as they say, enjoy the fourth of july weekend. one of the big stories of the day is what happened in washington, d.c. earlier demanding more explanation. you are seeing our live shot of washington, d.c. where we expect a news conference to begin in a moment. the navy recapping for us what transpired this morning. around 7:30 there was a call made inside the navy yard of a possible gunshot and now no sign of shooter or victim or shooting. we see a group walking toward the microphone on the street there. perhaps these are the folks we have been waiting for. we will see. as the news conference begins in washington, d.c. we will bring you back there. but we will get to other news

until then. from washington, d.c. to tennessee thousands evacuated after a train car holding a taxing material erupted. i am jenna lee. >> kristina trinkle: >> and i am in for jon scott. they evacuated people south of the town of knox vil and 5,000 people could be out of their home for days. the substance in the burning car and the smoke pouring from it is dangerous for anyone to breathe. >> john robert has more from the atlanta bureau. >> reporter: i talked to the blunt county sheriff's office and they say the fire is still burning. a cfx train was rolling close to

mary ville and an axle broke on a car carrying a highly toxic chemical and the police chief said the broken axle ruptured the car or caused it to crash. when it burns are creates a deadly gas that used to be used in gas chamber executions. so folks evacuated people within a one and a half mile radius of the crash and they'll likely have to stay out of their homes for at least another day. >> the fire man came to the door and woke me and my dog up. they told me a train wrecked and to evacuated. >> reporter: csx said they have

an emergency response crew on site and are taking air samples around the area. the strategy is to let the fire burn out because of the danger it is too dangerous for firefighters to get close enough to put the fire out. and the police chief said ten of their offices had to go to the hospital for decontamination. and nine of those cars carry the deadly chemical but only one is involved in the fire and it doesn't like it has spread. >> now to washington, d.c. they are talking about what happened in the navy yard. >> we went into the facility and that this time there is no evidence of gunshots no

evidence of a shooter and no evidence of any victims today. we look forward to finding out that all of our partmers -- partners responded as they should have. the chief of police will convene an after action meeting to see how everybody responded after it is clear. i am very proud of all of the officials that answered the call. we know there have been a lot of lessons learned from previous incidents and fatalities here at the navy yard and we have found there has been a clear, coordinated and convincing response to this scene. we are grateful at this point we have found no shooter evidence of shooting or any victims. i want to turn it over to the admiral so that the admiral can describe how navy officials responded and the current

investigation and the center and we will hear from the chief of the metropolitan police department. >> thank you. i am commander, navy commander and first and foremost i would like to thank the mayor, washington, d.c. metro, all of the first responders from federal and metro area. their response was outstanding and very much appreciated. as the mayor said we received report of active shooter at 7:29 and responded and called in assistance from metro pc. as the mayor states there has been no signs of shooter, no shooting, and no injuries. navy yard remains in lockdown and building 197 we are finishing up the final walk through checking and opening all secured spaces and expect to be done in 20 minutes. assuming we find nothing we will open up the navy yard.

for the folks evacuated from the building they went outside of the navy yard or to the conference center and based upon the event ozs of a couple years ago counselors and chancellors are with them providing support they need or desire. i would like to thank the mayor and response team for quick response. we have learned a lot over the years, exercised hard and review this to see what went wrong and what we can improve on. thank you very much. >> just a quick rundown. first the call was placed from inside a building around 7:29 and went to the internal call center inside the navy yard. that call received for possible sound of gunshots was then immediately taken by the naval district of washington police

and broadcast to the police department city wide channel as a request for metropolitan police to assist with a potential active shooter at the washington navy yard. along with the metro police, metro transit police ncis, united states marshall, atf, capital police and others respopded -- responded to the request. >> here is headline. there were reports of an active shooter at the washington navy yard and there was no shooter, no shooting, and no victims. that was the big story as it broke earlier this morning before 8:00 the public got informed about it. here we are several hours later and it was a false alarm. joe is retired nypd director and

we have a former fbi director. nice to talk to you. we want to talk to you about the response and what is ahead. joe, what did you think of the response? >> i think it was a great response. it shows the response today is critical. they took the threat, aaccessed it, and addressed it correctly. false alarm or not they had to respond in this manner. it shows the coordinated effort of all agencies and how it came along since 9/11. >> we compare it often to that. danny, your thoughts? >> i think they did a great job. i promise you they rehearsed this. they probably had table top

exercise and went out and surveyed this stuff. i am not surprised the response was as good as it was. at least it was a good dry run. >> it was a way to see what the response would be like if fl there there was a series of attacks. this is the third false alarm. we talked about the heightened sense of alert for fourth of july. what do you make of the alarms? business as usual or something different? >> because of the threats coming about for the fourth of july weekend you have to address each threat. but the false alarm is nothing new. people have done it for years. in brooklyn they would see what police officers are working and call an officer in trouble to a certain area and see who

responds. that could be the nature or pranksters. you don't know the situation but you need to be prepared for whatever is happening. since 9/11 we have become more proactive than reactive but the proactive approach reflects the reactive as well. we will have people test us day in and day out. >> and we have questions for whoever placed the call. it was an internal call as we heard from the news conference. a lot of questions on what was heard and what was the nature of the call. we are on a heightened state of alert alert. lawmakers are coming on saying this is the most dangerous time they have seen since 9/11. that is a lot of anxiety and that is inpart how terrorist win; causing us a lot of

anxiety. do you think lawmakers need to be more specific about the true nature of the threat we are con fronting? >> i think they are telling us. we know there is a general threat. i don't think we can have the intelligence agency not tell us about threats and we need to be prepared whether it is public or private security. and i know it makes people anxious but better anxious than dead. they need to be aware of their surroundings and know there is a potential attack and if there is one how to get out and be alert. if you see something say something. this time today it wasn't as sinister as they thought but better that and ignore it and have people lose their lives. >> and walking away from the several hours how great it is there is no active shooter and no one is injured.

in colorado a judge sentencing a woman who served on a juror ten years ago ten days in jail for lying on a jury survey and the man gets a new retrial. and in washington, d.c. the suspect charged in the murder of four wealthy family members including their housekeeper inside a burned out mansion is due in court today. he will get new attorneys and the first opportunity to question the evidence against the client. >> hillary clinton holding a 19-point lead over her closest challenger bernie sanders and that is among caucus goers in iowa. but her lead has dropped 26 points since may. all of this as bernie sanders

drew one of the largest crowds of the campaign last night at a rally in wisconsin. we go to the national reporter for the washington post and a political report for the daily caller. colby what a call for sanders, nearly 10,000 there in wisconsin. >> my colleague, jenna johnson was there and he hit all of the notes the progressives want to hear promisings paid maternity leave, paid vacation, minimum wage of $15 and progressives are excited and want someone who feels authentic. whether or not that translates to votes come primary time remains to be scene. it is hard to equate what sanders is doing to 2008 but it

isn't different than 2004 when dean ran and the grass fell around him but kerry got the nomination. >> the 10,000 crowd is the biggest crowd that any candidate has pulled together since announcing. >> you have the polls, in iowa, and new look in new hampshire. some polls having him down eight points. i think a lot of this is the elizabeth warren factor who came out and said nice things about sanders. they are a bunch of progressives and looking for somebody that can speak passionately to them. he is a self-described democratic socialist and he will talk about trade single-payer health care income inequality

being the state has been through a lot over the years in terms of internal politics. >> it is interesting sanders went to wisconsin when it isn't a normally state they would go to this early. there was a union fight and a lot of tension around that issue. and a lot of progressives want and are hungry for someone like sanders to deliver the types of messages he is delivering. it is resinateing and people want to hear from him and he presented the base for the african-american community and went out and talked about the iraq war and hillary clinton's vote and those are not there for bern ie sanders.

disaster. this isn't the first extension. i seem to have lost count. >> no it isn't the first time this happened. and the problem is it has happened many, many times. as we saw in august of 2013 with the destruction of redline and he kept using the destruction and we are seeing the destruction of american capability. this has happened many times before and iran knows they can keep shifting the goal post and our allies know we are not reliable and vladimer putin and the leader of china who are involved in the negotiations know they can play sides as well. they are economic. if they are not seen as creditable it has a negative consequence for strategy. >> the united states pointed out

on so many issues and in terms of inspectors and things at these facilities and i guess the question is keep whatever is negotiated in viena and is anything agreed to there and come back and pass muster for congressional review? >> that becomes the debate point. if you consider what is being talked about now compared to the framework agreement a couple months ago, it is different. we are seeing hedging on the ability of inspectors being able to access uranium sites and they are saying they cannot visit the site and the administration is saying there has to be a process. the process means iran decides the timeline and access and they can move things. if that is the deal i think

this is why you can see the allies having the sit downs with john kerry. >> france is putting out points that seem tougher. the prime minister of israel has said over and over this is a bad and dangerous deal. what are you hearing from your sources in jerusalem? anything israel can do to change the deal or are they looking past the goal post saying what happens if there is a deal not a deal, and is military option still on the table? >> i think what the israeli strategy is try to draw scrutiny toward the deal that is evolving at the moment. this one is so pathetic in terms of what it is demonic. it allows the israelis to push

lowest rate in seven years at 5.3% and 220,000 jobs were added in june. we are >> reporter: the labor department releasing 223,000 numbers is slightly less than wall street expected. and the unemployment rate is down to 5.3% don't cheer yet. it dropped because 430,000 people said i quit and gave up searching for work as summer began. the number of americans not working hit an all-time high. and wages were flat at 24.95 an hour. let's look at the market's reaction. positive at first and dow is down now 22 point and the markets are down for the week from the news in greece. but it is sending the message

that september might be too soon for the economy to handle higher interest rates. one more thing to point out this report might be a baseline going forward. the white house announced overtime rules and the data is showing how many hours workers are working before this takes affect. more workers becoming eligible for time and a half will the bosses cut back the hours? right now it is 34.5 hours. >> here is another story get agting a lot of attention. a federal investigation on the airlines as series of bankruptcy and mega mergers slipped down the airline industry and four carriers fly about 80% of us. interesting four carriers get

80% of the passengers. right? american delta, united, and southwest may have conspired to keep the number of available seats down and prices high. ben is a travel consultant and one mile at a time founder and our other guest are travel consult consultants as well. most of us go online to look at airline tickets but don't look every single day. ben is there evidence from what you see on a daily bases that airlines may be communicating about the prices and the seats? >> i would say at this point it is just speculation. they are talking about inclusion but i think it is coordinated behavior. the difference is airlines file transparent fares. it is easy for airlines to track

the prices others are charging. i don't think there is anything going on behind the scenes here. airlines are simply matching one another on fares and that is hurting consumers. >> easy to feel like the world is against us especially when travelling, jaime. do you agree with ben? smoke but no fire? >> i do. one thing you will notice with fares is you will find carriers competing. if you want lower fares on delta look at charlotte and miami. my opinion is there is nothing conspiracy theory going on here. i can they are doing well in the market and trying to compete with each other individually. >> would you see the justice department looking back to 2010 and coming out of the tough crisis and economy, why do you think the timing is significant of that? >> well that is when airfares

were at their lowest. it is a convenient time to look at. you see an increase in fares then. if you go go back further you are seeing airfares reaching the point they were before starting to fall. they were falling because people were not traveling during the recession and they faced record-high fuel prices so they cutback on the number of flights. airlines were loosing hundreds of billions and were not investing in competing with each other. they were competing to see who could cut back the fastest. we may see an e-mail that is embarrassing from one airline or another. but ultimately the driver of the fares we are seeing now isn't a conspiracy between the airlines. it is the simple outgrowth of the industry they were facing. >> now airlines are doing better over the years. it is an

astonishing fact that 80% of the travel is with four carriers. the justice department approved this so we could have mega airlines. do you think that is the best thing? now they are investigating them. >> if you look at how the industry was before a couple carriers were on the brink of liquidation and that would be worse for consumers if the airlines went bankrupt but fares would go up well. is it best? probably not but it is hard to determine what could be there. >> this is the world we live in and the world we will be traveling in. a ton of americans are hitting the road and i am curious if you have any tips. it is easy to feel like the airlines are against you as they

squeeze you into little seats and tell you they are giving you extra room. it is not a good feeling. >> one of the tips you can find is bundling fares. airlines are checking for bags but have fares if you pay for it up front you can reduce the cost. and airlines are discounting the first class seats. it may not be too much more money to travel up front get free meal free checked back and free lounge which isn't possible in the back. airlines are lowering the fares and there are mileage points and utilize credit card benefits. >> do you have a favorite credit card? a good credit card for airfares? >> a lot of the cobranded cars

can benefit like the american airlines or delta cobranded card. or there is alternative cards that can earn miles and points and other travel benefits across a broad variety like an american express platinum card. >> i will finish with you, gary you are flying out of austin's airport and they have great bbq there. >> it is really expensive to fly out of here because austin has grown and there is a limited number of gates and the airlines can't expand much. we are seeing the airlines battling each other head-to-head in a lot of markets. it is ironic we are seeing this investigation about collision at a time the airlines are beginning to fly more and compete aggressively. i would say the one thing the government could do if they

cared about fares and capacity is relax foreign ownership restrictions and that would bring in more competitors. we could actually do something about it but this investigation isn't. we mean see where the investigation goes -- we will -- but i think consumers have to be savvy and careful and know what route is supposed to cost if the airfare is higher wait if is lower pounce. purchase about 90-120 days out for leisure travel because you will lock in the best deals. and as time is good on the airlines and they are making money and expanding and that will drive down the prices. >> we have to plan ahead. we have to watch the last-minute deals and 90 days is probably wise. >> gary jaime and ben glad to have you all. >> thank you. those guys are trying to get you

>> we have new information you will not believe on the case of two airline pilots from argentina fired for inviteing a play boy model into the cockpit while it was flying and let her fly the plane even. the woman took videos during the flight and she is banned from that airline for five years and passengers on the plane may file suit as well. and we are learning the model may sue as well for sexual harassment. hard to imagine anyone is going to look good from this process.

diana and eric both criminal defense attorneys, joining us now. diana, does this make any sense anyone has the right to sue here? >> not really because in order to prevail in a lawsuit like this you would need damages. and the only damage i can see is maybe to here ego and you cannot get compensation for that. she is in no w victim or harmed party in this. she is taking selfies with the pilots in the cockpit and there is no reason or no standing why she would be suing anybody for anything. >> eric, would you represent her? >> of course if she has the money. but these pilots have to be a few fries short of a happy meal to allow a play boy bunny anyone to sit in the cockpit and they are taking video and acting like this as a secret

but it is just a customer service issues. there are no damages. no one was injured or hurt. they didn't know at the time the plane was flying there was a play boy bunny behind the wheels or control of the cockpit. they don't have any reason why they would need to sue. this is a horrible situation and they made a huge mistake in judgment in allowing her to fly the plane but there is no reason they would sue. >> we know eric would take the passenger's pace on if they would pay it. on a contingency case? >> the passengers may get a free ticket but they don't have damages. if something happened and they were fearful or hurt. i fly every week and i cannot get over the thought of someone else at the control of an

>> terrify moment for a california family and what a story this is. william is live with more. >> reporter: jenna this looked more like a crime scene. the kids and dolphin are screaming and blood is all over the boat. this family is out for a fishing trip when the pod of dolphins are along side playing and spinning and one unexpectedly lands inside the boat. >> i knew right away he would land in the boat. he knocked he backwards and landed kind of on my feet and ankles. >> it was pretty much chaos at that point. my wife calmed down. she was screaming, the dolphin was screaming, my daughter was freaking out. i had to keep the dolphin away

from the family get on the radio and make distress calls. >> i wanted to put the water on the dolphin until it followed me into the harbor and we could assist and get people off. >> reporter: 350 pound dolphin stuck on the boat. the woman had two broken ankles and the dolphin had cuts on its nose and tail. they pulled the dolphin from the boat with a rope and released it back into the water and it swam away. you know the husband said what is odd is he has been going out for seven years and nothing unusual. the dolphins are normally precise when they pace with the boat. the irony is people pay a lot to go swimming with dolphins but here the dolphin wanted to go swimming with the people. >> unusual story. glad the mom and dolphin is okay. quite the fright.
