hello, and welcome to "america's news headquarters." topping the news this hour a day of mourning in south carolina as supporters bring flowers to emanuel ame church in honor of the nine murder victims, now the long processed toward healing begins. and nearly 20 square miles going up in flames east of los angeles while firefighters swept through 100-degree weather all trying to get wildfires under control. plus donald trump says hire me for president. does he have a real chance? we'll talk about candidates who might be running just for the exposure instead of running for office.

but first, we begin with a fox news alert, a massive manhunt is now under way right now after a veteran new orleans police officer is shot and killed while transporting a suspect to the city jail. investigators say officer darryl holloway was shot when the suspect managed to slip out of his handcuffs, grab a gun and shoot the officer. the police vehicle then crashing into a utility pole allowing the suspect to get away. police are looking for this man, he's 33-year-old travis boys. the police chief issuing a statement that he will be caught and brought to justice. officer holloway was a member of the new orleans police department since 1992. he also was the father of three children. a day of grieving a day to remember and a day to celebrate in south carolina. as we learned emanuel ame church will reopen tomorrow people

from across charlston are celebrating the lives of nine people shot to death in cold blood as they studied the bible. flowers and balloons piling in front of the church in downtown charleston. 21-year-old dillon roofe described as a racist sitting in jail after a million dollars bond after a wrenching scene in court the loved ones of the nine victims offered forgiveness. hi, mike. >> reporter: hi heather. dillon roof is on suicide prevention protocol at the jail. he's been outfitted with a suicide prevention vest and he's in the protective custody section of the jail. beyond that a spokesman said he's being treated like any other inmate. you mentioned the dramatic step taken yesterday by the chief magistrate to bring in family members to make their impact

statements before we get to the guilt or innocence part of the trial. and the critics say the chief magistrate could impact the trial itself. >> the problem is now because we had a judge yesterday have all of the victims come up and say that they already forgive this guy before he's even actually been formally charged with murder is going to be a problem for the prosecutor. >> i set the tone of my court. it's my courtroom. i take control over it and i conduct business within the scope of the law. >> reporter: and the emanuel ame church will set out to prove that this deadly cold-blooded act will not deter that organization from its mission. as the flowers pile up for the makeshift memorial the church known as mother emanuel is scheduled to have its sunday services tomorrow morning. heather, back to you. >> listening to those families and their impact statements offering forgiveness really unbelievable. thank you, mike tobin.

right now several wildfires are burning in the hot, dry state of california. the largest of them in the san bernardino national forest. crews are facing scorching temperatures as they work to control the fires which are being fueled by high winds. the smoke being felt as far as away as arizona. will carr is live in los angeles with more details on this. it is quite a battle for the firefighters. >> that's right, kelly. with these dry drought conditions it really does not take much to spark a large wildfire. here in california the lake fire has burned 15,000 acres in the san bernardino mountains between los angeles and the mojave desert. more than 1,300 firefighters are on the ground right now. they are battling strong winds and the smoke is creating some air quality problems for some nearby communities. so far this fire is 10% contained. the cause is under investigation. the good news no injuries and no homes destroyed. to the east, the kearney river

fire is continuing to burn in eastern arizona. more than 1400 acres have burned there. fire crews are getting creative. yesterday using a train to carry 30,000 gallons of water. they hooked up water cannons to the train cars and blasted some of the highest flames. at one point 300 residents were forced to evacuate the area. they were allowed to return last night. that fire 40% contained. to the north crews are fighting 11 fires in alaska are burning. the fire is under investigation. another fire in alaska destroyed 26 homes and you have to keep in mind that officially summer hasn't even started. the first day of summer tomorrow. so at this rate could be a very long fire season kelly. >> and it's so dry out there, so much fuel for the fires here, will, we thank you for the report. well friends and family saying their final farewells to two cousins today who were among those victims killed in a balcony collapse. 22-year-old ashley donahue and

21-year-old olivia burke are being mourned at a northern california funeral and memorial service today. donahue is the lone american of all those killed. burke's body will be sent back to her native ireland. they were among the six people killed tuesday when that ball connellny balcony snapped in berkeley. seven people remain hospitalized from that incident. a man takes a personal issue out on an innocent crowd of people driving his suv straight into a crowd in austria, killing 3 people and injuring 34 others. one is in critical condition after he crashed into people he got out of the car and started stabbing people that he missed. all of this happening in austria's second largest city gratz. police say the driver has been arrested. the 26-year-old is described as someone who was mentally disoriented and acting alone. well coming up new research shows a significant drop in certain cancer diagnosis, so are americans getting healthier, or is current

be actually, you know the best he does in any poll which is very unfortunate for him. i think he's reached a ceiling, though. he has enough -- he's polling well enough right now to get into the debates which is the important number for him. he wants to be in the top ten and right now according to the real clear politics polling average, he's in that top ten. but i think he's got a ceiling. and the reason for that is this is that i think once conservatives start to learn a little bit more about him, realize things he said in the past, you know he's not always been very nice about the republican party, in fact he hasn't always been a republican. he was pro-choice at one point. he was outspoken for universal health care. i think once people start to learn a little bit more about him the numbers from the people who like him because he's straight -- he's a straight talker. i think those numbers are going to go down. >> well he's also very populace populace. he goes on to say our country's in serious trouble. we don't have victories anymore. some people might agree with that. but --

>> right. >> -- would they vote for donald trump based on what his statements are? you know here's a guy who is a tycoon a real estate mogul and a reality star producer. do we want reality tv stars or do we want someone who's potentially a president? >> yeah. and i think, you know, there's a segment of the republican party that primary electorate that likes what he says because he doesn't sound like a politician. if you remember in himself announcement speech last week he threw out the four-page prepared remarks and kind of spoke off the cuff for 45 minutes, something no other politician, you know would actually do. so i think, you know, that's where he is. where he's the biggest threat in this republican primary is not to candidates thinking that donald trump is going to win the nomination it's those debates. who he keeps out bobby jindal rick santorum and maybe john kasich he'll keep people out of the debates. >> maybe even john kasich who would be a very viable contender. he's done a great job in ohio as the governor of that state, and

even though he's a republican he's really drawing some bipartisan support with some of his actions, so when you look at kasich and possibly a scott walker who may jump in there sometime in july how big is this field going to be and how difficult will it be for people who really would like to vote for someone within the republican party? are they making it hard on themselves? >> well we're going to get -- it's time for the governors to get in. bobby jindal of louisiana is getting in we think next week. scott walker looks like he may be getting in in july. john kasich of ohio may be getting in in july as well and chris christie of new jersey so it's going to be time for all these governors and a lot of reasons that they're kind of waiting until now somebody like scott walker has said he's got to focus on the budget back home and so he's really taken his time, though i think it's an advantage for him unlike some of the others he's waiting until now to get in because he's able to bone up on the issues particularly foreign policy which may not be his strongest part and i think he's able to use this time to his advantage.

>> it's understandable. you got to bone up to make sure you're prepared on every front domestically and even foreign and even in terms of our national security. having said that when you look at the candidate, the field of republicans who are out there right now contending you look at a mike huckabee or a jeb bush they have qualifications that merit being called presidential yet would they be able to stand against a hillary clinton? >> well and that's -- that's going to be the whole debate. i think we're going to see a lot of these roishls argue srepublicans arguing that i'm the one that can beat hillary clinton. take rand paul, for example, he and his campaign are emfa sizing this. he performs best against hillary clinton and that's why you should support him. that's a very strong argument that i think any republican are going to want to make that argument. >> alex finally, what benefit does it have to see this many contenders come out for the republican party as well as for the country? >> i think all the republicans will argue that more competition is better and that the more people arguing and fighting and,

testing when and how. >> if you're high risk especially african-americans, if you have a family history of prostate cancer get a baseline psa at 40. it's go to pay attention to it. i think aua needs to wake up. we are seeing more and more younger men with metastasis. this is dangerous. get a baseline psa at 40. then have a conversation with your doctor whether you need one every year or age of 45. >> there are new levels of testing. there's a new blood test. we had discussed that at some point. >> i'm glad you brought it up. as we get more sophisticated and bring in more genetic testings we can distinguish between low risk and intermediate and high risk. that's when we can say, you don't need to be screened for the next five years. you need to either get treatment or biopsy or et cetera.

a prisoner being transported was somehow able to get a firearm and shoot the officer who was driving him. the car crashing near the intersection where the shots were fired. that officer darryl hole away. he took the life of a 22-year veteran. hi will >> reporter: heather, right now members of law enforcement are combing the streets of new orleans looking for the suspect accused of killing this veteran police officer who is also a father of three. police say the 33-year-old travis boyds was arrested for aggravated burglary and outstanding warrants. he was then placed into the back of holloway's car. at some point during the ride he managed to get his hands out in

front of his body. police say he may have been double jointed. he pulled a gun out. important to note here it's unclear where that gun came from. we know it's not the officer's gun. his gun remained in the holster the entire time. a struggle ensued. the officer was shot in the head and killed. >> officer holloway put up a fight to get him not to escape the vehicle but succumbed to his injuries. >> the car slammed into an electric pole near a shell gas station. take another look at his picture. he is armed and dangerous. he has a tattoo on the side of his neck. the mayor released a statement saying this despicable cowardly act represents is the lowest of the low. it is an attack on our community. we are bringing together every

law enforcement resource at our disposal to find capture and prosecute. they are doing everything they can to get him off the streets and behind bars where he should have been. as you can imagine, the memorial is growing outside the south carolina church where nine people were killed during bible study. the church expected to open again tomorrow while family and friends they are still mourning the loss of their loved ones. we are learning more about the 21-year-old suspect. rich is live from charleston south carolina with more details about him. rich? >> reporter: good afternoon, kelly. and he is detained eight miles from here. as federal investigators continue to comb through and investigate whether or not they're going to bring charges. he faced nine charges of murder

yesterday. will not post bond on that. that is dylann roof the 21-year-old, in all of this. back here at the emanuel ame church, which is just over my shoulder, this is the scene of the crime from wednesday evening. there will be sunday school classes tomorrow morning at 8:30 and there will be church services starting at 9:30 in the morning. folks from all across the state and all across the country are coming to the site here and leaving flowers, gifts, prayers, all paying their respects. >> it's kind of sad. when i heard about the shooting i didn't believe it. when i heard what was going on with it i mean it affected me because i go to church myself too. this could have been me. it could have been my family loved ones. i want to be out in this community and support people and show our support. >> kelly, tonight there is

expected to be a march around 6:00 this evening that will start by a nearby mall. they will march here. all who are attending are expected to bring a flower to lay in front of the church. a massive memorial by the hour here. after the church services this is the holy city because it has 400 places of worship in charleston. there is a suggestion out that perhaps all of those places of worship should ring their bells at 10:00 in the morning. and later tomorrow evening there is expected to be a large human chain across the pedestrian bridge to stand in solid is airport and show their respect for the victims of this horrible tragedy. >> thank you for that. that is a step towards healing. thank you. heather? new developments in the massive manhunt for two escaped prisoners in upstate new york. police now say the convicted killers were possibly seen near the pennsylvania border.

that was about a week ago. david sweat and richard matt broke out of a maximum security prison earlier this month. we are in dannemora with the latest. rick, why are we hearing about this a week later? >> reporter: this is when police told us about it. heather, it took them a while to find out about it as well. we don't know if these are the two men. police working to confirm it. they didn't know about the sightings until this past tuesday. they have been working to confirm whether or not these are the men they are looking for. the spotting again, two -- forgive me. new york state police were told about this on tuesday. they received surveillance yesterday which we're told so far is in chemicals iive. the two men matching the description of richard matt and david sweat were spotted walk anything a rail yard.

the next day a witness saw two walking on county line road in lindley. they are looking for additional witnesses and clues and analyzing the surveillance tape from the area. the men could have covered 300 miles in a week if they walked 15 hours a day. that was last saturday when the spottings were made. inhey could have traveled another 300 miles. they could be in west virginia virginia, ohio or anywhere else else. they have been added to the 15 most wanted list which is reserved for the worst of the worst. there is a total of $150,000 in reward money being offered for information leading to the arrest and capture of the two escaped killers. meanwhile the corrections department has put one corrections officer on administrative leave as to what went wrong inside this prison.

according to him, he said he cared about the poor people in his state. that's an interesting message that can resonate among a lot of communities but not the grassroots of the party. >> if you care about the poor people of your state you want the economy in general to get better. you don't need to be proud there's more people on welfare or within the poor framework of what government is handing out. ksaich is interesting. it is about name recognition. on fox, people got to know him when he was here. ohio is important. when you're starting out and you mention his quote, amateur hour is over. look, we don't want the gop. you can do this without attacking other candidates. you can do it without needing to use bluster. i think politics at least for the gop at this point, needs to be like golf. you're competing with yourself. and everybody else can do what it is they need to do. i think the more the merrier. besides, this looks like a cabinet to me. it should look like a cabinet to

will. but he can use this to bring america together. so what's exciting kelly, is that charleston is coming together. i have on my chest a prayer shirt. we had a solidarity prayer in the city of baltimore today where thousands of people came out to the various spots we have had trouble in baltimore, and prayed. remembering baltimore, south carolina, ferguson and beyond. so we can use this strategic time to come together. and we can heal the racial divide. it's a complicated thing in america because we have poverty, race, and then we have an access problem, class. and we've got to teal with those delicately. but we can do it. but it shows that there's not just violence and anger in the black side of town but also there's violence and anger, don't you think, in other

quarters, as seen by this young man taking so many lives. >> you recently launched a campaign to have a dialogue on race or racial reconciliation. joining you was bishop t.d. jakes and a lot of noteworthy ministers throughout the united states. when you have spiritual leaders doing it how do you get people to embrace the hope of america that you're discussing? >> well what we did when we came together was essentially this. we said show us tell each other our best practices. let's multiply the work that we're doing and then join hands in a multiracial manner and use each of these areas as bridges. time won't allow for us to go into seven specific areas that we're going to work on. i think it is going to take the leadership to focus the body of how they can move and the american christian movement

peace starting with charleston. as i'm here in baltimore and around the nation we can pray. and then we can pray for a better day. i believe that the old civil rights movement came to a certain point. and it's kind of slowed down. we can continue to believe that king's dream and god's dream for america can be lived out. i think we're on the way. america is a great country. our future is bright. tomorrow let's pray that we remember our legacy and future. >> when you talk about king's dream merging with god's dream where communities are reaching out to help each other, it was dr. king said that hatred cannot drum up made receipt. where do you bring the light? where to you bring the love and how do you inflict hope in the midst of these dire circumstances that we've now seen? >> well, what we've got to remember is that love has to

wear a certain kind of clothes. practical service is love in action. i think in inner cities we need to bring jobs. i think we need to serve people. we need to be sure communities start meeting together under the banner of love and making strategic plans for baltimore, charleston and beyond. i think in the rural communities there are also amazing problems with poverty and other issues. and so i think the church has become largely irrelevant in social issues in america. we're seen as those who say stop this. don't do that. we should not be policemen but servients. pray and then serve. pray in love. and then dawn the clothing of love, service. and to help the community, jesus said that our works are like

welcome back. the 21-year-old accused of killing nine people at a south carolina church is charged with nine counts of murder and possession of a firearm. governor nikki haley said she will seek the death penalty against dylann roof. witnesses say they heard him say he wanted to start a civil war. federal authorities are investigating the attack as a hate crime. all of this raising questions about how this case, how the case against him will play out. robert is a criminal defense attorney and david schwartz a defense attorney and former prosecutor. thank you both for joining us today. a lot o questions are beginning to be asked in this case. one of the first, who handles it? state authorities or federal authorities?

i'll start with you. >> listen this is going to be a major issue that's going on right now. of course this investigation will be looking at other participants, who else may have been involved whether it's a conspiracy. but the federal laws and the state laws are most was implicated here. having handled this from a policy-making decision there will be a little wrangling there. they want this case. federal prosecutors want it on hate crimes and civil rights as well as the death penalty potential. and the state prosecutors are going to want it because it happened in their jurisdiction. there's going to be a little bit of a back and forth. let's hope they don't do parallel investigations but rather pull their resource spss and work together. it's better prosecutors if that penalty and state law from having reviewed both of those statutes. >> the state of south carolina doesn't recognize a hate crime. how will that affect -- >> it shouldn't matter. it should be in the purview of the people of south carolina. the local district attorney's

office that prosecutes this case. i don't think there should be any wrangling whatsoever. the feds should be waiting back if they want to bring a prosecution after the state will bring it. of course this is a death penalty case. i don't think the hate crime will play a role. it's an eight-count murder case death penalty case. >> if they both work together and the federal government is charging and the state government is charging it gives a tremendous amount of leverage to the prosecution in charging this case. i can only see a plea deal as life with no possibility of parole. >> how do they defend him here? >> that's the easiest answer for a criminal defense attorney. it's keeping him alive for one more second one more hour one more day. they've got a bad case here the defense attorneys. this is a great death penalty case. as far as they're concerned they're going to stretch it out as long as they can. >> what about the issue of the judge? we heard the victim impact

statements going on one after another offering forgiveness. amazingly grateful. their loved ones murdered gunned down shot multiple times by the way. and he reloaded the gun also by the way. >> this is a bail hearing. i couldn't figure it out. i've never seen anything like it in my life that there would be victim impact statements at a bail hearing. it made no sense whatsoever. maybe they do things differently in south carolina. and to bring the families into that courtroom so fast after this murder took place, i couldn't believe what i was watching. certainly victim impact statements are very important later on obviously after the trial and when you have sentencing and certainly during the death penalty phase, that will play a huge role. but i can't believe it. >> could this have a negative impact? >> i'll tell you what this may

be one when the prosecutors sit at the table, they will look at the courtroom process and procedure. i agree with david. this was an extraordinarily unusual and in my opinion, imprudent action by the judge. this is what happens when tv cameras are in a courtroom. a judge isn't used to dealing with the media. it became in my opinion, a media spectacle. and the prosecutors had to be shaking their heads saying my god, what is going on here. that could be one of the reasons they say we need to pull it into federal court with a more seasoned judge. >> the suspect himself has been in trouble with the law before been in trouble with drugs. how will that impact? >> i don't think that's going to have much of app impact at all. there's a lot of drug cases out there. there's a lot of troubled people out there. they don't commit an eight-count murder, go into church and murder eight people. i don't think that will play much of a role. but his drug addiction will play a huge role.
