ontinue to create new technology to connect you to the people and places that matter. >> this is a fox news alert on the supreme court win for obamacare. the subsidies were upheld by the supreme court. today's #oneluckyguy from dc is ed henry and he is outnumbered.
9:01 am
this is the second victory for for president obama and a politically charged supreme court. mr. obama spoke a couple minutes ago. >> as the dust settled there is no doubt the law is working. it changed and saved american lives. after more than 50 votes in congress to appeal or weaken this law, after a presidential election based on preserving or appealing the law, after multiple challenges to the law before the supreme court, the affordable care act is here to stay. shannon is live outside of the
9:02 am
supreme court. >> reporter: it came down saying the subsidies would be expanded into the states that set-up their own exchanges. he said the credits are necessary to avoid the results that congress meant to avoid. he is saying i am going to find the credits extend everywhere because the subsidies that provide health care across the law will be in danger. the justice authored in opinion aviserating the majority saying they have done this to save obamacare and done it so much
9:03 am
they should call it scoutus care. the supreme court of the united states favors some laws over others and is prepared to do whatever it takes to uphold and assist its favorites. a lot of folks think the win is across the board on capitol hill. you have no backup play. the white house said it was confidant it would win. republicans quoted ideas but never nailed down anything. here is what the house speaker today said. boehner said after the ruling obamacare is broken increasing health care cost for millions and today's ruling doesn't change that. he said the law is a failure despite the growing report getting from the president. house minority leader nancy pelosi's reaction was this is a
9:04 am
victory for common sense and all-american families. it is long past time to abandon the hate full attitude on the health care act. basically it is the law of the land get over it. in a 6-3 decision the subsidies stay in place. >> what a huge ruling. with this big legal ruling handed down on obamacare for more on its impact and how the court reached the decision let's bring in judge andrew napolitano. judge, we have been running into each other in the hallways and i keep saying i cannot wait to hear your thoughts. speak how they came to the decision but the precedent this sets going forward. how they turned the u.s. constitution on its head and i believe put a nail in the democratic process. >> it is actually first of all,
9:05 am
andrea and everybody i am in washington, d.c. but thrilled to be on with you not withstanding the news we have to discuss because the supreme court, as justice scalia pointed out basically said words no long have meaning. if established by the state means established by the government, the drafters using the word state with an upper case s referring to the 50 states, no longer has meaning and the supreme court can change the meaning of the word. that is dangerous because the supreme court has the final say in our society on the meaning of the constitution and the meaning of statutes. if the drafters of statutes know that the supreme court will change the plain meaning of ordinary words, how can they draft the statute with the confidence it will be enforceds as they drafted it. that is the president i think
9:06 am
the headline tomorrow is scalia calls it scotus care meaning if the supreme court like as statute they will change the meaning of every day words. >> andrea mentioned bumping into you in the hallway. what do you think it is like when justice scalia will bump in the justice roberts in the hallway? in all seriousness chief justice roberts saved the law twice conservatives are furious about it. >> both times he did this he used involve arguments, that were not advanced in the briefs or oral arguments before the
9:07 am
court. this time around where the government said the language is not ambiguous and chief justice offered an opinion saying the language is ambiguous, it is one thing for him to find standard acceptable modes of understanding the statute. it is quite another to go off into almost legal never never land in a way to uphold a statue.
9:08 am
>> are there other legal challenges to obamacare? >> there is another wave of religious challenges that are making its way to the supreme court court. they are predomantly catholic there. this is not the hobby lobby challenge. this is another challenge that goes directly to the core teaching of religious organizations. that is going to make its way to the supreme court. but after today, who knows how it will end up. >> what does it mean going forward as far as the
9:09 am
controversy is concerned? you cannot chose your doctor, can't get catastrophic insurance there are so many extra expenses added to this, will that change. >> those arguments, i cannot keep my doctor it is costing me too much the deductibles they go to the presidential campaign.
9:10 am
>> it is andrea. speak again, you mentioned the precedent this sets and now lawmakers are going to put the lengthy purposes or upfronts in the law to protect themselves because what the court basically did was not read the law as it was written. they twisted it into a political pretzel which they did with the obamacare tax. this is a politicized court. is this decision bigger than marberry versus madison? >> that was a decision in 1803 that establishes the ability of federal courts to determine what the constitution means and what the statute means and to void to negate a statute inconsistent
9:11 am
with the constitution. it is hard to believe something could rise to that magnitude. if the word state with a capital s as pointed out injustice scalia's descent if the court can remove the capital s and put the lower case s, then your question is is there anything the court can't or won't change? i don't know the answer to that. >> judge as always thank you for your very insightful words.
9:12 am
>> we will continue to follow the massive reaction to the ruling of the supreme court and we will talk about what it means for democratic and republican candidates for the white house. also major developments as it is revealed thousands of e-mails and for from lois lerner were erased. and catch more from the couch on the web, join us for "outnumbered" overtime. click the ot tab. obamacare won today but we won because we have ed henry here.

e-mails related to the tea party scandal saying irs workers erased more than 400 backup tapes that contained 24,000 e-mails from lois learner who used to run the division. it happened months after the e-mails were subpoenaed. >> we have testimony from the irs commissione only to find out they have been degauzeing the tapes and they destroyed evidence. that is what they did. we are just trying to get them and read them and figure out what is going on.
9:18 am
everyone is pushing for political revelations and there is nothing to see here. years later we are looking for the e-mails and getting new revelation. and beyond the criminal part that is important and can't be dismissed. this is what infurriates people. how many times has the can just been kicked down the proceed? >> lawmakers have to say do our
9:19 am
words mean nothing. do they have disregard for people? >> unless they do something for people that erase the e-mails we can look forward to seeing more of this happen. there has to be consequences. believe me, i will telling my husband this. >> it tells me the consequences in this are better than the consequences of us reading the e-mails. it is basically the irs getting audited and they cannot come up with the records. >> can't you say that to the irs? i was looking for everything couldn't find it but i meant to. >> they were taken to hell and back by the irs to get the approval process. was there like an e-mail deleteing problem? do you think hillary thought
9:20 am
lois? when this scandal broke the president did go i believe to the rose garden, but he made a statement about the irs scandal and he mentioned it was a serious issue, and he said he would take issue, he even acknowledged -- it wasn't a phony scandal. >> it is making people mad from all parties when the president of the united states says we need get to the bottom of this and you never do. this is serious, the irs can ruin people's lives. if they want to get information they will get it from you. if we want it from them we have chairmans sending subpoenas. if you are in the state department and trayey gowdy is demanding e-mails being turned over. >> is the irs forcing americans

9:26 am
obamacare her own. whoever the republican party may nominate and one thing i can assure you and they will repeal obamacare with something better. >> and harry reid telling republicans that the game is over and stop banging our heads against the wall trying to repeal it. >> i think lindsey graham has a point. this should be an issue for the 2016 republicans because they can make the case that congress hasn't done anything. boehner and mcconnell talk a great game and how they will repeal obamacare the action and they haven't done that. that is just a fact. republicans might not want to hear that but it is the truth. chief justice john roberts have done nothing to talk about
9:27 am
obamacare. the last stop is to elect a republican president to work with a republican-led congress if they can hold on to the majorities. the president's legacy by the way is getting secure. he is a domestic president who can argue and pulled us back from a great depression and gave health care to millions of people it is not running perfectly but it has survived one vote in congress and two supreme court challenges. he has disaster after disaster whether it is russia putin iran deal, in 2016 hillary clinton will own this for better or worse. >> that is i think the silver lining here, rachel, if we are looking for one for republicans. now the democrats own this. hillary clinton was the one -- this started years ago with her husband in office -- a similar type of legislation and republicans can run against
9:28 am
this. >> i think you hit the nail on the head. look primary voters are paying attention to this vote. they are angry. i think it is a good day for scott walker. i think they are looking for someone who has been tested to have the political spine to stand up to what will be if they appeal it a backlash. we know scott walker did that. i think they are angry about roberts, angry at george bush and i am curious if they will punish his brother for that. >> a point on words don't matter. you heard the president it seemed like he was saying everything that wasn't true. premiums have gone down that is not true. >> right? and businesses -- >> he said on average. there is a bunch of people who have seen them go up. some have seen them go down. >> if you live in seattle and
9:29 am
north carolina and your premium went up they went up for you. the average doesn't matter. >> and they bumped doctors. >> 25% of people loosing doctors and limiting choice and that is what single-payer insurance does. i think there is a huge leap on capitol hill because democrats didn't have alternative or solutions. republicans don't want one. they don't want to have to deal with this. you have three republican senators in the presidential race and 2016 is going to be very interesting certainly for someone like rand paul and i think they will not want to make this the crown jewel in their presidential campaign because it is starting to look like yesterday's problem. >> if this is a great bill and law the president wouldn't have to pass delays and mandated. he would not have to post pone things like the employer mandate. he talked about it not hurting
9:30 am
job creation and i think a lot of jobs have been lost. republicans this could be a way to run against democratic candidates in a very sound way. >> you talk to any small business owner and it affected their bottom line. they are paying more money to cover their employees. many didn't cover employees. small business owners don't have a chance any longer. you have to buy into this. you have to accept the deductible and you cannot chose your own doctor.

>> six years into the recovery and still in a rut. republicans can run on that. and to her point, does obamacare have an impact on that. it is covering a lot of people but has it slowed the recovery? no one knows for sure. 1992, clinton it is the economy. you hear the republicans talking about this and which candidate is going to say it is about the recovery. >> maybe that is the way to tie the two together because they are linked. 1/3 of the u.s. any and your point is can the republicans do it affectively. >> the headline ought to be obamacare wins but the american winner losers. a new poll has good and bad news for hillary clinton. on the plus side she is the front runner but still might have speed bumps when it comes to the issue of honesty and
9:32 am
truthworthyness. 45% of them are rating her as not being honest. also in fox polls clinton tops each of the candidates in head-to-head match ups except for jeb bush who is giving her a run for his money. >> i will say has a problem on honest hon honesty. the republicans have to wake up to the fact that despite the
9:33 am
problem she is on paper and can beat every republican candidate out there. i wonder if going back to the last discussion we had the republicans continue to throw everything about the foundation and e-mail and it is baked into the cake. people know about this stuff. there might be more revelations but which republican is going to admit here are problems and here is what i am going to do to make the economy better and not dwell on scandals. bill clinton survived many of them. >> i would not doubt if she is hoping for more. we have seen the foundation and server and lord knows what else is looming. >> it is like jaws coming out of the water and eating everyone else alive. she wants more eggs and bacon. >> andrea i know you have run so many campaigns and have experience in this. i want to ask you about a poll people were asked if people
