controversial relationship between hillary clinton and a long-time clinton confidante the white house barred her from hiring. the state department released 3,000 pages of emails showing secretary clinton was getting advice from sidney blumenthal as far back as 2009 way earlier than previously earlier we knew of. also that the obama administration knew of hillary's private email setup. ed henry has been poring over those emails. >> reporter: wham interesting is hoing -- what's interesting is hillary clinton wanted today to be about her fundraising. the story today however is going to be about these emails pouring out from the state department. her tenure largely focusing on

2009. new information about her ties to sidney blumenthal and the fact that he was talking to british prime minister gordon brown on her behalf. he was not officially a state department employee. obama white house officials banned him from working at the state department because of political dirty tricks. so she was working with blumenthal secretly behind the scenes. republicans on that select benghazi committee in the house are saying that's a snapshot because hillary clinton deleted over 30,000 emails. >> we don't know if hillary clinton has turned over all the emails yet. and the fact that there were 60 new emails that we got that we had not previously had.

sidney blumenthal was being paid by the clinton foundation20,000 a year and he wasn't doing work for clint on foundation he was doing back door work for hillary clinton at the state department and pretending to be an intelligence genius and have all kind of sources and how much the secretary was paying attention to him and how much it influenced u.s. policy. but the overlay the deception as to what was happening and none of it was true. >> she doesn't follow the directions. my question is what does he know? why is he so important? he must have known something if they were so against her speaking with him. but she found it so important to speak with him. then also i find it hilarious that it just keeps coming out. first it's 30,000, now it's 60,000. she thinks america as amnesia

jedediah, i know you checked with one of our legal stars on fox news. >> i did. i spoke to judge napolitano. this is being compared to a situation in texas where there is a similar monument, judge nap said on record this oklahoma supreme court decision is based on oklahoma property law which is governed by the oklahoma constitution. that constitution prohibits use of all state property for any religious purpose, because state supreme court has final say on the meaning of that state's constitution, this decision is not appealable to the supreme court. he also reminds us that the supreme court in oklahoma is popularly elected. they're not there for life. if the voters don't like this, there is a chance for them to make a change. >> interesting. >> chris you have some strong thoughts about this, what are they? >> i'm a little sick and tired i guess this freedom from religion cause. i'm not devoutly religious person myself but this is america. we protect people's freedom to practice their religion. if the people of oklahoma feel comfortable and state elected legislators feel comfortable with this four people jumping
