humor since you've been on set this will be a fun hour. >> let's hope. >> believe me you will be happy with just four. >> i'm sure that's true. >> let's get to it. all eyes on the supreme court this week for a decision that could gut obama care as we know it. the nine justices preparing to rule whether to block health insurance subsidies in 34 states that use the federal insurance exchange. the anticipation whipping washington into a frenzy as republicans scramble to craft a contingency plan to keep millions of people from losing their financial aid. meantime a new report finds few states that rely on the federal exchange have taken steps any plan b to fill those gaps. in if high court blocks resident subsidies most of the governors say look, it is the job of congress to come up with a fix if these subsidies disappear. governor i can not understate what a complete disaster and what chaos will ensue if there is not some kind affix.

you've been governor of a state. >> right. >> new york as you know has its own exchange so it will not be affected by this but do you agree with the other governors congress needs to step in with a plan to be ready. >> i believe it is both. first of all, obamacare is a horrible law. i hope it craters as a result of this particular court ruling. by the way i think there is no question the court should decide it is wrong, illegal for the federal government to subsidize federally-run exchanges. i think that is very clear from the language and history of the law but there are solutions. >> what are they? >> one of the things i would do, i think congress should act. 6.4 million people are dependent on the exchanges. i would userries is a. erisa has been in place for like 20 years. when you were an employee and you had a retirement system and you lost your job and had to find a new job it allowed you to keep retirement benefits for 18

months while you transition to a new job. what i would do is pass a similar provision, anybody operating on, under a federal exchange having insurance for 18 months they are protected. during that 18 month-period they can look at alternatives in the private sector. they can look to the states to see if they come up with a different approach. by the way when i was governor we dealt with this issue without obama care in a way patient centric in a way that used the private sector. i recommend states do that as well. >> wow that is really an interesting idea too, because it speaks to the republicans in your party who feel very strongly they don't want to see an extension of the obamacare law as it stands now. so you're dealing with that. >> that's right. >> almost like a cobra for everybody. >> that is exactly right. obamacare should go. it's a bad law. but on the other hand you have to have a transition period. we have this model that the federal government had, erisa 18 months where there there will be

transition. governors can act states can exact and individuals can contact. >> do you feel like that is less political than the options we're hearing. >> washington is in a frenzy. they have always been in a friends sir, and always a political frenzy who should benefit. this should be about the people. >> you offer actionable ideas in the place of the current law but so far we've seen even in republican-led states reluctancy to have a contingency plan. republicans are saying get rid of this thing, they don't have a plan b. hasn't exactly looks good for the party. >> i disagree with you. it shouldn't look good for the democrats this was a partisan piece of legislation rammed through without one single republican vote, when democrats had veto proof control or filibuster-proof in both houses and president obama. they are the ones who are responsible for this law. but if i'm a governor i need a transition period. i don't want to see obamacare

extended but i also don't want to see people in my state dependent on the exchange all of sudden seeing higher premiums. i think this is a way to do that. >> i think president obama is responsible for this law horrific in the way it rolled out but i think republicans owe people better. back when hillary care came out, republicans should have led the charge on the issue. they knew it would come up and a democrat president would come in argue for this type of system. people were talking single-payer. would i have liked to see some leadership on their part so obamacare never had a shot to exist because republicans had something like you were talking about, that was patient centered and market centered before we even had to have this discussion. so i do kind of blame them. >> i don't. they did do that. >> where? >> tell you new york state had a great plan. i put together a plan for uninsured. we had three new programs family health insurance adults above the medicaid level had access to very inexpensive quality health care. children we had a child health

plus program. children and families with incomes up to 58,000, had low-cost access to health care. single individuals, whether they were entrepreneurs or working for a small business who didn't have it could group together under a program called healthy new york t was working great. there were alternatives out there but they were all superseded by obamacare. obamacare wiped them all out. >> governor i think you make a great point a lot of republican governors have said not in my state, i'm not going to take debate on this one. they knew the law was deliberately set up -- >> to force them. >> to force them to do it. a lot of blue state governors will have to deal with the consequence of this but i think congressional republicans are missing an opportunity to speak about some ridiculous mandates, pregnancy services for women 55 and over. that is so valuable to women in their 50s. >> driven up cost. >> open up insurance over state lines? >> state lines and also to end the ridiculous junk lawsuits

that drive up medical costs enormously. if i were a republican in congress i would pass measures like that, buying across state lines, reforming the medical lawsuit issue, and i would also authorize this transition period where states could act. so, i'm not in congress. i hope to have the chance to lead the country. if i do we're going to have alternatives. >> congress did miss an all opportunity here. >> on the other hand, this president and democrat, let me defend them. this president and democrats are the ones who rammed through this law and they are not a part of the solution. why aren't they saying if this is struck down we'll use this alternative, or we'll have a transition period. they want republicans to be embarrassed. it shouldn't be about politics. it should be about people. >> real quickly last wednesday we started to see republicans had their meeting when it looked like king versus burwell might be falling.

we do know that congressman paul ryan in the house has an idea. >> that's right. >> we know that senators barrasso and ted cruz have been working on an idea in the senate. >> there have been ideas out there. >> well the guy behind obamacare, with all the brilliant ideas remember him? >> lack of transparency is a huge political advantage and basically you know call it the stupidity of the american voter or whatever basically that was really really critical to getting the thing to pass. >> that was the so-called obamacare architect jonathan gruber back in 2013 calling americans stupid. now stunning new emails obtained by "the wall street journal" reveal that the mit economist was far more involved in the shaping of the health care law than the administration let on. the emails show he was frequently consulted by staffers and advisors for both the white house and hhs. one email from the top obama health advisor even thanks gruber for quote being an integral part of getting to us

this historic moment. despite all that when this controversy first erupted last year this is how president obama referred to gruber. >> the fact that some advisor who never worked on our staff expressed an opinion that i completely disagree with in terms of the voters is no reflection on the actual process that was run. >> well, a spokeswoman for hhs appeared to dismiss the emails saying they quote only echo old news. sandra i saw you shaking your head. >> old news? they called us stupid. >> sold news he was seriously involved drawing up this health care law governor. no two-ways about it. >> he was right smack in the middle of this. there are two overwhelming points. first of all that that is the stupidity of the american voter that gave them the chance to ram this through is not just his attitude. i think it is the attitude of the left in washington who believe they know better and trying to dictate how we run our

lives, obviously with health care but in some other ways as well. second point look at that obama clip. where he dismisses it and claims that he had nothing to do with it. and it is completely untrue. >> andrea, that is the response of the administration, this is old news when you have the president saying one thing, some advisor, who barely had anything to do with this, and now we learn according to the emails he was one of the central architects of the law. >> he was also a central architect of romneycare. >> right. >> this was the go-to guy with all the brilliant ideas. >> that's right. >> that is the reason sandra, when we have this tape surfaced how the law was set up, that is what i thought the attorneys for the plaintiffs should have played for the supreme court justices over and over because jedediah, it is not the job of these justices to interpret what they meant, what their intention was, how the law was written we have him on record it was written this wray into force states doing this. >> this guy was paid $400,000.

>> fox news alert. we're getting new information on the same two prisoners from up state in new york you know the ones on the run for 17 days now? police wrapped up a news conference in kate at thisville, new york. rick leventhal has more from there. rick? >> reporter: they confirmed our report from this morning search in allegheny over the weekend has wrapped up. they follow ad lead down there but couldn't confirm it. apparently that was some of 2,000 tips they perceived that didn't pan out. the scene in franklin county is a totally different story. they told us they did in fact follow up on a lead. there may have been a spotting of the men in hunting cabin in owls head. the police recovered items and

reached conclusive determination but not releasing details. they have set up roadblocks across the county. police in a number of strategic location and doing searches of cabins in this area because of what they apparently found inside of that one cabin. according to the plattsburgh press republican they found a jug of water inside with a jar of peanut butter. "new york times" found they found prison-issued underwear. a man went to check on his hunting cabin. saw the peanut and water. yelled for anyone inside do come out and he ran out the back door. authorities didn't get a good look. authorities believe they may have been david sweat and richard matt. they said there was dna match. there are some resources in franklin county who escaped from prison, convicted killers that escaped from prison two weeks ago, hairiest. >> these guys apparently have not split up, is what the dna is

pointing to. questions whether or not that would make them easier to find but apparently not. rick leventhal, we'll bring you back as the news warrants. we he bring you out to the couch a former new york governor who has a cabin not far from where the search originated from the prison. >> a farm. in the adirondack park. >> what can you tell us about your kind of impressions about all of this? it has been 17 days? >> it is ridiculous, nobody in the prison heard them using power tools. i'm stunned they were able to get away. the state police are a tremendous law enforcement agency. it is a time of year when enormous levels of foliage. i think they're doing a tremendous job. in fact harris, i snuck up to my farm for father's day there were two state vehicles patrolling whole area. i'm proud of them and i'm confident they will catch them. >> happy father's day. >> thank you harris. >> we'll talk about iran and the

deal coming up. the deadline is a week away. defiant move by iranian lawmakers eight days before a critical deadline to reach a final deal on the nuke program. iran's parliament voted to ban access to military and non-nuclear sites and to documents and scientists a part of the deal with u.s. and five other world powers. they don't want anybody interviewing scientists. members of parliament even chanted death to america during the vote. in response, a state department official reiterated what u.s. officials have maintained all along. any nuclear agreement with iran must include adequate access to those nuke facilities. remember the six world powers think iran could use it and iranians uranium enrichment program there to make nuke weapons which tehran of course denies. governor i will come back to you on this we're a few days away from this deadline. what are your thoughts about the deal? >> it doesn't surprise me. the iranians have from the beginning pretty much rejected every single line in the sand this administration has drawn.

now the latest one the same thing. no inspection of military sites. no discussion with scientists. eventually you would hope the obama administration would understand this isn't going to be a deal that works in america or the west. >> you are talking about a deal. will a final agreement come to fruition? >> i certainly hope not. the administration has pretty much caved on everything. the sanctions were only related to nuclear. now they're related to other issues like missiles. they will have snap-back sanctions. russia said that will not happen. they will have instantaneous checks. they said that is not going to happen. so i fear this administration is so committed for legacy purposes to having a deal, that they will cave on this too. i certainly hope not. i hope that that they come to their senses. that the number one sponsor of state terror can not have -- >> talk to plea, andrea, about the politics of this. you heard the governor mention

charleston, south carolina mayor reilly, speaking out on the issue of the confederate flag flying at a war memorial at state capitol grounds in the wake of nine black church-goers in charleston it has become a hot button issue. this issue put the republican party prodential contenders over the rightful place of the confederate battle flag since the tragedy last week, calling it a symbol of racial hatred mitt romney the party's nominee in 2012 fueling debate when on saturday he repeated the demand the flag be removed from the grounds of a south carolina state hughes. he -- house. he actually tweeted bit. not specifically calling for the flag to go, former governor jeb bush, my position on how to address the confederate flag is clear. in florida we reacted. moving the flag from the state grounds to a museum where it belonged. i'm confident they will do the right thing. other republican candidates striking more defiant tones saying debate has no role in the

this? i find this flag offensive. i think people of south carolina should be ones voting for this. this flag represents the fight in slavery. it was a flag that the southern democrats, democrats, used to fly against northern republicans. so i'm not sure why republicans are getting peppered on this. >> you don't have to go back to the 18 '60s on this. governor beasley was republican governor, took it down voted out laegely by issue by democratic governor. >> it was raised in opposition to republican. >> this should not be a partisan thing. this is about americans coming together. too much for political reasons trying to divide us so many different ways. we're all-americans. we have a common future. we have to understand that. >> i want to give advice to republican candidates. to say this has no role in the residential race is ridiculous. you're running for president. everything is on the table. be prepared, i don't care if black or white cats are racist. have an answer to the question.

and jeb bush surged to the top of the crowded gop field. governor, love to get your race on the take and who is winning? >> i think it is wide open. somebody may be surging the front in june of '15 but the election is november of 2016. the who is getting attention in the past but it should be about ideas. it should be about leadership. it should be about your experience. i'm confident it will be as we go forward. >> money in politics showing up, jedediah, as one of the number one concerns here. what do you make of that? >> that is a big problem for hillary. we talked about the idea romney didn't do so well. if you're wealthy can you go out and articulate that well? can you talk about opportunity? can you say yeah, i worked really hard to get here. i'm not penalizing your wealth. i will left everyone up instead of taking from one person to give to another. i hope that message is true but if not we're looking for new generation of voters that likes wealth distribution and doesn't

like the opportunity and entitlements f that is the way we're going i don't think so i don't think so. i think you can target voters with that. >> donald trump, i'm curious to know how you look how big this pack is, why are you running? >> i'm running first of all i honestly believe i can run this country well. i believe i have vision to reduce power and intrusiveness of government in our lives. not just ideas. i did it in new york for 12 years. i just didn't manage new york. i changed it dramatically. the things i'm talking about needing to do in washington, reducing the size of the government and it is workforce, reforming and lowering the tax burden growing economist. getting government out of people's lives. these are things i did in the bluest of the blue states where there are three million more democrats than republicans. i know i can lead this country. i know i can change the government. i think we need to do that in washington. >> one thing, donald trump kind of made it sexy. he will be the number one jobs

president. >> god ever created. >> god ever created right? >> right. >> there has been criticism of the gop not making it interesting. i'm going to grow the economy 4%. according to jeb busch, right? he can prove that he did do that in the state of florida. >> right. >> what can you do to champion that message? it is so hard for the average american to wrap their mind around how do you do this. >> so easy to talk in the sound bite. i'm the greatest jobs president since god. obama was very good in sound bites. hope and change. >> it was effective for him. >> it was effective for him but not for the people. we want a leader to work for the people. may not be so good at a sound bite but pretty good at running government and changing things. pretty good at bringing people together. that's what we need. if you want sound bites there are plenty of it. v opportunities for that. if you want a leader, if you want a leader i know i have the ability to do that.

>> governor, you're facing a lot of criticism from conservatives, when you ran for office elected, very conservative governor but being accused moving very far to the middle, embracing unions. a lot of headlines you're taking lumps from the right conservative party in new york seems to embrace carly fiorina, our own fox news contributor jonah goldberg compared you to bad clams. what is going on? >> whatever reason, he has attacked me since my first day as governor. i would put my record against any governor in america. 143 billion in tax reductions more than the other 49 states combined. reduced the state workforce by over 15%. we reduced the welfare rolls in new york state by over one million from when i took office and had almost 700,000 more private sector jobs. by the way i did that private health care change to provide access to the uninsured. and people like jonah hated that, because i did work with the unions to put in place a

private patient oriented health care reform. they didn't want me to do anything. too often conservatives say government has no role. i think government today has too big of a role. we need a government that empowers people. that's what i did as governor. >> he ran on hope and change and some sound bites. he was included saying that many, many times. now president obama saying he never actually said he could fix washington alone. is that true? or is the president just diverting blame from himself? ♪
