchell the 51-year-old prison worker who was arrested and charged earlier today for helping convicted murders richard matt and david sweat escape prison. here with me now are former washington, d.c. homicide detective rod wheeler and former nypd police officer dan bongino. you're a homicide detective, these guys are convicted of murder. they now got free. what are the odds we ever get them back in prison? >> i don't think they're going to return to prison alive, sean. i agree with you earlier when you said you think these guys will go out on a blaze. they know when they are caught they're going to go back to prison. they won't want to go back to prison. they feel they'll fight it out. that area part of new york is a very very dense area full of

forest area. and, you know it's going to take about a week to maybe two weeks for the authorities to cover that entire area up there. want don't be so surprised they have not flushed them out yet. those two dangerous men are still in that area up there in new york. >> it's very likely dan, let's say, though they happen to get ahold of a car or ride from somebody someplace, somehow, somewhere. we may be looking entirely in the wrong area. i don't want to discourage law enforcement. they're out there 24/7. that's the scary side that they may not be in the area. your thoughts? >> you're right. there are three things we need to be thing about right now. the scent, scent there is a lot of opinions on this. the bloodhound being able to track that scent, after a week or so you start to lose the capability. secondly their network. who were they contacting. keep in mind these men have not had an unmonitored phone call with their friends and family in

years. are they disciplined enough to not reach out to friends and family? i don't think so. third, needs. what are their needs? they need food transportation. they need clothing. that's why you have to be looking at these flood locations, you'll have to be looking at things like cars shutting off roadways pavement to them is the enemy. >> but, dan, if they were smart -- of course they wouldn't get on a phone or call people they know. why do i think if they were smart, they'd split up? they'd go their separate ways. >> yeah, that's a great point. they would split up. but typically they're not that smart. it creates greater search field. and everybody is looking for the two guys together because they've seen their pictures plastered on the news. >> they were smart enough to get out of prison. there was a certain level of
