the ground of the oklahoma state capitol must be taken down in a 7-2 decision. the oklahoma supreme court ruled the ten commandments on the monument are obviously religious in nature. and an integral part of the jewish and christian faiths. many oklahoma legislators have expressed regret at the ruling. some are calling for the oklahoma supreme court justices to be impeached. joining me is the oklahoma attorney general who disagrees with the court's discussion as well as state representative whose family funded the development of the monument in question. welcome to both of you. mr. attorney general, what recourse do you have? you called on them to reexamine the issue. i would doubt they're coming down on your side. >> it happens at times. we filed something called a petition for rehearing. encouraging news today the court has requested briefs from the other side. that shows they're considering this. they should. because it was a wrong decision.

when you look at the precedent of the court itself they have cased that stand for the proposition this monument is constitutional. we had examples nationally. this monument was modeled after something in texas that federal courts have said it's constitutional. what the state supreme court did in oklahoma yesterday is say the first amendment freedoms are insufficient. that's wrong and the reason they should rehear it. >> the suit was brought by the aclu of oklahoma? >> that's correct. >> now mike you're a representative. your family donated this. and apparently you had to reinvest in this there was some accident and it was destroyed in some way? >> a satanist ran over it and destroyed the monument. we replaced td within six weeks. what's your take on it? what are your constituents saying? >> historically my wife and i

are lovers of history. about 30 years ago we saw a trend that was happening kind of in our educational system. we decided to home school our children and emphasize to them what the basics were. they were not only tooecheaching the basics they were erasing our heritage. i love history. this month and year of our heritage in our fourth of july week we're seeing two great grandfathers who were in the revolution. we saw intertwined in the history the ten commandments that were being taken out. we wanted to erect an monument. it massed a super majority in the oklahoma legislature and signed by a democrat governor. we felt like with the attorney general's assistance and the liberty legal institution if it needed to be defended it wouldn't cost the taxpayers a penny. >> mr. attorney general as i look at what the oklahoma constitution says now public

money or property will be applied used for the use benefit for any support of church system of religion et cetera for use, benefits support of preacher or minister. what is your argument going to be on your petition for rehearing? >> what they disregarded is the connection of the ten commandments to our code of law. the supreme court itself, you vu have the law givers. there is a purpose here that's different than establishing a particular religion. this is part of a larger debate sean. we're facing here in oklahoma is not something that's lost across the country right now. there is a debate going on about what did the first amendment truly protect? what does it mean to have a right of free exercise? you see the movement nationally of folks trying to eradicate all forms of religion. that's not what our first amendment is aboutment that's not what this provision was

intended to address. hopally hopefully they will take a different approach. >> thank you for being with us. the oklahoma supreme court is spurring spurring controversy. a recent supreme court ruling concerning gay marriage. a local county clerk in mississippi has stepped down from her job because issuing a gay marriage license is against her religion. this goes against your deeply held religious views and convictions? >> that's right. >> all right. so tell us the process by which you realize that you felt you wanted to resign here. >> well i was waiting for the decision from the u.s. supreme court. when that came down i knew i could no longer fulfill my duties as circuit clerk an issue a marriage to same sex couples.

from america's news headquarters i'm jackie ibanez. u.s. and cuba are yet another step closer to normalizing relations. president obama announcing wednesday both countries will open embassies in each other's capitals. however, the government of cuba says more needs to be done. it wants to see an end to u.s. embargo and the return of u.s. naval base at guantanamo bay. several republicans are against the move and have vowed to block the appointment of an ambassador to havana and funding for the embassy. severe weather plaguing the midwest. tornado warnings and watches are in effect for missouri and kansas. the national weather service says at least one twister has touched down in suburban kansas city.

welcome back to "hannity" a stunning admission from the baltimore police department about officer conduct during the violent riots that took place in april after denying it for months the "baltimore sun" is reporting that police officials now admit they told their officers to hold the line and not engage rioters as they looted stores, set buildings and vehicles on fire and attacked the police. all told these criminals destroyed almost 400 businesses injured over 100 cops and caused an estimated $20 million in damage. we have been reporting this on "hannity" for monthsment. here now with more on this is the first person who told us about it maryland sheriff mike lewis and geraldo rivera. sheriff lewis you were on this program. you made the comment. you talked to the officers.

the stand down order. it seems to me that what the authorities are doing, the sheriff knows better than i. what the authorities now are doing is saying they're hiding behind a rhetorical device. they're saying we never give down a stand down order. what i think was the actual order -- it was not quote unquote stand down. the order was hold the line. in hold the line hold the line hold the line you lock shields, and the order was not to advance, not to stop any of the looting. the effect is the same. if you stand down the rioters then go and loot and commitment their violence and arson, et cetera. if you hold the line in other words you're a static line and everything is happening in front of you. the same thing happens. the police do not interrupt the violence the looting and what's going on. i think that what is -- we -- our job is not to let them hide behind the rhetorical advice. they have to admit and are admitting now they gave the order to hold the line.
