city courthouse with the very latest on the manhunt. >> 51-year-old joyce mitchell is expected back in court today, the woman at the center of the prison break investigation has just been accused of giving the prisoners tools and ultimately aiding them in their escape. she was arraigned on friday. she's been charged with promoting prison contraband which is a felony. she provided the escapees with hack saw blades chisles, a punch and a screwdriver, on or about may 1st. five weeks later, they carved their way out of the facility. investigators say mitchell was planning to pick them up and go with them but bailed on the plan and never showed. the three of them were planning to drive seven hours away to a wooded area where her four-wheel

drive jeep would come in handy. it turns out, it looks like it was going to be a break out and then a take out. apparently joyce mitchell has confessed during a ten-hour interrogation with the state police the plan was she was going to help the guys bust out. why would they bust out? well to get out, but then again, to kill her husband lyle but apparently it sounds like at the last minute she got cold feet and she told them and there's lyle right there, picture right. apparently she got cold feet because she said she still loved it. couldn't do it and that's why she -- >> if you still love them it's hard to kill them i think. >> it's a strange love there. the alleged accusation is that she was supposed to drive hem to her house. she didn't say she was going to help them kill her husband. she was alleged to have been getting them there. >> if she in fact does her job, which she did the hard part helping them get out, if she

does her job and brings them to this wooded area what was she thinking? somehow she gets cold feet and doesn't do this be you don't. i feel bad for the son who came out a couple of weeks ago and there's no way she could possibly be involved like this and now she's -- she is now looking at some serious crimes but she is fully cooperating, they say. >> sure that town is still on edge and people are asking for gun permits, like wild to protect themselves there. they are still looking day ten for these killers. meanwhile, let's get out the exclamation mark because jeb bush -- yesterday, he unveiled his logo he uses the name jeb with the exclamation mark. people say that's so he doesn't have to spell out bush. he's used the logo before in running for governor in florida.

welcome back. this is quite a story. last night, the local naacp president in spokane, washington accused of lying about her race pretending to be black, postponed today's meeting where she was expected to address the controversy. sounds like the meeting will be back on. >> that move already being challenged by fellow board members who say, quote, i don't see any language in the bylaws that empower ss you or any other member to arbitrarily cancel or postpone monday's meeting. what is going through the mind of someone like this that will pretend to be something they're not? probably had to break out a few textbooks to get out ahead of this one. dr. keith, get inside the mindset of this woman.

90 minutes, playing basketball because they ran late sbefs locked out of the house. jennifer brant and criminal defense attorney john laura. let me start with you. one of the neighbors called and said the kid next door is all by himself. the cops came charged the parents, took the kids away for two months put them in a foster home. do you think this is the proper thing they should have done? >> this is absolutely insane. an example of government officials gone wild. what the state would have to show is culpable negligence. what's the risk here? you're going to sprain your ankle playing basketball? nanny state morphing into a police state. >> generaljennifer, what do you say? >> we really don't know all of the facts here. we do know that the child was left alone. he had no food no water, no shelter, no access to a bathroom. and he was in such a state that the neighbor was concerned

enough to call cps. they only did what they were supposed to do. they came investigated clearly they found had enough evidence to charge these parents with culpable negligence. while key say that this is outrageous, i don't think their alcohols were going too far. they were doing what they were directed to do. >> the kid just played basketball at the basketball court outside his house. 90 minutes, it's not like he's stuck in the mountains for a week and a half. think about the fact that he was placed in the care of the state, in a completely foreign family foster family for two months. isn't that going to leave a mark on a kid? >> certainly if it was upsetting to him, it could affect him. we don't know what went on with these parents and we don't really know why he was put in foster care. what we do know is that cps has a policy. they need to investigate. if the investigation finds

enough evidence they follow the proper protocol by taking the child out of the home and putting them in with a relative actually in this case not a stranger. >> john we had a case a month or two ago, the parents down in maryland and we have a picture of the family -- so-called free range family. the state of maryland has decided that now kids can play or walk alone outdoors. the big question is for everybody watching right now, at what age is it appropriate that you can let your kids walk around outside without constantly being eyeballed by mom and dad? >> the issue here is governments should not be making those decisions for parents. parents should have the responsibility and the discretion to make judgment calls about what's best for their kids. every time they make a judgment call they shouldn't have to risk facing arrest and losing their children for two months. that's just ridiculous. >> jennifer i'll give you the final word. >> well i disagree. i think there does need to be
