who got away. his partner in crime richard matt was shot dead in his tracks near here yesterday. toting a shotgun he never fired. discovered shortly after a camper driver reported being shot at. and after a cabin owner called 911 when a liquor bottle appeared on a table that he hadn't placed it on. that's when search isers rushed in and heard at least one escaped prisoners caught partly because he couldn't suppress a cough. >> it there was movement detected by officers on the ground, what they believed to be coughs, so they knew they were dealing with humans as opposed to wildlife, and a team, a tactical team from customs and border protection met up with mat in the woods challenged him and and he was shot dead by border patrol. >> officials don't have any reason to believe david sweat wasn't standing right there when richard matt was gunned down. in fact, reports were they

here. >> sam alito one of the dissenting justices four out of nine warned in his dissent that this decision will leave those who oppose same sex marriage in a position to be persecuted. he wrote this: i assume those though cling to the old belief also be able to whisper their thoughts in the recesses of their home, if they repeat their they will be persecuted as bigots in their homes work and schools. >> jeb bush taking a more general election tone coming out in support of traditional marriage and saying with an eye towards the general election. ted cruz though thinking this is one of the darkest days in american history. louisiana governor bobby jindal warned this warning will pave the way for all-out assault against religious freedom in this country. >> governor mike huckabee saying if nothing else, take a look at what history tells us that what our political

and economic classes have told us about the three equal branches of government and something that we are not seeing here according to the governor, take a listen. >> i shutter when i hear people say it's now the law of the land. those of us who passed high school civics knows that the supreme court can't make a law. congress can. has to be signed, executed by the president. the supreme court can review a law. they can decide what they believe the law says. but the congress has to actually create a law. what they did was not rule on marriage equality. what they did was redefine marriage there is a fundamental difference. this is redefining a fundamental institution and doing it in a record period of time. >> we're going to talk to later in the show the former governor of texas rick perry about this. i am for people getting married i got married at 22. i'm for major. lost in the debate is the question of heterosexual marriage. collapsed in america. 40% of all children born out

airways flight is forced to make emergency landing in london. the flight from new york wants jfk to kuwait city was grounded after a food poisoning outbreak. as many as six people gotten sick. those passengers taken off the plane and now being treated. scary start to the weekend with two shark attacks along the coasts of the carolinas. >> saw a shark out there attack this man right here. oh my goodness. >> a 47-year-old man was bitten on the leg and lower back while frantically getting his kids and friends to safety. they were swimming in waist deep water at the beach at the time. he was taken to the hospital and is expected to be ookay. a pennsylvania tourist is recovering after get bitten on the foot while swimming at south carolina's hunt hadding island. this makes six total shark attacks in the carolinas this month. officials urging people to stay out of the water. so are you going swimming in the ocean this summer in the carolinas? >> and jimmy fallon is

who can't get vaccinated because they are too young and they are at extreme risk of getting these diseases. >> barbara to that point? >> yeah. i think we have to look at the facts here. 90% of the child pertussis cases in california last year that had vaccine records had been vaccinated. 30% of the cases of measles associated with disney land this year had been vaccinated. only 18% of all measles cases were in school-aged children. the fact is that we don't know how many people who are vaccinated are transmitting disease. so if everybody else is vaccinated in school, except for the immunicipalled compromised child that will not protect the uncompromised child from getting sick. children don't go to school in a bubble. >> i want to get this and then doctor can you respond. 20 states right now have philosophical exemptions. 48 states and the district of columbia have religious exemptions and nearly 29,000 children are unvaccinated for religious reasons currently in the state.

relatives and that spacialgd us to create dogs on deployment to help other service members in need. >> he they're essentially members of our family as a dog owner i feel that way. i don't have any kids so my dog is is my kid. how does the program work? >> the program works military members can register on the website and volunteers can sign up on the website as well to volunteer to watch a military member's petted while they are deployed or away for training. network and match up and find a border. >> what does this mean to you. >> this has been such an incredible opportunity. while i don't deploy, i'm in the coast guard i don't deploy as much as other military branches, but we are away from our pets and families for months at a time training or going away on cutters. it's really great to have this free option and to know that somebody is taking care of your pets as well as you would want to. >> certainly. there is a million ways to volunteer for whether you go to a soup kitchen readings to kids at school help our

military members is such an important thing. why did you decide to get involved. >> i read an article in guide post which is a little magazine. so i thought gee kind of sounds neat. went online and checked them out. filled out a profile. didn't hear anything for a few months. then i got contacted and that was our first deployment. teddy is my second. you liked it so much you decided to do it again. >> my first dog left on saturday and i was contacted the following tuesday for teddy. he arrived on the following saturday and his dad was on board the ship on saturday afternoon. >> he had a very short notice that he was deploying. >> are they starting to become parts of the family as well? >> great friends after this boarding experience. and even one military member

>> we want to get to this fox news alert. it's a busy saturday morning here and tragedy overseas. carnage in three different countries from france, to tunisia, to kuwait. a trio of terror attacks hitting three different continents and killed more than 60 people. some people just sunbathing on the beach with their families when suddenly these killers come up and attack them brutally. >> a horrifying story out of tunisia, that's exactly right. scores of british tourists on the beach in tunisia historic live a muslim country but a very faceful stable country. you are seeing video right there. you are seeing how beautiful it is right in the mediterranean. the terrorists came up on jet skis with weapons hidden under pair soles and guns them down. many of the women. some of them elderly on the beach as they sat there because they were western. >> unbelievable. all right. so were all three of these attacks coordinated somehow by isis? isis claiming responsibility for at least two of those. i have heard some terrorism analysts saying it's not

ban same-sex marriage. there were 13 states that explicitly banned the practice and now those laws are officially invalid. >> you're looking at the majority on the left side of your screen in a 5-4 decision. the dissenting votes are allowed to do what's called a reconsideration. they can have the supreme court about three weeks until this would actually become official they can have the majority reconsider their decision over that time. but that didn't stop thousands of people from pouring into the streets and statehouses across the country from performing marriage ceremonies almost immediately. but there are those who are writing dissenting opinion, samuel alito being one of them, who wrote this. he said "i assume that those who cling to old beliefs will be able to whisper their thoughts in the resess of their home but if they repeat those views in public they will risk being labeled as bigots and treated as

such by government employers, and schools." >> so could people with traditional values become marginalized because of this? gop presidential candidates reacting. let's listen. >> the last two days the supreme court decisions have been heartbreaking. they have been the embodiment of judicial activism. they've been lawlessness. >> it sort of leaves open again, the -- a lot of lawsuits that are going to restrict religious liberty in this country. i don't think there's any question about it. >> reporter asked me about it and i said flippantly might as well get rid of the supreme court and save some money. i mean what's the point? >> the most important thing right now is to recognize that we have to protect the rights of people who have traditional beliefs. >> we also heard from governor huckabee saying let's take a look at what we learned in our ninth or 12th grade politics class, three equal branchs of government and you shouldn't be able to legislate from the bench. >> there's that complaint that the supreme court decision actually didn't reflect the

constitution. the constitution doesn't address this directly. when i look at video of people excited about the opportunity to get married, i'm for that. i'm excited for people getting married. i just wish we could be that excited about heterosexual marriage which has basically collapsed in this country, and that's what matters. that's what the majority engaged in or used to and the question is what happens to kids when their parents stop getting married. 40% of all kids born out of wedlock wedlock now. that's a disaster. nobody mentions that on either side. >> you also don't hear business owners who were refusing to serve gay couples wedding cakes and perform ceremonies and things of saying i won't marry you or i won't make a wedding cake for you if you've been divorced before. you do in some situations. or vuld sex before you get married and things like that. >> i get it. >> all sins are the same -- >> but the sin we care about as a country is the sin of raising children in unstable households.

the decision raising questions about the court overstepping its bounds with critics saying justices shouldn't be legislating from the bench. >> joining us with his view former texas governor and presidential candidate rick perry. good to see you. >> good to be with you. thank you. >> what's your response to the supreme court's decision yesterday? >> well again, they hit it right on the head. i'm a traditional marriage supporter and the supreme court in this case overstepped its bounds. it legislated from the bench. you know as i travel across this country, americans are talking about how do we get our country back on track from the standpoint of economically how you're going to create a climate where people truly have a good job and they are worried about the safety of our country and what's going on abroad. but, you know, this issue should have been decided by the states. we need to be really thinking about do we need the supreme court to be the legislators in robes. >> politically, though since

this is happening with quite a bit of lead time between the 2016 race when everybody actually gets out there and votes, will this make it not so much of an issue and national security and the economy will be the bread and butter issues that people will be voting on? >> as i said earlier, that is what people are focused on. i travel across the country, that's what people are asking me about. lay out your plan. i talk to them about what we've done in the state of texas, creating 1.5 million jobs from the end of '07 through the end of '14. we talk to them about, you know, our concepts about how you deal with isis how you secure the boarder in this country, keeping our community safe and keeping this world safe and defending western values. that's what people really care about. so i think the focus will be on that as we go forward and rightfully so. >> you know, of course tampa bay couples do care about their right to marry and whether or not this legal morass they've been facing by traveling across state borders, one state they

get married in they go to texas and then they're worried about whether or not the laws in that state would allow them to have insurance rights or this and that. and it became a mess for gay couples. you saw in your state yesterday the city of dallas and austin holding ceremonies almost immediately after that decision came down. gay couples in this country waking up this morning knowing they could troovl all 50 states and not have to worry about their legal rights. >> lewis brandeis an old supreme court justice, said the states are the laboratories of democracy, and i think that's what we've gotten away from this the country and this idea that one size fits all, i don't think that's a formula to keep this country very happy from the stand point there are a lot of people that do believe that marriage is between one man and one woman. but more importantly, as i travelled the country, wa people are talking act is how are you going to get this country back on track, what are the policies

you're going to put in place. and i go back to if we'll let these states compete against each other with economic policies they'll make the right decisions and this country will be stronger economically and that's what people really care about. >> governor, we have seen in the last 23 hours three pretty severe terror attacks in tunisia, france and kuwait part of a wave of terror. it has increased. it's not just our imagination. why is this happening? >> well i think the president stepping back whether it was in libya, whether it was in egypt, obviously we had the opportunity to stop isis and syria by funding the syrian rebels early. i completely agree, had we funded the peshmerga in northern iraq they would have stopped isis at that particular point in time. again, the president hi stepping back from engagement against isis has been a terrible dilemma for our country and i think for the middle east. we must have a plan working with

our middle eastern allies to go in and to eliminate isis. >> and governor perry, a new poll out asking registered voters is barack obama too soft on islamic extremists? 36% saying no 58% saying yes, hours after that air products factory had that attack officials in france came out and said these were terrorists. is that an issue we're seeing from our leadership in the united states not naming our enemy? >> well it is and, again, i think this administration whether it was pulling out of iraq in 2011 whether it's not having a coalition in the middle east to stop isis continues to send the message of america's erratic at best, our allies don't know whether we'll be there with them obviously our adversaries don't respect us either. >> are you paying attention to polls in the presidential race right now, governor? do you care about pollthe polls?

schools. parents can choose to opt their kids out of the class but why introduce the topics in the first place? >> whitney neal has four kids in the schools. and thanks for joining us. tara, if you took a poll of fairfax county seventh-graders, a minority would know what decade the civil war took place on. a lot of educate them on. why in the world are we taking time out to push gender identity propaganda on children? >> i doefl don't think it's propaganda. i think what we're seeing is a wonderful time for people and educators to have a safe space for kids especially teen and this is the age group they're targeting here learn about differences. i think it's really important if we learn about our differences that we can find a safe place for these people to be able to explore, ask questions, and learn more about them. one of the biggest things we realize is ignorance breeds hate. if we can have an environment where we learn about people's

differences, there's less likely a chance for these kids to get bullied, more a chance for people to have understanding about what's going on with these kids and that are eventually going to be adults in our society that are a part of our society and we need to know about them. >> the counterargument is this is an optional class, and if you want you can say that your kid can't go to the class and all their friends will know they're from an uptight loser family and they'll be of course ostracized but you can still do it so what are you complaining about? >> we can say it's optional parents can pull their kids out of the class, and that creates additional problems for students that aren't attending. the bigger thing in fairfax county when the school board approved this did they look at what training teachers will have to discuss these topics and questions. we haven't seen anything official any kind of accountability for what will be discussed along these lines. as a parent i would want to know that before i even had the opportunity to make the decision

to opt in or out. >> exactly. you know as well as i do both sides will not be represented. they're not going to have a gender identity activist who arguings that gender is a social construct and an evangelical christian arguing hi side. that's the definition of propaganda. why push it on children? >> i definitely as i said don't think this is propaganda. educating about what is a reality in our society about different types of people and different things they're encountering and they're experiencing is critical to our social fabric and social construct as you said. i don't think it's anything about propaganda. nobody's encouraging them to question their gender identity. i think that what they're learning about is that there are folks who, you know, identify with a gender that's different than the one they were born with. this is not a choice for these people. >> that's reassuring. whitney for the last second you have children in the public schools in fairfax county. are you satisfied that your point of view will be represented in this education, in this curriculum? >> no i'm not.

one of the most anticipated movies opening this weekend celebrates our four-legged hero who is work along side our servicemen and women on the battlefield. in the movie "max," a fallen marine's family adopts his dog and must overcome obstacles in the most different time of their lives. >> animals can come down with posttraumatic stress like people can. max bonded so closely with kyle it's been impossible to get him to bond with his family. >> sit. good boy. >> with us now is a head trainer for the movie "max," mark forbes and he brought along jager, one of the stars of the film. nice to see you. >> you two. >> nice to see you, buddy. there are a number of dogs in this film playing different roles. you trained all of them? how did you get involve in this

project? >> got a call from a producer i worked with on a film called "marlee and me," and she had another dog script and read it and jumped into it. >> so you're getting typecast. >> yeah, a little bit. >> it's interesting when you look at the different roles of the dogs in the movie, some have a little more energy and some don't. jager is a little more mellow. >> mr. mellow yes. >> in the movie he plays a more mellow version of the dog max. >> he does. >> how difficult is it to train this dog to show e snoegs that's what film making is about, to show emotion. >> this film almost more than any other that i'd worked on really the dog had an emotional journey from working in the field, his handler being killed him coming back and getting adopted by the family. he had -- and him almost being traumatized by the event. there was a whole journey for him. so we used five different dogs and we used the personalities of each dog, which with this one obviously did the sleeping scenes to portray the different aspects of the character.

>> one thing you noticed by going overseas and looking and studying the military men and women who have these relationships with these animals, that it's really a deep deep connection. >> it is. the handlers that work with them out in the field, it is a relationship that lasts a lifetime with them that they -- they're going into battle with this animal and they rely on each other. the thing i got back from guys that we worked with was it really is all about the relationship between them and the dog. a lot of it was just -- i think it just passed the senate where all the dogs now come home. it wasn't necessarily the case before. but they come home and the handlers and their families actually have the first rights to adopt the dog when it comes back. >> why these dogs? >> you wouldn't know it from jager, but these dogs have so much energy. i keep describing it as a motor that does not stop. it goes all day long. that's kind of why they have ended up in both police work and military work is they have all this energy that can be channeled into doing a job.

so that's what they're used for. >> in the movie you're behind the scenes, the cameras are there, we have all the cameras in the studio right now. it's difficult, lights shining, action. can you get him to show a little emotion if you had to d with a director looking you right in the face for a scene? >> you have to all the time. one scene jager did people will recognize from the film is he is in a cage in the backyard and it's 4th of july and the town fireworks are going off. he is flashing back a little bit to a traumatic time you know overseas. and josh comes home our actor comes home and sees that he's in a little bit of distress climbs in the cage with him, and, you know that was all jager and it was some behaviors we had trained for him to do but it was him sort of being in the moment and acting with his actor. >> nice to meet you. i don't want to wake him up. leave him here the rest of the show. pleasure to meet you. go see "max" out this weekend. thanks so much. >> thank you.
