commandments memorial outside the oklahoma capital grounds. the oklahoma supreme court yesterday ruled the monument violates the state's constitutional ban on using public property to benefit for religion. but is this just another instance of judicial activism? joining us now, state representative mike ritzy who with his family donated the private funds to erect that monument. he joins us from tulsa. good morning to you, mike. >> good morning, thank you. >> thank you. there is a little delay between here and there. let me ask you this your reaction to the fact that the supreme court of oklahoma said no you're going to have to take it down. they didn't cite the u.s. constitution. they cited your own oklahoma state constitution right? >> well that was the problem that we had, we're very concerned about that because their so-called opinion really

didn't cite any of the previous precedent laws and they never ruled against a display like the den commandments a passing display like the ten commandments before. they only had three pages in the ruling. i'm told by the legal scholars and attorney general here at oklahoma that it was probably not their best work as far as the supreme court. >> okay. you say this is just another example of judicial activism. why? >> well again, it was purely a political decision more than a precedent because the oklahoma supreme court basically has ruled since then many times the constitution article 2, and they have stated that the display such as this are constitutional oklahoma had two other courts that look at the lower courts and ruled it constitutional. the supreme court of the u.s. has ruled on this identical to

the texas state capital and display on public property in utah. we were taken aback a little bit and disappointed by their nonopinion. we thought really it was kind of shooting from the hip. >> sure. well you know it is curious because in many instances like this mike it is -- things in state capitals and on public ground are regarded as historical. that's where our laws and our heritage comes from, came from in the beginning when this nation was first founded. how did the people of oklahoma and your constituents feel about this? >> we had all through the process, seven years since we wrote and passed the law by a super majority in the legislature and signed by the governor we had percent polling anywhere 80% of oklahoma citizens are in favor of this. they like to know their heritage. that's one thunging, my wife and i

home schooled three children. one went into law, one went intoed meinto ed me medicine and one is a patrolman. they could recite the president's names of the united states and the governors of oklahoma. we home schooled them and hoped to continue to other youth in oklahoma and citizens to understand the heritage and the historical significance of the ten commandments. one thing we tried to emphasize is don't let your freedom slip by don't let your heritage your history, if you forget your history, you forget your future. and as an army veteran and having two great grandfathers in the war for independence i find it really odd at the eve of the birthday of our founding of our country coming up this decision coming out, a slap in the face for all of those that fought for freedom. >> absolutely. it is not over i understand. people will be fighting to change all this. we'll keep people posted.

really matter. certainly not right now. and not in new jersey where, you know we have 700 or 800,000 more democrats than republicans. so it is not really unusual that the democrats in new jersey would prefer that you know a democrat be in charge and not a republican. and as a republican with a democratic legislature, you know chris has done a great job of trying to meld the two and come up with solutions. but the polls don't rally bother me. and i don't pay much attention to them. >> does trump bother you? he had a big bump. the governor said we're friends, but we're going to dole this thing out. >> sure. donald and ilana are friends and he's been an incredible businessman. i think it is honorable. anybody that wants to put their hat in the ring and talk about serious issues that are facing our country deserves to be heard. and as you can see, the more the merrier it seems in the republican field.
