dead bode is real. you'll hear how having kids can pack on the pounds. good tuesday afternoon from the desk. donald trump attacked one of his rivals by reading a sitting u.s. senator's personal phone number live on television. that as a new survey shows donald trump has the highest poll number us of any gop candidate. the highest any has reached so far in this cycle. nearly double his closest republican rival. donald trump. that's according to a new abc news/"washington post" poll. it shows donald trump with a support of 24% of the republican leaning voters nationwide. 24%, by far, the highest number the biggest lead any republican has scored so far in the race for the white house in 2016. rival scott walker and jeb bush pretty much tied for second place. that's a big jump from the latest fox news poll. just last week it showed trump

14 counts of corruption for. actually more than that 18 counts and he went away for 14 years. an appealing court has overturned the former governor's conviction. blago tried to sell the senate seat when president obama went to the white house. and in addition we have just learned that the appeals court has ruled he should not be out of prison while the courts take all of these new matters on. our mike tobin is getting more details. he's in the midwest news hub this afternoon. mike it's bleeping golden. >> it certainly is. it's always good to be dealing with rod blagojevich. he's two years into a 14-year sentence. the two pieces we're missing what specific charges have been essentially thrown out by the appeals court. we know his legal team started arguing, amped up arguments on

tuesday. which essentially said there has to be a quid pro quo to get a conviction in this particular case. that he was trying to sell a senate seat vacated by senator barack obama. you know how that went ultimately 18 counts. the first trial, he got convicted. one charge of lying to the fbi. the second trial, they got him on 17 additional charges. some of those involved lying to the fbi. some of those involved wire transfer. and some involved extortion. the blago legal team said this was ultimately political horse trading. and they made that in the absence of quid pro quo. that was the back bone of their argument. now, we know that the appeals court has essentially said that some of those charges will not stand, but not all of them because they said that blagojevich will not go free. he's been in prison two years.

terms of the region. but thing we have concerns in the region about perhaps immediately in the area. we have concerns here about what the deal does and what the deal doesn't do. i think the administration is going to make its case in terms of how it's 15 years. and many who question the deal will say what happens after those 15 years. >> of course it doesn't really matter does it? china and russia have moved on. they're going to do what they do the sanctions have all come back. they've made it perfectly clear. >> well it matters if iranians violate the deal because it they violate the deal in a significant way, then the sanctions snap back in. now, the real question i think that many raise, includeing ourselves, what happens with smaller times of violation? how do you ensure that consequences that are clear for smaller violations and how do you build it over time?

mike. >> well talking about the vacating of five different counts. we'll get into details on those counts. two of them, 5 and 6 are wire fraud counts. it has to deal with trying to move the money around. you got two counts of extortion vacated. and one was conspiracy. and it looks like looking at the language in the indictment itself the original indictment that that was the conspiracy to sell the seat then vacated by senator barack obama when he went on to become president. you saw some of the language. it does not necessarily mean he's going to be out of prison but those particular charge vacated and sent over for a new trial. it doesn't necessarily mean a new trial is going to take place. patrick fitzgerald has district attorney for the northern district of illinois at the time. now it's jack fardon who is the prosecutor for -- the government's prosecutor for the northern district of illinois which encompasses chicago. it ultimately will be his call

if he wants to proceed with a third trial against blagojevich for the charges that have been vacated, according to some of the language that we have seen thus far. there have been some experts who have weighed in indicating that they don't think that fardon will be interested in doing that. particularly as you see blagojevich has two years into what was a 14-year sentence. >> mike thanks. according to the reporting of the chicago tribune, if prosecutors elect to keep the counts that were thrown out on appeal. then the court should proceed to resentencing. mercedes colwyn talks as legal analyst with us. >> so far, you look at the counts eliminated. you still have count 24 which is the false statement that we talked about before the break. that carries a five-year sentence so that will stay in place. as well as other counts. what happens is there will be a recalibration of the sentencing. the judge will say, listen, you were sentenced to 14 years, here
