that, have we seen that covering in talks? >> the french appear to be the hard lean in the negotiations with iran and we saw some evidence with that just in secretary kerry touched down in vienna just a few hours before he was to sit down with secretary of state kerry, the french foreign minister issued his own set of red lines for the talks and make clear, for example example, that it's nonnegotiable that they should have access to iran's military sites. and it seemed to many eyes that the release of those red lines just before the meeting with secretary kerry that they were aimed at much at the americans as iranians and that's just one example of how we're seeing back stange, if you will some degree of tension as they formulate their own postures and opinions and they doesn't take into account the russians and chinese, shannon. >> we know he's been under

another day, another shark attack on america's beach coast. the latest attack was yesterday off the outer banks in the beach town of rhoden thigh. a 17-year-old was airlifted to the hospital after a shark bit him on the leg, rear end, and hands. this was the sixth attack in two weeks after north carolina's coast. the most serious attack was two

it wasn't willful. can you accept that explanation? >> well absolutely not. no rational person can accept that explanation. this has been in the packet of the irs since the very beginning of these rev laugss. they find out more and more important people are involved and then they find out lois lerner lerner's hard drive was dried. if you can believe this, it's astounding to believe it could have happened. it's a pattern and long-term pattern and somebody needs to be held into account. >> the inspector general said the irs never looked in five of six potential places where e-mails might have been stored including the server. this is their own watchdog who's saying basically've if you're not saying they willfully dried something, they didn't look where they potentially could have found what they were ordered to find.

>> you know in the civilian world, this would lead to head rolling, fraud and impeding investigation charges. those are the kinds of things that are going to have to come down in this irs case if we're going to prevent this from happening in the future. right now nobody has been held accountable in any way of consequence. >> that's the question. do you think with all of the bluster and press releases and all of the frustrations by those investigating this expressing outrage, are we really going to get anywhere? we know the justice department has in some cases involved and detached to this says there's nothing to see here. we're moving on. there are several investigations still ongoing, but for as much as we talk about it, are you confident anybody will actually be held accountable? >> no i'm not confident at all. history tells us that they won't. they tell us don't make for prosecution. you've got a department of

prosecution that's not going prosecute anybody. you have a president that's assured us at the very top of the ladder that there's not a smidgen of corruption at the irs. with all of those things it's not possible for there to be any justice. the only chance is for private citizens to hold them accountable. >> you're involved with one of the only main lawsuits against the irs related to the tea party scandal. what can you tell us about the status of that case? >> sure. citizens for self-governance is part of it. we're paying for the christian groups pro-israel groups that were targeted for additional unconstitutional scrutiny. that lawsuit is moving forward. we've made it past the motions. the others that bone out on the motion to desist there and the appeal phase, we're moving forward, moving into discovery. the federal government has been

because a majority of the supreme court justices did exactly what judges are supposed to do. they looked at the text of the law as a whole and applied it exactly as law wrote it. >> the chief took a lot of heat for that. he talked about it being taken out of context. so ryan do you think he got it right or wrong? >> i think he got it wrong. established by the states means established by the states not the states or the federal government. looking at the larger intention, we have jonathan gruber several times caught on camera saying this was intended to be a way of forcing the states into the exchange exchanges. when the states chose not to this law should have been struck down. >> a lot of people asked me. it's such a wonky way the court

works. they were asking why wasn't gruber in play. of course that wasn't part of the record. >> what's important to remember is jonathan gruber didn't write this law. those who did filed a brief that made clear that was never the way the law was supposed to operate. when you look at the text of the law as a whole it's very clear that those four words do not tell the full story. tax credits are supposed to be made available. >> and at the end of the day that's where the chief came to in writing, saying his assumption is that what congress intended was to make sure that health care insurance was done more broadly. some disagree some agree with that but it is the official decision. the following day we got the 5-4 ruling authored by justice kennedy. he's the swing sort siding with the four members of the court that are wildly classified as the left although i know the

justices don't like to be put into those categories. it was a sweeping opinion and we thought it might go more narrowly. they're to be treated exactly like opposite sex couples and he's often talked about them. it seems like that was -- that resonated with him. of course four scathing descents who said essentially, ryan that he made law where it wasn't intended to be found. >> i think before the defense got to the case they're exactly right. anyone who carings about constitutional law, the rule of law has to be disappointed by what the majority did in this case. justice kennedy redefined marriage not based on anything in the constitution but based on what marriage is. the constitution is silent on what marriage is. that's why they say we the people have to decide whether it's a gendered institution or a genderless institution. but judges don't have any

greater insight into that question and the constitution certainly doesn't say anything to that question and so it was judicial activism for the court to redefine marriage in all 50 states. >> brianne, a number of descenting judges also played up the idea that this should have been an issue. justice justice ginsburg criticized roe. >> mean our constitution is a supreme law of the land and we put certain fundamental rights into the constitution precisely so we don't have to ask our neighbor wls it's okay to exercise them. the supreme court justices did what they're supposed to do looked at the text. that's that there should be marriage equality. obviously people can disagree. they can continue to disagree but that disagreement can't

trump the fundamental right to equality that's in our national charter. >> justice kennedy talk bd the fact that there are those with concerns of religious objections e. but we have dissenters that say should you voice any opinion you're going to be deemed a big got and you may risk your job and livelihood and all kinds of things. >> we're seeing catholic charities being forced to shut down baker, forest the photographer. the important thing here is the matter people said they have a religious freedom to teach and to preach and justice roberts says it's the free exercise that our constitution protects and they were silent about that. will they have the freedom to live about it our eyes monday through saturday not just sunday morning. >> i think we all agree that's probably going to be the next part of this debate.
