>> it does depend on the candidate. but you see someone like bernie sanders getting huge crowds. just had 5500 in colorado last night. there is concern he is getting a foothold n early states. he is talking against these kinds of deals. something that hillary clinton hasn't effectively come out against nor supported much to the angst of the administration. i think it affects the democratic presidential politics a little bit and it may affect the support for some of the lawmakers on re-election 2016. >> let's talk about the supreme court. we know it is expected to rule on obamacare before the end of the month. the decision that could affect the subsidies for more than six million americans. the department of health and human services believes the average subsidy for americans is

about $270 per month. if those are struck down what happens brett? a lot of the state hasn't made concrete plans for what happens if the subsidies are ruled illegal. >> that is the $64,000 question. there are two or three states that made efforts to get state exchanges but the rest of the 34 have not. there will have to be action by congress to at least have a patch to take them from now until whatever the alternative is if the supreme court rules the federal subsidies are not legal and can't go forward. it is a fascinating case. there are readers on both sides who say it could go either way. the jonathan gruber story, the mitt economist who came out

saying the obamacare law passed because the american people were stupid, now there is e-mails showing he had more knowledge and communication with the administration te -- the beginning. >> he was the guy nancy pelosi said she never heard of. prior to obamacare if someone showed up at the hospital without health care they were required to treat them. presumably if the law is shutdown someone might show up at the hospital and be turned away. why not go back to the old system, require the hospital to treat them, and sort out the billing later? >> a couple things. hospitals have never stopped even in the transition. they have accepted. hospital emergency room visits in many states have gone up

an accident at a work site in new jersey with a power working stuck in mud. they used their hands to free the torse and legs. investigators are investigating what caused the mishap. the prosecution arrested in the case of james holmes after weeks of testimony from first responders and police officers on the attack that left 12 people dead. prosecutors laid out the case saying he was legally sane. holmes is pleading not guilty by reason of insanity. does the defense face an uphill battle?

how can you not? 12 people dead so many injured, so if somebody is teetering on the edge, i think they will go over to the he is guilty not insane side. >> this is one of the few cases, if not the first, where you have a death penalty case where insanity is the defense. even if john is right and the prosecution makes the case in part of the emotion when it comes to sentencing, you know the majority of the evidence shows he had major mental problems and i think it will certainly lend itself to the defense in sentencing against the death penalty. >> we will see what happens. the defense starting later this week. more word of a crisis at the veterans association with reports some veterans are waiting longer for care than they did at the height of the scandal and why the wait times could be getting worse. and the u.s. is ramping up the
